School District Concept Plans with City Council, EDA & Planning and Zoning. Community Development Director Smith Strack introduced the subject and those in attendance. Rich Rodich of Bray Architects and Jeremy Anderson of Design Tree Engineering presented the concept plans for the upgrades at the school district facilities. The Council, EDA and Planning Commissions had a lengthy conversation and asked questions of District staff representatives. School District Superintendent Laager agreed to do a safety study on the concept. Mayor Evans called for a 5-minute recess at 7:30 PM. Mayor Evans reconvened at 7:36 PM. 3.2. Discussion: streamlining the Development Review Process with City Council, EDA & Planning and Zoning. Community Development Director Smith Strack reviewed the current process for Development Review with a brief slideshow and highlighted areas that could be streamlined. The Council, EDA and Planning Commissions held a lengthy conversation. The Council directed staff to work on ordinance changes for the most common occurrences including moving to one public hearing, minor variances, lot combo/splits. Discussion: Public Works Lawn Mower Replacement. Public Works Superintendent Otto reviewed the request for a replacement lawn mower. The Council held a lengthy discussion. ROLL CALL. The Belle Plaine City Council met for a Drone Demonstration on Thursday, August 6, 2026 at 4:32 PM at the Fire Department 700 East Main Street, Belle Plaine, MN. Councilmembers Brady Hartmann, Shane Theas, Luke Otto and James Evans were present. Councilmember Rex Stacey was absent. The proposed replacement mower is a 2021 John Deere 1580 with 2,960 hours of use. The maintenance log is attached for review. Attached is a copy of the Quote Summary from Kibble Equipment – Belle Plaine in the amount of $30,123.14, after applying the total trade-in allowance of $9,000.00. The Public Works Committee discussed this item and recommended that it be brought forward for discussion at a Work Session. The City Council reviewed the request at the August 3 Work Session, where the majority of the Council recommended moving forward with the purchase of a new mower. Currently Belle Plaine Chamber of Commerce also conducts lawful gambling at Neisen’s Corner Bar, Johan’s Bar and Grill, Oldenburg Brewery, Ruby’s Family Restaurant and Steel Horse Tavern in the City of Belle Plaine. The City of Belle Plaine renews premise permits for lawful gambling purposes annually. The renewal period is for January 1 through December 31, due to the mid-year change of ownership and name the City requires a new premise permit be pulled. ## FISCAL ## IMPACT: The City requires 10% of lawful gambling proceeds be contributed to the City of Belle Plaine, those funds are used for Public Safety purposes. ## STAFF ## RECOMMENDATION: Approve Resolution 26-100 Approve Premise Permit for Belle Plaine Chamber of Commerce at The Shipwreck. Representatives from Scott County have developed the attached Cooperative Agreement for the construction of the TH 25/CSAH 3 Roundabout Project. The Cooperative Agreement has been reviewed by City staff and legal and is recommended for approval. City Attorney Vose noted Section 4a, Future Modifications, which states that no right- of-way permits for up to 5 years, the City Attorney comments that there may be legal required for issuing right of way permits. The City Council previously adopted Resolution 24-176 accepting Local Partnership Program funds from MnDOT for the TH 25 at CSAH 3 (Main Street) Roundabout Project for Fiscal Year 2026, with a maximum state funding award of $1,000,000 in eligible project costs. On May 18, 2026, the City Council also adopted Resolution 26-063 authorizing the advertisement for bids for the project. On July 20, 2026, the City council also adopted Resolution 26-090 authorizing execution of cooperative construction agreement with the Minnesota Department of Transportation. Page 16 of 104 ## CP 03-09 ## City of Belle Plaine ## County of Scott 1 ## COOPERATIVE AGREEMENT THIS AGREEMENT, by and between the County of Scott, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the "County" and the City of Belle Plaine, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the "City". ## RECITALS: A. City has plans to reconstruct the intersection of County Highway (CH) 3, Walnut Street, and Trunk Highway (TH) 25 as a roundabout, County Project (CP) 03-09, State Aid Project (SAP) No. 070-603-015, and SAP No. 239-010-004. The plans include grading, concrete, bituminous paving, lighting, roundabout and ADA improvements construction and other associated construction, together referred to as the “Project”. B. The above-described Project lies within the corporate limits of the City. C. City applied for and will receive up to one million dollars ($1,000,000) in funding through the Minnesota Department of Transportation (MnDOT) Metro Local Partnership Program for the Project. D. County supports the planned Project and is willing to cooperate with City to complete the Project and share costs related to the Project. E. City has prepared an estimate of the County’s cost share for the Project contract work in the sum of two hundred fifty-three thousand seven dollars and forty-five cents ($253,007.45). F. It is contemplated that the Project shall be carried out by the parties under the provisions of Minn. Stat. §162.17, subd. 1 and Minn. Stat. §471.59. NOW, THEREFORE, in consideration of the mutual undertakings and agreement contained within this Agreement, the County and City hereby agree as follows: 1. Incorporation The recitals set out above are hereby incorporated into this Agreement as if fully restated herein. 2. Scope of Services a. City shall advertise for bids for the work and construction of the aforesaid Project, receive and open bids pursuant to said advertisement and enter into a contract (Contract) with the successful bidder at the unit prices specified in the bid of such bidder, according to law in such case provided for cities. The Contract will include the plans and specifications prepared by City or its agents, which plans and specifications are by this reference made a part hereof. b. City shall have overall authority to administer the Contract and inspect the Page 17 of 104 ## CP 03-09 ## City of Belle Plaine ## County of Scott 2 construction of the Contract work for the Project. City shall have ultimate authority in initiating and determining change orders, supplemental agreements, and final quantities. The County Engineer shall cooperate with the City Engineer and his staff at their request to the extent necessary but shall have no other responsibility for the supervision of the work. c. County agrees to provide any and all permanent or temporary right-of-way on property owned by the County and needed by the City for the completion of the Project at no cost. d. The City Engineer shall prepare monthly progress reports and furnish to the County upon request. 3. Payment a. A cost estimate for construction of the Project is attached to this agreement and incorporated as “Exhibit A”. It is specifically agreed that the estimate(s) mentioned in this Agreement is only a preliminary estimate of the cost for the work on the Project and that the unit prices set forth in the Contract and the final quantities as measured by the City Engineer shall govern in computing the total final construction cost for apportioning the cost of the Project according to the provisions of this section. b. Based upon the total final construction costs: 1) County shall reimburse the City one hundred percent (100%) of the final actual construction costs of the Project work on the County Highway 3 leg of the intersection. c. City shall be responsible for one hundred percent (100%) of the final Project costs for engineering and contract administration costs, which includes all actual costs of planning, design, environmental review, permits, preparation of bid, specifications, and contract administration related to the Project work. d. Upon completion of the Project, City will submit an invoice to County for the payment due, and County shall pay all amounts due within thirty (30) days. ## 4. Ongoing Maintenance Items a. Future Modifications. County reserves the right not to issue any permits for a period of five (5) years after completion of the Project for any service cuts in the roadway surfacing of the County Highway included in the Project for any installation of underground utilities which would be considered as new work; service cuts shall be allowed for the maintenance and repair of any existing underground utilities. b. Pav ement S triping and Markings. Initial pavement striping and markings shall be included as part of the Project. The County shall be responsible for all subsequent pavement striping and markings on its county roads as required after the initial work and shall be responsible for one hundred percent (100%) of the subsequent related costs. The City shall be responsible for all subsequent striping and markings on its city roads, including pedestrian markings across its City roadway intersection legs, as required after the initial work and shall be responsible for one hundred percent (100%) of the subsequent related costs. c. S now and Ice Control. Upon completion of the Project, the City, at its expense and discretion, shall perform snow, ice, and debris removal on all trails and sidewalks constructed with the Project. All future maintenance costs of Trail improvements constructed under this A greement will be shared equally between the County and City regardless of which party performs the maintenance work. Either party can initiate and complete such maintenance work with notice given to the other party. Upon completion of such work the initiating party will invoice the other for fifty percent (50%) of the actual total cost. The preventative maintenance on trails constructed with this project, including sealcoating, will be cost shared equally between the County and City with County administering the process. e. S tormwater. Upon completion of the Project, County shall maintain all stormwater quality, rate control, and volume control features such as ponds, infiltration basins and all aesthetic landscaping elements. All future maintenance of the stormwater features shall be the responsibility of County. City shall reimburse County annually for its share of the costs for maintenance of the stormwater features based on its percentage of contributing flow, determined as the area of drainage that flows to the basin outside of County Road right of way. City may in the future alter the stormwater quality, rate control, and volume control features to accommodate future development as long as County drainage is maintained at which time City’s percentage of contributing flow will be recalculated. f. R oundabout Landscaping. Upon completion of Project, City shall be responsible for maintenance of any landscaping in the roundabout Project area. Maintenance includes but is not limited to, vegetation control, litter and debris removal, removal and replacement of all dead or diseased plantings, and any other maintenance activities necessary to perpetuate the landscaping in a safe, usable, and aesthetically acceptable condition. g. Li ghting. As part of the Project, six (6) integral streetlights will be installed at the roundabout. The maintenance of these lights shall be shared between City and County as follows: 1) Electrical energy shall be one hundred percent (100%) the responsibility of City. City shall pay for the hook up cost and application to secure an adequate power supply to the service pad. City shall also pay all monthly electrical service expenses. 2) City shall be responsible for minor maintenance including, but not limited to, re-lamping or LED luminaire replacement, repair or replacement of all damaged luminaire glassware, luminaires when damaged or when ballasts fail, and photelectric control on luminaires at the sole cost of City. 3) Within County right of way only, County shall be the owner of the integral streetlights and shall perform all major maintenance, including, but not limited to, Gopher State One Call locates, knocked down poles including wiring within the poles, damaged poles, pull boxes, underground wire, loose connections, damaged foundations, defective starter boards or drivers, damaged fuse holders, and blown fuses for the entire system at the sole cost of County. 4) All decorative and continuous lighting shall be the sole responsibility of City. h. A future County Global Maintenance Agreement, upon execution, may supersede maintenance responsibilities stated in this Agreement. Term of Contract This Agreement will terminate upon City’s completion and close out of the Project, provided that the Ongoing Maintenance Items section shall survive the Agreement termination. ## 7. County and State Audit Pursuant to Minn. Stat. Sec. 16C.05, subd. 5, the books, records, documents, and accounting procedures and practices of the County and City pursuant to this Agreement shall be subject to examination by the County, City and the State Auditor. Complete and accurate records of the work performed pursuant to this Agreement shall be kept by the County and City for a minimum of six (6) years following termination of this Agreement for such auditing purposes. The retention period shall be automatically extended during the course of any administrative or judicial action involving the County or the City regarding matters to which the records are relevant. The retention period shall be automatically extended until the administrative or judicial action is finally completed or until the authorized agent of the County or City notifies each party in writing that the records no longer need to be kept. 9. Liability and Indemnity a. Neither party, its officers, agents or employees, either in their individual or official capacity, shall be responsible or liable in any manner to the other party for any claim, demand, action or cause of action of any kind or character arising out of, Page 20 of 104 ## CP 03-09 ## City of Belle Plaine ## County of Scott 5 allegedly arising out of or by reason of the performance, negligent performance or nonperformance of the described maintenance, restoration, repair or replacement work by the other party, or arising out of the negligence of any contractor under any contract let by the other party for the performance of said work; and each party agrees to defend, save, keep and hold harmless the other, its officers, agents and employees harmless from all claims, demands, actions or causes of action arising out of negligent performance by its officers, agents or employees. b. It is further agreed that neither party to this Agreement shall be responsible or liable to the other or to any other person or entity for any claims, damages, actions, or causes of actions of any kind or character arising out of, allegedly arising out of or by reason of the performance, negligent performance or nonperformance of any work or part hereof by the other as provided herein; and each party further agrees to defend at its sole cost and expense and indemnify the other party for any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising in connection with or by virtue of performance of its own work as provided herein. Each party’s obligation to indemnify the other under this clause shall be limited in accordance with the statutory tort liability limitation as set forth in Minnesota Statutes Chapter 466 to limit each party’s total liability for all claims arising from a single occurrence, including the other party’s claim for indemnification, to the limits prescribed under §466.04. It is further understood and agreed that the Parties’ total liability shall be limited to that of a single governmental unit pursuant to Minn. Stat. §471.59, Subdivision 1a. c. It is further agreed that any and all employees of each party and all other persons engaged by a party in the performance of any work or services required or provided herein to be performed by the party shall not be considered employees, agents or independent contractors of the other party, and that any and all claims that may or might arise under the Workers’ Compensation Act or the Unemployment Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said employees while so engaged shall be the sole responsibility of the employing party and shall not be the obligation or responsibility of the other party. 10. Insurance Since each party is a political subdivision of the State of Minnesota, each party shall maintain a program of self-insurance or insurance covering general liability and automobile liability coverage protecting itself, its officers, agents, employees and duly authorized volunteers against any usual and customary public liability claims to the limits prescribed under Minn. Stat. Sec. 466.04 and Workers’ Compensation in accordance with the Minnesota statutory requirements. Said coverage shall be kept in effect during the entire term of this Agreement. ## 11. Data Practices All records kept by the City and the County with respect to the Project shall be subject to examination by the representatives of each party. All data collected, created, received, maintained or disseminated for any purpose by the activities of the County or City pursuant to this Agreement shall be governed by Minnesota Statutes Chapter 13, as Page 21 of 104 ## CP 03-09 ## City of Belle Plaine ## County of Scott 6 amended, and the Minnesota Rules implementing such Act now in force or hereafter adopted. ## 12. Equal Employment and Americans with Disabilities In connection with the work under this Agreement, City agrees to comply with the applicable provisions of state and federal equal employment opportunity and nondiscrimination statutes and regulations. In addition, upon entering into this Agreement, City certifies that it has been made fully aware of Scott County's Equal Employment Opportunity and Americans With Disabilities Act Policies, that it supports these policies and that it will conduct its own employment practices in accordance therewith. Failure on the part of City to conduct its own employment practices in accordance with County Policy may result in the withholding of all or part of regular payments by the County due under this Agreement unless or until City complies with the County policy, and/or suspension or termination of this Agreement. ## 13. Controlling Law The laws of the State of Minnesota shall govern all questions and interpretations concerning the validity and construction of this Agreement and the legal relations between the parties and performance under it. The appropriate venue and jurisdiction for any litigation hereunder shall be those courts located with the County of Scott, State of Minnesota. Litigation, however, in the federal courts involving the parties shall be in the appropriate federal court within the State of Minnesota. 14. Changes/Amendments The parties agree that no change or modification to this Agreement, or any attachments hereto, shall have any force or effect unless the change is reduced to writing, dated, and made part of this Agreement. The execution of the change shall be authorized and signed in the same manner as this Agreement, or according to other written policies of the original parties. 15. Severability In the event any provision of this Agreement shall be held invalid and unenforceable, the remaining provisions shall be valid and binding upon the parties unless such invalidity or non-enforceability would cause the Agreement to fail its purpose. One or more waivers by either party of any provision, term, condition or covenant shall not be construed by the other party as a waiver of a subsequent breach of the same by the other party. ## 16. Entire Agreement It is understood and agreed that the entire agreement of the parties is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter hereof as well as any previous agreements presently in effect between the County and City relating to the subject matter hereof. Due to a lengthy build time, the City has now received the truck, and it is ready to be placed into service. As a result, the City is able to retire Plow Truck No. 8 from service. Nuss Truck and Equipment has offered the City $20,000.00 to purchase the truck through its buy-back program. Staff is requesting Council discussion and direction regarding which option to pursue for the Sale of Plow Truck No. 8. The following options are available: Option 1 – Trade-in for Cash Value to Nuss Truck and Equipment Trade-in the truck directly to Nuss Truck and Equipment for the offered purchase price of $20,000.00. Option 2 – Sell at Auction. Place the truck up for auction and accept the highest qualifying bid. Option 3 – Advertise for Sealed Bids. Advertise the truck for sale and accept sealed bids. The City reserves the right to reject any or all bids. The Public Works Committee reviewed this request on August 12 and recommended bringing the matter to the City Council for discussion and direction. City Council members toured the existing facility with City staff and received detailed information regarding the current condition of the building, including deficiencies related to compliance with current regulatory and operational standards. After a preliminary facility plan presentation and extensive discussion, it was the consensus of the majority of the Council to proceed with preparation of construction documents. On June 16, 2026, the Council authorized Resolution 26-079 Authorizing Advertisement for Bids for the Belle Plaine Public Safety Facility Renovation and Expansion Project. The bids were received and reviewed on August 12, 2026. Staff was asked for an option that would eliminate the security fencing. Removing the fencing would result in a deduction of $134,489.25. Attached is the bid information with the apparent low bid from KUE Contractors, Inc. in the amount of $3,463,827.22. ## Available Funding: ## City Contribution – Capital Fund 402 Land Sale $1,195,248.00 ## City Contribution – Capital Fund 402 Encumbered Ambulance $149,501.56 ## City Contribution Land Sale August 2026 $265,000.00 ## Cash Fund Available $1,609,749.56 **Another option is for the Council to redirect the $300,000 in capital funds allocated for land purchases and the $52,000 allocated for Police Facilities to this project. The impact of using these funds would be a reduction in available capital funds for future land purchases. Staff has requested a bond run from the City’s financial advisors, Ehlers, for the remaining cost of the project. The program provides a maximum award of $1,000,000.00 for construction costs eligible for State funding. On May 18, 2026, the City Council authorized staff to advertise for bids for the project. The City ## Council subsequently authorized execution of MnDOT’s Cooperative Construction Agreement on July 20, 2026. Bids were received and reviewed on August 13, 2026. The apparent low bidder is Holtmeier Construction, Inc., with a bid amount of $1,147,522.43. The bid tabulation and supporting bid information are attached for the Council’s review. It is appropriate for the City Council to review the submitted bids and take one of the following actions: 1. Improvements proposed for the 2027 construction season include the full reconstruction of Linden Street from Main Street to Park Street and Prairie Street from Elm Street to Ash Street. Reconstruction shall include municipal improvements to watermain, sanitary sewer, storm sewer, bituminous pavement, curb and gutter and ADA accessibility. Also included are reclamation/resurfacing improvements on Orchard Street from Meridian Street to Hickory Blvd, Aspen Lane, and East Commerce Drive from Main Street to 900’ south. Following the presentation of the Preliminary Engineering Report, the City Council may accept the preliminary report and call for the improvement hearing for Monday, September 21, 2026. At that hearing, affected property owners will have an opportunity to review the proposed project and to address any concerns they have regarding the project with the City Council and Staff. Location maps are included in the packet. Full reconstruction of Linden Street from Main Street to Park Street and Prairie Street from Elm Street to Ash Street. Reconstruction shall include municipal improvements to watermain, sanitary sewer, storm sewer, bituminous pavement, curb and gutter and ADA accessibility. Also included are reclamation/resurfacing improvements on Orchard Street from Meridian Street to Hickory Blvd, Aspen Lane, East Commerce Drive from Main Street to 900’ south. WHEREAS, The City Council has been advised by the consulting engineers that said improvements are necessary, cost-effective and feasible and should best be made as proposed, and the consulting engineers’ report to this effect has hereto been received by the Council, and filed with the City Clerk; and WHEREAS, The statute provides that no such improvement shall be made until the Council shall have held a public hearing on such improvements following mailed notice and two publications thereto in the official newspaper stating the time and place of the hearing, the general nature of the improvement, the estimated costs thereof, and the area proposed to be assessed, in accordance with law. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Belle Plaine, Scott County, Minnesota as follows: 1. A public hearing will be held at the time and place set forth in the Notice of Hearing attached hereto as Exhibit A to consider proposed improvements. 2. The nature of the improvements, the estimated cost of each major portion thereof, and the areas proposed to be assessed therefore are described in the form of Notice of Hearing hereto attached. 3. The notice of said public hearing shall be in substantially the form contained in the notice hereto attached. 4. The City Administrator is hereby authorized and directed to cause notice of said hearing to be given two publications in the official newspaper. Said publication shall be one week apart, and at least three days shall elapse between the last publication and the hearing. Not less than ten days before the hearing the City Administrator shall mail notice of the hearing to the owner of each parcel of land described within the area proposed to be assessed as described in the notice. For the purpose of giving such mailed notice, owners shall be those shown to be such on the records of the County Auditor or, if the tax statements in the County are mailed by the County Treasurer, on the records of the County Treasurer. As to properties not listed on the records of the County Auditor or County Treasurer, the City Administrator shall ascertain such ownership by any practicable means and give mailed notice to such owners. 5. The City Administrator is hereby authorized and directed to cause to be prepared the Impact of Assessments, which may be in the form attached hereto as Exhibit 2, consistent with the determinations of this City Council on and prior to the date hereof.
