## A PROCLAMATION FROM THE CITY OF BECKER DECLARING
## JUNE 13-20, 2026 AS FREEDOM DAYS IN BECKER, MINNESOTA
WHEREAS, the City of Becker is a proud community that hosts many social gatherings and celebrations
where friends old and new can come together; and
WHEREAS, the City of Becker has a long history of holding formal community-wide gatherings, and this
year we will gather once again to celebrate not only our independence as individuals, but also the United
States of America’s 250
th
birthday, as our country continues to endure as the greatest democracy in the
history of the world; and
WHEREAS, Freedom Days celebrates our freedoms as Americans and allows citizens to express their
patriotism and love of our country; and
WHEREAS, the City of Becker contributes in many ways to the success of the celebration, and appreciates
the efforts of the Freedom Days organization, committee members, sponsors, businesses and volunteers,
and encourages citizen participation in the many activities during the week to enjoy the camaraderie and
sense of community built by a festival of this kind; and
WHEREAS, this year’s week-long activities begin on Saturday, June 13
th
and will include a BBQ Bash and
culminate with the Grand Day activities, including the parade and fireworks on Saturday, June 20
th
.
NOW, THEREFORE, BE IT RESOLVED, I, Mark Kolbinger, Mayor of the City of Becker, do hereby proclaim
June 13
th

, 2026 as Freedom Days in Becker, Minnesota, and I urge all citizens to get involved and
participate in the many events and activities planned that celebrate our freedom. Visit
beckerfreedomdays.com for everything you need to know.
BE IT FURTHER RESOLVED, I urge all citizens to honor and thank all those military personnel who have
served their country to protect and preserve our freedom, and remind everyone attending the parade to
stand if able, and remove your hats and place your hand over your heart as the American Flag passes by in
a tribute to our great country. Please also take a minute to teach our next generation the value of this
gesture.

## Introduction / Background / Justification / Key / Legal Issues:
At the March 17
th
council meeting, staff were given authorization to put this project out for bid. Because
this is an MSAS project, the plans and specs had to be approved by the state. There were a couple of
revisions and resubmittals needed, but the final plans were approved on May 21
st
and uploaded for
contractor review. This necessitated the bid opening be moved and it was pushed to June 2
nd
at 2:00.
We did not want to lose additional construction time, so we have placed the bid award on the June 2
nd
agenda. I will update the RCA in advance of the meeting to reflect total number of contractors bidding
the project, along with the engineer’s recommendation to award.
UPDATE: Bids were opened at 2:00PM today. We had five contractors bid on the project. The Bids
ranged in price from $2,086,4 67 to $2,669,514, with Capital Paving being the apparent low bidder. We
will proceed as such, with SEH working to verify the bid and provide their letter of recommendation as
soon as tonight’s meeting, for sure it will be to us within the next few days. The request for council
approval tonight is dependent on SEH giving their approval after vetting the bids.
## Board Commission / Committee Action:
This project has been socialized at PWC and council several times to get us to this step in the process.
Recommendations have been given to continue to move the project forward.
## Budgetary / Fiscal Impact:
The engineer’s estimate for this project is $2,799,740. I will update the actual bid amounts prior to the
meeting. The funding source is our MSAS accumulated balance and the advance funds that were agreed
to earlier in the year. We do have future improvement funds if the total cost is higher than the current
funds available through MSAS. UPDATE: We are requesting approval of the project for the Capital Paving
bid of $2,086,467 plus a material testing and reporting allowance of $50,000 for a total of $2,136,467.
The funds will come from the allocated MSAS funds, and the Advanced Funds already approved.
Working with the Finance Department, we have sufficient funds to cover this project.

We know of no reason the project should not be awarded to the low bidder for the amount of $2,086,466.38.

## RESOLUTION 26-53
## A RESOLUTION AWARDING A CONTRACT FOR THE EDGEWOOD STREET
## AND TRAIL IMPROVEMENT PROJECT
WHEREAS, the City Consulting Engineer, Randy Sabart of SEH, has developed
plans and specifications for the Edgewood Street and Trail Improvement Project;
and
WHEREAS, the plans and specifications have been published for bid as per City
Council’s direction; and
WHEREAS, the city has competitively bid the project as per Minnesota State
Statutes; and
WHEREAS, the city received five competitive bids for the project with the low bid
at $2,086,467 and the high bid at $2,669,514; and
WHEREAS, Capital Paving is the lowest responsible bidder and can perform the
work; and
WHEREAS, the engineer’s estimate of probable cost for the project is
$2,799,740; and
NOW THEREFORE, BE IT RESOLVED that the Becker City Council hereby
authorizes the Mayor or the City Administrator to enter into an agreement with
Capital Paving for the purpose of completing the Edgewood Street and Trail
Improvement Project for total cost of $2,086,467.
BE IT FURTHER RESOLVED that the Becker City Council also allocates a
$50,000 allowance for independent material testing and reporting as called out
by MSAS standards, for a total project cost of $2,136,467.

As staff has worked through the design process for the Edgewood Street and Trail Improvements, a few
changes were identified for trail safety and improved traffic movement. We are keeping the trail on the
south side of Edgewood Street eastward to 27
th
Ave. This change, along with the proposed road
extension for LuAnn Drive, requires an additional easement to make the trail location and the turn lane
for LuAnn Drive work. We have been in contact with the property owner, Martin Hartsad, to socialize
the proposed changes and the need for the additional easement as detailed in the plans. We have also
discussed it with the developers working in the area and the easement will not impede their
development plans being proposed. All parties are willing to work with the city on the additional
easement. The city is looking to make improvements to both Edgewood Street and LuAnn Drive without
any assessments for the project to the current property owner or developers.
## Board Commission / Committee Action:
The plans and concepts have been reviewed by council; this easement request being socialized during
that time. Support has been given to continue to move the project forward.
## Budgetary / Fiscal Impact:
There is no cost being paid for the easement acquisition, and no payment or assessment to the current
property owner or future developers. By obtaining the additional easement we will be able to improve
pedestrian, bike and vehicle movements and safety in the area.

## THIS GRANT OF EASEMENT FOR ROADWAY, DRAINAGE, UTILITY AND
TRAIL PURPOSES (“Easement”) is made on this _____ day of _______________, 2026, by
EICHI, INC, a Minnesota corporation (“Grantor”), to the CITY OF BECKER, a Minnesota
municipal corporation (“Grantee”).
## WITNESSETH:
WHEREAS, Grantor is the owner of real property situated in the County of Sherburne,
State of Minnesota, legally described as follows:
## Lot 9, Block 3, EVERGREEN PARK NORTH, Sherburne County, Minnesota
(hereinafter “Parcel 1”)
## AND
## Lot 9, Block 3, EVERGREEN PARK NORTH, Sherburne County, Minnesota

conveys and dedicates to Grantee, its successors and assigns, a non-exclusive perpetual
easement for roadway, drainage, trail, utility and related purposes, over, under, across and
upon that portion of the Property in the location legally described on Exhibit A-1, and

Exhibit A-2 attached hereto and as depicted on Exhibit B-1, and Exhibit B-2 attached
hereto (the “Easement Area”).
2. Grantee’s Right. The grant of the foregoing easements for drainage, utility, trail, roadway
and related purposes includes the right of the Grantee, its contractors, agents and employees
to enter upon the Easement Area to construct, reconstruct, inspect, repair, replace and
maintain the drainage, utility, trail, roadway, storm sewer, sanitary sewer and water
facilities or improvements in the Easement Area; to erect and maintain signage and light
poles, if any, in conjunction with the use of the roadway and trail; to enter upon the
Easement Area at all reasonable times to construct reconstruct, inspect, repair, replace and
maintain pipes, conduits and mains; and the further right to remove trees, brush,
undergrowth and other obstructions.
3. Title of Grantor. Grantor represents and warrants that Grantor is the owner of the Property
and has the right to convey the easements specified herein.
4. Successors and Assigns. All of the provisions of this instrument, including the benefits
and burdens, shall permanently run with the land. All of the provisions of this instrument,
including the benefits and burdens, shall be binding on and inure to the benefit of persons
owning or acquiring any right, title or interest therein, and of the heirs, assigns, successors,
tenants and personal representatives of the Grantor and Grantee, herein.
5. Headings. Paragraph headings used in this Easement are for convenience only, and shall
not affect the construction of this Easement.
6. Counterparts. This Easement may be executed in any number of counterparts, each of
which when so executed shall be deemed to be an original, and all of which counterparts
of this Easement, taken together, shall constitute but one and the same instrument.
7. Entire Agreement. This Easement, and the Exhibits attached hereto, constitute the entire
understanding of the parties hereto with respect to the transaction contemplated thereby,
and supersede all prior agreements and understandings between the parties with respect to
the subject matter. No representations, warranties, undertakings or promises, whether oral,
implied, written or otherwise, have been made by either party hereto to the other unless
expressly stated in the above-referenced documents, or unless mutually agreed to in writing
between the parties hereto after the date hereof, and neither party has relied on any verbal
representations, agreements, or understandings not expressly set forth herein.
8. Applicable Law. This Easement shall be governed and construed in accordance with the

There are 23 PLC’s in the
## Water/Wastewater
System for the city of
Becker. PLC stands for
## Programmable Logic
Controller and is a device
used to automate or
control facility equipment
and processes. The PLC
serves as the “brains”
behind the operations of
water and wastewater
equipment like pumps
and aerators. A PLC can
control equipment,
monitor inputs, process logic, and control outputs (motors, valves, pumps, etc.)
The expected operational life span of a PLC is 10 – 20 years. The physical hardware often outlasts the
manufacturer’s technical support, software compatibility, and spare parts availability. Our controls
integrator recommends a life span of 10-years for PLC’s in our water and wastewater system. The PLC’s
I am recommending be replaced are from 2005 (21 years of service) and are obsolete. I am
recommending a planned replacement now rather than having a failure and having to scramble to
replace the unit and be without normal operations while waiting for that replacement. See the

## A RESOLUTION APPROVING THE WASTEWATER TREATMENT FACILITY
## PLC REPLACEMENT PROJECT FOR 2026
WHEREAS, the City of Becker owns and operates a wastewater treatment facility; and
WHEREAS, there are 15 PLCs in the WWTF that process data and control operational
equipment and functions; and
WHEREAS, the expected service life of a PLC in the city’s wastewater treatment system
is 10-years; and
WHEREAS, the PLCs in MCC-2 (WWTF Admin Building), MCC-3 (Industrial RAS/WAS
Building), and MCC-5 (RDP Control Room) were installed in 2005 and have surpassed
their expected service life; and
WHEREAS, staff are recommending replacement before the existing units fail and cause
operational disruptions; and
WHEREAS, staff received a replacement quote of $81,618.00 from Total Control
Systems, Inc. for the replacement of these 3 PLCs; and
WHEREAS, money is set aside each year in the Water, Domestic Wastewater, and
Industrial Wastewater CIP funds to cover the cost of PLC replacement as the units reach
the end of their expected service life; and
NOW THEREFORE BE IT RESOLVED that the Becker City Council hereby authorizes staff
to
proceed with the PLC replacement project as outlined in the RCA for the
quoted price of $81,618.00 and a price not to exceed $89,800.00 (10%
contingency to cover any unforeseen costs for the project).

Sergeant Job Description: The Sergeant job description was reviewed by staff and adjusted to reflect the
job duties that will be assigned to that position. The job description document is included as an
attachment for this RCA. The job description was also reviewed by Personnel and Police Committees,
and staff recommends approval of the job description.
Sergeant Wage Scale: The Sergeant job description was reviewed internally using the DBM method and
also by Flaherty & Hood using the same DBM method and the sergeant position was recommended as a
C51 DBM rating. The wage scale for that band in the current salary structure is $42.37 - $55.09 with 9
steps after the starting wage. In order to have the Sergeant starting wage above the top patrol wage,
the actual hiring wage is anticipated to start at $46.20 with 6 steps to top pay for that range. Staff
recommends the approval of the sergeant wage scale identified and attached to this RCA.
Supervision History: The Becker Police Department operated with the Chief of Police being the only
supervisor for the department until December 2013, when the City Council approved a Sergeant
position to supervise the night shift officers and support the Chief. The Sergeant resigned in November
2015, and the Sergeant position remained vacant. Between November 2015 and February 2022 there
was no other supervisor besides the Chief. Due to changes in department structure and needing to
maintain investigation work, in February 2022 the City Council promoted me to the Lieutenant position.
In that role I was supervisor for the patrol staff and remained the department investigator. The
Lieutenant role had more administrative duties but because it was combined with investigations, the
role did not allow for much supervision of the night and evening shifts. The Lieutenant position has
remained vacant since I was promoted to Chief last year.
Department Needs: With the hiring of Officer Henkels in 2025, the department has the same staffing
number prior to my promotion (eight full-time including the chief). A patrol officer has been assigned as
a Patrol-Investigator to perform investigations, but they remain in the rotation. The department
currently operates alternating power shifts (2pm to 2am) and alternating night shifts (6pm to 6am).
With no first line supervisor, the Chief is identified as their direct supervisor. While I take a considerable

amount of calls after hours to answer questions and provide guidance, I do not have the opportunity to
be out on calls with them, which allows a supervisor to gain vital knowledge of their job performance,
ask immediate questions and see situations live. As our department grows, or we have the need to fill
vacancies, the officers with the least amount of experience typically end up working the overnight shifts,
which need the most supervision. Based on my previous experience I recognize that the supervisor
cannot do both jobs (supervise and investigations) while working evening shifts, nor is it effective to
have both department supervisors working day shifts. Based on these needs, I recommended the
addition of a sergeant position be added in 2026, beginning mid-year.
Sergeant Overview: The Sergeant will be the first line supervisor for any evening or night shift officers
and the second in command of the Becker Police department in the event that the Chief of Police was
unavailable. The Sergeant would be responsible for assisting the patrol officers on calls for service,
ensuring compliance with policy and procedures, scheduling for the evening and night shifts, providing
input for performance evaluations and managing training for the officers that report to them. The
Sergeant schedule may change with the needs of the department; however, it is planned that the
sergeant would work 8 10-hour shifts per pay period that would cross both sides of the schedule,
ensuring that they work with all officers that report to them. The Sergeant will work an alternating
weekend schedule to ensure that they are working with both sides of the schedule on the weekends as
well.
Hiring Process: Should the position be approved for posting, the job posting would be submitted to the
Minnesota POST Board and put on our website for approximately 3 weeks. After the application period
closes, the following hiring steps will be taken:

I presented the Sergeant position at several Police Committee meetings since last June, when initially
planning for funding the position. More recently, I have been working on the job description, hiring
process, wage review and scheduling. I have also had several meetings with Personnel Committee
where we discussed the position, the wage structure, job posting and proposed hiring process. Both
committees supported bringing this to full Council for consideration.
## Budgetary / Fiscal Impact:
During the last budget process the Council approved funding the Sergeant position with a start date of
late June. The total for wages and benefits was identified as $69,136. With the re-grading of the position
to C51 and a likely hire date of August 1
st
the revised budget impact is $52,265.

## POSITION OVERVIEW
The City of Becker is now accepting applications for a full-time Patrol Sergeant – Night Shift. This is a
newly established position created to provide dedicated first-level supervisory leadership to the Becker
Police Department’s patrol division during evening and overnight hours. The Patrol Sergeant will be
responsible for directly overseeing patrol officers assigned to the night shift, ensuring the consistent
delivery of professional law enforcement services to our community.

## ESSENTIAL DUTIES AND RESPONSIBILITIES
The Patrol Sergeant will perform first-level supervisory and administrative work to assist the Chief of
Police in managing uniformed patrol personnel. Duties include, but are not limited to:
• Supervising, directing, and evaluating all patrol/police officers assigned to the night shift,
including preparing shift schedules, authorizing overtime, approving time-off requests, reviewing
timesheets, and inspecting personnel and equipment.
• Coaching, mentoring, and providing ongoing performance feedback to officers; providing input
to the Chief of Police regarding officer performance and corrective measures.
• Providing technical leadership and guidance to officers on investigative techniques, legal
authority, evidence gathering and processing, interviewing practices, and case management.
• Reviewing officers’ reports and paperwork for accuracy and compliance with department and
state standards.
• Enforcing departmental policies, disciplinary standards, and work rules; promoting workplace
safety through example.
• Carrying out directives and initiatives of the Chief of Police and preparing, processing, and
maintaining required forms and reports, including ICRs, UCRs, and daily logs.

• Associate’s degree or higher in Law Enforcement, Criminal Justice, or a related field.

• Currently licensed as a peace officer with the Minnesota Peace Officer Standards and Training
(P.O.S.T.) Board, or eligible to be licensed at the time of appointment.
• Must meet all Minnesota P.O.S.T. Board minimum selection standards for hiring a peace officer.
• Current certification as a First Responder (EMR), CPR, and First Aid.
• Ability to communicate effectively with the public, department personnel, and other city
employees through oral and written means.
• Ability to work rotating evening, overnight, weekend, and holiday shifts as assigned.
## PREFERRED QUALIFICATIONS
• Bachelor’s or Master’s degree in Law Enforcement, Criminal Justice, or a related field.

WHEREAS, the City of Becker operates a police department; and
WHEREAS, The City of Becker established a job description for a Police
Sergeant that has identified the requirements of the position; and
WHEREAS, The City of Becker has reviewed the job description and completed
a Decision Band Method (DBM) assessment and identified the Sergeant position
as a DBM rating of C51 in the City of Becker Salary Structure; and
WHEREAS, A separate DBM was completed by Flaherty & Hood for the

for a Planned Unit Development (PUD) Conditional Use Permit and Preliminary Plat for a mixed use
residential development to be known as Edgewood Village. The applications were received on April 24,
2026 and deemed complete on April 27, 2026. The subject property consists of approximately 19.23
acres located south of Edgewood Boulevard and along the LuAnn Drive corridor, east of 1st Street in the
City of Becker. Properties are currently owned by EICHI, INC. (Martin Harstad, President; 7 parcels) and
John McChesney (1 parcel), both of whom signed the applications. The property is legally described as:

## City Actions
On May 5, 2026, the City Council considered amendments to the Comprehensive Plan and Unified
Development Ordinance related to residential density standards in the Multi-Family High Density district
(Resolution 26-41 and Ordinance 302, 2nd Series). Additionally, the City Council approved a
Supplemental Letter Agreement with SEH for road and utility improvements for LuAnn Drive (Resolution
26-38). The LuAnn Drive extension is a city-led infrastructure project funded in part through a state
grant, with the City Engineer overseeing the design and construction of the roadway and public utility
extensions within the right-of -way. This project was initiated independently by the City prior to the
Edgewood Village development proposal, though the proposed development is anticipated to connect
to and benefit from the planned public improvements.
## Key Issues
• The proposed development includes 215 dwelling units: four 38-unit apartment buildings (152
units, 3-story), three 8-unit townhome buildings (24 units, 3-story with tuck-under garages), five
5-unit rowhome buildings (25 units, 2-story with attached garages), and 7 twin home lots (14
units). Overall density is 11.18 units per acre on 19.23 acres. The applicant is requesting a PUD
CUP overlay to establish dimensional and design standards for the mixed housing types.
• The PUD proposes reduced lot widths, lot depths, and a 20-foot front yard setback for certain
twin home lots around the central cul-de-sac. The requested PUD standards are summarized in
the table below.
• The City Engineer's review of the civil plans is ongoing. Conditions have been added to the
resolutions regarding required review and amendments of the plans.
• Given the proximity of Pleasant Valley Park (approximately one-third mile) with recently
updated playground equipment, and the inclusion of on-site private amenities including a play
area and dog park, city staff, in consultation with City administration, are recommending an
adjusted fee-in-lieu of parkland dedication of $200,000 ($930.23 per unit). A Development
Agreement will be required to be executed with the City and all fees required under said
agreement must be paid before any construction begins.
• The City has been awarded a grant for the LuAnn Drive extension to Edgewood Boulevard. The
City Engineer is responsible for design and construction of the road and public utility extensions.
The developer's timeline is intended to coordinate with the LuAnn Drive construction schedule.
• The plat includes three outlots (A, B, and C) for stormwater management, drainage, and open
space. Outlot C also encompasses the Great River Energy transmission line easement.
Maintenance responsibilities will be addressed in the Development Agreement.
• A Tax Increment Financing application has been submitted. The TIF analysis process is ongoing.
• Approval of the PUD and preliminary plat shall become null if TIF approval from the City Council
is not obtained and the decision is made by either developer not to proceed with the project.
• An Environmental Assessment Worksheet (EAW) is required to be submitted to, reviewed, and
approved by the City.

WHEREAS, the Applicant requests that the subject property be rezoned to Planned Unit
Development – Multi-Family High Density (PUD-MFH) pursuant to Article III, Sec. 3.9 of the
UDO, and that approval of the PUD CUP shall require simultaneous amendment of the Official
## Zoning Map; and,
WHEREAS, the Applicant has submitted a PUD Narrative dated April 24, 2026, describing the
proposed dimensional deviations from MFH zoning standards for the various housing types
within the PUD, including reduced lot widths, lot depths, and selected front yard setbacks; and,
WHEREAS, the proposed development consists of 215 dwelling units on approximately 19.23
acres (11.18 units per acre), including four 38-unit apartment buildings (152 units, 3-story), three
8- unit townhome buildings (24 units, 3-story with tuck-under garages), five 5-unit rowhome

WHEREAS, the PUD dimensional deviations enable a mixed housing type development that
would not be achievable under the standard MFH zoning dimensional requirements; and,
WHEREAS, a public hearing was duly held on May 18, 2026 in the City Council Chambers,
Becker City Hall, 12060 Sherburne Ave, Becker, MN 55308, at which time all parties were
given the opportunity to be heard; and,
WHEREAS, notice of the time, date, place, and purpose of the aforementioned hearing was duly
given as required by statute; and,
WHEREAS, the Becker Planning Commission recommended approval of the PUD CUP via
Resolution PC 26-07 on May 18, 2026; and,
WHEREAS, the Becker City Council has reviewed the application, the PUD Narrative, the civil
engineering plans, the stormwater narrative, and all supporting materials submitted by the
Applicant; and,
WHEREAS, the Becker City Council finds that the PUD CUP, as conditioned herein, is
consistent with the City of Becker Comprehensive Plan, is compatible with the surrounding area,
and that reasonable conditions have been imposed to protect the public interest;
In considering this application, the Becker City Council makes the following findings of fact
pursuant to Article I, Sec. 1.13 of the City of Becker Unified Development Ordinance:
(A) Relationship to the City’s Comprehensive Plan. The proposed PUD is consistent with the
Comprehensive Plan’s designation for multi-family residential uses in this area. The City
Council approved density amendments to the Comp Plan and UDO on May 5, 2026 (Resolution
26-41 / Ordinance 302) which amendments allow the proposed density in the Multi-Family High
(MFH) zoning district.
(B) The geographical area involved. The subject property encompasses approximately 19.23
acres situated south of Edgewood Boulevard and east of 1st Street, part of the Evergreen Park
North plat. The site is relatively flat with prairie grass and brush cover.
(C) The character of the surrounding area. The surrounding area includes agricultural land to
the north, commercial and light industrial uses to the south, Prairie Village Apartments to the

northeast, and single-family homes to the southeast. The proposed mixed residential
development provides a transition between existing commercial and residential uses.
(D) The availability and design capacities of existing or proposed utilities. Municipal water and
sanitary sewer are available via the current constructed portion of LuAnn Drive. The City has
been awarded a grant for the LuAnn Drive extension, which will include public utility extensions
designed by the City Engineer. The stormwater narrative demonstrates adequate capacity using
three infiltration basins.
(E) Whether the request will tend to or actually depreciate the surrounding area. The proposed
development is not expected to depreciate the surrounding area. The PUD provides a variety of
housing types, landscaping, and screening buffers that are compatible with adjacent uses.
(F) Whether the request will place an undue financial burden on the City. The development will
not place an undue financial burden on the City. All site improvements will be paid for by the
developer per the required Development Agreement. The LuAnn Drive improvements are a City
led project with separate grant funding.
(G) Whether the request will impair an adequate supply of light and air to adjacent property.
The proposed setbacks and building heights are adequate to ensure that light and air are not
impaired for adjacent properties. A 25-foot landscape buffer is provided along the southern
boundary.
(H) Whether the request will unreasonably increase the congestion in the public right-of-way.
The development will be served by the LuAnn Drive extension and internal streets. Access is
designed to distribute traffic and avoid congestion on surrounding streets.
(I) Whether the request will increase the danger of fire or endanger the public safety. The
development will be served by municipal water with fire hydrants and will be constructed in
compliance with applicable building and fire codes.
(J) Whether the request is consistent with the spirit and intent of this Article. The PUD CUP is
consistent with the spirit and intent of the UDO’s PUD provisions, which are designed to allow
flexibility in development standards to achieve a better overall development outcome.
The Becker City Council further makes the following findings pursuant to the Standards for
Findings for Conditional Use Permits required under Subsec. 1.11.5(I)(d) of the City of Becker
## Unified Development Ordinance:
(1) That the conditional use will not be injurious to the use and enjoyment of other property in
the immediate vicinity for the purposes already permitted. The development provides appropriate
setbacks, buffering, and screening to protect neighboring properties.
(2) That the establishment of the conditional use will not impede the normal and orderly
development and improvement of surrounding vacant property for predominant uses in the area.
The PUD complements existing and planned development patterns in the area and fills in an
undeveloped parcel within the City.

(3) That adequate utilities, access roads, drainage, and other necessary facilities have been or
are being provided. Municipal utilities are being extended via the City’s LuAnn Drive project.
Internal streets and stormwater facilities are provided by the developer.
(4) That adequate measures have been or will be taken to provide sufficient off-street parking
and loading space to serve the proposed use. Parking meets or exceeds UDO requirements for all
unit types. Covered carport parking is provided for apartment buildings.
(5) That adequate measures have been or will be taken to prevent or control offensive odor,
fumes, dust, noise, and vibration, so that none of these will constitute a nuisance, and to control
lighted signs and other lights in a manner that no disturbance to neighboring properties will
result. The proposed mixed residential development does not generate offensive odors, fumes,
dust, noise, or vibration beyond that typical of residential development. Street lighting will be
fully shielded to minimize light pollution.
(6) That proper facilities are provided which would eliminate any traffic congestion or traffic
hazard that may result from the proposed use. The internal street network and LuAnn Drive
extension provide adequate access and circulation.
(7) The demonstrated need for the proposed use. There is demonstrated demand for a mix of
housing types in the City of Becker, including rental apartments, for-sale townhomes, and twin
homes.
(8) The proposed use is in compliance with the City’s Comprehensive Land Use Plan adopted
by the City Council. The proposed development is consistent with the Comprehensive Plan as
amended.
(9) The use does not result in adverse effects on public health, safety, and welfare nor does it
create additional pollution potential for ground and surface waters. The development will be
constructed in accordance with all applicable codes and standards and will not adversely affect
public health, safety, or welfare.
The Becker City Council further makes the following findings pursuant to the PUD Review and
Evaluation criteria required under Subsec. 1.11.5(D)(4) of the City of Becker Unified
## Development Ordinance:
(1) The interior circulation plan, including access from and onto public rights-of-way, does not
create congestion and is adequate for the safety of the residents and the public. Internal streets
and drive aisles are designed to City standards with adequate turning radii. Sidewalk
connections are provided throughout the development.
(2) A sufficient amount of parkland is publicly dedicated, or appropriate fee in-lieu in
accordance with Article III, Sec. 3.3 is submitted. Given the proximity of Pleasant Valley Park
(approximately one-third mile) with recently updated playground equipment, and the inclusion of
on-site private amenities including a play area and dog park, Staff, in consultation with City
administration, recommends an adjusted fee-in-lieu of parkland dedication of $200,000. Fees
shall be paid per the City fee schedule at the time of final plat recording.
(3) Sufficient usable open space is provided for residents. The development includes Outlot A
(common open space), a dog park, and a play area.

(4) The arrangement of buildings, structures, and accessory uses does not unreasonably disturb
the privacy of the surrounding area. Buildings are oriented and set back to minimize impacts on
adjacent properties. A 25-foot landscape buffer with trees screens the development from
southern commercial neighbors.
(5) The architectural design of the project is generally compatible with the surrounding area.
Architectural standards will be reviewed at the time of building permit application. The PUD
narrative indicates a cohesive design approach.
(6) The drainage and utility system plans are sufficient to provide adequate services to
properties in the development and meet relevant standards as determined by review and approval
of said plans by the City Engineer and Public Works Department. The stormwater narrative
demonstrates compliance with City and MPCA standards. Three infiltration basins are planned.
Final engineering review is ongoing.
(7) The development schedule ensures development of the site will protect the public interest.
The development is coordinated with the City’s LuAnn Drive construction timeline. Phasing and
construction sequencing will be addressed in the Development Agreement.
(8) Principal and accessory uses and requirements are in compliance with the regulations in this
section and other applicable zoning district provisions in which the development is intended. All
proposed uses (apartments, townhomes, twin homes) are permitted in the MFH district with
PUD overlay.
(9) The Becker City Council finds that the design of the PUD and the proposed structures can
meet all required findings and will not be detrimental to the City in any way. The development
provides needed housing diversity, generates tax revenue, and utilizes existing and planned
infrastructure.
NOW THEREFORE BE IT RESOLVED, that based on the findings of fact required in the
City of Becker Unified Development Ordinance, as detailed above, the Becker City Council
hereby approves the Planned Unit Development Conditional Use Permit for Edgewood Village,
with the PUD Minimum Standards, set forth below, pursuant to Article III, Sec. 3.9, and the
following conditions:

The following dimensional deviations from MFH zoning standards are hereby approved pursuant
## to Article III, Sec. 3.9:
1. Apartment lots: Minimum lot width 150 feet; minimum lot depth 150 feet; maximum lot
coverage 56%; all setbacks 30 feet.
2. 5-Unit Rowhome lots: Minimum lot area 1,248 s.f.; minimum lot width 26 feet; minimum lot
depth 48 feet; front and rear setback 30 feet; side setback 20 feet.
3. 8-Unit Townhome lots: Minimum lot area 768 s.f.; minimum lot width 24 feet; minimum lot
depth 32 feet; front and rear setback 30 feet; side setback 20 feet between buildings.
4. Twin Home lots: Minimum lot area 8,061 s.f.; minimum lot width 46 feet; minimum lot depth
133 feet; maximum lot coverage 35%; front setback 30 feet (20 feet for Lots 5-8, Block 5 and
Lots 1-5, Block 8 around the central cul-de-sac); side setback 10 feet; rear setback 30 feet.

5. Maximum structure height for all building types: 45 feet.
1. The development shall comply with all applicable state laws, building codes, fire codes, and
City of Becker ordinances.
2. The development shall comply with the Unified Development Ordinance except as
specifically modified by this PUD CUP.
3. No work shall commence on the site until all necessary permits have been obtained, a
Development Agreement has been fully executed with the City, and the final plat has been
recorded.
4. Civil engineering plans shall be reviewed and approved by the City Engineer and City Staff
before any building permits are issued.
5. The development shall be constructed in accordance with the approved civil engineering plan
set and stormwater narrative, as may be required to be amended by the City Engineer and City
Staff.
6. All structures shall be connected to municipal water and sanitary sewer.
7. Nothing shall be constructed on the PUD site except in conformance with the approved PUD
plans and the Unified Development Ordinance.
8. The City Attorney may make necessary adjustments to this resolution as to form.
9. The Official Zoning Map shall be amended to designate the subject property as PUD-MFH
upon final approval by the City Council.
10. Trash enclosures, designed to be cohesive with the design of the buildings, must be provided
for each apartment structure.
11. The approval of this PUD conditional use permit, district dimension standard variations, and
PUD zoning district establishment, shall become null if TIF approval from the City Council is
not obtained and the decision is made by either developer not to proceed with the project.
12. An Environmental Assessment Worksheet (EAW) is required to be submitted to, reviewed,
and approved by the City and a negative determination made on the need for the Environmental
Impact Statement (EIS) by the City. Should a positive determination be made by the City on the
need for an Environmental Impact Statement (EIS), said EIS must be submitted and approved by
the City prior to construction of the development.

commercial uses to the west and single-family residential to the southeast.
● Provides adequate access to existing or proposed municipal utilities with sufficient
capacity for the intended use. Municipal Water and Sewer will be extended via the City’s
Lu Ann Drive Project. The developer will construct internal utility infrastructure to
connect to the public system.
● Will not tend to or actually depreciate the surrounding area. The development, with its
landscaping, screening, and site design, is not expected to depreciate surrounding
property values.

● Will not impose an undue financial burden on the City of Becker. All development
improvements, including, but not limited to, Landscaping, Utilities, Streets, Curb and
Gutter, Sidewalks / Trails, Stormwater ponding, Parkland Dedication Fees, Trunk Fees,
and Sewer Availability Charges (SAC) and Water Availability Charges (WAC) will be
funded by the developer as negotiated in a required, City Council approved Development
Agreement. LuAnn Drive improvements are separately funded through a City grant.
● Will not impair an adequate supply of light and air to adjacent property. Proposed
setbacks and building heights ensure adequate light and air for neighboring properties.
● Will not unreasonably increase the congestion in the public right-of-way. The LuAnn
Drive extension and internal street network provide adequate traffic distribution.
● Will not increase the danger of fire or endanger the public safety. The development will
be served by municipal water with fire hydrants and will comply with all fire and
building codes.
● The request is consistent with the spirit and intent of Article I. The preliminary plat is
consistent with the UDO’s subdivision standards and the PUD provisions (see Resolution
26-50).
THEREFORE, BE IT RESOLVED that the City of Becker City Council hereby adopts the
following Findings of Fact, as required by UDO Article I Zoning, Section 1.13:
● The Plat, as conditioned herein, is consistent with the construction standards, design
standards, and other requirements set forth by the City's Unified Development Ordinance.
The plat meets UDO subdivision standards as modified by the PUD CUP (Resolution 26-
50).
● The physical characteristics of the site, and area surrounding the site, including but not
limited to topography, erosion, flooding potential, soil limitations, and overall suitability
for the type of development or use proposed. The site is relatively flat with good soils. A
geotechnical investigation dated April 17, 2026, has been completed. No floodplain areas
are identified on the subject property.
● The proposed development is consistent with the City's Comprehensive Land Use Plan.
The development is consistent with the Comprehensive Plan as amended by Resolution
26-41.
● The City will not face unnecessary interrupted use of public roadways, facilities, or
property for an unspecified amount of time due to development the City is not ready for.
Traffic control and construction sequencing requirements will be specified in the
Development Agreement. The developer shall coordinate with the City’s LuAnn Drive
construction project with project development and implementation.
● The subdivision will not prohibit the orderly growth of the surrounding areas or the City
as a whole. The development fills an undeveloped area within the City and extends
municipal infrastructure in a logical manner.
● The Plat will be developed per the construction and development standards that have
been set within the City. All construction shall comply with City standards and
specifications.

● The subdivision will not create a negative fiscal or environmental impact upon the City.
The development provides housing stock, generates property tax revenue, and manages
stormwater through infiltration basins designed to protect downstream resources.
● The City will not face undue financial hardship due to the development in question.
Developer funded improvements and grant-funded LuAnn Drive infrastructure ensure no
undue burden on the City.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Becker City Council, based on
the findings put forth in this resolution, hereby approves the preliminary plat request for
Edgewood Village subject to the following conditions:
1. No work shall commence until all necessary permits have been obtained.
2. Safe access shall be provided through all required improvements as determined by City Staff
and the City Engineer.
3. All City Engineer and City Staff comments on the preliminary plat, final plat, and associated
civil plans shall be addressed prior to final plat recording.
4. All easements and rights-of-way shall be dedicated as shown on the approved preliminary plat.
5. The final plat for the first phase of the development shall be recorded within one (1) year of
preliminary plat approval, or a new application shall be required.
6. Sidewalks shall be constructed as shown on the approved civil engineering plans, as may be
amended. Sidewalks must be concrete and shall be 6' (feet) in width.
7. All drainage systems shall be provided as required by the City Engineer and City Staff,
including the three infiltration basins and associated storm sewer infrastructure.
8. All roads shall be constructed to urban standards per the required Development Agreement.
9. Civil engineering plans shall be reviewed and approved by the City Engineer before building
permits are issued.
10. A Development Agreement shall be executed and approved by City Council. Said agreement
must be reviewed and approved by City Staff, City Engineer, and City Attorney.
11. Park dedication fees and any other applicable fees shall be calculated pursuant to the City of
Becker fee schedule in effect at the time of final plat recording. The exact allocation shall be
calculated and inserted into the required Development Agreement.
12. A 25-foot vegetated landscape buffer shall be maintained along the southern property
boundary as shown on the landscape plan. Said buffer must be maintained in good condition
including regular tree and limb maintenance, dead or diseased tree removal, and replacement of
any vegetation removed.
13. A street lighting and mailbox plan shall be submitted for review and approval prior to the
recording of the final plat.
14. Positive drainage shall be maintained away from all structures and directed to the
retention/infiltration basins.
15. Topsoil and vegetation shall be replaced to minimize erosion in all disturbed areas.
16. Reclamation and filling shall be subject to approval by the Zoning Administrator and City
Engineer.

17. The maintenance of Outlots A, B, and C shall be addressed in the Development Agreement.
18. The developer shall coordinate construction schedules with the City’s LuAnn Drive
extension project.
19. The City Attorney may make necessary changes to this resolution as to form.
20. An Environmental Assessment Worksheet (EAW) is required to be submitted to, reviewed,
and approved by the City and a negative determination made on the need for the Environmental
Impact Statement (EIS) by the City. Should a positive determination be made by the City on the
need for an Environmental Impact Statement (EIS), said EIS must be submitted and approved by
the city prior to construction of the development.
21. Approval of this preliminary plat shall become null if TIF approval from the City Council is
not obtained and the decision is made by either Developer not to proceed with the project.

## A RESOLUTION PROVIDING FOR THE SUSPENDING OF CERTAIN PROHIBITIONS AND CITY CODE
## REQUIREMENTS OF THE CITY OF BECKER FOR THE ANNUAL FREEDOM DAYS CELEBRATION
WHEREAS, the City of Becker hosts an annual celebration known as Freedom Days; and
WHEREAS, this year the celebration occurs between the dates of June 13 - 20; and
WHEREAS, during the course of normal Freedom Days activities certain activities occur which would
otherwise be prohibited by the Code of Ordinances, thereby requiring a suspending of certain areas of
the Code of Ordinances; and
WHEREAS, the celebration includes off-premise promotional signage, a parade, golf cart use by city
elected officials, city staff and event staff, including volunteers, private vendor sales on city streets and
sidewalks, and alcohol consumption within the festival area.
NOW THEREFORE BE IT RESOLVED that the Becker City Council hereby authorizes the temporary
suspension of the following rules and requirements of the Becker City Code to provide for certain types
of activities listed and in conjunction with the Freedom Days Celebration as approved by the Freedom
## Days Committee:
1. For off-premise temporary signage, the Becker City Council hereby temporarily suspends
Subsec. 2.5.2.C. Temporary Signs of the Unified Development Ordinance which reads:
(C) Temporary signs in commercial and industrial zoning districts shall not exceed thirty-two
(32) square feet in area and are subject to the following regulations:
1. Shall only identify or advertise an establishment, person, activity, goods,
products, or services produced or conducted on the premises where the sign is
located.
2. One (1) on-premises temporary or portable sign is allowed per business, as
allowed by the City Zoning Administrator or their designee, subject to the
following:
a. Signs may not be displayed for more than sixty (60) calendar days per
calendar year.
b. Signs may not be displayed without a permit. Up to four (4) permits per
year may be issued to a business, not to exceed the number of days
allowed in subsection 2a of this section. Each permit must indicate the
number of days the sign is to be displayed.
Additionally, the Becker City Council hereby temporarily suspends Subsec. 2.5.3.B. Prohibited
Signs which reads:
The following signs are prohibited:
(B) All off-premise signs.
NOTE: Approved Temporary signage, not exceeding 100 square feet in area, are allowed from
June 5-June 22.
2. For traffic during the Freedom Days parade the Becker City Council hereby temporarily suspends
a section of the Becker City Code that reads: It is a misdemeanor for any person to drive a

vehicle contrary to lane restrictions or prohibitions painted on any street, or contrary to sign
posted, fenced, or barricaded restrictions or prohibitions;
3. For the use of city owned golf cars by City of Becker elected officials, city staff and event staff
working to operate Freedom Days activities the Becker City Council hereby temporarily
suspends a section of the Becker City Code that reads: No person shall operate a motorized golf
car without obtaining a permit for the motorized golf car as provided herein...;
4. For the use of golf cars by City of Becker elected officials, city staff and event staff working to
operate Freedom Days activities the Becker City Council hereby temporarily suspends a section
of the Becker City Code in that reads: It is unlawful for any person to drive or operate a golf car
on any public sidewalk or public property designated for use as a pedestrian walkway or
bicycle trail, except when crossing them to gain access to the other side...;
5. For private vendors to temporarily use public streets, parking lots, and sidewalks for parking and
sales the Becker City Council hereby temporarily suspends a portion of Section that reads: Upon
an application duly made to the City and reviewed and recommended by the City, the Council
may in its discretion, grant special permission whereby City owned on-street parking, parking
lots, ramps or public sidewalks may be temporarily ... dedicated to private use...;
6. For private vendors to use public streets for sales the Becker City Council hereby temporarily
suspends the section that reads: It is a misdemeanor for any person to place, deposit, display
or offer for sale, any fence, goods or other obstructions upon, over, across or under any street
without first having obtained a written permit from the Council, and then only in strict
compliance with the terms and conditions of such permit, and by employing precautionary
measures for the protection of the public. For purposes of this Section, the definition of an
obstruction shall include, but not be limited to, an electrical cord or device of any kind;
7. For alcohol to be purchased from the Becker Lions Club and Charlie’s Sports Bar & Grill and said
alcohol to be possessed in an unsealed container and consumed in the designated festival area
on June 20, 2026 from the hours of 10:00 am to 12:30 am (June 21st, 2026) the Becker City
Council hereby temporarily suspends a section of the Becker City Code that reads: It is unlawful
for any person to consume, or possess in an unsealed container, any Alcoholic Beverage on
any (2) street, in favor of allowing festival participants to purchase alcohol from the Becker
Lions Club and Charlie’s Sports Bar & Grill and possess in an unsealed container and consume in
the festival area as defined (the festival area) by the Freedom Days Committee.

meters throughout the city. The MRX is a
portable, vehicle-mounted date collector
that reads radio frequency (RF) equipped
water meters. This unit allows staff to
capture and process usage data from up to
150 feet away as they drive through
neighborhoods. This information is then
relayed to the billing clerk so water/sewer
bills can be issued to users. The current
unit was purchased in 2018 and stopped
working. Staff worked with IT to get the
unit sent in to see if it could be repaired. Per Ferguson, the city’s unit could no longer be repaired due
to age and availability of parts. Staff currently have a loaner MRX unit from Ferguson and will use this
for meter reading until a new unit can be acquired.

Staff did ask the Ferguson rep what an expected lifespan is for a unit like this. The answer was

to use to ship it to them. Make sure you include the MRX’s accessories in the package: the
MRX itself, the power cord, and antenna assembly. Finally, could you please write the RMA
number on the outside of the box to facilitate the process more efficiently? It’s RMA 462818.

## A RESOLUTION APPROVING THE REPLACEMENT OF THE MRX METER
## READING UNIT FOR PUBLIC WORKS - WATER
WHEREAS, the City of Becker owns and operates a public water supply system; and
WHEREAS, city staff read water meters monthly for utility billing purposes; and
WHEREAS, a MRX unit is an integral tool required for reading water meters; and
WHEREAS, the current MRX unit was not working and was sent in for repairs; and
WHEREAS, the age of the current unit made it not eligible for repair; and
WHEREAS, staff received a replacement quote of $15,000.00 from Ferguson
Waterworks; and
WHEREAS, the Finance Department has verified there are sufficient reserves in the
Water CIP to cover the cost of this replacement MRX unit; and
NOW THEREFORE BE IT RESOLVED that the Becker City Council hereby authorizes staff
to
purchase the replacement MRX unit for the quoted price of $15,000.00 and a
price not to exceed $16,500.00 (10% contingency to cover any unforeseen costs

The City Council approved of the final plat for Fossum Fields Third Addition via Resolution 26-40. As
required by condition #13 of said resolution, the developer (Sherburne Land Company, LLC) is required
to execute a development agreement prior to beginning construction and recording of the final plat.
## Key Development Agreement Requirements
• Section 17 of the draft agreement (attached) requires securities be submitted to the city before
construction begins. The developer is currently working on obtaining bids to complete the
project. The developer would be required to provide the city with an Engineer’s Opinion of
Cost detailing the estimated quantities of work and unit pricing. This opinion would be
reviewed by the City Engineer for reasonableness and to set the required security amounts
which would be inserted into the agreement prior to final signatures and recording.
• Based on the current formulas in Article III of the Unified Development Ordinance, staff
determined the total parkland dedication fee to be $156,119.66 (1.79 acres required multiplied
by an AFMV per acre of $87,217.63) or $3,007.29 per unit ($156,119.66 / 52 units). Due to a
6.41 acre park going in approximate .20 miles northwest of the site that will serve lots in the
development, staff recommends reducing the parkland fees to $980.39 per unit which equates
to a total of $30,392.09 (31 units * $980.39).
• Escrow was submitted for the land use applications the city previously obtained (PUD CUP,
Preliminary Plat, and Final Plat). Fees for engineering, city administration, and legal expenses
related to the development would be paid by existing escrow being held from the previously
submitted applications. Additional escrow funds would be required to be submitted to the city
to replenish the account should funds run low.
A copy of the draft agreement was provided to Sherburne Land Company, LLC. Approval of Resolution
26-54 would authorize adjustments to be made to the agreement as deemed necessary by the City
Attorney and City Engineer prior to final signatures and execution.

AGREEMENT (“Agreement”) is made and entered into this ____
day of ____________, 2026, by and between the CITY OF BECKER, a Minnesota municipal
corporation (“City”); and SHERBURNE LAND COMPANY, LLC (the “Developer”).
WHEREAS, the Developer has made application for and requests approval of a project
including a fifty- two (52) lot preliminary plat (Exhibit A) and a fifty- two (52) lot final plat (Exhibit B);
and
WHEREAS, the proposed project would result in all lots, except for Outlot A and Rights of Way
to be dedicated as noted on the preliminary and final plat for Fossum Fields Third Addition

Resolution 26-40 (Final Plat); and,
WHEREAS, the Developer has made assurances and covenants to the City as hereinafter

NOW, THEREFORE, in consideration of the mutual promises and obligations contained herein,
the Developer and City agree as follows:
1. REQUEST FOR APPROVAL. The Developer is the owner of certain lands in the City
of Becker and has asked the City for approvals, as noted above, to plat said lands (as described below). The
lands (“Property”) are situated in the City of Becker, County of Sherburne, State of Minnesota, and are
legally described as follows:
Outlot C, Outlot D, Outlot F, Outlot G, Fossum Fields, according to the recorded plat thereof,

The Property is zoned PUD-SFD (Planned Unit Development – Single-Family Detached) pursuant to
Resolution 26-36.

2. CONDITIONS OF REMAINING APPROVALS. The City hereby approves the
remaining applications on conditions that the Developer enter into this Development Agreement, furnish the
security required by it, provide title evidence that good and marketable title to the Property is in the name of
the Developer, and record the conveyance with the County Recorder within 90 days after this Development
Agreement is entered into. This Agreement does not operate as a waiver of the requirements to apply for
and receive building permits for all the proposed buildings on the site.
## 3. COMPLIANCE WITH STATE LAW, CITY ORDINANCES AND AGREEMENT.
Developer agrees to and shall comply with all requirements of state law, city ordinances and this
Agreement. In the event Developer is required to obtain any approval, permits or do any act either as a
condition to commencing such Development or to continue any stage or phase of such Development, the
Developer shall submit in writing to the City proof of compliance with any such requirement before
proceeding. The failure to submit such proof of compliance shall be grounds for the City to order the
Developer to cease any and all physical activities, of whatever nature, upon the Property. Developer
acknowledges that it is proceeding at its own risk as to any costs incurred by its failure to comply with this
Agreement. Within the Property, the Developer may not grade or otherwise disturb the earth, remove trees,
construct sewer lines, water lines, streets, Utilities, public or private Improvements, or construct any
buildings until all of the following conditions have been satisfied: 1) this Agreement has been fully
executed by both parties and filed with the City, 2) the necessary security has been received by the City, 3)
the final plat has been recorded with the Sherburne County Recorder’s Office, and 4) the City has approved
the plans and specifications.
The City may refuse to approve final plats of subsequent phases of the plat if the Developer
has breached this Agreement and the breach has not been remedied. Development of subsequent phases
may not proceed until the City approves development agreements for such phases.
4. PROPOSED DEVELOPMENT AND DEVELOPMENT PLANS. The Developer
intends to install Utilities and other Improvements (including natural gas, electric, storm sanitary, sanitary

5. ALTERATION OF PLANS. In the event the Developer desires to change any plans,
drawings, specifications, conditions or any aspect of the Development which differs from those initially
approved by the City, the Developer shall first obtain the written consent of the City before initiation,
construction, or incorporating such change in the Development.
6. UTILITIES. The Developer agrees that the following improvements will be constructed
or provided within the Development by Utility Companies or the City (if the utility is provided by the
City): Natural Gas Service, Electric Service, Telephone Service, Cable. T.V. Service, Broadband Service,

Street Lighting, and Signs (including road identification and traffic signs) (“Utility” and “Utilities”). As
for each such Utility, the Developer will provide the City, for approval, as part of this Agreement: the

City and Utility Company must approve the location of the Utility before installation of the Utility. All
electrical, telephone and broadband lines, and cable must be installed in sized conduits underground when
such lines or cables cross the City’s right of way. All Utilities for the first phase of the Development, as

The Improvements shall be installed in accordance with all required provisions of the City Code and
coordinated with and approved by the City’s Planners, Engineers, and Public Services Department.

the Developer wishes to split the Property into two phases the following requirements apply under this
Agreement.
1) Phase 1 shall consist of thirty-one (31) lots. Phase 2 shall consist of twenty-one (21) lots, as
identified in the PUD Narrative and on the preliminary plat.
2) The Sanitary Sewer design must be approved by the City Engineer. At the City Engineer’s
discretion, the sanitary sewer may be required to be installed for all phases to accommodate the
required minimum depths of the system.
3) Positive drainage, directing stormwater away from all structures and away from neighboring
properties, must be provided for and maintained on all lots within the Development during all
phases. Additionally, drainage and grading must direct runoff to retention basins within the
Development during all phases.
4) Six (6’) foot sidewalks must be installed along one side of all streets running throughout the
development.
5) A Ten (10’) foot bituminous trail must be installed around the perimeter of the Development
adjacent to 153rd Ave SE and 127th Street SE on the western and southern boundaries of the plat
during the first phase of the Development. A portion of said trail will be required to be installed by
the Developer across Outlot E of Fossum Fields when either of the following occur: (a)
Development to the east of Fossum Fields Third, and subsequent phases, occurs; or (b) When the
City determines a turn lane is necessary on 127th Street SE. The cost of the trail shall be the
responsibility of the Developer. If portions of the trail do not lie within the public street right of
way, dedicated trail easements must be provided to the City as part of this Phase of the
development.
6) Since this is a multi-phased plat, final plat application(s) for any subsequent phases must be
submitted within two (2) years after approval of the previous phase final plat or the preliminary plat
shall be considered void. Prior to the expiration of the final plat deadline, the Planning Commission

may extend the approval for an additional (2) years. Only one (1) extension may be granted per
phase of the preliminary plat.
7) Subsequent phases of the plat must obtain separate development agreements from the City at the
time of requested approval for said plat.
The Developer shall submit plans and specifications for permit which have been prepared by a competent
registered professional engineer to the City for approval by the City Engineer which approval shall be
provided on the condition that such submittals comply with the Plans, this Agreement, and the approving
Resolutions. The Developer shall instruct its engineer to provide adequate field inspection personnel to
assure an acceptable level of quality control. In addition, the City may, at the City’s discretion and at the
Developer’s expense, have one or more City inspectors and a soil engineer inspect the work as the City may
reasonably determine. The Developer, its contractors and subcontractors, shall follow all instructions
received from the City’s inspectors. The Developer’s engineer shall provide for on-site project management.
The Developer’s engineer is responsible for design changes and contract administration between the
Developer and the Developer’s contractor. The Developer or his engineer shall notify the City Engineer a
minimum of 48 hours prior to commencing construction on the Property. Within thirty (30) days after the
completion of the Improvements and before the security is released, the Developer shall supply the City
with a complete set of reproducible “as constructed” plans, an electronic file of the “as constructed” plans
and preliminary and final plats in an Auto CAD file based upon the Sherburne County coordinate system, all
prepared in accordance with City standards for all public Improvements.
8. IRON MONUMENTS. In accordance with Minnesota Statutes 505.02 the final
placement of iron monuments for all lot corners must be completed before any applicable security is
released. The Developer’s surveyor shall also submit a written notice to the City certifying that the
monuments have been installed.
9. PERMITS. The Developer shall obtain or require its contractors and subcontractors to
obtain all necessary permits, including but not limited to City of Becker Building Permits and any
required supplemental drawings, plans or other information.

10. TIME OF PERFORMANCE. The Developer shall install all required Improvements
for the Development as contemplated by Section 4 and 6 and the approved Plans by ______________,
20____.
11. LICENSE. The Developer hereby grants the City, its agents, employees, officers,
and contractors a license to enter the described Property to perform all work and inspections deemed
appropriate by the City in conjunction with the Development Plans.
12. EROSION CONTROL. All areas disturbed by the excavation and backfilling operations
shall be stabilized or reseeded within five (5) days after the completion of the work, weather permitting, or
in an area that is inactive for more than seven (7) days, unless otherwise authorized and approved by the
City Engineer, and in accordance with the project’s accepted Storm Water Pollution Prevention Plant
(SWPPP) and the requirements of any required National Pollutant Discharge Elimination System (NPDES)
permit. Except as otherwise provided in the erosion control plan, seed shall be in accordance with the City’s
current seeding specification which may include certified oat seed to provide a temporary ground cover as
rapidly as possible. All seeded areas shall be maintained as necessary for seed retention. The parties
recognize that time is of the essence in controlling erosion. If the Developer does not comply with the
erosion control plan and schedule or supplementary instructions received from the City, the City may take
such action as it deems appropriate to control erosion. The City will endeavor to notify the Developer in
advance of any proposed action, but failure of the City to do so will not affect the Developer’s and City’s
rights or obligations hereunder. The Developer shall reimburse the City for all costs incurred in connection
with such actions. If the Developer does not reimburse the City for any cost the City incurred for such work
within ten (10) days, the City may draw down the letter of credit to pay any costs or seek reimbursement by
other methods. No development, parking lot, or Utility construction will be allowed, and no building permits
will be issued unless the Subdivided Property is in full compliance with the approved erosion control plan.
13. TREE PRESERVATION, DRAINAGE AND LOT DESIGN. These plans for the plat were
submitted on April 3

14. LANDSCAPING & HARDSCAPING. The Developer shall ensure landscaping
conforms to the submitted plans (and any other revisions to said plan required by City Staff).
Landscaping, including but not limited to lawn maintenance, tree planting, and boulevard restoration and
maintenance shall also conform to current City Code. The Developer must ensure that all hardscaping,
including but not limited to sidewalks, curb and gutter, driveway aprons and other pathways, are installed
according to the aforementioned Civil Plan Set dated April 3

installed. All planting material must be maintained in its natural and proper state according to accepted
landscaping and horticultural practices. Determination that the buffer is not being maintained is at the
discretion of the City. If the City finds that maintenance is not occurring or that accepted landscaping and
horticultural practices are not being properly followed the City shall notify the property owner of their
responsibilities to maintain said buffer. In the same event, the City will fix any issues, including but not
limited to pruning, replacement, and removal of debris, that arise from lack of maintenance and adherence
to accepted landscaping and horticultural practices and will bill all costs back to said property owners. If
prompt payment is not made for all costs incurred by the City, the amount will be assessed against the
property and said assessment will be recorded against title at Sherburne County. The Developer must
provide the buyers of Lot 12, Lot 13, Lot 14, Lot 15, Lot 16, Lot 17, and Lot 18, of Block 2 of Fossum
Fields Third Addition a copy of Resolution 26-37, Resolution 26-40 and the Development Agreement
highlighting said buyer’s responsibilities of maintaining said vegetated buffer.
15. CLEAN UP AND SNOW REMOVAL. The Developer shall clean dirt and debris from
streets and rights-of-way that has resulted from construction work by the Developer, subcontractors, their
agents or assigns. The Developer shall identify in writing a responsible party and schedule for erosion

control, street cleaning, and street sweeping. Developer shall be responsible for all snow removal from
sidewalks on vacant lots to the extent that City ordinance requires snow removal from sidewalks on
constructed homes. Developer shall be responsible for ensuring that all vacant lots comply with the City’s
Code regarding nuisances.
16. TRAFFIC CONTROL SIGNS AND STREET MAINTENANCE COSTS. The
Developer shall supply all traffic control signage and keep streets free from grit, dirt, and debris. Developer
will timely respond to signage or maintenance needs, if in the opinion of the City Engineer signage is
necessary, damage is done to the street, or material deposited on the street will result in corrective action
upon notification.
17. SUMMARY OF SECURITY REQUIREMENTS. To guarantee compliance with the
terms of this Contract, the Developer shall furnish and deliver to the City with a cash escrow or letter of
credit, in the form attached hereto as Exhibit A (or as deemed acceptable by the City), from an FDIC insured
bank (“security”) for $ _XXX,XXX___ before any additional City approvals become effective. No work
shall be commenced under this Agreement until the Developer shall file with the City security for the
amount specified. The security must be pledged for the duration of the installation, construction and
payment of Improvements and Utilities and the performance of this Agreement and for the warranty period
required in this Agreement as assurance and warranty for the proper installation and construction by the
Developer of the Improvements and Utilities. All security provided must specify that funds will be paid to
the City upon written demand from time to time by the City to the extent of default herein by the Developer
in the completion of construction, installation, completeness, fitness, payment and warranty of the
Improvements and /or for the performance of this Agreement. The amount of the security includes all of the
security requirements set forth in the preceding sections of this Agreement, and was calculated as follows:

This breakdown is for historical reference; it is not a restriction on the use of the security. The bank
shall be subject to the approval of the City Administrator. The Letter of Credit shall allow the City to draw
upon the instrument, in whole or in part, in order to complete construction of any or all of the Improvements
or to satisfy the claims of contractors or suppliers which have not been satisfied by Developer. The City
may draw down the security, upon ten (10) business days’ prior written notice to the Developer for any
violation of the terms of this Agreement. Amounts drawn shall not exceed the amounts necessary to cure to
the default. If the required Improvements are not completed at least thirty (30) days prior to the expiration
of the security, the City may also draw it down. If the security is drawn down, the proceeds shall be used to
cure the default. Upon receipt of proof satisfactory to the City that work has been completed to the quality as
required by the City, and that the Developer has taken all steps necessary to ensure that no liens will attach
to the plat, and financial obligations to the City have been satisfied, with City approval the security may be
reduced from time to time up to ninety percent (90%) of the financial obligations that have been satisfied.
Ten percent (10%) of the amounts certified by the Developer’s engineer for financial obligations that have
been satisfied shall be retained as security until all Improvements have been completed, all financial
obligations to the City satisfied, the required “as constructed” plans have been received by the City, a
warranty security is provided, and the public Improvements are accepted by the City Council. The City
standard specifications for Improvements, Utilities and street construction outline procedures for security
reductions.
18.
SUMMARY OF CASH REQUIREMENTS. The following is a summary of the
cash deposit under this Agreement which must be furnished to the City prior to the recording of the Final

Plat. All amounts are to be paid in USD. Developer is installing water, storm, and sanitary sewer
infrastructure so no payment for Trunk Fees is required. Fees must be paid as required by the agreement
prior to its finalization. Parkland dedication fees (in-lieu of land dedication) are required. Based on the
current formulas in Article III of the Unified Development Ordinance, the total parkland dedication fee is
determined to be $156,119.66 (1.79 acres required multiplied by an AFMV per acre of $87,217.63) or
$3,007.29 per unit ($156,119.66 / 52 units). Due to a 6.41 acre park going in approximate .20 miles
northwest of the site that will serve the lots in the development, parkland fees have been reduced to
$980.39 per unit.

The following is a summary of the cash deposit required under this Agreement which has already been
furnished to the City through the preliminary plat application:

The $8,000 escrow amount identified above will be held and all bills will be paid from said
escrow. If said fees are less than estimated, the City shall reimburse the Developer within thirty (30) days
of receipt of final invoices. If it appears that the actual costs incurred will exceed the escrow held,
Developer and City shall review the costs required to complete the project and Developer shall deposit
additional sums with the City. If escrow deposit to replenish the account is not made in a timely fashion,
the project will stop until such escrow, in an amount deemed necessary by the city, shall be receipted.
## 19. RESPONSIBILITY FOR COSTS.
A. Except as otherwise specified herein, the Developer shall pay all costs incurred by
it or the City in conjunction with the development of the legal, planning, engineering and inspection
expenses incurred in connection with approval and acceptance of the project, the preparation of this

Development Agreement, review of construction plans and documents, and all costs and expenses incurred
by the City in monitoring and inspecting development of the project, as well as review of record drawings
and updating City base maps.
B. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred resulting from project
approval and development. The Developer shall indemnify the City and its officers, employees, and agents
for all costs, damages, or expenses which the City may pay or incur in consequence of such claims,
including attorneys’ fees.
C. The Developer shall reimburse the City for reasonable costs incurred in the
enforcement of this Development Agreement, including engineering and attorneys’ fees.
D. The Developer shall pay in full all bills submitted to it by the City for obligations
incurred under this Development Agreement within thirty (30) days after receipt. If the bills are not paid on
time, the City may halt plat development and construction until the bills are paid in full. Bills not paid
within thirty (30) days shall accrue interest at the rate of twelve percent (12%) per year.
F. The Developer will pay a park dedication fee, as totaled in Section 18 of this
Agreement. As previously stated in Section 18 of this Agreement, this payment must be submitted to the
City prior to the recording of the Final Plat. No building permit will be issued until such payment is
received by the City. A Parkland Dedication fee will be required for all lots under subsequent phases.
Parkland Dedication Fee for subsequent phases will be pursuant to the most recent City Council adopted
fee schedule.
G. In addition to the charges and special assessments referred to herein, other charges
as required by City ordinance may be imposed such as, but not limited to, sewer availability charges
(“SAC”), water availability charges (“WAC”) and building permit fees. SAC and WAC fees shall be paid
by the Developer at the time a building permit is pulled for each unit in the development. The Developer
acknowledges that sewer and water access charges will be payable at then current rates at the time building
permits are pulled for construction.

H. The Developer agrees to reimburse the City for any costs incurred by the City in
the review of the final plat for this Development. The Developer is required to submit the final plan in
electronic format. The electronic format shall be in the form of a .dwg (AutoCAD file). The Developer
must also submit to the City one complete set of reproducible construction plans and plat on Mylar.
20. DEVELOPER’S DEFAULT. In the event of default by the Developer as to any of the
work to be performed by it hereunder, the City may, at its option, upon giving fourteen (14) days written
notice to the Developer citing such default, either 1) perform the work and the Developer shall promptly
reimburse the City for any expense incurred by the City, or 2) declare all of the unpaid amounts levied
pursuant to this Agreement, if any, due and payable in full, and may immediately commence legal action
against the Developer to collect the entire unpaid balance, including reasonable attorney’s fees and costs.
This Development Agreement is a license for the City to act, and it shall not be necessary for the City to
seek a Court order for permission to enter the land. When the City does any such work, the City may, in
addition to its other remedies, assess the cost in whole or in part. For this purpose, the Developer expressly
waives any procedural and substantive objections to the special assessments, including, but not limited to,
hearing requirements and any claim that the assessments exceed the benefit to the Property.
## 21. MISCELLANEOUS.
A. The Developer represents to the City that the project complies with all city, county,
state, and federal laws and regulations, including but not limited to, zoning ordinances, and environmental
regulations. If the City determines that the project does not comply, the City may, at its option, refuse to
allow construction in the project until the Developer does comply. Upon the City’s demand, the Developer
shall cease work until there is compliance.
B. Third parties shall have no recourse against the City or Developer under this
Development Agreement.
C. Breach of the terms of this Development Agreement by the Developer shall be
grounds for denial of building or other permits.

D. If any portion, section, subsection, sentence, clause, paragraph, or phrase of this
Development Agreement is for any reason held invalid or unenforceable, such decision shall not affect the
validity of the remaining portion of this Development Agreement.
E. The action or inaction of the City shall not constitute a waiver or amendment to the
provisions of this Development Agreement. To be binding, amendments or waivers shall be in writing,
signed by the parties and approved by written resolution of the City Council. The City’s failure to promptly
take legal action to enforce this Development Agreement shall not be a waiver or release.
F. This Development Agreement shall run with the land and will be recorded against
the title to the Property. The Developer covenants with the City, its successors, and assigns, that the
Developer is well seized in fee title of the Property described herein and/or has obtained consents to this
Development Agreement, in the form attached hereto, from all parties who have an interest in the Property;
that there are no unrecorded interests in the Property; and that the Developer will indemnify and hold the
City harmless for any breach of the foregoing covenants.
G. Each right, power or remedy herein conferred upon the City is cumulative and in
addition to every other right, power or remedy, express or implied, now or hereafter arising, available to
City, at law or in equity, or under any other agreement, and each and every right, power and remedy herein
set forth or otherwise so existing may be exercised from time to time as often and in such order as may be
deemed expedient by the City and shall not be a waiver of the right to exercise at any time thereafter any
other right, power or remedy.
H. The Developer may not assign this Development Agreement without the written
permission of the City Council. The Developer’s obligation hereunder shall continue in full force and effect
even if the Developer sells the entire Property or any part of it. City will not withhold its consent to
Developer assigning this Agreement to an entity controlled by Developer, where control means a greater
than fifty percent equity and voting interest if Developer provides reasonable evidence of such control. Any
assignee must assume all responsibilities under the Agreement. No assignment of this Agreement by
Developer shall release or relieve Developer from any obligations or liabilities under this Agreement.

I. The City hereby grants license for the Developer to obtain access to and from
said Property. Any such access shall receive all necessary permits and approvals and shall be removed at
the Developer’s expense at the time of construction of the public Improvements.
J. The Developer herby grants the City, its agents, employees, officers and
contractors a license to enter the Property to perform all work and/or inspections deemed appropriate by
the City during the development of the Property.
K. The construction, installation, materials and equipment used shall be in
accordance with the plans and specifications approved by the City Engineer. The Developer will cause
the contractors to furnish the City Engineer with a work schedule at least (10) days prior to
commencement of construction work of the Improvements. Grading and the use of power equipment
between the hours of seven (7) o’clock p.m. and seven (7) o’clock a.m. is prohibited.
L. The Developer shall secure and make available to the City at no cost to the City
all permanent or temporary easements necessary for the installation and maintenance of the
Improvements and Utilities as determined necessary by the City Engineer. All such easements requested
by the City shall be in writing in recordable form approved by the City, and recorded by the Developer
prior to construction. Copies of easements shall be provided to the City prior to construction and also
provided to the City with verification of recording.
M. Low maintenance monument signage must be installed at the main entrance to the
subdivision on 153rd Avenue SE. The sign and landscaping must be approved by the Zoning
Administrator and City Engineer. Maintenance of said monument signage is responsibility of the property
owner of Lot 1, Block 2 of Fossum Fields Third Addition. Said sign must be maintained in good repair in
perpetuity. Determination that the sign is not being maintained is at the discretion of the City. If the City
finds that maintenance is not occurring the City shall notify the property owner of their responsibilities to
maintain said signage. In the same event, the City will fix any issues, including but not limited to
replacement or materials, and removal of debris, that arise from lack of maintenance and will bill all costs
back to said property owner. If payment is not made to the City for all costs incurred by the City within

sixty (60) days of the date of the invoice, the amount will be assessed against the property and said
assessment will be recorded against title at Sherburne County. The Developer must provide the buyer of
Lot 1, Block 2 of Fossum Fields Third Addition a copy of Resolution 26-37, Resolution 26-40, and the
executed Development Agreement highlighting responsibilities of maintaining said signage.
N. All homes to be built must be of varied styles including, but not limited to, split-level
homes. All homes to be built must include architectural features, including, but not limited to, porches
and varied exterior materials, including, but not limited to, stone, brick, and shakes.
O. All final building garage elevations must be at least 18 inches above the finished street
grades in front of each lot unless the lot elevation is significantly lower than the street grade AND
drainage for the lot can be accomplished in another fashion which is acceptable to the City Engineer and
the building official.
P. Fences constructed on Lots 12 through Lot 18, of Block 2 of Fossum Fields Third
Addition must remain outside of the drainage and utilities easements for the infiltration basin adjacent to
153rd Ave SE and 127th Street SE unless authorized by City Staff and the City Council.
Q. All street lighting must be fully shielded to minimize light pollution.
R. All mailbox locations must be installed to required local, state, and federal regulations
and must be approved by the local Postmaster and City of Becker Public Works Department.
S. Outlot A, as shown on the Plat, shall be dedicated to the City of Becker for drainage and
stormwater management purposes.
T. To the greatest extent possible, the Developer shall encourage all trucks delivering
supplies, including but not limited to soil and heavy construction equipment, to access the site via
appropriate routes as determined by the City Engineer.
22. INSURANCE. The Developer agrees to take out and maintain or cause to be taken out
and maintained until after the City has accepted the public Improvements, public liability and property
damage insurance covering personal injury, including death, and claims for property damage which may

arise out of Developer’s work or the work of its contractors or subcontractors. Limits for bodily injury
and death shall be no less than $1,500,000 for each occurrence; limits for property damage shall be not
less than $500,000 for each occurrence; or a combination single limit policy of $1,000,000 or more. The
City and it’s agents must be named as an additional insured on the policy. The Developer shall file with
the City a certificate evidencing coverage prior to the City signing any future approvals. The certificate
shall provide that the City must be given thirty (30) days advance written notice of the cancellation of the
insurance.

The Becker City Council met in regular session at 5:00 p.m. on Tuesday, May 19 , 2026, at 12060
Sherburne Avenue, Becker. Present-Councilmembers: Mayor Mark Kolbinger, Rick Hendrickson, Robin
Dingmann, Becky Olmscheid, Mike Doering. Guests were in attendance.
1. Mayor Kolbinger called the meeting to order at 5:00 p.m.
2. The Pledge of Allegiance was recited.
3. Changes to agenda: The Consent Agenda has been revised. Parks & Rec Commission is
removed from Item 6.
4. Motion by Dingmann, second by Hendrickson to approve the agenda for May 19,
2026, as revised. All in favor, motion carried.
5. Guests and Open Forum: Nicole Hubbard approached the podium to address roadway safety
concerns at 150
th
Avenue and 122
nd
St SE. This section of roadway is jointly governed by Becker
Township and the city. Hubbard spoke at the township board meeting last night. Vehicles use
this section of roadway for a cut across and go at very fast speeds. She was out walking with
her daughter and had to get in the ditch to avoid being hit by a vehicle going fast and
fishtailing. She has spoken to Becker Police and Sherburne County Sheriff’s departments. The
speed limit is 55 MPH. Her suggestion was to make this a dead-end road so only local traffic will
use. Jeff Vogt, Bradden Parks and Josh Vlieger also spoke on the dangers of the roadway speed
and doing a dead-end or something before there is an accident.
## 6. Committee Reports, Presentation, Awards
The Personnel Committee met May 5. Chief Lindbloom provided an update on the sergeant
position. An out of state travel request was approved for Mark Ebensteiner and an update was
## provided on MN Paid Leave. The
EDA met May 11. There is interest in the 5.75 acres owned by
the city at the industrial park. There are 19 homes for sale, 17 pending sales and 12 contingent
sales. The
Public Works Committee had discussion on the crosswalk at Banks Street and 3
rd
## St
N. No action was taken. There also was discussion on the crosswalk by Kolbinger Park. That
one will stay as is. Parking on 2
nd
St. can get tricky with mailboxes and driveways. One
driveway may need to be widened. T ests have been done on Well 7 & 8 and two at the golf
course. One was acceptable at the golf course but is not a viable spot. The
## Police Management
## Committee
met last Friday. The sergeant position was reviewed. Staffing continues to be tight
with officers out on leave. Shifts are getting covered but time off is being denied. In the past,
part-time officers were easy to hire as there was so much competition for full-time positions.
That is no longer the case. The department will not be bidding on the SRO position at Becker
Schools since staffing is so tight now. The purchase of the amplifier is successful as it is working
well and the squad car was discussed. The
## Xcel Advisory Board met last Friday. Updates from
all entities were presented. The
Fire Board met last night. The bills were reviewed and the
overall budget looks good. The audit report needs to be submitted by June 30. A special
meeting may take place in June if the audit is not completed by the June regular meeting. The
Joint Budget meeting is in July. The fitness equipment has been upgraded. The roof repairs
were only $1000 which is much less than expected. In June, Xcel Energy will be doing some

battery training for area departments before the project is installed at their facility. LPI has
donated funds for a compression machine. The HVAC project looks to be coming in under
budget and the grass rig should arrive any day. The
Planning Commission met to conduct two
public hearings for Edgewood Village. The
## LPI Advisory Board met last Thursday. An update
was provided on the last shutdown to finish the upgrades.
## 7. Board, Committee and Consultant Reports
A. 2027 Squad Care Purchase – Chief Lindbloom explained the process for ordering
squad cars. Last year when the order was placed, the unit did not make the production
line and the order was cancelled. That unit will be ordered, and production started the
end of the month. Another squad car will be ordered but the city can pick the production
time so will schedule the second unit to be delivered in the 2027 budget year. Motion
by Doering, second by Olmscheid to adopt Resolution 26-44 allowing
purchase of a 2027 police squad car and allowing Chief Lindbloom to enter
into an agreement with Tenvoorde Ford of St. Cloud for the purchase. All in
favor, motion carried.
B. 1st Quarter Financials – Mark Ebensteiner presented the financials for the first
quarter. All funds are right on target at 25% or less. There has not been any revenue in
the general fund as property tax settlements are not received till May/June. No action
was needed.
8. Consent Agenda: Greg Lerud presented the following revised consent agenda:
## a. Hiring Termination Report
b. Payment of the Bills - Authorize the Tuesday, May 19, 2026 payment of claims as
presented. The claims listing has been provided to the city council as a separate
document and is available upon request for public view at city hall. The total claims are
$439,889.18.

Motion by Doering, second by Dingmann to approve the revised consent
agenda as presented and adopt the resolutions, therein. All in favor, motion
carried.
Mayor Kolbinger stated the items presented during Open Forum do not have formal action
taken the same evening. The subject of the roadway is moved to the Public Works Committee
with conversations to take place with the township.
9. Motion by Hendrickson, second by Doering to adjourn the meeting at 5:44 p.m. All in
favor, motion carried.

The Executive Session was called to order at 5:49 p.m.
Alison Miller and Amelia Bakalars from Sherburne County Public Health presented statistics on
the county and city of Becker in the areas that public health covers. Public health emphasis is
on prevention and health promotion for a community whereas health care diagnoses, treats and
cares for an individual. The top three priorities for public health in the next three years is
Community connection, stability and access. There was a breakdown of poverty rates and ages
in the community. There is an increase in households over 65 years of age in Becker. Public
health is part of the Statewide Health Improvement Partnership (SHIP) and they do provide
funding for healthy activities that focus on walking and biking and healthier food. They also
touted the new Child Care Finder available on the county’s website. This allows real-time
numbers for all childcares in the county showing what openings each has.
Greg Lerud explained the Hwy 10/Co. Rd 11 Grant Application with a cost share option with
Sherburne County. There is a federal grant program, “Consolidated Rail Infrastructure and
Safety Improvements Program” that Sherburne County has been successful in securing funding.
The county approached Becker to see if the city would like to participate in the next funding
round. The funding request would be for two intersections that are currently being studied –
one in Becker and one in the county. The funds for Bolton Menk to complete the application can
come from the road improvement fund. Council felt it was a worthy share. Lerud will have the
agreements at a future council meeting.
Rick Hendrickson will not be at the next council meeting.
Recycle Day went well. They may look into reducing the hours down to a two-hour window.
More to come on that topic.

Minutes of April 23, 2026
The Budget & Finance Committee held a meeting starting at 5:00 pm on April 23, 2026. The meeting was completed electronically
via Teams. Members Rick Hendrickson, Robin Dingmann, Greg Lerud, Mark Ebensteiner and Lorrie Franz were in attendance. Justin
Nilson attended as a guest to present the 2025 draft audit report.
The minutes from March 26, 2026, meeting were reviewed and approved.
Discussion items included:
- 2025 Audit Presentation – Justin Nilson with Abdo presented the 2025 audit report remotely via Teams. He had a
PowerPoint presentation and highlighted the clean unmodified audit opinion, no audit findings, one legal compliance
finding and touched on the financial results of both governmental and business-type activities. Justin will present the
audit report to the full city council at the May 5, 2026 council meeting.
- Budget Calendar Review – The group reviewed the budget calendar and had a short discussion on some of the key
calendar events. The only special additional meeting will be planned for July 14
th
from 6:00-7:30pm.
March 2026 financials were examined. Financials are tracking within budget and expectations. March General Fund revenues are at
4.27% of budget and expenditures are at 19.1%, 25% through the year. Some departmental expenditures are trending ahead as
annual dues and fees have been paid in the first quarter.
The EDA fund expenditures are at 20%. Revenues are at 4%. With the Rockefeller Grant wrapped up in 2025, activity within the fund
continues to now be more consistent.
Water and Sewer utility funds were discussed and are tracking within expectations through the first quarter of the year. For the
Water fund revenues and expenses are approx. 53%/18%, respectively of budget. A portion of the PFAS settlement, $356k, was
received in March, resulting in the revenue budget variance. The group discussed breaking out the PFAS settlement onto a separate
line for future analytics.
The Domestic Wastewater fund revenues and expenses are approx. 21%/20%, respectively, of budget, and Industrial Wastewater
revenues and expenses are approx. 24%/18%, respectively.
Golf operations were discussed with revenues at 18% and total expenditure at 17%, three months into the year. Golf is reporting
$59k of net income.
The past due utility balance greater than 60 days old was $23,600. The group also discussed the upcoming water shut-off schedule.

## Agenda:
1. The posting of the sergeant position was discussed. Chief Lindbloom went over the hiring
process and provided committee members with the job posting template. HR is currently waiting
for the company working on the wage study to review the job description and provide insight
into where this position falls in our salary structure. It was decided that if there were an external
candidate from another Sherburne County agency, we would not have one of their supervisors on
the interview panel. Police committee members recommended bringing this to council the first
meeting in June pending a response back on the wages.
2. Chief Lindbloom updated on current staffing at the PD. There are currently two officers out on
Minnesota Paid Leave. One will likely return shortly and the other will be out until mid-June at
best.
3. At the Request of Councilwoman Olmscheid, Chief Lindbloom provided an update on part-
time officers. With the current job market being saturated for jobs the department only has part-
time officers with full-time employment at other jobs. This has limited the availability of part-
time officers to day shifts on weekends and occasional afternoon coverage. With the staffing
levels right now, this has resulted in an increase in Chief Lindbloom covering shifts, overtime
use and time off denials. Committee members proposed having a minimum percentage of hours
that part-time officers have to cover each month which Chief Lindbloom will work to develop.
Additionally, committee members asked Chief Lindbloom to provide a report showing what the
costs of the 3 part-time officers are compared to one full-time officer.
4. Chief Lindbloom provided an update on the EOP process. All City Council members received
some Emergency Support Function documents to review and provide input on. Chief Lindbloom
explained that there will be additional work in the future to ensure all personnel involved in the
EOC are trained and that there will be annual training exercises related to the EOP.
5. The new scheduling system is getting closer to being implemented. Staff have been working
closely with the vendor to fine tune how the system interacts with our current pay codes in the
payroll system.
6. This year marks the end of the contract between the Becker School District and the Sherburne
County Sheriff’s Officer for providing a School Resource Officer. In 2023 the Becker Police
Department had drafted a proposal to the district to provide a school resource officer. After
review of current staffing and the quick turn around to provide a proposal the Becker Police
Department will not be making a proposal to the district to provide a school resource officer.
7. Staff at the PD are looking into software to make the FTO program more efficient and
available digitally. Currently, the department uses a large paper binder to track FTO progress.
This makes it difficult to keep track of how recruits perform, strengths, weaknesses and overall
progress, especially between multiple officers. Chief Lindbloom got a demo of a program from
Lexipol however there was a high annual cost that would not make it worth the cost, especially
in years when we do not hire or only hire one. In 2025 the PD worked with their current records
management vendor to use a new FTO module, however it had problems and the department had
to abandon the project. Chief received a proposal from the RMS vendor to custom build the FTO
module for the department for a fee. Committee members supported doing that if the vendor
would defer payment until the project was complete and it could be proven that it met our
standards. Chief Lindbloom will follow up.
8. The new Bi-Directional Amplifier has been turned on. This project added 4 antennas to the PD
to amplify radio signal so there are no dead spots. Officers are monitoring to ensure it is working
properly. We were able to save about $1,500 on this project because our current UPS in the
server room could accommodate the needs of the amplifier.
9. A squad car purchase was discussed. In years past the department had ordered the following
year squad between August and October and it was usually received about 6 months later. After
our 2026 squad purchase was cancelled, we examined other options. Ford has a new ordering
system that will allow agencies to request a build week. This will allow us to order sooner and
request a later build date, which will hopefully help to guarantee our squad is built. Chief
proposed that we order our 2027 squad at the end of May when the order window opens and
designate a build date of late December 2026 or early January 2027. This would not impact the
CIP as the payment for the squad would not be made until fiscal year 2027. There would be a
change to the CIP for 2031 as the 2026 and 2027 squads will both hit the road about the same
time. We would propose moving to purchasing two squads in 2031 and then continue that
rotation schedule. Committee recommended to bring to council.
10. The new safe-exchange zone has been established at City Hall. There are two parking spots
on the northwest side of the City Hall lot that have signs designating the safe exchange zone
parking area. This area is monitored by camera and is well lit for evening use. Huge thank you to
the Safety Committee for making this project happen.
11. Chief Lindbloom discussed some of the upcoming community engagement events that the
department will be participating in.
12. Current statistics were provided. Calls for service are down, mostly with pro-active calls for
service.
