Mr. Sanders presented the preliminary and final plat for the Country Lumber property, detailing its division into three lots. He explained the process for resolving title issues stemming from the original 1904 plat, MDOT's approval with conditions for developments adjacent to Highway 10 (especially concerning stormwater), and the requirement to remove two existing buildings located on proposed property lines by September 30th. Planning Commission had recommended approval of the plat under these conditions.

Miss Mortonson introduced Ordinance 303, explaining that it is the culmination of a recodification project by American Legal Publishing, approved in June 2025. The updated code features revised language, resolution of conflicts with state statutes, and a new online format. The ordinance will become effective on September 1st, allowing city departments, particularly the police, time to transition their systems for administrative fines and citations. The project was completed under budget.

Mr. Ruds presented the consent agenda which included authorizing a significant payment of claims, approving minutes from previous council and executive sessions, reviewing minutes from various committee meetings, adopting a Memorandum of Understanding with the City of Monaceel to share community access during the BCC's closure for repairs, accepting substantial donations for horse trails and baseball dugouts, approving a final payment for an air handling unit project at the BCC, and approving a contract for fire protection services at city facilities.

There are some title uh issues inevitably when you get plats that are this old, which this one's uh I think is 1904 was the original one. So long time ago, the very initial plat you tend to get title issues over time that just come up. Um there's a path that's been laid forward so uh Mr. Frederickson so shooter Frederickson his attorney and our attorney know the path um to clear up that title and before we sign the final plat that title what their path for it all be executed and cleaned up.
one of the bigger things was there's two existing buildings that sit on one of the proposed property lines currently. We discussed this with the attorney and one of our ideas of staff that we [snorts] came up with is adding a condition that any of the existing storage buildings that are located on this property line. So, it's shown in the packet in the figure must be removed prior to either the sale of the lot or issuance of any building permit for either of them. Um, and then there's a deadline to remove those, which is September 30th.
um last June in 2025, you had approved um American Legal Publishing cod recottifying our ordinances that were in place at that time. So when they do the recottification, they look at language. They look at if it conflicts with state statute. Um they go through and update any of your indexing tables. Um reformat the pages. Ours has been absolutely reformatted. it went from now we have titles instead of chapters.
um we're proposing that the code does not go into effect till September 1st of this year. Um simply because that will give the police department time to update their systems and work with the county. um because of the different administration fines or citations, that's a whole another process to get all of that moved over to the new system.
