5-0 Approved

Dissent: None

Moved by Mr. Lara [0:26:40] · Seconded by Mr. Whiting [0:26:48]

The discussion centered on the Board of Adjustment and Appeals' (BOA) decision to overturn a staff denial for a home occupation permit for a dog daycare. Staff originally denied the permit due to neighbor concerns, but the BOA approved it, finding the applicant met ordinance requirements and there were no prior verified complaints. Council's role was to determine if the BOA correctly applied the ordinance. Questions addressed the applicant's prior unlicensed operation and the enforcement mechanisms for future complaints.

Appeal of revocation of hotel license for American Group of Properties LLC, Baymont Hotel

4-1 Approved

Dissent: Mr. Whiting (voted against upholding revocation, preferring a conditional license)

Moved by Mr. Lara [0:57:48] · Seconded by Councilmember Contrarus [0:58:08]

The City Council reviewed the revocation of the Baymont Hotel's license following severe incidents, including drug-related deaths and a large-scale event with gang threats and widespread illegal activities. City staff detailed the hotel's history of violations and non-compliance despite warnings. The hotel's legal counsel and owner presented a proposal for a conditional license, acknowledging past failures but promising operational reforms, new management, and financial compensation for city oversight. Council members expressed strong skepticism regarding the hotel's past conduct, its management's common sense, and the feasibility of city staff managing hotel operations. Concerns were raised about the time it took to discover the deceased individuals and the general disregard for safety and city warnings.

What are the remedies if concerns pop up? So, mayor and council, as you'd mentioned, mayor, there's the board of adjustment appeals looked at all of the conditions that are in the current ordinance. If there are violations, they would notify the police department, the code enforcement officer would go out and then they would get back to us and as we said at the board of adjustments, then the board of adjustments could then revoke the license.

The police department had told them that that was not a good idea and that it was a possibly violating many multiple uh ordinances uh city ordinances. and the management decided that they went ahead and were going to do it anyway.

I think if if council decides to go that route, which I'm positive that has not been determined at this point, um I would prefer our staff team along with our police department and our zoning coordinator to be a part of that process if that's council's wishes.
