Page 2 of 80 ## The Office of the Mayor Belle Plaine, Minnesota May 18, 2026 Expressing support for the designation of May 22 nd 2026, as “National Poppy Day” in honor of our fallen. ## PROCLAMATION Expressing support for the designation of May 22, 2026 as “National Poppy Day” in Belle Plaine as recognizing the importance of honoring those that have worn our nation’s uniform; and WHEREAS, poppies are worn and displayed as a symbolic tribute to our fallen and the future of living veterans and servicemembers; and WHEREAS, at the end of World War I, The American Legion and VFW Families adopted the poppy as a symbol of freedom and the blood sacrificed by troops in wartimes; and WHEREAS, the use of the poppy symbolically comes from the poem In Flanders Fields, which movingly begins, “In Flanders Fields the poppies blow, between the crosses, row on row,” referring to the poppies that sprang up in the churned earth of battlefields across Belgium and France where soldiers died fighting; and WHEREAS, The American Legion and VFW Families has long utilized the red poppy as its official flower, symbolizing the blood shed by those who have served in our U.S. military; and WHEREAS, wearing a poppy will unite citizens from across the country who decide to show their patriotism; and WHEREAS, May 22, 2026 would be appropriate date to designate as “National Poppy Day” WHEREAS, the Belle Plaine VFW Auxiliary and the American Legion Auxiliary will be distributing the traditional red poppy on May 22, 23 and 24, 2026. We are fortunate to have a number of returning aquatic staff members, guards and W.S.I. certified instructors. Aquatic Center Manager Wadsley and I have reviewed and interviewed the all applicants and recommends hiring as listed in Resolution 26-056. This benefit provides employees with 70% of their wages, up to a maximum of $1,423 per week while on leave. The City contributes 0.40% of each employee’s wages, and employees contribute 0.39% through payroll deductions. At the April 6, Finance Ways and Means meeting the Council discussed the City’s options for coverage of employees with the MNPL in effect. After full discussion it was the consensus of the Council to move forward with a modification of the long-term disability (LTD) benefit. This modification is an estimated cost savings to the City of $3,289.89. The International Union of Operating Engineers Local 49 Union, which covers specific City Public Works employees, has reviewed and approved the change. The proposed change: Eligible full-time employees will receive standard long-term disability coverage equal to 60% of monthly wages, up to a maximum of $5,000 per month. Page 13 of 80 ## MEMORANDUM OF UNDERSTANDING ## Short- and Long-Term Disability This Memorandum of Understanding (“MOU”) is made by and between the City of Belle Plaine (“City”) and Law Enforcement Labor Services, Inc., Local 101 (“Union”). WHEREAS, the City and Union are parties to a collective bargaining agreement (“CBA”) in effect from January 1, 2025 through December 31, 2027, providing terms and conditions of employment for a bargaining unit of City police officers; WHEREAS, effective January 1, 2026, the State of Minnesota requires that employees be covered by the Minnesota Paid Leave Law (“MNPL”), Minn. Stat. 268B.001 et seq., wherein employees are eligible to receive wage replacement benefits pursuant to the MNPL while on a MNP L qualifying leave; WHEREAS, Article 19 of the CBA provides for short-term disability wherein employees may receive up to $600 per week while on a qualifying leave and employees are provided with standard long-term disability coverage with the option to purchase additional long-term disability coverage; and WHEREAS, the City and Union recognize that the potential value of MNPL benefits outweigh the short-term disability benefits and agree to amend Article 19 to remove short-term disability and expand long-term disability benefits; NOWTHEREFORE, the City and Union agree that, effective June 1, 2026: 1. Short-term disability benefits under Article 19 shall be discontinued. 2. Long-term disability benefits under Article 19 shall be expanded to coverage equal to 60% of monthly wages, up to a maximum of $5,000 per month. 3. The paragraph in Article 19 addressing short and long-term disability and life insurance shall be amended as follows: ## SHORT TERM DISABILITY PAID FAMILY MEDICAL LEAVE/LONG TERM ## DISABILITY/LIFE INSURANCE Eligible full time employees receive short-term disability and standard long-term disability coverage plus a term life insurance policy, an amount set by City Council no less than $500.00 per month. Additional long-term disability and term life insurance may be purchased by the employee through a payroll deduction. Effective January 1, 2026, the City shall pay at least fifty percent (50%) of the Minnesota Paid Leave Law premium for each employee, and the employee shall pay the remaining through payroll deductions. Page 14 of 80 Eligible full-time employees shall receive standard long-term disability coverage equal to 60% of their monthly wages, up to a maximum of $5,000 per month. Eligible full-time employees shall receive a term life insurance policy in an amount determined by the City Council. Employees may purchase additional life insurance through payroll deduction. 4. If the MNPL law and/or benefits change or are discontinued, the City and Union agree to meet and negotiate short-term and long-term disability benefits for City police officers. The City and Union agree the intent of such negotiation is the reinstatement of Article 19 benefits the same or greater than those amended by this MOU. 5. The terms of this MOU, or such other terms as negotiated by the parties related to this MOU, shall be incorporated into the CBA during negotiations for a subsequent CBA. 6. A violation of any applicable codes, regulations and ordinances, and the conditions of approval herein shall be grounds for revocation. 13. This conditional use permit may be subject to annual inspection and audit by the City. 14. This conditional use permit shall expire if the Use ceases for more than twelve (12) consecutive months, in the event the structure is destroyed and a building permit is not issued within 180 days, or if the Use is changed to a different Use. 15. The Conditional Use permitted under this Resolution may not change to another conditional use or further intensified without a new application and approval by the City Council. 16. The Use permitted under this Resolution shall remain in effect as long as the conditions of the Resolution are observed. The program awards a maximum of $1,000,000.00 for State- funding eligible construction. Unless an alternate schedule is approved by MnDOT Central Office, the project must be let no later than June 30, 2026 in order to receive funds. MnDOT plans to encumber funds by the end of May, allowing for an alternate schedule if necessary. Following MnDOT’s full review and approval of the plan, the next step in the process is to advertise for bids. Upon MnDOT concurrence, advertisement will appear in the official newspaper and on QuestCDN for a minimum of 3 weeks. WHEREAS, Bolton and Menk, Inc., the consulting engineers for the City, has prepared final plans and specifications in conjunction with MNDOT review for the TH 25 and CSAH 3 (Main Street) and such plans and specifications have been presented to the Council for approval. ## NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BELLE PLAINE, ## SCOTT COUNTY, MINNESOTA. 1. Such plans and specifications are hereby approved and ordered placed on file in the office of the City Administrator. 2. The City Administrator shall prepare and cause to be inserted in the Henderson Independent, the official newspaper, and online on QuestCDN which qualifies as a regional trade publication, an advertisement for bids upon the making of such improvements under such approved plans and specifications. The advertisement shall be published in each of said publications at least once not less than three (3) weeks before the date set for opening bids, shall specify the work to be done, shall state that bids will be publicly opened on a yet to be determined date at Belle Plaine City Hall, 218 North Meridian Street, Belle Plaine, Minnesota, in said City and that no bids will be considered unless sealed and filed with the City Administrator and accompanied by a cash deposit, cashier’s check, bid bond, or certified check payable to the City of Belle Plaine for five percent (5%) of the amount of such bid.
