These are the consent agenda items for Tuesday, January 20th of 2026. 5A approves the wetland replacement plan for Green View. 5B moves the February 3rd, 2026 City Council and EDA regular meeting date to February 4th of 2026. 5C purchases turnout gear, which is a washing extractor. 5D is used outdated surplus. 5E is FM Fire Service Grant Award. 5F is the Minnesota Department of Labor and Industries MNOSHA Workplace Safety Consultation Program Grant Application. 5G approves the January 6, 2026 City Council minutes. 5H approves 50% share in the cost of design work with Gensler for Canterbury, not to exceed $50,000. 5I approves a tobacco license for SM Liquors LLC doing business as Merwin's Liquor. 5J is more surplus property. 5K approves a cooperative agreement with Scott County for the construction and maintenance of the CH-16 modernization project. 5L approves plans and authorizes bidding for the Old Carriage Court Corridor improvements. Brings us to 8A, annexation MUS expansion and comprehensive plan map amendment. This will be director of planning and development, Mr. Kursky. When you're ready, sir, the floor is yours. Good evening, Mayor and Council. So, as you said, this is the annexation and MUS expansion and comprehensive plan amendment. US Home, uh doing business as Lennar, is proposing the annexation and comprehensive plan amendment to figure 4.12 entitled planned land use and the figure 4.60, the planned Metropolitan Urban Service Area or MUS area, in the 2040 comprehensive plan for the Scott County utility site and for the Green View proposed development. The subject properties are located west of Marystown Road and east of Zumbro Avenue, and Scott County emergency communications facility directly north of the site. They are proposing the MUS amendment to include the Green View development. This is the area we're talking about. So, High View park is right up here. This is the communication towers for Scott County, and this is the proposed Green View development site. These properties are presently um zoned UER in Scott County, which is the urban expansion reserve. This request would guide the Scott County property as utility, and the proposed Green View subdivision as suburban residential, which is three to six dwelling units per acre, where both properties are currently guided as suburban edge residential, which is 0.01 to three dwelling units per acre. Suburban residential would be consistent with their proposed concept plan. The application request would also be consistent with the orderly annexation agreement approved between Jackson Township and the city. So, this is the figure planned um land use. This is the existing guiding in the yellow, and this would be the proposed guiding. So, this would be utilities where the tower are, and this is the proposed guiding suburban residential for the Green View project. And then on the MUS, this is the current MUS map. This is the area we're talking about here, and now extending the MUS into. So, this would be the proposed MUS expansion area. So, there are two separate actions tonight. One is to approve resolution R2026-002 approving the annexation of property in Jackson Township into the City of Shakopee, which requires a simple majority. The other is approving resolution 2026-003 approving a comprehensive plan map amendment to figure 4.12 entitled planned land use guiding in figure 4.60, the planned Metropolitan Urban Service Area or MUS area, in the 2040 comprehensive plan, which requires a supermajority. Thank you, sir. Questions of staff? The annexation was requested by Uh Mayor and Council, the annexation was requested by the developer. Okay. Mr. Whiting. I asked this question uh in the past, and I know the answer, but uh any issues with utilities or uh um stormwater in the concerned area? >> [snorts] >> So, Mayor and Council, you'll see in the upcoming uh next action items, uh there is a preservation that will occur of Here we go. Down in this area, a existing wetland, and the developer worked with engineering and staff to preserve that area, including the trees along the road, and there are some other stormwater ponds being built into this. Uh there are existing utilities that were proposed to bring down into this area when uh High View park was developed. So, we shouldn't have any sewer issues here. Thank you. The second uh resolution is a comprehensive plan amendment and planned land use. Wishes of council, Councilor Lara. It's the long one. I'll make a motion to approve resolution R2026-003 approving the comprehensive plan map amendment to the figure 4.12 entitled planned land use guiding and figure 4.60 planned Metropolitan Urban Service Area in the 2020 2040 comprehensive plan for the Scott County utility site and for the Green View proposed development. Brings us to 8B, zoning of Scott County emergency communications facility and planned unit development preliminary plat of Green View. Mr. Kursky, go ahead. Again, uh Mayor and Council, this is the zoning of the Scott County emergency communications facility and the planned unit development and preliminary plat of Green View. City of Shakopee and Lennar are proposing to establish zoning for the Scott County emergency communications facility as agricultural preservation, as well as a preliminary plat and planned unit development PUD for the proposed Green View subdivision. Subdivision would create 198 single family residential lots on the property located west of Marystown Road and east of Zumbro Avenue. So, again, here is the proposed site. This is the communication towers. This is the site for the residential. Lennar is proposing two phases of development for this property, starting primarily with the eastern area to introduce a sampling of all three products proposed within the project. This subdivision includes 11 acres of land compliant with the required 15% open space for a PUD that would be available as desirable open space, preserve natural resource areas, and trails within the project. Lennar is also required to construct the east-west road connecting Marystown and Zumbro. Lennar is proposing homes compliant with the residential design performance standards for urban residential R1B zone. With the exception of reduced lot widths, which will be a mixture of 50-ft wide lots, 55-ft wide lots, and 65-ft wide lot wide lots with all homes to provide LP siding or hardie on the front elevation. Scott County parcel presently contains the emergency communication facility and a 250-ft tower and within equipment shelters, which will remain and shall stay in compliance with the conditional use permit that was approved for this facility in 1990. No other plans for the property are being proposed at this time. So, here is the area to be zoned agricultural preservation in the cream color, and this is the PUD in the blue. So, here's the proposed >> [clears throat] >> preliminary plat. This is the area that we worked for a few months with the developer to preserve. There's a large growth of trees here, and this is an existing wetland that'll be preserved. And then the blue areas are new stormwater ponds, and you can see there is now an extensive trail system proposed through the project including on street. This is the new street that will connect between Marystown and Zumbro, and there again are some stormwater ponds in the lower east corner southeast corner of the property. So, there are three separate actions adopting ordinance approving the zoning to planned unit development PUD district number 15 for the proposed Greenview subdivision adopting ordinance 02026-003 approving the zoning to agricultural preservation zone for the Scott County emergency communication facility and number three is approving resolution 2026-004 approving the preliminary plat of Greenview. Thank you, Mr. Kursky. Questions to staff? Mr. Lara. Mr. Kursky, I have a question on um it's regarding the open space um that's south of the main road that runs through there. Oh, it's not on that map. So, Mayor and Council, the open space will basically be this area up here, all this area that wraps around here, some of the land over here, and then this large piece here that connects to an existing stormwater pond that's up in the D.R. Horton subdivision. Uh we did purchase a play structure um at 50% off last year that we will eventually be installing right here. I guess the reason why I asked is because so the map I'm holding and the map that's on the screen are two different ones. Um it's um Do you see on Road 11? The map is further back here. It's on this one right here. Okay. >> I mean, they must have Did they update the plats or something? Cuz on this one has open space. I was just curious why they had that, but they obviously filled it in. Yep, this is Mayor and Council, this is the latest plan that was worked on by Lennar that ended up preserving this, and they did add one lot into the subdivision to make up for the four lots they lost over here. >> Okay. >> Oh, okay. That makes sense. All right. No questions. I'm set. Any other questions to staff? I I have a few. Um the the road from Zumbro to Marystown um to what standard will that be built? Do you know if it's going to be Is it Mayor and Council, that roadway is a collector roadway in our street system, which is why there are no houses that direct access it. In the future as development continues west, that road will also continue west to serve other areas in in Jackson and Louisville townships that would be annexed for development. It's built to state aid design standards, so it's designed to carry larger larger volumes of traffic. Okay. That's a city engineer, so somebody knows. Um the other question I had was where you have the the property lines backing up to the open spaces we've all dealt with numerous issues of people utilizing that open space as their property, sheds, all kinds of things. What are we going to do to prevent that from happening in the in these developments? So, Mayor and Council, we have been placing city markers on these properties letting people know that it's not their property and not to go beyond that point. They can go by beyond and utilize the open space, but they can't put structures in the backyards or >> can't put their fire pits, lawn furniture, sheds, etc. Okay. And the the last one I had is I see a glimpse of maybe a driveway up here at the top right of the screen that we're looking at. And where where this new road comes up to Marystown does that meet the county spacing guidelines? Uh this top right there looks like a a apron up there. So, you'd be down about an inch and over 2 inches to the right. A little up. Up. And about an inch down. Yeah, a little bit more. A little bit more. Yeah, right there. Mayor and Council, this is an exist So, the roadways there's existing homes and a farm or two over here. They are going to have to reconstruct this portion of the road to put a turn lane in and uh dedicate some additional right-of-way. And then this one up here will just dead end. This is a single-family home right now that is um they're not interested in selling, so we have allowed for a future connection to that area. So, it'll be a temporary overlength cul-de-sac? I'm not really sure, Mayor and Council, this is really a true cul-de-sac. This one is, but this has to remain because we need to be able to connect to this uh house someday in the future. This will end up getting developed. >> Right, I understand that, but since there's no secondary access point, it would be a cul-de-sac to the cul-de-sac from the main city street, and I don't know what that distance is. I think our requirements are Is it 1,500 ft or something like that? Yep, and Mayor and Council, the fire department has looked at this, and there aren't any issues. So, there's ways This will be the backyards along this street. They can fight a fire, for instance, in these homes from the backside and up into here they have enough room. Okay. And Mayor and Council, I I can also address that. In the open space area south of the blue stormwater pond at the top of the screen, that trail looks wider, and the definition it is it's 16-ft wide, which would accommodate an emergency vehicle to provide that secondary access if the main Okay. Your mic cut out, but I I heard you. Just Um the last question that I had was throughout the development pedestrian sidewalks uh we see some of these trails. Um any sidewalks? Mayor and Council, there's sidewalks on one side of the street for most of the streets where we have trails. That's would be the kind of brown color. So, as the city engineer mentioned, there's um trails on both sides of this street, and then we have trails coming down that will then connect to these trails, which eventually will connect into the next property that gets developed in Louis Louisville Township. Is the dark gray bigger line on on these rows of houses is that that's the sidewalks there? The dark darker color gray are sidewalks. Okay. Mr. Whiting. And I don't want to assume Mr. Lara's initial question, but on page 124 it does show an extra open space. Uh That's the one for three lots that are in the kind of the the east-west road. Uh I can't read it. It's too small. >> know if you can see this extra green space, but uh It's it's it's lotted out as lots here, but it's in our packet it's open space. So, I'm just which which is correct? [clears throat] Excuse me, Mayor and Council, this is correct. So, we worked with the developer >> is not Yep. So, we're still at 15%, uh which is the requirement. Um Mhm. And that's gone. And basically we were able to preserve this whole area up against the wetland and all the trees that are there. >> Okay, so you got the open space available. Okay. Oh, I see. Yeah, there it is. Yeah. Discussion on the motion. I have one. This is a preliminary plat. Will we will we see a final plat or if it's consistent with what is in front of us would it be administrative? Mayor and council know you will see the final plat. I know the developers anxious to move forward so you'll probably see that in February or March. Okay, very good. Item 8C, approval of resolution approving bid advertisement for fire station two renovation. Shakopee Fire Chief Simon is in attendance and when you're ready to go, sir, the floor will be yours. Good evening, Mayor and Council. At the October 7th, 2025 meeting Council approved proceeding with design services from CNH Architects and construction management services from Terra Construction for the remodel of fire station two. This renovation is essential to meet future staffing needs and improve safety. Since that approval, staff has worked closely with CNH and Terra on design and planning and at this stage staff recommends approving the resolution to authorize advertising for bids for fire station two. In accordance with state law, all necessary approvals will be presented to the city council before any work begins. Uh we have joining us this evening uh Quinn Hudson and John Vanderveldt from CNH Architects and they can talk about the renovation plans and if needed, Corey Reiners is here from Terra Construction and he can talk about the construction plans and uh cost estimate if needed. Is there questions of Chief Simon first? Do we know the age of the air handlers and the mini splits? In a rough I guess. Uh 2012 would be original, Mr. Mayor. All three? Yeah. Okay, so we're at uh 2012 20 22 uh 12 15 years maybe? Roughly, 13 14. Okay, and the average life expectancy of these items, roofs are 15 20. So we're close. I don't know what the life expectancy of the other two items are. Yeah, uh the reason for the air handlers is uh to solve and Corey might be the one to kind of be the uh the expert on that from Terra Construction. Uh it solves the an issue with being able to control the temperatures of the of the living spaces, the dorm rooms. And the current air handlers can't do that. Okay. I'll ask the consultant there we if we're splitting that up from the area of the the trucks and equipment from the living area. Um it's it's not split up, no. Okay. Well, let's So yeah, John is here from CNH and he can talk about the plans. Let me Uh Mayor and Council, my name is John Vanderveldt. I'm an architect with CNH. >> Sir, would you do me a favor and take that mic and pull it up right next to you and speak directly into it. >> Check. Check. I appreciate it. Sorry. Uh John Vanderveldt, CNH Architects have been working on the project. Uh we've got a couple of slides to discuss it. This is the existing building. And uh we were brought in to do this design work because the uh organizational changes that are happening with the fire department. Uh they are going to have additional firemen, additional rescue personnel are being hired, but more importantly they need people to stay overnight, which is not what the original building was designed for. Uh also there's some security changes that have to happen to the servers in the digital area and we were looking at the capital improvement project, the roof, the new HVAC system that you were just speaking about is being folded into this now because the work we're doing the main thing maybe that we were originally addressing is adding residency so overnight stay room for people and that is going to involve taking down a lot of the ceiling and doing some duct work. So it makes sense to also do the HVAC work and change those RTUs on the roof at the same time. Otherwise, you wait a year, change them out and again you're tearing the ceiling out and having to rebuild it. But so yes, I'm sorry. The organizational changes that are not supported well, this is what we're looking at doing. So we've added uh residential space is the blue in the sort of the lower right-hand corner of the building. You can see we've taken some areas that were formerly office and conference space and converted them into um >> [clears throat] >> acceptable living quarters. There's also there needs to be more storage for people's clothing and so forth so we've also along the lines or as part of that required for occupancy, you've got additional locker storage space, additional changing space. Uh additional showers and preserve the conference space on the left. Expanded kitchen and pantry. That's the other thing. So we've had to in the upper right-hand corner you can see that the day room which includes the sort of kitchenette in the food storage area has had added to it additional cabinetry and refrigerators so that each of three shifts can have an area for their food and still fit into the existing space. So that was part of the brief. The other part of the brief was to was along the lines of improving safety uh with more current thinking on fire station design, you try and separate contamination and the decontamination work from the living space. So we've moved the turnout area where the gear gets stored and gets thrown on before you go out is moved to the west side of the bays, the other side of the bays. And the decontamination washing machines, the SCBA washers, the things that wash the equipment which would also be contaminated potentially are all in one room so it's centralized on the west side in that room. Uh in addition to that, a Plymovent system will be added which is a venting system for the equipment bays that pulls the exhaust out so that it doesn't affect people as they're in there walking around and doing their business. Uh and in addition to that, we've added some training facilities. This is pretty common now that the building will have an artificial window that can be practiced and an artificial balcony in order for the firemen to uh train and learn how to use uh ladders and so forth. And that would be on the mezzanine space. Uh we've created another wall with a openable balcony and a uh also a window, a breakaway window for training. Uh and that's that's the overview. So Thank you. Uh questions for And that's I think you answered my original question about having the the air handling in the western area pulling that out so it's not entering into the other areas. Sleeping areas. >> Yeah. So you've addressed that. All right. Any other any questions, Mr. Whiting? Uh on the second level next to the training mezzanine, it looks like there's a pressure washer system, Hotsy pressure pressure washer system on the second floor. It just seemed odd to be on the second floor. Uh there's an existing Hotsy. It heats water and sends it down pipes and then they wash >> Oh, okay. Okay. the equipment with it. And that's where it is. We're moving it into a different room. But it needs to vent either through the roof or out the sidewall. So it kind of has to be around that location. Okay. Uh basically to be more practical in terms of venting it. But that's not new equipment. That's already there. >> That is not new. That's going to be moved into the northwest room. Uh actually the minimum absolutely the minimum we could move it to free up the space for the training mezzanine was into that room. So we can we're still able to use a lot of the venting duct it work that exists now without having to completely rebuild it. Okay. Thanks. Any other questions? Is there a capability to get in and out of this building if the electronic security system malfunctions? If the electronic which system, sorry? Electronic security entry if that system goes down, is there a way for the fire people to get in and out of the building? He's nodding his head yes. >> [laughter] >> Yeah. I'm going to say yes. Part of using access cards >> case, they could break in the Yeah, because it is a storefront window, but The axes are inside the [laughter] building. That's true. They'd have to keep one with them. I'm just thinking of, you know, redundancy so that, you know, electronics are sometimes they fail. Yeah, no, that makes sense. But they they currently have a card access system now, I believe. So this is not necessarily different. >> Consistent with what's there now. Okay. Okay, not a whole lot going on. We have the 169 quarter coalition. We have only three members left, and I think they're having meetings this week. We'll probably see those resolutions next week for the dissolution of the But the final meeting again being in February. And there is a SPU MMU training Friday. That's about it. All righty, thank you, sir. Mr. Whiting. I had our board meeting for the MVTA. I do have some discussion. It's kind of other business. I can wait with it or bring it up now. Your call. MVTA is seeking our city's guidance on pursuing a change to state statute that would allow riders to bring alcoholic beverages on the MVTA buses within the Shakopee established social district. Now this is just the Canterbury social district. Um During events there'll be a circulator bus that goes around there, and we know it's a social district, so not encouraging, but allowing people to have their beverages with them. So MVTA designed some trolleys for that event, which kind of They're buses, but they look like trolleys. Um part of the local circulator there for those events. MVTA is working with Live Nation, Canterbury Park, and businesses in the district to sponsor the circulator that would result in free rides on the service for those events. Public safety is primary reason MVTA is requesting the city's guidance on this issue. The development is spread out, not overly walkable. A circulator will create a safe option compared to pedestrians trying to navigate the development on foot, possibly while intoxicated. If pursued, MVTA would seek to amend the existing social district legislation to include public transit vehicles being exempt from current state statute that bars alcoholic beverages on public transit currently. >> [snorts] >> If not pursued, MVTA still intends to run the circulator, but alcoholic beverages would not be allowed on the buses. And if successful, it If MV There is a chance that MVTA may ask the city to amend the social district to include Canterbury Road, but I was assured that Canterbury Road is currently included on that map. So I think we'll be okay there, but wanted to bring it before the council and see if there's any concerns or questions. >> They'll need garbage cans on the bus for empty cups, right? >> Yeah, I think they handle that. >> Um I'm thinking this would be something that we would ask staff to take a look at, get some feedback from police and and all that first, and maybe bring it back and have we can have a good discussion on it if if that's Is there a consensus of council to do that? Yeah, I have a question. Um Where do they want to Are they running from one district to the other or just in Canterbury >> in the Canterbury for event nights. Circulator bus going around. It'll take you from the parking lots and other businesses and take you to the events. Is how I'm reading this. So if they pick you up at the bar going up to the the amphitheater, [clears throat] you can carry your drink with you. So >> I I guess I would just want to make sure that they wouldn't be taking it from like the bus to the parking lot. Like they that would be that would be like the no part. >> Right, it would just be the circulator if you know, you they're not going to be the DWI cops, but Well, I think Now I'm confused because Counselor Lara, what you're saying is you don't want them you having it on the bus to the event. >> No, from like if it's like taking you from a parking lot to the place, I don't want it to prevent someone like leaving the bus with it to the parking lot. Then they they then proceed to their car. >> If the parking lot is within the social district area, that would be and it's the cup, that would be allowed. Right. >> be allowed regardless of the bus. Correct? Correct. So if it's allowed on the bus and you get off the bus in an area that it's allowed within the district, you're okay. Policing it might be another issue, but >> Right. Well, I guess yeah, that's >> And that's why I think it needs to go through the process if that's council's wishes. Sure. Counselor Delaney, you had your hand up. >> Yeah, my only question is these buses will be identified as pretty much those red trolley buses that they drive? Well, they're they're MVTA colors, but they're they have a different look to them. And if that [clears throat] breaks down, I'm not going to guarantee it's always going to be the trolley bus doing the circulator, but that's the intent. Yeah. Thank you. And it wouldn't it would require a state law change. And MVTA would do the lobbying. But they would lobby with our support if in fact we do support it. >> it. Correct. All right. There are no objections that I can think of, but you know, give us some time to take a look at it if council wishes. I I we'd be more than happy, obviously, to take a hard look and and bring a recommendation, but at first blush I don't see anything wrong with the proposal. I think one of the keys would be to make sure that the the buses are totally know what the Correct. Yeah. >> guidelines are for the social district certain hours you may have people after them hours thinking that they can continue to do this when it's outside of that hours. So some maybe it would be posted on the bus. Yeah, we'd have to have the rules definitely defined. And then even maybe one of our little placards could be put up in that window for the the time period or something like that just to show that we're They might have to pay the fee whatever [clears throat] it is. So Friday I attended the SCALE meeting where we had the SMSC Chair Cole Miller and Administrator Bill, sorry, provide a monthly meeting host update. And then our main focus was the annual opioid update. And that was They they just talked about initiatives to combat opioid addictions through the South the Southwest Metro Drug Task Force and choose not to use. And the legal and law enforcement activities to support efforts to investigate, arrest, and prosecute offenders in the fight against this opioid misuse in our communities. And um our Scott County Public Health Director Lisa Brotsky and our very own Shakopee Chief Tate was there. And our Scott County Ron also were our presenters. All in the front lines of the >> [clears throat] >> of this prevention and law enforcement effort. So that's pretty much it. >> Very good. I've I've heard good successes out of that uh drug rehabilitation court thing or whatever it's called. Mr. Lara. Nothing this week. Very good. My report um um NLC had a a meeting that I attended. Um it was all about the housing. Um Some housing bills that are slowly working their way into the state legislative process. And you know, it's it's going on 3 years now. We all know that they've been pushing for a lot of these housing affordability and household affordability, but I'm sitting there listening at this meeting, and it seems like and I told them this. I said, you know, it really seems like we're moving up moving away from the actual reason of having these conversations. And so I asked the senators and representatives that were there if they could put [clears throat] a one line on the bottom of each one of these bills to tell us how exactly this makes houses whole housing and households more affordable. And their response was, well, that's not what we're trying to do here. And couple of others chimed in, other mayors from other areas, and said, I beg to differ. We started this conversation 3 years ago specifically for housing affordability, and now it seems like we're going toward down this road of let's let's build as many as possible wherever we can. I mean there's different communities that have different approaches to it where you know, they they want to allow residential and commercial maybe in an industrial certain areas and it doesn't fit all communities. Um So, you know, if the if the issue is affordability, we need to get back to that as a group and if it's about just building as much as possible, then let's just say that and and not try to cover it up. So Um Council member Contreras and I were participated in the interview process for future chief of police. Ours is retiring and moving on. Um Many years of great service. So, um We had three very good finalists. And uh a lot of discussion and debate. And uh there was what nine people I believe on that panel roughly? Yes, sir. Um Councilor Contreras and I um did our due diligence along with everybody else and we believe that uh we selected the best candidate out of the finalist. So, that'll be coming back to council later. And I think that's all I have. Mr. Whiting. So, the Civil Service Board brings us three candidates. Right. >> And we got to pick one of them through the interview process. They I don't know how many they screened. Um but they send the top three. There's a ranking. Um and then this panel interviewed all three. Um That that was the process and I'm pretty confident that was the process that was followed when uh I served on that 16 17 years ago with uh current Chief Tate. Um so, pretty consistent. Do we know how many candidates the Civil Service Board interviewed? I believe there were 10 or 11 total candidates that applied.
