We are in the process of developing the new Sandhill Park on the east side of town. We started with a
sliding hill and parking lot in 2025 and are looking to add more features in 2026 and 2027. During the
pond lining project at Pebble Creek this year we hauled the excess pond material to the park location
with the intention of better preparing the site for play equipment, a pavilion and open green space. The
extra material will help level the entire area of the park.
With the approval of the adjacent road improvements at the council meeting on August 5
th
, we will have
a contractor prepared to do the road work pending approval from the township on the 17
th
. To take
advantage of the contractor already being mobilized, I asked if he would be interested in working the
park property to get the base grade set for the proposed improvements. He is willing to do the work for
us on a time and material basis. He anticipates it taking roughly 6-8 hours. We are not importing
anything else to the site, so no trucking will be involved, and our Public Works staff will work on final
grading of the site prior to any other work being done.
## Board Commission / Committee Action:
The site prep was discussed with the Park & Rec Committee previously when they did a site visit. They
will be discussing this again at their August 17
th
meeting and will give a recommendation at that
meeting. Their recommendation will be shared with the full council on Tuesday when this is presented
for consideration.
## Budgetary / Fiscal Impact:
The anticipated cost is relatively low, but I am asking approval for the total spend not to exceed $7,500.
While this is not specifically budgeted for 2026, there is sufficient money dedicated to play equipment
for the park and funds identified for irrigation/turf establishment for Carl E Johnson Park that will not be
used as we are doing that work from the operating budget. With that said, we have sufficient funds in
Parks CIP to cover this cost.

$7,500 would be appreciated.

The Becker Community Center Gym has 4 exit doors on the north side of the building leading out to
what was once a concrete patio. The patio was cracked, weeds growing through it, and was removed.
Grass was planted in its place. These doors were originally placed with the intention of being able to
host weddings on the patio, and in the gym. The BCC has not hosted weddings in many years.
We are proposing to remove the two center doors in the row of four, and replace them with windows.
We will keep the two doors on the ends of the row as emergency exits. When the gym curtain is down,
this will provide a safe exit on both sides of the curtain.
There are also leaking windows that need to be replaced in this project.
The 2026 CIP has budgeted $25,000 for this project. To replace the doors, and leaking windows the
expense is $8,227.78 with Heartland Glass.

City staff have been working with a developer for a development proposal for the land adjacent to the
planned LuAnn Drive street and utility project. The developers have changed for this project, with one
of the previous developers assuming responsibility for the entire project. The city previously submitted a
TIF application, but the scope of the project has changed, and the request for assistance is just for three
initial apartment buildings. The remainder of the development is planned for one additional apartment
building and a yet to be determined housing component.
Northland Securities, Inc. serves as the city’s public finance consultant on an as-needed basis for various
financial matters. Because the city does not have an existing contract with Northland, they have
provided the attached professional services agreement that would allow them to complete the TIF
analysis.
Because there was a previous TIF application that was received, the cost to the developer for this review
is less than normal at a not-to-exceed price of $9,975. If the Council decides to proceed with
establishing a TIF district for the project, staff will then work with Northland and the City Attorney to
complete the remaining tasks, including collecting any additional fees required from the developer.

## PROFESSIONAL SERVICES AGREEMENT
## BY AND BETWEEN
## THE CITY OF BECKER, MINNESOTA
## AND
## NORTHLAND SECURITIES, INC.
## TAX INCREMENT FINANCING (HOUSING) DISTRICT
This Agreement made and entered into by and between the City of Becker, Minnesota (hereinafter the
“City’), and Northland Securities, Inc., of Minneapolis, Minnesota (hereinafter "NSI").
## WITNESSETH
WHEREAS, the City desires to use the services of NSI for financial planning assistance related to the
establishment of a Tax Increment Financing (Housing) District to facilitate the development and
construction of an apartment project (the “TIF District”).
WHEREAS, the services to be provided by NSI are intended solely for financial planning and NSI is
not providing advice on the timing, terms, structure or similar matters related to a specific bond issue.
WHEREAS, NSI desires to provide services to the City as hereinafter described.
NOW, THEREFORE, it is agreed by and between the parties as follows:
## SERVICES TO BE PROVIDED BY NSI
The scope of work NSI will undertake is the process to establish the TIF District. Legal services to
review the Tax Increment Financing Plan for the TIF District (the “TIF Plan”) and to prepare written
agreement with the applicant requesting tax increment financing assistance (the “Developer”), among
other legal documents, are not provided by NSI and are not subject to this agreement.
NSI will provide the following services:
1. Prepare proposed calendar with timeline of events for establishment of the TIF District.
2. Collect data or documents for the TIF District, including:
• Parcel identification numbers for all parcels to be within the TIF District
• Taxable market value and tax capacity value for parcels within the TIF District
• Current property tax rates for all taxing jurisdictions
• Map showing boundaries of the Project Area and the TIF District
3. Evaluate and advise the City on the statutory requirements for consideration of the
establishment of the TIF District.
4. Collect data about the project within the TIF District, including:
• Type, size, value, and timing of the development within the TIF District
• Estimated project costs to be paid from tax increments from the TIF District
5. Review basis for findings for establishing the TIF District, including:
• Statutory criteria for the TIF District
• Developer’s justification in the application for tax increment financing assistance for
the use of tax increments to assist the development
6. Complete financial evaluation and analysis of the sources and uses of funds for the
construction of the development and development pro forma as provided by the Developer.

7. Prepare and distribute a memorandum with the conclusions of the financial evaluation of the
Developer’s pro forma and the need for financial assistance.
8. Determine basic understanding of key criteria for the process including:
• Boundaries of the Project Area, including amendment to boundaries of the Project
Area, if needed
• Specific development objectives to address in the planning documents
9. Obtain any additional data not collected in item 1, including:
• Building permits issued for parcels in the TIF District over the past 18 months.
• Comprehensive plan for the City
10. Assist the City with preparation of the notice of hearing and compliance with statutory
requirements for mailing and publication.
11. Provide county commissioner with written notice of the proposed establishment of the TIF
District.
12. Provide the attorney to the City with the terms of assistance and other financial terms for the
attorney to include in the development agreement with the Developer.
13. Provide comments to the City and the attorney to the City on proposed language in the
development agreement with the Developer.
14. Prepare the Development Plan for the Project Area and the TIF Plan for the TIF District
(together, the “Plan”).
15. Distribute the Plan with letter of explanation, including notice of public hearing for
establishment of the TIF District, and other supporting information to county and school district.
16. Assist the attorney to the City with the drafting of the resolutions approving the modification to
the Project Area and the establishment of the TIF District, among other related documents that
may need to be drafted.
17. Assist the attorney to the City with the preparation and distribution of the resolution for planning
commission findings.
18. Assist with preparation of documents to be included in the meeting agenda packet for the City
Council of the City of Duluth for the public hearing, including resolution to adopt the TIF Plan.
19. Prepare (electronic) transcript of documents.
20. Submit, on behalf of the City, a request to the county auditor for the certification of the TIF
District.
21. Submit the TIF Plan, along wither other forms as required, to the Minnesota Department of
Revenue and the Office of the Minnesota State Auditor.
## COMPENSATION
The budget for undertaking the tasks in this agreement is an amount not to exceed $9,975. The amount
is based on the estimated number of hours required to complete these tasks at an hourly billing rate
of $285 per hour. NSI will bill monthly for actual services performed.
The City may at its discretion authorize NSI to undertake additional tasks, including meeting
attendance, beyond the tasks listed above. Additional planning services will be billed monthly at a rate
of $285 per hour.
Invoices will detail the work performed, requested compensation for the period, and show amounts
previously billed.

## ASSIGINED NORTHLAND EMPLOYEES
The NSI employee responsible for providing services pursuant to this agreement and for the
services performed is Jessica Green, Managing Director.
## SUCCESSORS OR ASSIGNS
The terms and provisions of this Agreement are binding upon and inure to the benefit of the City and
NSI and their successors or assigns.
## DISCLAIMER
In performing service under this agreement, NSI is relying on the accuracy of information provided by
the Developer and THE CITY and the services provided by NSI are based on current state law. The
parties agree that the Minnesota property tax system and other laws may change and may affect the
accuracy and validity of services provided by NSI. NSI will perform its work using the best available
information. THE CITY recognizes and accepts that future property values, tax levies and tax rates
may vary from the assumptions used by NSI and such changes may affect the work product produced
and provided by NSI.
NSI recognizes and accepts that the requirements of Minn. Stat. Sec. 13.05, Subd. 11 apply to this
Agreement. All of the data created, collected, received, stored, used, maintained, or disseminated by
NSI in performing pursuant to this Agreement is subject to the requirements of the Minnesota Data
Practices Act and NSI must comply with those requirements as if it were a government entity.
## TERM OF THIS AGREEMENT
This Agreement may be terminated by thirty (30) days written notice by either the City or NSI. In the
event of early termination by the City, NSI shall provide the City with an itemized hourly statement of
services already provided. All billable hours by NSI shall be billed at the stated hourly rates should
early termination occur.

The city of Becker has used the law firm, Barna Guzy & Steffen as the city attorney for a number of
years. Scott Lepak, who serves as the lead city attorney from the firm, announced that he is retiring at
the end of the year. He said that based on that decision, as well as some internal changes at the firm,
that the firm has decided to leave the municipal and public sector area. There is an option to retain
their real estate attorneys under a separate contract for that specific work.
Staff recommends that the city approve and distribute an RFP to solicit proposals from law firms to
provide civil work for the city beginning January 1, 2027. The advance notice from Mr. Lepak will allow
the city the time necessary to select a firm and to ensure a thorough handoff from BGS to the new firm.
To that end, staff prepared the attached RFP for council approval. The council can make any changes it
wishes to the RFP and once approved it will be posted where interested firms can view it.
The RFP calls for an interview of finalist firms, and staff will rely on the council’s decision regarding who
and how that interview will be held.

## Request for Proposals
## Civil Attorney Legal Services
## REQUEST FOR PROPOSALS FOR
## CIVIL ATTORNEY LEGAL SERVICES
The city of Becker is soliciting proposals for civil attorney services from qualified law firms.
Preference will be given to those submittals demonstrating experience in the area of municipal
law. The successful applicant shall possess sufficient resources to ensure that the demands for
the city’s legal needs will be met on a timely basis. The relationship will be on a consulting or
contractual basis. The city plans to enter into an initial two-year contract with the selected firm
beginning January 2027, with the option to continue the relationship at the mutual agreement of
the parties.
Included in this RFP is a more detailed description of the services to be provided, an outline of
the proposed requirements, and a description of the proposal review process.
In order to ensure a fair review and selection process, firms submitting proposals are specifically
requested not to make other contacts with city staff or City Council regarding these proposals.
Failure to comply with this request will result in disqualification of the proposer. Proposals are
due 4:00, September 21, 2027. Questions regarding the process should be directed to: Greg

glerud@beckermn.gov. If questions are submitted prior to the submission deadline, responses
will be shared with all interested proposers who the city is aware have requested an RFP.
## About Becker
Becker is a full services city of approximately 5,250 people located in Sherburne County,
approximately 40 miles from Minneapolis and 20 miles from St. Cloud. The city is a Plan A
statutory city governed by a city council made up of a Mayor and four Council Members all
elected at large and serve four-year staggered terms. The City Administrator reports to the City
Council and is responsible for managing the operations of the city. Council meetings are held on
the first and third Tuesdays of each month.
The city employes approximately 50 full-time/part-time benefitted employees and approximately
225 part time/seasonal employees. Police protection is provided by eight licensed peace officers,
and fire protection is provided by the Becker Fire Department, which is a Joint Powers Agency
operated by the City of Becker and Becker Township. The Becker Fire Department is a separate
organization not covered by this proposal. The city owns and operates a 27-hole golf course,
community center, and provides water and sewer services to its residents.
The total 2026 budget for the city is approximately $20M, with a General fund budget of
$7,578,000.
The city has nine committees/commissions; including, Becker Fire Department Joint Power Fire
## Board, Joint Planning Board with Becker Township, Planning Commission, Economic
Development Commission, Budget and Finance committee, Personnel committee, Parks and Rec
Committee, Golf committee, Public Works Committee.
Criminal prosecution for the city is provided by Sherburne County, and the city retains a bond
counsel for financial related matters.
## SECTION ONE: SCOPE OF GENERAL LEGAL SERVICES
The law firm/attorney(s) are required to be knowledgeable in a variety of legal areas, including
but not limited to:
• General municipal laws
• General state and federal laws relating to municipal government
• Zoning, housing, annexation, subdivision and land use law
• Government employment law
• Economic development activities including development, redevelopment, enforcement,
and property/real estate law
• Ordinance and resolution development and interpretation
## • Government Data Practices
## • City Charter and City Code issues
• Contract law
• Environmental law
• Municipal leases
## • Eminent Domain
• Trial activity
## CIVIL SERVICES TO BE PROVIDED
Except as specifically limited below, the services and qualifications that are required by the city
for civil law services covered the successful proposer. This is not necessarily an exhaustive list,
and proposers shall be prepared to provide all legal services to the City.
• Attend City Council meetings, or meetings of the boards or commissions of the City as
requested by the City Administrator.
• Meetings and/or telephone conversations with and advising Mayor, Council Members,
City Administrator, Department Heads and other staff on general legal matters.
• Research and submission of legal opinions on municipal or other legal matters requested
by City staff or City Administrator; availability to answer staff questions by telephone.
• Legal consultation and general support for Mayor, Council Members, City Administrator,
Department Managers and other staff on general legal matters.
• Review of municipal contracts, including contracts for public improvements,
developments, subdivisions, joint powers agreements, construction, purchase of
equipment, and the like for content, form, legality and execution as requested.
• Examine and advise regarding the legality of all proceedings and actions of the City
Council and other boards or commissions.
• Render written opinions on law when requested, including interpretation of statutes,
ordinances, rules and regulations.
• Review of ordinances, ordinance amendments, resolutions, developer agreements and
contracts, subdivision agreements and correspondence as requested. Draft such
documents as requested by the City Administrator.
• Review bonds, deeds, securities and insurance requirements required by or for City
contracts or activities.
• Review data requests and related documents and advise staff regarding release and
redactions.
• Provide legal advice to City Council, Commissions and staff regarding zoning code
matters.
• Represent the City in matters related to the enforcement of city building, subdivision,
maintenance and zoning codes.
• Represent the City in litigation on zoning matters; i.e. rezoning, variances, special
permits, subdivisions.
• Review acquisition requirements with appropriate departments, evaluate any special legal
or cost problems, develop acquisition timetables, make preliminary cost estimates and
obtain or develop proper legal descriptions.
• Examine title to each parcel as requested by the City Administrator.
• Prepare documents necessary for land purchases and/or sales.
• Where no insurance coverage is provided, make appropriate evaluation of claims for
legality, investigate facts, and make recommendations to the City Council.
• Defend in court all litigation where no insurance coverage is available. This includes but
is not limited to: (1) condemnation; (2) zoning and land use regulation matters; (3)
permits and administrative actions; (4) administrative citations; (5) code enforcement
issues; and a ssist in resolving claims not resulting in litigation; (6) investigate and
evaluate all claims by the City against others and recommend appropriate course of
action, including, but not limited to: code enforcement issues and administrative citations.
• Attempt collection of all proper claims including litigation where necessary and
authorized by the City.
• Provide such services as requested by the City regarding contractual dealings with
Federal, State, County, Township, Municipal, and Special Districts by the City, including
Joint Powers Act Public Improvements.
• Handle disputes between the City and other governmental units, including litigation.

Costs to prepare the RFP are solely the responsibility of the proposer, and the city will not
reimburse any expenses. Information provided in this proposal shall adequately demonstrate the
firm’s capability, experience, and capacity to provide the services identified in Section One.
Title Page - Show the RFP subject: Provision of Civil Attorney Legal Services, the name of the
respondent's firm, address, telephone number, e-mail, name of contact person, and the date.
## General Information -
Provide a brief background history and description of the firm, and number of attorneys
employed. An organizational chart or description of office organization would be helpful.
Designate the primary contact and identify those who would be working in more specialized
areas. Describe the current principal responsibilities for the individual designated as lead
attorney. Describe how the firm would structure the working relationship between the City
Attorney and the City Council, City Administrator and other staff members.
Describe the standard time frames for response by the City Attorney to direction and/or inquiry
from City Council or City Administrator.
Describe the systems or mechanisms that would be established for monthly reporting of the
status of projects, requests, and litigation.
Include a current resume for each attorney who will be primarily assigned to City of Little Falls.
This information should include relevant academic training and degrees, description of prior
experience in law areas described in the scope of services, number of years with the firm, areas
of responsibility with the firm, and other background or experience which may be helpful in
evaluating your proposal.
Provide information as to how many attorneys are knowledgeable about municipal law and
related fields as described in the scope of services.
Indicate the location of the primary office and attorneys assigned to service this account. Provide
the address, phone number(s), e-mail address of the firm.
Provide an assessment of the availability of the attorney and other professional staff to be
assigned to a contract with the City of Little Falls. This includes availability of back-up attorneys
in case of illness, turnover, or other loss of personnel.
Provide a statement of how the workload of the City of Becker would be accommodated and
what kind of priority it would be given. Be sure to address items outlined in the scope of services
section. The proposal should expand upon each item and set forth the firm's approach/ability to
carry out each activity. Include a description of the proposed allocation of work between the
attorney(s) and support personnel identified (i.e. who will be the lead attorney and what work
will be handled by junior partners, associates, or paralegals).
If the firm or any of the attorneys employed by the firm have ever been sued by cities or other
clients for malpractice, been the subject of complaints filed with the State Bar, or had discipline
imposed by the State Bar, please provide information about the nature of the incident, the dates
of when the matter began and was concluded, and the results of the situation.
Describe malpractice insurance coverage: carrier, limits, and exemptions and provide a copy of
Malpractice/Liability Insurance Certificate in a minimum amount of $2,000,000.
Specialized Issues - Any areas of specialty that may relate to municipal law may be outlined in
this section.
References - Provide a reference list of three (3) recent (within five years) municipal clients. If
municipal clients are not available, other major clients may be submitted. Particular attention
will be given to municipal client references. Please provide contact information including,

## SECTION THREE: SELECTION PROCESS/PROPOSAL EVALUATION
## AND CONTRACT AWARD
The City intends to award a contract to the respondent evaluated to be best qualified to perform
the work in Section One for the City, based on the extent and quality of the firm's resources, cost,
communication and presentation skills, compatibility and quality and extent of municipal
representation experience. Proposals received after the deadline will not be considered. Other
performance factors may also be considered. Based upon review of the submitted proposals,
firm(s) may be asked to interview with a Selection Committee.
## The Selection Committee will
recommend to the City Council a firm to be retained.
• The city of Becker reserves the right to reject any and all proposals, to waive
irregularities and informalities, to request additional information from any or all
respondents, and further reserves the right to select the proposal which furthers the best
interest of the city.
• The approval of the firm selected and the contract award will be made by the City
Council.
• The city reserves the right to negotiate the final terms and conditions of the contract to be
executed. Should the city and a consultant be unable to mutually agree upon the entire
contract, the city reserves the right to discontinue negotiations, select another consultant
or reject any or all of the statements of the proposal.
• Once a contract is awarded, the term of contract duration shall be subject to ongoing
review and evaluation by the City Council and City Administrator.

## City Council Regular Meeting of August 5, 2026
The Becker City Council met in regular session at 5:00 p.m. on Wednesday, August 5, 2026, at 12060
Sherburne Avenue, Becker. Present-Councilmembers: Mayor Mark Kolbinger, Robin Dingmann, Rick
Hendrickson, Mike Doering, Becky Olmscheid. Guests were in attendance.
1. Mayor Kolbinger called the meeting to order at 5:00 p.m.
2. The Pledge of Allegiance was recited.
3. Changes to agenda: Item 8B has been added and the Consent Agenda is revised.
4. Motion by Dingmann, second by Doering to approve the agenda for August 5, 2026,
as amended. All in favor, motion carried.
5. Guests and Open Forum: Shane Zahrt from the Coalition of Greater Minnesota Cities (CGMC)
provided a PowerPoint presentation to update council on the work of CGMC. He provided a
legislative recap with bonding and housing being a focus. The elections this year will have an
impact on the next session.
## 6. Committee Reports, Presentation, Awards
The Budget and Finance Committee met Ju ly 23 . The financial numbers were reviewed thru
June 30. They should be at 50% or less. Expenses in the General are at 46.6% of the budget.
Golf revenue is at 57% with expenditures at 47%. Past due utilities are at $10,000 which is low.
BCC memberships are over 1,000!! The
Planning Commission met for discussion on Fossum
Fields which is on tonight’s agenda. The
Joint Planning Board met on July 28 . They looked at
two developments in the township. One was platted and the other pulled from consideration
due to title issues.
## 7. Board, Committee and Consultant Reports
A. 122nd Street Road Improvements –Phil Knutson provided the background on how a
resident approached the city council in May for something to change on 122nd St. This
is a shared road with the township. After many meetings with the township and traffic
engineers, it was determined the best course of action was to create a cul-de -sac and
stop through traffic. The city will pay for the entire project with an agreement that the
township will pay 50%. The entire amount is $21,755 with the funds coming from the
2026 Street Project. That project came in lower than budgeted. Motion by Doering,
second by Olmscheid to adopt Resolution 26-70 approving cost share for the
Road Improvements on 122

Street. All in favor, motion carried.
## 8. Administrator and Staff Reports
A. Northland Securities TIF Assistance Professional Services Agreement – Jacob
Sanders presented the request for a developer to have TIF Assistance to complete a 56 -
unit apartment project. Northland Securities will complete a TIF analysis before more
discussion takes place on the use of TIF for this development. Motion by Dingmann,
second by Hendrickson to adopt Resolution 26-69 approving the professional

services agreement with Northland Securities, Inc for TIF analysis assistance.
All in favor, motion carried.
B. Lift Station #16 Pump Replacement-Chris Lisson explained the location of the lift
station (intersection of Hillcrest Court and County Road 24). The station has two pumps
that were replaced in 2019. The less expensive model was chosen but they could not be
rebuilt. The projected life was 12 years. One of the pumps has failed. Staff would like to
replace both pumps and keep the working one in inventory for backup. Funds will come
from the Domestic Wastewater CIP fund. Motion by Doering, second by Olmscheid
to adopt Resolution 26-72 approving the pump replacement for Lift Station
#16 as presented for a price not to exceed $11,400. All in favor, motion
carried.
9. Consent Agenda: Greg Lerud presented the following revised consent agenda:

h. Partial Pay Request No. 1: Capital Paving for 2026 Edgewood Street Improvements. The
construction contract amount is $2,086,466.38. The partial pay request is in the amount
of $461,946.65 leaving a construction contract balance of $1,624,519.73.
Motion by Doering, second by Hendrickson to approve the consent agenda as
presented and adopt the resolution, therein. All in favor, motion carried.
10. Anniversary Announcements: Mayor announced the following anniversaries: Full-time: Josh
Kuha-8 yrs; Troy Zwilling – 5 yrs. Part-time: Kristin Faul-17 yrs; Jamie Langely-8 yrs; Kadence
Cox-6 yrs; Lily Keenan-6 yrs; Laneen Duke – 5 yrs; Macy Spear – 5 yrs. Seasonal: Eli
Scheideman – 6; Brayden Graning – 5.
Mayor thanked the seven Night to Unite gatherings. Third Street had custom t-shirts made. The
Fire Department and Police Department participated with the Ambulance wanting to participate
in 2027. The senior apartments were appreciative of all the street repair. Solicitors do need a
permit from the city. Residents can request to see the permit. Business owners should follow
the rules of the city for permits. Item will be discussed in September at an Executive Session.
