maintain a shared um Hill for uh snow removal maintenance and there is a lot of drama within the association and there's no money in the association and it's so we're trying to see if there's options that we could look at to have the city take care of the road since it's owned by the city and I'd like to add it's an unofficial Association that we kind of inherited from moving into the neighborhood yeah what do you mean by unofficial Association there's no documentation within that's been filed on the association that we can find yeah all we've been told is that the city disowned us and they don't maintain our street there's no street lights there's no plowing there they don't maintain anything yeah okay let me uh it was it was from what do we understand is is Dave SAA had created this back in 1993 and he went around and tried to have the homeowners at the time sign something but I can't find anything where he actually filed it with the city okay now at this at this point we don't take actions per policy but we do allow council members and staff to ask clarifying questions Mr whing yeah I would uh like to see if staff knows of the area that we're talking about uh thank you mayor and Council yeah I'm aware of the area I think it's Dean Lakes road that goes down the Gravel Hill yes it's not a gravel road it's tar though sure the hill is yeah is is that the extent of what we know of that is that a private uh yes it's a private road from the city's perspective we don't maintain uh there's no City Utilities within the area as well okay I'm trying to I'm trying to figure out where exactly this road is Mr Mayor uh it's uh along Country Road 16 East of con 83 there's the Frontage Road Eagle Creek Boulevard that was constructed when the county reconstructed Eagle Creek there's a private roadway that goes down the hill towards Dean Dean Lake um and there's private roads that front Dean Lake on the south side of the lake M okay yeah there's some houses on the bottom of that Hill that's correct there's 10 houses down there yep okay um I guess I guess if it if I was in your shoes I would be talking to the county about you know your property IDs and stuff and see what kind of information they can dig up because I don't know where is that information stored on if there was some sort of uh home owners agreement or or a policy would that be on their at the county on their titles normally it would be part of their title and there's nothing on any of our titles I've gone to the county and I've searched it um and uh um the county has put three X's as the ownership on the hill but there's a piece of land at the bottom of the hill that is owned by the city and then there's they I mean they spu comes down and cleans the the the power lines and and the road maintenance that way or does that but and then there's another strip of gravel that's owned by the city as well but interesting and even like I purchased the house in 2021 and there was nothing when we purchased the house nothing stating anything on the title the deed like the L nothing about a Association we didn't actually know until she knocked on our door and said hey by the way we have an association okay yeah and been trying to just kind of continue to maintain it because we have to be able to get up and down the hill but there's just been so much back and forth and with all of the turnover of the households less and less people that were part of the original deal are around anymore so the gentleman that started all of this he passed away about 5 years ago so we have no way to even see what paperwork he had a a homeowners association is a contract between the homeowners and essentially amongst yourselves uh the city with a normal homeowners association would have nothing to do with it uh also when it comes to a private road if it's not a city road the city does not have anything to do and we have a lot of community unfortunately uh at a time period we allowed developers to build private roads roads and this is exactly the problem that happens um we've had residents come before asking us to take care to take over the road systems and their particular developments the problem is is those roads are probably not made to Specs to City specs and with every other Road in the community community taxes have been used to uh keep those roads uh in in workable condition private roads have not and so uh we've never taken over a private road uh and made it a city road so when it becomes an issue though for safety whether it's for police officers to come down or fire or ambulances what happens then if there's no actual contract of an association there's no one to maintain the road than what happens and if we can't put together 10 people to collect enough money to hire a snowpow company then what do we do well well I you know we're not we're not supposed to be finding Solutions here we're supposed to be taking in the information and asking clarifying questions um well I wanted to make sure that they were aware of ab and we we we we are aware of that or we kind of are and we're just trying to find a solution here CU or get pointed in the right right direction to get to a I I I would seek legal counsel somewhere yep and does staff have both of your contact information make sure they have it make sure you have that Mr Whiting I was just curious if do your properties have utilities sewer and water we have uh septic and well okay but they do have electricity we do have electricity from the utility G public yeah spuck is who are G or electric is all through you're you're not the only unique situation in the city of Shaka over the years I've learned some unique situations and especially old Shaka um shared sewers buildings on over property lines all kinds of stuff uh things were a lot different back in the late 1800s early 1900s um I was just curious I know that you know I suppose technically all your neighbors could join together and petition the city for an improvement but you'd be waving all the appeals to any assessments for them improvements which you'd be paying for them improvements um that was my next question is that would be the process of moving that into a city road and then we'd probably only do that when utilities would be moved into the areas my my thought possibly but I don't know that it's available on 16 I don't know where we're at but that's a that's a whole another process that you would have to look into and and talk to staff was it always a private road uh mayor and Council I I believe that is the case and I believe these properties were annexed into the city at some point I know there's history on this and staff has had conversations recently about this area um and we have researched the ability to extend utilities through the area water is a lot easier sewer we need to come from a pretty far distance to the West um through the dean Lake Development Area um so it's it's something that would be challenging to serve the or withour and very expensive um but uh it's certainly something that we have discussed at staff and we can continue to do more research and bring it back to council and uh I think that was Eagle Creek Township back in the day when it was annexed in okay well we really appreciate the conversation sorry we couldn't more help kind of neat having some of these Rarities come forward yeah so I would encourage you to seek legal action as as uh Mr Reynolds pointed out uh find out if there actually was a a homeowners association or if it was a neighborhood handshake deal which holds no legal Merit um and that's what I've found is is it's just a handshake deal sit down with staff and uh you know you're going to learn that to a peti petition for that in way of right to Appeal assessments especially the S part and stuff like it's going to be pretty costly but you know if you're that's what you want to do I mean if you're willing to pay that that cost I I have no idea what it would take if he's feasible or not you'd have to talk to the engineering department it'd be exceptionally expensive um do do you pay homeowners association fees currently it's $500 a year is what we've collectively chose to pay and we just it's basically you pay that not to pay it there's nothing we can do about it because we don't have any Authority with it the question is who do you pay that to who do you pay that to we just all collectively just collect it and then we pay a a service to do it so they just give us all they collect a check to one of us and then we pay the the person so right now they're paying me and I'm paying the service so me huh yeah well it's been a light light cost year for you this year for plowing not much snow yet but it's coming may all and so we're ready to and they have executed their side of the lease the second uh lease is for what was the shaky Market this to work yummy bites so it's for a group called yummy bites are out of Minneapolis and um they're a coffee and treat store we're proposing a 5year lease with an option for another five years at $18 a square foot with a 50% increase every year thereafter February and March would be rentree as they prepare the space they would need to do architectural plans use our tenant plumber and mechanical contractor and then the Eda would install the signage on the front and back this is uh some of their products so we think it's going to be a great addition at downtown another U kind of more active space than the one that was in there before and they have a really great reputation uh actually Tim zunker from the chamber has been there for meetings they have really good reviews online um and the owners are here tonight they brought some treats with them and uh I think they'd be happy to answer any questions questions of staff I might have one um any chances it looks like it's a specialty um y treats any chances of having any uh sweet bread sweet bread like aan want you for the treat and uh course go ahead uh first of all I'd like to start with my name I'm I'm ali um it's my father my little brother my father is Muhammad my little brother's Hamza we work you know as a team in the shop also along with my wife with us too so we started all started about a couple years ago uh we we maded from Iraq in 2012 uh we came in here you know he didn't speak any English we had to go to SL classes went to high school got out of high school we wanted to do something for ourselves in here start a new life and started a couple years ago exactly we were sitting at home and we're like you know we like to make you know sweet stuff at home we like to cook you know and unfortunately there isn't really many options that opens late at night for those who likes you know sweet treat at night so we're and back home for us it's knowing cuz it's you know the temperature is really hot so many places opens late they don't open like during the morning so they start opening like 3:00 4:00 p.m. closes at like 2: 300 a.m. so we're like we can do like 1:00 p.m. till midnight and let's see how that works you know so that's how is our hours right now and in our first location it's 1:00 p.m. till midnight and surprisingly we get we stay open sometimes till 1: and 2:00 a.m. yes so you know a lot of people likes to get sweet stuff at night now everybody wants to go to a bar now everybody wants to go to a Club everybody you know some people likes to get you know they get that sweet too you at night uh we just started making stuff we like to make Baklava we started to make milkshakes something new that's not really you know like uh popular and I'll say in the midwest like we do nut Nutella shakes we do pistachio shakes we do cookie butter shakes we do sneakers shakes we do uh Twix shakes KitKat shakes we do all these fun you know flavors we also o do mini ban cakes and you know all these flavors goes also for the mini ban cakes we also do waffles same flavors uh we do you know ice cream cups uh that's pretty much it beside you know the the lattes of course we do a lot of lattes too so and we do virgin Mojitos so we came up with the Virgin Mojitos idea mainly for the kids we decorated the store to be a you know kids friendly environment uh a lot of growing UPS ended up loving our Mojitos you know we have lines just for the Mojitos now so the reason we wanted to come to shaku because we get a lot of business from that area so we get a lot of business from Shak Beach and Hassen saage uh Eden Perry uh Bernville we get a lot of customers coming from there like 11:30 at night and like we have to sometimes reopen for them cuz I'm like huh they drove 40 minutes away I can reopen you know and it happens like every day almost you know so we're like you know might as well let's just go there too it it's a a niche time period and um I think it'll fit into our downtown time yes schedule real well I know one council member might be down there at 11:30 for coffee but I might come down at 11:30 for I mean I'm I'm kind of familiar with shaki uh I married uh to my girl and she's from shaku but then we moved back to Columbia Heights but now we're probably going to move back to shakobe there you go thank you well let's talk about that's Mr Lon Mr President uh you said coffee too yeah we do lattes it's all lattes yes all all t a lates espresso chocolate we do Nutella lattes we do pistachio lates cookie butter lattes chura latte we do a lot of typ hot chocolate we have a latte that's the most popular one it's a Spanish latte that's really sweet and creamy and everybody loves it so you have chocolate and coffee yes I might have to put my new desk Believe It or Not sir we get people coming from Iowa you said Snickers too and he likes that one too so yes and business was really busy at this location and it's really small that we had to get our own security to uh manage like you know traffic outside w wow yes well let's talk about your business uh um and we we'll move on thank you for your treats and any other questions of of the yes uh what part of Iraq were were you from uh Iraq what park uh what park uh we're from my father uh is from diala but we were born and raised in Baghdad until 2008 we had to uh migrate to Syria when it was you know in a stable condition back then and uh we had to stay there you know like uh in a you know like immigration Camp pretty much uh for 5 years until and the last year it was actually a war another war in Syria so we had you know really bad experience until you know finally we were m ated to America in 2012 well welcome thank you appreciate it all right thanks Mr KY uh where are we add any other questions of staff on this project there's two two points to this there's um the dress shop which is one one portion and they were the same tenants that were in that space before let me read that was that's the same Mr President yeah uh Mr C the uh the annual rent differences are spaces much well we don't hear often no we don't all right I think uh we'll move on to uh our next item on our agenda tonight is uh this disposition of property uh five 4B 4B Mr kki chair and board members so this is the west and land West End Land Development so you remember um city has since sold off this piece here this is where there's a Town Home Project under construction and this is the Rehab Clinic and doggy do is over here this is the churny property if you remember uh we sold this in the middle of the pandemic and churny got constructed they actually own this property right now through cabin um realy out of Boston and I've spoken with them they have no use for this so they're going to uh willing to sell back this portion of the land if you remember this is an outlot this is the contaminated piece where the city sign sits today so this was um the original plan back when Opus had the property so churny would have been here they proposed a new industrial building here with about 81,000 Square ft um this is the same plan they plan on moving forward with so this will be for some smaller tenants that are in the market that had express interest and so the uh Eda would sell subdivide and sell this property at the same closing we would purchase it back from uh cabin Industries and then sell it to the new property owner questions of Staff Mr L Mr President a couple of questions the uh original was it an abatement for the churn um development churny um Mr President and board members attourney has I believe a nine-year property tax abatement okay and that property that we're talking about was included in the calculations for that sort of I was not of much value all the value is really in the building so it really won't impact their um abatement very much okay and four acres I got prime location all new utilities I got a I got to think that per acre is got to be $175,000 an acre okay and the the sale the dollars from the sale will go where so we'll have to buy back the land from churny for what we sold to them for which I think at the time was about $3 a square foot so we'll have to pay that back the balance after we do that goes back into the eda's real estate fund all right I'm not sure that I understand that um I I know that we got the land reduced because it was menot Surplus so so Mr President board members so we sold the whole property for about 3 a square foot to to cabin Industries or cabat real estate out of Boston who developed the churny building with Opus as their partner part of the agreement was if they didn't use the rest of this land that we could buy back at what they paid for it so or what they paid us for so at the closing we would get $170,000 an acre and we would pay them back I think it was 150,000 Acres so the difference would go back into the eda's real estate fund that's about $100,000 difference any followup any other questions I I have some concerns um my concerns is the end product being out there for spec do we have committed buyer and people that are going to move into this space because I I so Mr presid president and board members so there are a number of people that the developers talk to about U moving into the building some of them are smaller businesses that can't find Space right now in Chaka as you know most of our buildings are 150 200,000 Square F feet this is a smaller building so there are some tenants out there looking for smaller space so and it would be similar we have design standards in our code so this would be tilt up concrete just like the churny building would have Windows just like the churny building they would be very compatible in design now your your design here shows two separations is is there a plan for more uh Bays more uh tenants in that building or at this point it's just two Mr President and board members so this was uh opos is kind of concept plan back in the day it could end up being three or four different spaces could be anything okay I know they've been talking to one tenant who I think is just over 10,000 and they have another one that's probably 50,000 right any other question questions what are the wishes Mr L um question so with I believe it's um then Trident is the company that's owned by him so have prices been negotiated with him in terms of like is he expecting to purchase that at a certain price or is he purchasing at a market rate or so this market rate I mean um is about 175,000 an acre right now um he did purchase and is developing the piece across the street so he's pretty familiar with the market he bought that piece from the Eda I think two years ago so I would say it's a tough Market financially out there right now for financing and he has financing lined up and is ready to move ahead with this project because there are some tenants that are interested mrman one last question Mr President so this uh property once it's sold will be removed from the nine-year abatement for attorney correct okay be out of tax rolls it'll become on the tax R yes this is the plan as you can see there's a dotted line on this scheme so that'll be the split in the property so churny will our cabin Industries will everything will own everything to the south of that line and the new owner will everything to the north and I guess I got one more question go ahead sorry I'm I'm looking at the existing building parking and and the new building parking um we've done analysis of how much extra traffic this is going to create and if verling drive extended can handle that I know I know 69 certainly can Mr President board members so this was designed originally for two big buildings so um well the answer is yes yes it was right on the roundabout and it was designed there's trees planted right now where those truck spaces are because um churny wanted a devising line between kind of the weeds and the trees to the north um from their property those all come out when they build the docks and we'll see a whole other okay concept plan I'm sure any anything else no what are the wishes of the board oh action oh just information okay we'll bring it back a formal contract we just want to give your heads up correct staff works on getting the PowerPoint up screen right oops yes get it to move come on there you go all right thank you um back in uh 20 19 I believe it was we had all come together over a several month period and worked hard on a strategic plan and uh essentially we had some intervening or major intervening event uh since that time and that was Co and it impacted our ability to carry out some of this plan but I'll go into that a few minutes but essentially uh the plan was originally supposed to be in effect until the end of 2024 uh because of the loss of about a year and a half if you if you will uh it's my intent to continue to move and address the areas that we have yet to address in this plan because I think they all are of value uh and some of them are in currently in motion and will be uh done in the relative uh near future as well one we haven't touched at all and I'll talk a little bit about about that when it comes up next slide please oh wait a minute I've got it right here hey so what is a strategic plan uh it essentially takes our big idea plans if you will our aspirational plans such as our our uh comprehensive plan and our Parks Master plans both of all which by the way had extensive amount of work and an extensive amount of public input uh to both of those and both of also I have to say are award-winning uh plans as well uh and and it essentially it takes those ideas and it tries to put us in a position to make those things happen or at least a portion of that uh it essentially is direction from all of council is that this ultimately will be essentially your big guiding points for the next four years and I think that incredibly important because that literally you know as staff members it's it's difficult at times as we kind of get pulled by individual council members who who have certain things that they want and we understand that that's important and and we want to try to do as much as we can within those within those bar within those boundaries but the reality is is that we have to look at the council as a whole and sometimes we don't get the guidance unless it's from something like a comprehensive plan so the great thing about this was is it was passed 50 and was pretty much a Bedrock this is what you will be working on in the future this is a council plan by the way this is not a staff plan this was developed by Council as we work through a a a facilitator that helped us through this process and Council came up with four different strategic uh uh priorities Financial stability enhanced Community strengths effective public services and communication now the very interesting thing is that the majority of these things is something that we've been working on for decades uh but what we did was essentially put them into a plan and and come up with strategic objectives out of the end of it we also came up with our vision mission and value statement and just as a reminder our vision statement which took some time to craft by the way shaki is a place where people want to be a distinctive River Town with a multitude of business cultural and recreational opportunities and a self excuse me a safe welcoming and attractive environment for Resident and V visitors there are a couple points of of the vision statement that stand out to me obviously one of the things that we found out from our Park master plan and our comprehensive plan was the concept of us rediscovering the river and that's why when we talk about a distinctive River Town actually in our Vis vision statement it kind of brings that forward and and and is an anchoring point for for the community and say yes we are a River Town the other thing is that it it recognizes that we're an entertainment town uh that's what we do and and we're getting our fifth Crown Jewel coming up here with the amphitheater before too much longer uh and we want to be safe welcoming and an attractive environment for residents and Visitors by the way 2024 was our lowest crime rate ever so we're continuing to be safe and welcoming our mission is to deliver highquality Services essential to maintaining a safe and a sustainable Community we commit to do this coste effectively with integrity and transparency uh cost effect effectively integrity and transparency are the key points there and we also outlined what our values are number one Integrity we say what we mean and we mean what we say best for the Community we work on behalf of community interests not individual interests accountability we are committed to achieving results and accountable for our actions Innovation we strive to creatively improve our services and our community and we have been rewarded by Awards uh in the last four years because of some of our Innovative work welcoming and open to difference we are receptive we listen and we are open to the differences of others fair and consistent and respectful and our service to the public and finally fun we enjoy what we do and we have fun doing it as I mentioned we had a couple things that uh we didn't know about when we adopted this plan one which was a complete out left field and the other one um uh we didn't really put together the first one was co uh for basically a year and a half we weren't really concerned about the comprehensive or about the Strategic plan to be very upfront uh we were were trying to keep the lights on as I've said in the past and the other part which we we didn't recognize at the time and we probably should have if we would have looked a little closer meaning staff uh no databases really exist for a couple of the things that we were trying to measure one was the number of public events and two was the people at those public events uh you know we really had no way to put those two pieces together overall the plan is about 75 complete 75% complete and you know to be very upfront this was an ambitious plan and we knew that and we knew that going into it um our biggest uh non aievedirect the funds for the Hub Innovation Center those things will happen uh we just weren't able to get the funding stream for those uh all locked in along the time frame we had originally anticipated so what I'd like to do is just kind of briefly look at each one of these strategic priorities and talk about what we did what we didn't do why uh and what we can think about in the future stable tax rate uh obviously a very important piece to everything we do uh and something that we talk about at the beginning of every tax season we did achieve a rate change equal to or lower than the implicit price deflator the ipd is essentially uh a a measurement of inflation based upon a known Point uh and how that uh uh the change between that known point and and and ultimately the inflation in real dollars uh we annually achieve that every year from 20 to 2024 uh we had a boots on the ground F long-term financial plan that Council wanted we also put that together uh and it's been part of our budget process since 2022 diverse Revenue sources uh which is essentially something that council is looking for for an increase in yearly nonpr property tax revenue one of the things that uh really kind of skewed everything was Co and the federal funds that came in um that really you know kind of made our needle Bounce Around a little bit but the interesting thing from my perspective is that as we were starting to do the research we are so far above now what the normal percentages are when it comes to non uh property tax revenue for our general fund that uh you know we still want to try to move and get that better but the reality is is that we're literally doing it almost better than anybody else we're almost 50% of our general fund is coming from nonpr property tax sources it could be more especially if we can uh get our tourism Revenue ticket sirch charge essentially for lack of a better term uh we we have agreements with the smsc in place uh we have an oral commitment from uh Live Nation My Hope Is that we can go to some of our other uh organizations and try to get them to agree to uh help us out in this regards because we don't have the political will to make it happen frankly not here just uh from the State House ensure adequate funding of the CIP this is kind of yes we achiev 50 50% of high priority projects uh by 2024 however you know we didn't move those big ideas and I think that that is the real again Point uh that we look back and say man if we could have just got one of those done that would have been something uh and don't forget that we do have uh supplemental planning for Street reconstruction and funding that would help in these these areas too that'll be coming back for year review in March we did improve the 5year CIP process and revamped it and it and it has been revamped from the 2022 to the 2025 budget process strategic priority number two from the council was enhancing Community strengths we' talked about the Big Ideas projects not funded but we continue to move forward on all of them uh enhance the quality of employment and jobs a lot of great economic data even during the pandemic that came out uh we achieved a 10% increase actually it was an 18.2% increase in the average median income by 2024 we did refine our business promotion and attraction process we've actually done that twice uh since this plan was in place and increased economic assistance to at least $28 an hour now and we achieved received an hourly wage of $41.25 more than the 26 that we looked at in 2024 successfully maximize entertainment options for tourism and visitors uh because of Co our overnight stays in hotels it still is having an impact uh and so we did not reach those numbers but the average daily rate the ADR did increase to over $100 it is actually at 104 now again and we do know that we've had increase in public public events and participation both on the chamber side and on the city sponsorship side as well as some uh uh other events that go that are going on but we really have nothing no way to measure that so um it's not like I can say we know that a thousand more people have come than would have W otherwise there is an interesting thing that the chamber has really been working on has been exceptionally Innovative and they've been working on it now for several years is the the uh their ability to track the data of visitors that come into the city uh and are at the events and where they come from what they spend their money on and that's really changed the dynamic of what the chamber is doing excuse me what the the tourism arm of the chamber is doing and we're seeing a lot of real impact from that and I suspect that we will they have a lot of data that we could borrow they have an exceptional amount of data Mr Reynolds I just wanted to point out that the information that the chamber is gathering um on visits is willing willingly offered by those that they're Gathering it from I think they're using some digital fencing too they're collecting it GE Geo fencing which essentially is raw collection of data um to them sites willingly and clicking on it information not digital Fen not not with the GE Geo no their their phone walk it's it's it's GPS it's on your phone it's a essentially taking the data on your phone and incorporating that with other people's data and bringing out a big Target as a it's not no one's saying that you know I'm looking at Matt Layman's information it's the overall information that's coming in okay Matt Layman from duth was in shaki that day you yeah there's a couple of us there's one in Bill plane too I'm just saying s priority number three effective Public Services I'm very proud about this stable Workforce that was a real concern from Council four years ago uh and so we we look to try to find ways to incorporate uh some stability in the organization uh part of that was a yearly turnover of 15% or lower average government turnover is 18% by the way uh we actually uh if you don't achieve retirees it's 6.4% that we had that's excluding that's excluding re retirees if you add retirees then it's just under 10% uh the other metric was 50% of internal candidates selected as supervisors actually we had 60% we conducted Staffing studies in August of 22 and a fire department specific study in February of 24 and we established a comprehensive performant management plan in February of 21 all things that the uh Council was looking for we partially achieved a prior PR ized infrastructure plan and funding philosophy and we did develop fully a 15-year I CIP in 2023 and that is now been involved as part of our budget process every year since 23 one of the goals was to determine Staffing levels for three departments uh we actually since 21 have Incorporated Staffing level review as part of the budget process uh determined service delivery standards we have not completed three we've completed one with the fire department however we are currently working on both Park and wreck and public works and the one thing in this whole plan that we have not done anything on whatsoever uh is to develop impact review processes determine effectiveness of a program we have done nothing on this I have no answer as to why other than we just didn't look at it and it wasn't on the top of our list list so that is one of the things that I'm very interested in starting to peel the the uh uh banana on and see what we can uh move forward with in the future that's the only thing in this plan that that has not had some movement communication knocked it out of the park uh we developed strategies to reach underserved populations by adding translation services to the website and upgraded it to Ada standards as well uh through our survey uh survey data was was an important piece of what we were looking at when this was put together uh the council very much wanted to see uh some movement now obviously when you're making a movement in a survey it's because of real impacts of other things that you're doing to get that Movement we did achieve a 5% increase in confidence in shaki government and we actually a achieved a 15% uh increase in uh the opinion of the city's image itself part of that I think is because of the uh strategic Communications plan that was developed in December of 21 and that was rolled out and was implemented uh and then we also uh put together new branding guidelines ined introduced in February of 2023 so that's an overview um as I stated before my Pro my my thought process is is that I really would like the opportunity to crack some of these other nuts that we don't fully have uh uh fleshed out uh Co kind of put a pause on us for a while and I think we almost got cheated yes sir what what do you uh expect would you put say some of Co might have put our some of these goals back three years would that be a good goal or two to three years you know it's hard to say uh councilor Whiting I think um I mean quite literally this was not on our game plan at all during co uh it sat on the shelf uh and so um I I I can't answer that I mean some of this stuff is still impacted by CO as our our our uh our daily uh uh Hotel visits I mean that's clearly those hotels still have not come back from where they were preo let alone hitting the goals that we had set Amphitheater might change that but yeah yeah the financial Matrix is is hit because the the federal covid dollars that came in kind of skewed it quite a bit and it's going to skew it for a while you know you almost have to back that out to get a true picture but you can't because it's incorporated into services that you're trying to supply in a situation you've never been in yeah we you know we we put it out there we recognize that it skewed everything and then we're trying to find that Baseline that we can move forward with and that's but I still think there there sections have not recovered from covid to to have that Baseline including some of the federal funds we're communities are still were not but some communities are still just now finishing uh up with their federal funds that they they were received so I mean that could have a longterm effect about it if I can continue I I think we did a lot with what we had um there's a couple opportunities here um and I think you know you're looking for some more of that data under uh and I think working with the chamber on some of that uh information might help us collect some of that data I think the the events in town Co clearly knocked that back quite a bit but I think that's coming back strong um the other the only other point that I wanted to make was uh the the big one is develop impact review processes to determine effectiveness of programs and and that could be something as easy as surveys after some of these programs too yeah and and and unlike County or state government this is going to going to sound bad but I promise you I don't mean it bad what we do is relatively simple we fill potholes we put bad guys in jail we put out fires uh and then we have programs for people to have fun in Parks that's what we do and sometimes you know measuring that may uh uh you know it may seem too simple and maybe that's why we kind of I I'm not sure why we didn't get to that uh but no it's something that I I I want to dig into and see you know what we can do it it should not be that complicated to be absolutely up front with I think any park and wreck program could easily have a little survey at the end of it and we could use that for some measurement filling the potholes uh I'm not sure if we can measure that if unless and that's and that's part of it but you know we can we can certainly take a look and and talk with all of the Departments to figure out what opportunities there because we have not had those I'm looking at it a little differently and not only is it to I'm looking at it as from the standpoint of efficiencies and end results are you not picking on your department bill but potholes or streets or plowing or whatever um are are we doing that in a effective efficient manner um with good end results and like I said I'm not picking on your department you can do that with any service um and and kind of review you know what is it what we really are trying to accomplish and how are we accomplishing that on these day-to-day services that we provide I don't know if that makes sense it does and and you know like I said I I'm I'm really kind of chomping up the bit to try to work on this one just because it's kind of was that outlier that you know I'm like all right we got to we got to we got to tackle this puppy so yeah I was looking at it was easier well and and that that same mindset could apply to park and recck services too it's it's yeah you've got the the user side information same with the driver side information of you know quality of streets timely repairs stuff like that but then you have the internal side so if you take like a like a park park and wreck something that's being offered um you know how's the delivery of that how's it flow how's the efficiency you know all these things combined you want it the internal side and you want the external side and they might tell two different pictures or they might tell the same story um or or we might be having a program that we're um doing incredibly well from a a money monetary standpoint and everything else and then nobody likes it or somebody likes it but yeah they like it because we're losing so much money I mean there's a lot of ways to look at yep or there's a service maybe even program review board uh internal kind of something like that what uh kind of uh the subject matter experts can uh critique each other and uh look at the financials and things like that well not only that but you might find that there's a service that we're providing that we're not providing enough of maybe there's just overwhelming support for something them uh you know something at the community center that we're not you know we're not providing enough of um and both internally we have the capacity to do that with no extra EXT extraordinary expenses and they're externally from the comments like you said from outside you know there's just this overwhelming desire for this you gather all that information and kind of put it together and and it's good information to have both internally and externally so I think internal audits are important for any organization absolutely well thank you for your comments we will um continue to work on things and be back to report when we have more successes any other questions comments go ahead um I know you said they blew it out of the park but to Communications and with not having a newspaper amazing work thank you so much everything they've done and I've seen it you know when they ask me for something or questions like we should go check on the website oh yeah I found it it's on there and putting it in different languages again thank you so much very good point councelor contr because I think think we're always going to have a level of lack of communication not that we don't want to strive to be perfect because we do and communication is probably the most important piece of all of this and the problem that we keep going back to is you have the old school that don't do computers and I think of my mother and things like that um and then you have the other Generations that only do computers so you know we don't have the we don't have the newspaper and a lot of people miss it um but realistically realistically that model is not very efficient in today's world it's very cost prohibitive actually so how do we make how do we connect that how do we make that barrier work tough question don't have the answer good comment though thank you um anything else from Council on that okay item 10B discussion on pawn shop fees good evening mayor members of council uh at a prior meeting uh Council asked staff for more information on pawn shop fees it's something that we hadn't looked at for several years um staff did reach out to several cities I'll show you here what we got back um on their fee their current fees um as you can see we're in the middle to kind of the lower half of that um they do range again from $3 up in fredley to 60 cents per transaction in um Mano uh last year in 20124 the city collected $1,942 in pawn shop transaction fees our bill for leads online uh where we monitor this stuff is $4,620 um there's also a staff time for finance doing the billing um monthly with the pawn shops so we are covering our cost again this is not something that we have raised uh it's been a150 ever since I can remember it's at least at least 20 years um that it's been a $150 per transaction but as you can see we're not uh higher low um necessarily compared to other cities that have pawn shops staff did uh conduct an audit on both pawn shops in the city a pretty comprehensive audit actually I'm happy to report that both passed with flying colors these are pretty regulated heavily regulated uh businesses in terms of what they have to record how they have to record it what they can take what they can't um and both both pawn shops did a really really good job and uh we didn't fight any discrepancies so again 10 , 942 is what we got last year the year before it was slightly over 11,000 I will tell you those are low compared to what we normally have seen over the last decade or so back in 2009 uh 2010 when the economy was really poor we were getting I want to say $819,000 in pawn shop fees Chief is that based on quantity of of transactions yes it's based solely on the number of transactions so you're looking at 3600 roughly per pawn shop um staff is not recommending any change at this time uh I would say that if Council does want to in the future look at um raising pawn shop fees that is something again kind of dusting this off we hadn't done that in a while um these businesses when they do take something in they are required by a law to hold on to it for 60 days so it is something that I would if we are going to like say for the 26 uh 2026 uh fee schedule adoption raise our fees to $2 we I would want to give those Pon UPS some lead run uh runup time uh so that they could adjust uh obviously their transactions they have to bake this into the cake um so purely informational here unless Council wants to direct staff to uh increase these fees at all no I think this was uh another exercise we wanted to make sure we weren't losing any money the the goal goal isn't to get more money out of uh people making transactions here it's just so that we're making sure our pawn shops are doing the right thing and uh we're not losing money on the deals so uh thanks for that exercise and I think I'm okay with it any other questions of council for staff I do think it's um something we need to consider in the future and based on what what I mean if Jeff did uh do City say do they regularly raise them is there um do you know any history on what they've done in the past besides what they have now when you say are you talking about other cities yeah yeah when you got this information from them did you ask them just for this number did we ask them like how often did they raise it um when was the last time they raised it sure mayor and councel uh we did not ask those questions I can tell you that back in 2009 that 2010 again that there were a number of cities uh this actually created quite a bit of news at the time we're looking at you know the economy was what it was here's a opportunity from a revenue standpoint to increase fees a little bit and Burnsville was one of them I mean Burnsville went very very high then they eliminated them now they're at A110 so it was when the economy was poor and and there were a lot of pawn shop transactions at that time that several cities started looking at that's really the last time I think I ever stood before Council and talked about pawn shop fees it was back in 0920 we had to kind of go through this same exercise was this going to be um something we should look at and we I remember that slide I presented we were right smack dab in the middle and Council elected to stay there so and we're still kind of there uh Chief I have a question for you C Lara that answer question y okay um question I have is do we use any technology specific to pawn shops I I'm thinking back to that 2010 discussion and I think at the time there were some changes in State Statute that required the pawn shops to do some kind of state electronic um inventory or something like that mayor and Council that would have back then would have been the aps uh program that Minneapolis the City of Minneapolis ran right now that was the leads online program that um I said that was 4,000 something okay uh is what we uh get built for that so they are required to I'm everything from record everything a a photo ID government photo ID all of that um any very very detailed they're even required to video the actual transaction and hold on to that video for 30 days okay so that's all still happening we are still in that system these fees help offset our cost for that okay do you anticipate that system changing anytime soon mayor that changed maybe five six years ago I want to say and went away from APS to to this uh program and we're we're covering our our cost absolutely yes okay very good any other questions for staff on this I just wanted to say I don't think we wanted to make this a money maker uh these are fees that are it's actually a sustainability we're getting old stuff moved on to a new home and uh uh sometimes the people buying them are can't buy the new one so okay thank you Chief thank you all right moving on to item 11 a 10 C was on consent 11a discussion on ebike motorized bicycles and foot scooters this should be a good one uh hopefully all right good evening mayor and councel um bring in a discussion in front of you on ebikes motorized bikes and foot scooters um going to some State statutes just to diff differentiate between the three things um this is helpful these are these are all things that we use to educate the public and help them try and understand the difference in these things um ebikes electronic electric bikes um two or three wheels has pedals attached that can power the bike by human propulsion so they have to have pedals if it's an ebike it's got to have a p it's got to have pedals Max 250 watt motor there's three classes they are allowed on trails and sidewalks um you do not need a permit or a license you must be 15 years or older to operate stop yep so when you say they're allowed on trails and sidewalks that's by State Statute 169.000 one1 that is correct mayor so if we didn't want them on sidewalks we'd have to change state law well you could a city ordinance well but our city ordinance I don't know if it would I'll get to the city ordinance okay okay in a little bit um this is just showing you the difference in classes so like I said there's three classes of ebikes class one and class three are pretty similar um the difference there is the max speed that the bike will reach um Class 2 equipped with an electric motor that is capable of propelling the bike without the rider pedaling and stops when the bike reaches 20 M an hour and I'd just like to point out that we can enforce speed limits when it comes to ebikes they have a maximum speed that they'll reach depending on the class but we can't enforce speed when it comes to you know the Riders um an ebike does not meet the definition of a motor vehicle under the DWI statute therefore you cannot be arrested for DUI while riding an ebike and per statute a person may operate in the electric assisted bicycle in the same manner as provided for operation of other bicycles I think it's important to note that just it see seems to me that they're treated just like a bicycle you can ride them on the sidewalks you know you're you're to abide by the same or similar rules as a regular bicycle that's not propelled or assisted by a motor um moving on to motorized bicycles uh think more of like a moped when we talk about motorized bicycles um propelled by electric or liquid fuel motor um of a pis piston displacement capacity of 50 cubic cmers or less Max of two brake horow uh can travel no more than 30 m an hour on a flat surface with not more than 1% grade in any direction and they have to be registered with the state as a moped they can operate at night with proper lighting they do not have pedals so that's obvious viously makes them different than an electric bike um headlights and tail lights are required they're not allowed on Trails or sidewalks you have to have a DL or a motorized bike permit and if you're under 18 you have to wear a helmet then you have the foot scooters you see those that's the ones where the kids are standing on them um they have handlebars you can sit or stand on them um powered by internal combustion engine 12-in wheels are smaller max speed of 15 M hour on a flat surface again same rights and responsibilities as a bicycle Rider cannot operate on a sidewalk no passengers and at least 12 years old must wear a helmet under 18 cities cannot prohibit or regulate motorized foot scooters on city streets however May prohibit un bik bike paths Lane Trail or bike way but uh those little just the wheels that you stand on have you seen the wide wheels what are they called Segways not a Segway it's just a wheel it's a motorized wheel and it's kind of like a skateboard would that fall under this one I don't think so because it does not have handlebars okay but I know what you're talking about yeah kind of similar to a hoverboard yeah yeah not sure where that would fall in here just noting um a section of our code that talks about ATVs the definition there um defines ATV as a trail bike mini bike moped amphibious bike or vehicle and uh similar devices other than snowmobiles our code State spe specifies you cannot operate an ATV unless it's Reg registered as a motor vehicle on a roadway Trail uh or alley used for motor vehicles and uh you cannot operate an ATV on a public sidewalk so lots of definitions just kind of pointing out the differences of each of these things does does that counter what the state law says since we're talking about mopeds on a public sidewalk so is that our issue which would take uh precedence here well I think I guess what was your question which would would that be allowed under State and then can we change it uh can we have our own ordinance on that what he's asking is if you go to your 141 slide of definition of ebike an ebike by State Statute is allowed on trails and sidewalks so if an ebike is in violation of our city ordinance on on a trailer sidewalk because it's under its own power and not Pedal Power uh we can't restrict that because state law allows it specifically right because it has pedals right correct this is a complicated and I think and I think it's you know it would be extremely difficult to determine if is this bike being propelled by the the motor or by the pedals right um just a few other things to point out you know I don't think we're the only ones that have these questions these questions are being asked by a lot of different cities um I've I've reached out to a number of different cities uh trying to see if anyone has you know enacted any type of ordinance or any type of enforcement effort on these things uh with not much luck I think they're so news still that we're all learning um there's really no crash data surrounding these you know we haven't had an abundance of complaints um I think maybe six over the summer involving these and typically it's kids driving fast and I think also important to remember when you they're allowed on sidewalks so you're walking down a sidewalk and an ebike comes by you at 20 M an hour that seems very fast um but that's kind of what the few complaints that we've had you know surrounding the the speed of them um also just to point out we've done a ton of Education through our SRO in the schools the middle schools the high schools you know the kids kids are the ones generating the complaints um so I think it's really important that we continue our efforts uh educating in the schools on all the stuff we just talked about the state law um you know the safety of it uh making sure these kids understand that the same rules apply on an ebike as on your bicycle whether it be yielding to Vehicles stopping at intersections and those types of things Mr whing yeah I think you know the ebikes um are a new thing and kind of cool and they were really not my concern you know I had concerns more of uh if you know what I'm talking about the little pocket bikes where someone is really down low to the ground and they're on our city streets no they're no it's actually a small little mini bike that is probably a foot off the ground are you familiar with like am yeah and and you know by Statute those should be registered with the state as a motor vehicle and I don't think they have the lights but to me there's a safety concern cuz they're so low and you couldn't you might not see around corners or they might not see and they're they're ridden on the streets in town and when Society had common sense they used to have flags on the back of things like that you know that might be a simple simple fix for a city ordinance you got to have a flag but well when they're that loaded to ground you're not going to see them right no you can't don't councelor contras um Captain Pearson my I'm okay with all this and I appreciate all the information um I know doesn't cover it but I'd like to see if maybe later we could talk about golf carts and miners on golf carts and you know doing the things that they do so I just when you can if you have a moment I'd like to get educated on that we have a city ordinance on they should be permit you know they should be under permits right if I'm not mistaken y they should be permitted and there there's we approve the routes and things of that nature um and I would be happy to put something together and we can have a discussion you know on golf carts is there a way of knowing if they are um permitted or if they have one or how do we know like we keep those records okay I think councelor contras is asking about um people driving golf carts 15 15 years old or so or younger or younger they don't reach you can see them they're what's currently what's current are you allowed currently with a permit to drive a golf cart on these approved routes at the age of 15 to be honest I would need probably some time to look into it I don't know off the top of my head what the age restrictions are and and things of that nature I know when we give them a permit we give them a physical permit and they have to they have to put it on the golf cart itself now what the age requirements and things like that are of a golf cart that's something that I can certainly look into and and come back to you with that and councelor contus we can direct uh staff to just email that information out to us and if we if you don't like it then bring it up and we'll change it perfect and I think one of the reality is I've talked about it in my neighborhood you know I'll be doing yard work or something and there'll be a vehicle going down the road that clearly should not be on the streets the reality is is by the time i' get to my phone and and and you know they're already gone and you know the other piece of it is is like well I'm not going to call right you know in so enforcement is always you know you literally have to be right there and catch them uh in order to to get some enforcement and that's very very difficult and I guess my question is like when when you say you approve the routes routes on sidewalks right routes on streets routes on what for sidewalk for Street on why know it's like they're usually on sidewalks that's my thing I sure they supposed to be on side in order to get a Perman for the golf cart you have to be 18 so the young children maybe that's something we can review again and take a look at I'd like to yeah I would like more information on it okay um any other questions on the scooters I I think well I'll let Council go first anybody any more questions on staff no I think we answered some questions I didn't think they were allowed on the city uh sidewalks and we find out that they aren't but they are some are some aren't but uh so that's a good good information to have and then the the other thing is these little little things that we can't see that we don't have an ordinance we can't uh enforce it and uh we don't have enough I'm trying to make some kind of sense out of this I'm gonna I'm GNA get in trouble but I'm going to say make some sense out of this mess that the state is so graciously thrust upon us please correct me wherever I go wrong which is often if it has pedals operational pedals whether it has a electric assist or a gas assist it's allowed on the sidewalks yes sir okay so I'm trying to break this down not by city I'm trying to break it down if it if it doesn't have pedals then it's not allowed on sidewalks correct okay and which ones can you drive drunk and not drive drunk the pedals neither of them meet the definition of a motor vehicle under the DUI statutes okay not an invitation there are other things that you might be cited for well the re the reason I ask is because we've all seen people getting pulled over for DWI on TV or whatever on a lawn trctor I want to see them keep it up and that's obviously not a motor vehicle either I the judge I mean like I said I think this stuff is still so new that with time some of this is going to change um you know there's rumors of legislation coming and being talked about and things like that it's just not here yet okay and I think it's going to with time we're going to see things kind of expand and it's just so new all right well we appreciate your uh your your presentation Mr W yeah last word I I I brought this up because I don't want to have to talk about this after an event you know I want to at least have this conversation um so we know where we're at before I in the unfortunate if if something ever Happ and I think again that's why it's important that we continue our efforts in the schools with the kids in terms of education on rules and safety so they know at least have been told not that they'll do it but you know operate these things in a safe manner well thanks for that the the last thing I would say is um you talked about potential State legislation are there legislative changes that the Shak Police Department would like to see or that this Council would like to see because if there is I'd like to know that well the ebikes on the sidewalks I think if you have I think if it has pedals that operate I I think that's a tough hurdle to to get that changed maybe providing that they fall within the speed requirements and power requirements even though they might be modified which is another issue and then to me if it's a a young person they should be on the sidewalk you know so but you know we have age limits too so if if there's State Legislative changes that anybody is if this body is looking for if the police department is looking for let me know and in my moving forward my discussions with the state people I'll mention it to them when they get in session right right thank you yeah thank you okay thank you for that uh report item number 12 lison and administration reports and I think we started over here now we're over here sure um let's see last week on the 27th uh school board meeting um Full House um I don't know if you've seen online there was um discussion about modifying the uh uh the learning structures of incorporating fied art music um in stem so U there was a lot of comments on that the what the Schoolboard ended up doing was um uh delaying the vote until the 10th of February to get more information on that um other than that that's all I gotor contr oh I was going to say to Mr Jesse L um and I saw it on the news just before I came down here about the potential of the federal government turning education over to the states if that happens I mean I don't know if that's good or bad but I'm sure the school board is probably looking at that going hm I was going to reach out to um some members of the school board about that but I think I'll let them have some time to process that because I'm sure they found out just as when I did um I'll be curious to I'll report back if they talk about it on the 10th all right and I know it would have to go through the state and the state would deal with the block granting there's money that's they don't have the money um councelor contras thank you mayor I have no report today C Whiting thank you uh mvta Matt um we had our elections and I am the new uh Vice chair uh Dan Keeley is moving uh staying on as the chair and Paul esler uh is our secretary um at that meeting we talked about moving some of our property that uh is at the Apple Valley Transit station and potentially putting in selling that to uh some development like Workforce housing type development that's looking for this Transit near Transit uh availability you sell them the equipment they would then own it sell them the property it would be a 99 year lease I think we're looking at actually and there's also some property and Savage that's being uh sought after too um we move forward with the conversions uh to the trolley that'll uh I won't say they'll always be at Canterbury but that was the main focus one is going to be kind of a higher end oak finish uh chairs and the other will have the the comfortable seats you don't want to sit on Oak chair shair too long but it'll look good um we're we're working on a a couple of uh infrastructure grants uh the raise Grant will'll be competing with a few people for that including Burnsville um and then we had our annual operator the Year award for our uh full-time employee uh operators and our part-time employee so that was our uh had a nice event for them so that's all I have to report very good thank you Mr Whiting Mr Delaney okay 169 Coalition um got our transportation day at the capital coming up next month so we're getting our lid together for that uh let's see py Public Utilities Ami we had some uh people opting out so we had that whole going through that process again before they they come in and they um I guess go through the process of either opting outside or trying to get some relief there um also talk solar panels I think there was a family here tonight we're talking through that yeah are they going to let people opt out yeah you can opt outside it's um oh outside yeah okay not opt out complete but outside that's I was going to say I just had both mine done I didn't know there was an opportunity to opt out it's going in just outside the house um let's see that's it went through couple legislative updates uh represent bber had his early this month uh Senator pratton uh representative tapi had his Friday at the shaki Brew Hall which was very informative big crowd lot of good discussion there I don't know if we talked chamber lunching did that oh yeah I think everybody was there at the end yeah we made that too yeah we were there I was looking I was looking at when did I report on that oh congratulations to our Public Works I think you guys are a two- Peete now is that like building a dynasty there and the hockey day Minnesota how could we miss that that was a fun time hope everybody got out in the cold um great event for the city um a lot of turnout I don't know if they're going to come and give us a final report update to the would be good to see how many people actually turn out for I think that's pretty cool I think that's all I got um stand for questions questions I I do want to mention the chamber and and thank our Public Works uh team they also they won an award from the chamber this year so I forgot to mention that event um that's uh want to make sure I got that in and the other thing is uh I got my new new uh meter in third time got than three but very helpful they took care of me what was wrong with the first two spinning too fast dripping oh oh the water meter yeah oh you're that Resident we talked about yeah I'm sure you talked about me yeah well it be the flood I didn't have all right let's see mine I forgot to write it out so I'm going to have to look through my calendar here um 17th 17th I attended the retirement of uh Barb head head headstrom head Headland uh get that pronounced right uh at the Shak BPD um she' been around a long time victim Advocate great gal sorry to see her go but I hope she enjoys retirement um oops 23rd obviously all of us were at the Canterbury uh chamber event um had the opportunity to speak a little bit and uh again I'll say it again the chamber probably doesn't realize just how wonderful of a job that they actually do and how important what they do is uh 31st I attended the representative Tab Key at the Brew Hall uh legislative update or overview um obviously we all know that there's not a whole lot going on right there right now but uh had a good conversation about what some potential funding um issues could be and the amounts um with some of the federal stuff that's going on at that level too so he like I said you know let's see where the dust settles on the fifth no where am I I'm wrong got to go back and yep that's that's all I have at
