Appeal of Staff Decision to Deny Home Occupation Permit (Dog Daycare/Boarding)
Dissent: None
Moved by Commissioner Robbins [00:54:15] · Seconded by Commissioner Foresight [00:54:19]
The discussion centered on the balance between neighbor concerns and the applicant's proven track record of operating a responsible home-based pet sitting business. Staff initially denied the permit based on administrative review feedback from four neighbors, citing potential issues like noise, odor, and traffic. The applicant, Allison Newter, presented evidence of proactive management, security cameras, and a history of no formal complaints during over a year of operation. Commissioners debated the city's process for home occupation permits, which heavily weights neighbor objections, versus the tangible evidence of non-disruptive operation presented by the applicant.
Conditional Use Permit for Exterior Storage at 4500 Valley Industrial Boulevard South
Dissent: None
Moved by Commissioner Vandervine [00:59:17] · Seconded by Commissioner Foresight [00:59:20]
The Board considered a Conditional Use Permit for Associated Mechanical Contractors to establish exterior storage. The proposal detailed site improvements including an expanded parking lot and a 2-acre dedicated storage area with both bituminous and crushed granite surfaces for various equipment and materials. The staff report confirmed compliance with relevant city codes regarding screening, lot area, proximity to residential zones, and improved surfaces.
Conditional Use Permit for Telecommunication Tower at 7700 County Road 101 East
Dissent: Commissioner Foresight abstained due to a possible conflict of interest.
Moved by Commissioner Robbins [01:05:40] · Seconded by Commissioner Wiler [01:05:43]
The discussion focused on the proposed construction of a 115-foot telecommunication monopole by The Towers LLC, intended to improve wireless service. Verizon Wireless is slated as the initial carrier, but the tower is designed for multiple future users, which aligns with city preferences to avoid numerous single-user poles. Staff confirmed that the proposed tower is necessary due to the inability to accommodate equipment on existing structures within a half-mile radius and complies with specific city code requirements for height, design, and setbacks.
Conditional Use Permit for Vehicle Repair at 1515 Morris Street
Dissent: None
Moved by Commissioner Foresight [01:10:48] · Seconded by Commissioner Robbins [01:10:52]
The Board considered a Conditional Use Permit for Royal Imports, a vehicle repair business planning to relocate to Shakabe. The applicant, Oscar Brady, specified that the business focuses on regular passenger vehicles, offering a range of services from fluid changes to powertrain repairs, but explicitly excluding bodywork and painting. The site was previously used for a business whose permit was revoked, making the new application a backfill for the space. Staff noted the property's zoning in light industry and a mixed-use employment center.
Planned Union Development Amendment at 1300 Crossings Boulevard
Dissent: None
Moved by Commissioner Robbins [01:13:30] · Seconded by Commissioner Sandu [01:13:32]
The Planning Commission opened a public hearing for a proposed amendment to a Planned Union Development. However, before any discussion or presentation of the item, city staff requested that the item be continued to a later meeting. The commission approved the continuance without setting a specific new date for the hearing.

No, the ordinance allows when we change the ordinance that neighbors within 500 feet are notified and they can object to a home occupation. So home occupation is not granted by any kind of right. It's a privilege and it's based on feedback from basically your neighbors.
The reason why I appealed the denial is I thought that it was unjust and unfair. Um, especially with the city planner, Amanda, she actually sent me an overview of the process um, when I first applied. And it specifically said as one of their procedures that staff will assemble any comments received and further discuss with the applicant any questions, comments, concerns, and see how if they can be addressed and that was not done.
I haven't heard anything here tonight that would cause me to want to deny um this uh this business. I mean I have heard uh the owner talk at some length about how she works. Um, I've heard her talk about the meets and greets. Um, um, that she's around all the time. Um, and, um, I'm inclined to want to say um, to overturn this. In other words, to um, agree with the appeal. I just haven't seen anything un unless there's something that I don't know. Um I haven't seen any evidence that this business is disruptive to the surrounding neighborhood.
I'm torn. I think I think the applicant has done a fantastic job, frankly, of setting up your business, setting up a process, thinking of the issues that could happen and having ways to mitigate from the incoming meet and greet, the whole deal. uh you've stated you've had to kick some dogs out because of non-compliance, if you will. So, it shows you take action in the event that it doesn't go the way it's supposed to go. Um, so I agree from that standpoint. I see no reason why this shouldn't continue. What I'm struggling with is the process that is set up by the city says they file for the I'm going to get the word wrong, but the um
So that's the city's preference not to have polls with just one user but to have multiple users on the polls.
Basically, you're a landlord of the tower and you rent space to carriers. Correct. Essentially how it works. Yep. Their business model is to have the infrastructure for the carriers to to uh lease from and uh generally they work with one carrier as a seed company that helps cover the cost of of constructing it and getting it in place. Um I don't know with financials but yeah you know their business model is to gain more carriers. That's how they really generate revenue.
It would be regular passenger vehicles. you know, sometimes they'll there'll be a business car or a business truck. Um, nothing big semi-truckss or anything like that. No cargo vans, none of that.
Yeah, you need to continue this till the next meeting.
