Liquor License for Firehouse Grill LLC
Dissent: None
Moved by Council Member [00:05:17] · Seconded by Council Member [00:05:18]
The application for a liquor license for Firehouse Grill LLC was moved to General Business because a council person owns the business, requiring her abstention. Staff confirmed all standard conditions for the application had been met and recommended approval.
Department Head Employment Contracts
Dissent: None
Discussion centered on the benefits of contracts for department heads (protection, recruitment, retention) versus the potential downsides (restraint on termination, legal costs). The city attorney strongly advised against it, citing employment-at-will principles and market trends. Council expressed initial openness but ultimately sided with the attorney's recommendation and decided against pursuing them.
Utility Billing Late Fees Waiver Policy
Dissent: None
Moved by Council Member [00:27:00] · Seconded by Council Member [00:27:01]
Following a system transition, 60-70 utility accounts did not make payments, prompting discussion on handling accrued late fees before annual assessments. Options included maintaining the appeals process, providing a temporary administrative waiver, or deeming it unappealable. The council opted for a one-time administrative waiver for late fees, subject to specific criteria, to minimize staff burden and provide a grace period.

Because the business is owned by a council person, um, Kate. She is unable to act on this item and must abstain and as a result, it cannot be on consent agenda.
When you see these in place, the rationale behind them is usually protection from termination without cause. I'll be very direct. Um, this is a political environment and um it provides a deterrent or a um benefit that is provided individuals who may be dismissed um without warning that has nothing to do with their performance.
It's not something I would recommend. No. Okay. I'm also hung up on the market study as well of just not having anyone else have them is a little bit concerning and then knowing we'd be opening ourselves up to potential legal recourse.
I hear a lot on nobody's really on board and now is not the time. I think that's agreed. It's not the time. I'm fine with that. And if our attorney is advising us not to do it, I think we listen to her.
Despite doing all that, um we've had uh between 60 and 70 utility accounts um who have not made payments since we made the switch over. And when you look at it, it appears that those people basically for whatever reason chose not to pay their bill through traditional um standard hard copy means um or enroll into the new electronic payment system.
So on the high end if it is like 65 people and say three people resolved it already we're talking like less than $2,000. I almost think we should just forgive it all because it's hard getting a new system and I know that there's, you know, no excuse for all the communication, but it's not that much money that I think we should be opening up to the appeals process and staff time.
