Resolution 26-32 ## Consent Agenda: Yes No X ## Introduction / Background / Justification / Key / Legal Issues: The city of Becker completed a comprehensive overhaul of the compensation schedule and job descriptions in 2022 with the work being completed by Gallagher. This included implementing the Decision Band Method of job evaluation with a corresponding step schedule. It was concluded in 2022 that a compensation study should be conducted in 2026 to assure the step schedule is still competitive. Cost of living adjustments (COLA) have been implemented annually on the step schedule. An RFP was released March 24, 2026 with a response deadline of April 20, 2026. The goal is to have the data available for 2027 budgeting purposes. Twelve proposals were received. The range of costs was $8,500-$48,500. The median average is $23,000. The lowest priced proposal that met all the requirements was Flaherty & Hood at $8,500. David Drown Associates submitted $13,800 and Gallagher submitted a total of $17,575. Flaherty & Hood is a reputable firm and can complete the study in the timeline expected. ## Board Commission / Committee Action: The Personnel Committee reviewed the proposal and are recommending entering into an agreement with Flaherty & Hood, P.A. ## Budgetary / Fiscal Impact: The compensation study was budgeted in the 2026 CIP Budget for $25,000. The amount bid is well below the budgeted amount. ## Action(s) Requested: 1. Flaherty & Hood, P.A. approaches related studies in an objective, methodical, and customized manner. ## Background An employer’s success depends on its employees’ performance. To recruit and retain a productive and reliable workforce, public sector entities need to sufficiently compensate employees. In establishing employee compensation, public sector entities must ensure that each job in the organization interrelate to each other so that the entity can: optimize achievement of the organization’s mission, goals, and objectives; determine the relative worth and appropriate pay rate, other pay, and benefits for jobs; and comply with pay equity laws. In order to achieve these objectives, employers need to establish job classification and compensation systems that appropriately value jobs within the organization. ## Job Classification Job classification involves the systematic study of jobs to determine which activities and responsibilities they include, the personal qualifications necessary for performance of the jobs, the conditions under which the work is performed, and each job’s relative importance and worth to other jobs internally and externally. Though Flaherty & Hood has developed and utilizes its own Flaherty & Hood Job Evaluation System for job classification purposes which consistently and equitably measure the skill, effort, responsibility, and working conditions required of each job class, we are also able to utilize other systems that are in place if the organization has enough access to the system to fully evaluate a position. Compensation establishes the standard of living for employees and is the primary indication of the value the organization places on a position within the organization. We developed and utilize a Cluster Analysis to identify comparable entities for public sector entities. The market survey includes determining factors for each benchmarked position. The data collected is reviewed and organized in a user-friendly spreadsheet. Job classifications with usable market pay rates are utilized in the regression analysis (i.e., statistical approach to show the relationship between two variables, in this case the market pay and job evaluation points). ## Communication Given our extensive experience with serving local government entities, we understand the importance of open and honest communication with management and staff regarding classification and compensation issues and will maintain the highest degree of professionalism while working with these groups. Flaherty & Hood will continually consult with management for the entire study. We encourage management to give input and ask questions throughout the process. (hereinafter “FIRM”). ## Recitals WHEREAS, CITY has a need for Compensation Study services; WHEREAS, FIRM submitted a quote to provide Compensation Study services to CITY; and WHEREAS, at a meeting of the CITY COUNCIL, the CITY COUNCIL determined that FIRM be engaged to perform Compensation Study services and directed that an agreement for such services be executed between FIRM and CITY. ## Terms NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows: 1. APPOINTMENT: CITY appoints FIRM to perform Compensation Study services. 2. AUTHORIZED CITY CONTACT PERSONS: The City Administrator and/or their designee(s) shall be the primary contact person between CITY and FIRM to request Compensation Study services from FIRM. 3. For Base Services, Flaherty & Hood, P.A. will bill the CITY for one-third of the base services of the lump sum cost up-front, one-third 8 weeks after start of study based on satisfactory progress, and one-third upon completion of pay equity compliance testing. 2. For Additional Services For Study as part of the study following FIRM submitting bill. 3. For Additional Job Classifications or Same Job Classifications after Study is Complete or Other Services after completion of respective service following FIRM submitting bill CITY will pay the bill of FIRM within thirty (30) days or less of its receipt by CITY. ## Agreement for Compensation Study Services Page 5 of 8 4.3. Disputes. In the event that CITY disputes any aspect of FIRM’s bill, the CITY Administrator shall contact Brandon M. Fitzsimmons at FIRM stating the nature of the dispute. The parties pledge their mutual good faith in resolving any disputes. 4.4. Interest. Because CITY will be paying FIRM’s bills within thirty (30) days from their receipt, no interest will be charged. If CITY determines that it will be necessary to deviate from that payment schedule, then CITY will notify FIRM thereof. An interest rate of eight (8) percent per annum will be charged to CITY if CITY does not pay any bill of FIRM within thirty (30) days or less of its receipt by CITY with such arrangement subject to change as may be mutually agreed between the parties. 5. TERM AND TERMINATION: This Agreement shall commence following execution of the parties and shall continue in effect until such time as either party terminates this Agreement. This Agreement may be terminated by CITY at any time or by FIRM upon 60 days written notice. CITY shall pay FIRM for the work performed prior to the effective date of termination based upon the payment terms of this Agreement. 6. NOTICE: Any notices required under the provisions of this Agreement shall be in writing and sufficiently given if delivered in person or sent by U.S. mail, postage prepaid, as follows: 6.1. Notice to CITY shall be mailed or delivered to Greg Lerud, City ## Administrator, City of Becker, 12060 Sherburne Avenue, Becker, MN 55308. 6.2. Notice to FIRM shall be delivered to Brandon M. Fitzsimmons, Flaherty & Hood, P.A., 525 Park Street, Suite 470, St. Paul, MN 55103. 7. STATUS OF FIRM AS INDEPENDENT CONTRACTOR: FIRM shall be an independent contractor for all purposes and shall be entitled to no compensation other than the compensation provided for in this Agreement. No statement contained in this Agreement shall be construed so as to find FIRM to be an employee of CITY. FIRM shall not be entitled to any of the rights, privileges, or benefits of employees of CITY, including but not limited to, workers’ compensation, health/death benefits and indemnification for third-party personal injury/property damage claims. FIRM acknowledges and agrees that no withholding or deduction for state or federal income taxes, FICA, FUTA, or otherwise, will be made from the payments due FIRM and that it is FIRM’s sole obligation to comply with the applicable provisions of all federal and state tax laws. FIRM shall at all times be free to exercise initiative, judgment and discretion as to how to best perform or provide services identified herein. FIRM is responsible for hiring sufficient workers to perform the services/duties required by this Agreement, withholding their taxes, and paying all other employment tax obligations on their behalf. ## Agreement for Compensation Study Services Page 6 of 8 8. DATA PRACTICES: All data collected, created, received, maintained or disseminated for any purposes by the activities of FIRM because of this Agreement is governed by the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13, as amended, the Minnesota Rules implementing such act now in force or as adopted, as well as federal regulations on data privacy. This paragraph does not create a duty or any obligation on the part of FIRM to provide access to public data to the public for inspection or otherwise if the public data are available from CITY. 9. AUDITS: Pursuant to Minn. Stat. §§ 6.551 and 16C.05, subd. 5, FIRM agrees that CITY, the State Auditor, or any of their duly authorized representatives, may examine any books, records, documents and the accounting practices and procedures of FIRM. If either CITY or FIRM requests that the State Auditor conduct such an examination, then the requesting party is liable for the costs of the examination. 10. INDEMNIFICATION AND INSURANCE: FIRM agrees it will defend, indemnify and hold harmless CITY, its officers and employees against any and all liability, loss, costs, damages and expenses which CITY, its officers or employees may hereafter sustain, incur, or be required to pay arising out of FIRM’s negligence related to performance of this Agreement. FIRM further agrees that in order to protect itself as well as CITY under the indemnity provision set forth above, it will at all times during the term of this Agreement keep in force lawyers professional liability insurance with a coverage amount of not less than $1,000,000 per claim. CITY agrees it will defend, indemnify and hold harmless FIRM, its officers and employees against any and all liability, loss, costs, damages and expenses which FIRM, its officers or employees may hereafter sustain, incur, or be required to pay arising out of CITY’s negligence related to performance of this Agreement. Nothing herein shall be deemed a waiver by CITY of the limitations on liability set forth in Minnesota Statutes, Section 466.04, as amended from time to time, and CITY’s obligation to indemnify, hold harmless and defend FIRM shall be limited by the limitations on liability set forth in Minnesota Statutes, Section 466.04. FIRM and CITY specifically agree and acknowledge that the above described indemnification and hold harmless provisions shall survive the termination of this agreement. 11. USE OF ELECTRONIC COMMUNICATION DEVICES: FIRM is authorized to utilize email without encryption to transmit and receive confidential client information and to use cellular telephones and other wireless devices for the same purposes. CITY specifically acknowledges that it understands the confidentiality risks associated with inadvertent interception. 12. FORCE MAJEURE: Each party shall be excused from any breach of this Agreement which is proximately caused by war, strike, act of God or other similar circumstance normally deemed outside the control of well-managed businesses. 13. GOVERNING LAW: This Agreement is made pursuant to, and shall be construed in accordance with the laws of the State of Minnesota. ## Agreement for Compensation Study Services Page 7 of 8 14. HEADINGS AND CAPTIONS: Headings and captions contained in this Agreement are for convenience only and are not intended to alter any of the provisions of this Agreement. 15. No other agreement, statement, or promise made on or before the effective date of this Agreement will be binding on the parties. 16. MODIFICATION: Any modification of the provisions of this Agreement shall be reduced to writing and signed by the parties hereto. 17. SEVERABILITY IN EVENT OF PARTIAL INVALIDITY: If any provision of this Agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire Agreement will be severable and remain in effect. 18. CITY APPROVAL: The City COUNCIL has approved FIRM’s fees and expenses to provide Compensation Study services for CITY during the term of this Agreement. The signing of this Agreement will be ministerial, and the FIRM is authorized to commence performing services following execution of this Agreement. 19. AGREEMENT NOT ASSIGNABLE. Except relating to conflicts of interest, the rights and obligations created by this Agreement may not be assigned by either party. 20. COUNTERPARTS. This Agreement may be executed in counterparts. Facsimile, photocopied or scanned signatures shall be considered as valid signatures as of the date thereof, although the original signature pages shall thereafter be appended to this Agreement. 21. WORK PRODUCTS. Hourly Basis Option The Client and Consultant select the hourly basis for payment for services provided by Consultant. Consultant shall be compensated monthly. Monthly charges for services shall be based on Consultant’s current billing rates for applicable employees plus charges for expenses and equipment. Plots, Reports, plan and specification reproduction expenses. 6. Postage, handling and delivery. 7. Expense of overtime work requiring higher than regular rates, if authorized in advance by the Client. 8. Letter Agreement - 5 City of Becker (Rev. 05.29.25) ## Exhibit B-1 A Listing of the Duties, Responsibilities and Limitations of Authority of the Resident Project ## Representative Through more extensive on site observations of the construction work in progress and field checks of materials and equipment by the Resident Project Representative (RPR), Consultant shall endeavor to provide further protection for Client against defects and deficiencies in the work of contractor (Work); but, the furnishing of such services will not make Consultant responsible for or give Consultant control over construction means, methods, techniques, sequences or procedures or for safety precautions or programs, or responsibility for contractor’s failure to perform the Work in accordance with the Contract Documents. Contract Documents are the documents that govern or are pertinent to contractor’s Work including but not limited to the agreement between Client and contractor, the contractor’s bid, the bonds, construction plans, standard specifications, special provisions, field design changes, permits, manuals, addenda, clarifications, interpretations, change orders, and reviewed shop drawings. The duties and responsibilities of the RPR are further defined as follows: ## A. General RPR is an agent of the Consultant at the site, will act as directed by and under the supervision of Consultant, and will confer with Consultant’s project engineer regarding RPR’s actions. RPR’s dealings in matters pertaining to the on-site work shall in general be with Consultant’s project engineer and contractor assisting with keeping the Client informed as necessary. RPR’s dealings with subcontractors shall only be through or with the full knowledge and approval of contractor. RPR shall generally communicate with Client with the knowledge of and under the direction of Consultant’s project engineer. ## B. Duties and Responsibilities of RPR 1. Schedules: Review the proposed construction schedule, schedule of shop drawing submittals and schedule of values prepared by contractor; and consult with Consultant’s project engineer concerning acceptability. 2. Conferences and Meetings: Attend meetings with contractor, such as preconstruction conferences, progress meetings, project conferences and other project-related meetings, and prepare and circulate copies of minutes thereof. 3. Liaison: (a) Serve as Consultant’s liaison with contractor, working principally through contractor’s superintendent, and assist with understanding / communicating the intent of the Contract Documents; and assist in serving as Client’s liaison with contractor when contractor’s operations affect Client’s on site operations. (b) Assist in obtaining from Client additional information, when required for proper execution of the Work. ## 4. Shop Drawings and Samples: (a) Record date of receipt of shop drawings and submittals provided by the contractor and coordinate that review has been completed by appropriate team members. (b) Receive samples furnished at the site by contractor, and notify Consultant’s project engineer and Client of availability of samples to review. (c) Notify Consultant’s project engineer and contractor of the commencement of any Work requiring a shop drawing or sample if the submittal has not been reviewed for general conformance by Consultant. ## 5. Review of Work, Observations and Tests: Short Elliott Hendrickson Inc. Letter Agreement - 6 City of Becker (Rev. 05.29.25) (a) Conduct on site observations of the Work in progress to determine if the Work is in general proceeding in accordance with the Contract Documents. (b) Regularly update the Consultant’s project engineer to keep them informed of issues and progress of the Work. (c) Notify the Consultant’s project engineer immediately of any unanticipated project conditions, any Work believed to be unsatisfactory or defective and does not conform to the Contract Documents, any unauthorized Work, or any non-conforming materials that are subject to rejection. (d) Coordinate with the project materials tester and/or testing consultant to schedule testing. Confirm compliance with project requirements and the project Schedule of Materials Controls. RPR shall confirm that test report records or certificates of compliance have been received prior to the incorporation of materials in the Work. (e) Review and monitor the contractor’s schedule for construction. (f) Confirm that the contractor is performing daily reviews of construction signing, detour signing, completing traffic control maintenance and is taking corrective actions in accordance with the Contract Documents. (g) Conduct or coordinate with others the completion of wage interviews in the field with individual contractor/subcontractor employees and properly file documentation in accordance with project requirements. (h) Perform reviews of temporary and permanent erosion control measures on the project and verify contractor is maintaining compliance with applicable permits and Contract Documents. (i) Determine if tests, equipment and systems start ups and operating and maintenance training are conducted in the presence of appropriate personnel, and that contractor maintains adequate records thereof; and observe, record and report to Consultant appropriate details relative to the test procedures and start ups. (j) Accompany visiting inspectors representing public or other agencies having jurisdiction over the Project, record the results of these inspections and report to Consultant’s project engineer. (k) If unsafe conditions are observed, notify the contractor immediately, and if unresolved, notify the Consultant’s project engineer and Client for determination of possible suspension of Work. 6. Interpretation of Contract Documents: Report to Consultant’s project engineer when clarifications, interpretations, and requests for information regarding the Contract Documents are requested by contractor and transmit to contractor clarifications and interpretations as issued by Consultant’s project engineer. 7. Modifications: (a) Convey contractor’s suggestions for modifications in construction plans and specifications to Consultant’s project engineer and assist with evaluation. Transmit to contractor decisions as issued by Consultant. (b) Assist with evaluation of proposed change orders and obtain change justification from contractor. Provide assistance with preparation of final documentation of change orders and field design changes. 8. Records / Reporting: (a) Measure and document project field quantities, maintain an up to date item record account, and enter quantities into the Project filing system in a timely manner. (b) Maintain orderly files of correspondence, reports of project conferences, shop drawings and samples, reproductions of original Contract Documents including all addenda, change orders, field design changes, Short Elliott Hendrickson Inc. (c) Keep a diary, recording contractor hours on the job site, weather conditions, data relative to questions of change orders, or changed conditions, list of job site visitors, daily activities, decisions, photos, observations in general, and specific observations in more detail as in the case of observing test procedures; and send copies to Consultant’s project engineer. (d) Document changes in the plans and field conditions for record plan preparation. (e) Record names, addresses and telephone numbers of all contractors, subcontractors and major suppliers of materials and equipment. (f) Furnish Consultant’s project engineer periodic reports of progress of the Work and of contractor’s compliance with the proposed construction schedule. (g) Prepare appropriate lists of observed items requiring completion or correction by the contractor. (h) Notify Consultant’s project engineer and Client immediately upon the occurrence of any accident. 9. Payment Requests: Review applications for payment for compliance with the established procedure for their submission and forward with recommendations to Consultant’s project engineer, noting particularly the relationship of the payment requested to the schedule of values, Work completed and specific pay requests for materials and equipment delivered to the site but not incorporated in the Work. 10. Certificates, Maintenance and Operation Manuals: During the course of the Work, verify that certificates, maintenance and operation manuals and other data required to be assembled and furnished by contractor are applicable to the items actually installed and in accordance with the Contract Documents, and have this material delivered to Consultant for review and forwarding to Client prior to final payment for the Work. 11. Completion: (a) Prepare final documentation of construction pay items, quantities, material certification and other requirements as per the plans, specifications, and special provisions. (b) Conduct final inspection in the company of Consultant’s project engineer, Client, and contractor and assist with preparation of a final list of items to be completed or corrected. (c) Observe that all items on final list have been completed or corrected and make recommendations to Consultant’s project engineer concerning acceptance. (d) Assist Consultant’s project engineer with preparation of record plans and documentation. ## C. Limitations of Authority ## Resident Project Representative: 1. Shall not authorize any deviation from the Contract Documents or substitution of materials or equipment, unless authorized by Client. 2. Shall not provide direction, superintendence, or guidance to the contractor, their crews, their subcontractors, or their suppliers on means and methods to accomplish the Work. In October of 2025, the city was notified that they were awarded the grant, and council accepted the grant at their November 4 th , 2025, meeting. We are now looking to enter into an agreement with SEH to start the design work for the project. Conceptual designs have been put in place, but the SLA will take the project through final design to bid advertisement. With the interest of developing the surrounding properties, the SLA will take into account the concepts of the area impacts and build it into the final phase of LuAnn Drive. Since this work falls outside of the Master Agreement currently in place with SEH, the SLA is used. ## Board Commission / Committee Action: This has been reviewed and discussed at several council meetings and work sessions to get us to this point, with support given to continue to move the project forward. ## Budgetary / Fiscal Impact: The grant covers 50% of the build, the cost of the design and engineering will come from future improvements and has been planned and socialized with the council and vetted through the Budget & Finance Committee. Equipment Utilization The utilization of specialized equipment, including automation equipment, is recognized as benefiting the Client. The Client, therefore, agrees to pay the reasonable cost for the use of such specialized equipment on the project. Consultant invoices will contain detailed information regarding the use of specialized equipment on the project when it is to be reimbursed by the Client. With the new shared use path being installed on the west side of 23, we have been working through the design with the county to move the roadway to the east. To allow for this and keep our patrons in a better position on the course, we are proposing to re-route the cart path that leads from #10 green to the tee boxes on #11. We are proposing to reclaim the full section of trail from the tee box on #11 south towards the parking lot so we can use the reclaim material as the base material for the new cart path. Reclaiming the existing trail will also get any of the existing pavement out of the construction limits for the county project. We would look to repave the remainder of the cart path next year when we finish up the overall cart path work on the Local 9. Hansen Paving has been the low bidder for three consecutive years for the course path improvements with several contractors declining to bid. Staff met with Hansen Paving, and they offered the quote supplied here and would do the work with the rest of the path work that has already been approved for this year. The supplied quote is in line with their previous bid for linear footage cost, slightly higher because of the increase in dirt and base prep work for the new path. This quote is good as long as the work is done while they are doing the other cart path improvements. It saves them on mobilization costs. ## Board Commission / Committee Action: This was reviewed and discussed at the April 28 th Golf Committee with support given to bring it to full council for consideration. ## Budgetary / Fiscal Impact: The cost of the proposed work is $10,200. Because we are moving the cart path to accommodate the road improvements, I propose we use funds from Streets CIP. The application was received on April 3, 2026 and deemed complete on April 7, 2026. The subject property consists of approximately 16.52 acres located at 153rd Avenue SE and 127th Street SE, legally described as Outlot A, Fossum Fields Second Addition, and Outlots C, D, F, and G of Fossum Fields, according to the recorded plats thereof, Sherburne County, Minnesota (PIDs: 60-00476-0030, 60-00476-0040, 60-00476- 0060, 60-00476-0070, 60-00489-0010). ## Figure 1.1 Location Map ## REQUEST FOR COUNCIL ACTION ## MEETING DATE: May 5, 2026 ## CITY COUNCIL ACTION  Approved  Denied  Amended  Tabled ## Development History The original Fossum Fields subdivision was approved by the Becker City Council under Resolution 2004- 94. Initial site grading, some storm ponding, and some underground utilities (sanitary sewer, water main, storm sewer) were constructed on the Fossum Fields Third properties in approximately 2005 in association with the first phases of the Fossum Fields development. The first and second additions to Fossum Fields were platted and developed, but the outlots that make up the Third Addition were never developed and the land has remained vacant. On March 1, 2022, the Becker City Council approved City Council Resolutions 22-11 and 22-12, granting preliminary and final plat approval for Fossum Fields Third Addition. That approval was for a 44-lot development processed under straight SFD zoning, without a PUD Conditional Use Permit. No Development Agreement was executed and the final plat was never recorded with Sherburne County within the required timeframe. The 2022 approvals have accordingly lapsed and are no longer in effect. The current 2026 application is a new, independent application subject to all City ordinances, standards, and fee schedules currently in effect. The prior approval history is provided for reference only. ## Key Issues • The 2026 applications propose 52 total lots, an increase of 8 lots over the lapsed 2022 approval of 44 lots. This increase is enabled in part by the PUD dimensional deviations requested, including reduced minimum lot width (65 ft. vs. 80 ft.) and smaller minimum lot area (7,800 sq. ft. vs. 10,890 sq. ft.). • The 2026 applications include a PUD Conditional Use Permit, which was not part of the 2022 approval. The PUD is required to accommodate the proposed dimensional deviations. The requested PUD standards are summarized in the table below. • The City Engineer has completed a preliminary review of the civil plans from Widseth and has noted concerns similar to those identified in the prior 2022 submittal. Written comments from the City Engineer will be provided to the applicant and must be addressed to the satisfaction of the City Engineer. Conditions have been added to the resolutions regarding required review and amendments of the plat and civil plan drawings. • Park dedication fees and any other applicable fees are subject to the current City fee schedule in effect at the time of final plat recording. A development agreement will be required to be executed with the city and all fees required under said agreement must be paid before any construction begins. The agreement will come before council at a later date for consideration. • The development is proposed in two phases. Phase 1 (2026) consists of 31 lots along 42nd Avenue SE on the west and south sides of the development. Phase 2 consists of the remaining 21 lots, estimated to follow two to five years after Phase 1. • Outlot A, as shown on the Plat, shall be dedicated to the City of Becker for drainage and stormwater management purposes. • Existing infrastructure from the original 2005 construction, including sanitary sewer stubs and water stubs, will need to be inspected and verified prior to new construction. Code requires that district designation be “PUD” followed by the alphanumeric designation of the underlying zoning district. With SFD as the underlying zoning district, the development will be designated PUD – SFD; and, WHEREAS, the Applicant has submitted a PUD Narrative dated April 3, 2026, identifying requested deviations from standard SFD dimensional requirements; and, WHEREAS, the Applicant proposes a 52-lot single-family detached residential subdivision on approximately 16.52 acres, to be developed in two phases, with Phase 1 consisting of 31 lots and Phase 2 consisting of 21 lots; and, Resolution 26 -36 Page 2 WHEREAS, the proposed PUD deviations, including reduced minimum lot width, reduced minimum lot depth, and reduced minimum lot area, are what enable the proposed 52-lot count, representing an increase of 8 lots over the lapsed 2022 approval; and, WHEREAS, a public hearing was duly held on April 27, 2026 in the City Council Chambers, Becker City Hall, 12060 Sherburne Ave, Becker, MN 55308, at which time all parties were given the opportunity to be heard; and, WHEREAS, notice of the time, date, place, and purpose of the aforementioned hearing was duly given as required by statute; and, WHEREAS, the Becker Planning Commission recommended approval of the PUD CUP via Resolution PC 26-02 on April 27, 2026; and, WHEREAS, the Becker City Council finds that the proposed PUD is consistent with the City of Becker Comprehensive Plan, is compatible with surrounding land uses, and that the requested dimensional deviations are reasonable and consistent with comparable residential PUD approvals previously granted by the City; In considering this application, the Becker City Council makes the following findings of fact pursuant to Article I, Sec. 1.13 of the City of Becker Unified Development Ordinance: (A) Relationship to the City's Comprehensive Plan. The proposed PUD is consistent with the City of Becker's Comprehensive Plan, which designates this area for low-density residential development. (B) The geographical area involved. The proposed PUD is appropriate for the geographical area, which consists of existing residential development on three sides with unplatted agricultural land to the east that is also zoned Single-Family Detached (SFD). (C) The character of the surrounding area. The proposed single-family detached residential PUD will not alter the character of the surrounding area, which is residential in nature. (D) The availability and design capacities of existing or proposed utilities. The subject property will be served by municipal water, sanitary sewer, and stormwater systems as conditions, reviewed, and approved by the City Engineer and City Staff. (E) Whether the request will tend to or actually depreciate the surrounding area. The proposed PUD will not depreciate surrounding area values. Single-family detached residential development is consistent with and complementary to the surrounding neighborhood. (F) Whether the request will place an undue financial burden on the City. The City and Developer will enter into a Development Agreement to ensure the City will not face undue financial burden. This agreement will be required to be approved by City Council. (G) Whether the request will impair an adequate supply of light and air to adjacent property. The proposed single-family residential PUD will not impair adequate supplies of light and air to adjacent properties. Setback requirements are maintained at SFD standards on all but side yards. Resolution 26 -36 Page 3 (H) Whether the request will unreasonably increase the congestion in the public right-of- way. Traffic generated will be consistent with single-family residential development. Access is provided via multiple existing public streets. (I) Whether the request will increase the danger of fire or endanger the public safety. The development will be served by municipal water and fire hydrants as required by the City Engineer and Public Works. As conditioned, the PUD will not increase the danger of fire or endanger public safety. (J) Whether the request is consistent with the spirit and intent of this Article. The proposed PUD is consistent with the spirit and intent of the City of Becker Unified Development Ordinance, providing flexible residential development standards while maintaining the residential character of the area. The Becker City Council further makes the following findings pursuant to the Standards for Findings for Conditional Use Permits required under Subsec. 1.11.5(I)(d) of the City of Becker ## Unified Development Ordinance: (1) That the conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted. The proposed single-family detached residential PUD is consistent with the existing residential character of the surrounding Fossum Fields development and will not be injurious to adjacent properties. (2) That the establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding vacant property for predominant uses in the area. The proposed PUD continues the established residential development pattern in this area and will not impede orderly development of surrounding properties. (3) That adequate utilities, access roads, drainage, and other necessary facilities have been or are being provided. Municipal water, sanitary sewer, public streets, and stormwater management facilities are provided as shown on the approved civil plans and stormwater management report. Conditions added to the PUD and the plat resolutions ensure that submitted civil plans are reviewed and approved by the City Engineer and City Staff and that any necessary revisions requested to said plans will be incorporated prior to construction. (4) That adequate measures have been or will be taken to provide sufficient off-street parking and loading space to serve the proposed use. Each single-family residential lot will provide off-street parking via individual driveways and garages in conformance with City Code. (5) That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise, and vibration, so that none of these will constitute a nuisance, and to control lighted signs and other lights in a manner that no disturbance to neighboring properties will result. The proposed single-family residential use does not generate offensive odors, fumes, dust, noise, or vibration beyond that typical of residential development. Street lighting will be fully shielded to minimize light pollution. (6) That proper facilities are provided which would eliminate any traffic congestion or traffic hazard that may result from the proposed use. Access is provided via 42nd Avenue SE, 44th Avenue SE, 153rd Avenue SE, and 127th Street SE. Traffic generated is consistent with single-family residential development and will not create congestion or traffic hazards. Resolution 26 -36 Page 4 (7) The demonstrated need for the proposed use. The City of Becker has identified a need for additional single-family detached housing inventory. The PUD provides 52 new single- family lots to address this need consistent with the City's housing goals. (8) The proposed use is in compliance with the City's Comprehensive Land Use Plan adopted by the City Council. The Future Land Use designation for this area is low-density residential. The proposed single-family detached PUD is consistent with this designation. (9) The use does not result in adverse effects on public health, safety, and welfare nor does it create additional pollution potential for ground and surface waters. The development includes a stormwater management system designed to manage surface water runoff. No adverse effects on public health, safety, welfare, or water quality are anticipated. The Becker City Council further makes the following findings pursuant to the PUD Review and Evaluation criteria required under Subsec. 1.11.5(D)(4) of the City of Becker Unified ## Development Ordinance: (1) The interior circulation plan, including access from and onto public rights-of-way, does not create congestion and is adequate for the safety of the residents and the public. The proposed street layout provides adequate internal circulation with multiple access points onto existing public streets. (2) A sufficient amount of parkland is publicly dedicated, or appropriate fee in-lieu in accordance with Article III, Sec. 3.3 is submitted. Park dedication will be satisfied pursuant to the City of Becker fee schedule in effect at the time of final plat recording, as required by the Development Agreement. (3) Sufficient usable open space is provided for residents. Stormwater outlots and drainage areas within the development provide open space for residents consistent with the requirements of this section. (4) The arrangement of buildings, structures, and accessory uses does not unreasonably disturb the privacy of the surrounding area. Individual single-family lots with standard setbacks will not unreasonably disturb the privacy of surrounding properties. (5) The architectural design of the project is generally compatible with the surrounding area. The proposed single-family homes will be constructed to the same standards and materials as homes in previous phases of Fossum Fields and adjacent developments, as represented in the PUD Narrative dated April 3, 2026. (6) The drainage and utility system plans are sufficient to provide adequate services to properties in the development and meet relevant standards as determined by review and approval of said plans by the City Engineer and Public Works Department. The development shall be constructed in conformance with the Fossum Fields Civil Set and Stormwater Management Report. The City Engineer has completed a preliminary review and has noted concerns similar to those identified in the prior 2022 submittal. Written comments from the City Engineer and City Staff will be provided to the applicant and must be addressed to the satisfaction of the City Staff and City Engineer prior to recording. (7) The development schedule ensures development of the site will protect the public interest. The two-phase development schedule, with Phase 1 consisting of 31 lots and Phase 2 Resolution 26 -36 Page 5 consisting of 21 lots, is clearly identified in the PUD Narrative and on the preliminary plat, and is structured to protect the public interest. (8) Principal and accessory uses and requirements are in compliance with the regulations in this section and other applicable zoning district provisions in which the development is intended. The proposed single-family detached residential use is a permitted use in the SFD underlying zoning district and complies with all applicable regulations except as expressly modified by this PUD. (9) The Becker City Council finds that the design of the PUD and the proposed structures can meet all required findings and will not be detrimental to the City in any way. NOW THEREFORE BE IT RESOLVED, that based on the findings of fact required in the City of Becker Unified Development Ordinance, as detailed above, the Becker City Council hereby approves Planned Unit Development Conditional Use Permit for Fossum Fields Third Addition, with the PUD Minimum Standards, set forth below, pursuant to Article III, Sec. 3.9, and the following conditions: ## PUD Minimum Standards for Fossum Fields Third Addition: The following dimensional deviations from SFD zoning standards are hereby approved for Fossum Fields Third Addition pursuant to Article III, Sec. 3.9 of the City of Becker Unified ## Development Ordinance: 1. Minimum lot width: 65 feet (SFD standard: 80 feet) 2. Minimum lot depth: 120 feet (SFD standard: 136 feet) 3. Minimum lot area: 7,800 sq. ft.; maximum lot area: 19,000 sq. ft. (SFD standard: 10,890 – 43,560 sq. ft.) 4. Side yard setback: 10 feet for the principal structure, 5 feet for an attached or detached garage (SFD standard: 10 feet) 5. Front yard setback: 30 feet (no deviation from SFD standard) 6. Corner side yard setback (adjacent to street): 30 feet (no deviation from SFD standard) 7. Rear yard setback: 30 feet (no deviation from SFD standard) 1. Future projects in the plat must be developed in accordance with all applicable and required state laws, uniform building codes, fire codes, and City codes. 2. The PUD must be developed in accordance with all zoning, development, and design requirements of the City of Becker Unified Development Ordinance, except as expressly modified by this PUD. 3. No work shall commence on properties within the PUD boundaries until all necessary City, State, and Federal permits and approvals are obtained, development agreements executed, and the final plat(s) are recorded. 4. Civil engineering plans, including grading plans, for any future project on the site must be submitted to, reviewed by, and approved by City Staff and the City Engineer before any building permits are issued. Any necessary revisions requested to said plans must be incorporated and approved by the City Engineer and City Staff prior to construction. Resolution 26 -36 Page 6 5. The development shall be constructed in conformance with the Fossum Fields Third Addition Civil Set and Stormwater Management Report as reviewed and approved by City Staff and the City Engineer. 6. All lots shall be served by municipal water and sanitary sewer. No on-site septic or private well systems are permitted. 7. Nothing shall be constructed on the PUD site except in conformance with this PUD, approved plans and plats, and the City of Becker Unified Development Ordinance. 8. The City Attorney may make any adjustments to said resolution as to form. 9. The subject property is guided for low-density residential development. The proposed 52-lot single-family detached subdivision is consistent with this designation. ● Is compatible with the geographical area involved. The subject property is surrounded by existing residential development on three sides with unplatted agricultural land to the east. The proposed subdivision is appropriate for this geographical area. ● Is compatible with the character of the surrounding area. As conditioned, the proposed single-family detached residential subdivision will not alter the character of the surrounding area, which is residential in nature. ● Provides adequate access to existing or proposed municipal utilities with sufficient capacity for the intended use. The subject property will be served by municipal water, sanitary sewer, and stormwater systems as reviewed and approved by the City Engineer. ● Will not tend to or actually depreciate the surrounding area. This is a single-family development that is similar to the existing development to the north of the site. It is not anticipated that the development will depreciate the surrounding area. ● Will not impose an undue financial burden on the City of Becker. The City and Developer will enter into a Development Agreement to ensure the City will not face undue financial burden. All utilities, parkland dedication fees, public utilities, road construction, private utility stubs, driveway aprons, sidewalks, ten (10’) foot bituminous trail, lighting, mailboxes, site grading and erosion control, and SAC/WAC fees are all being paid for by the developer. All fees paid will ensure that that City is able to maintain it’s sewer, water and utility infrastructure now and in the future. The road, curb and gutter, and other improvement installations must be approved by the City Engineer, per the Development Agreement, prior to said improvements being dedicated to the City. ● Will not impair an adequate supply of light and air to adjacent property. The proposed single-family residential subdivision will not impair adequate supplies of light and air to adjacent properties. Resolution 26 -37 Page 3 ● Will not unreasonably increase the congestion in the public right-of-way. Traffic generated will be consistent with single-family residential development. Access is provided via multiple existing public streets. The City Engineer noted that there would only be room enough for one-sided street parking. ● Will not increase the danger of fire or endanger the public safety. As conditioned, the development will be served by municipal water and fire hydrants as required. ● The request is consistent with the spirit and intent of Article I. The proposed subdivision meets the intent of the Unified Development Ordinance by meeting all applicable standards and complying with land use zoning, except as expressly modified by the PUD approved in Resolution 26-36. THEREFORE, BE IT RESOLVED that the City of Becker City Council hereby adopts the following Findings of Fact, as required by UDO Article I Zoning, Section 1.13: ● The Plat, as conditioned herein, is consistent with the construction standards, design standards, and other requirements set forth by the City's Unified Development Ordinance. ● The physical characteristics of the site, and area surrounding the site, including but not limited to topography, erosion, flooding potential, soil limitations, and overall suitability for the type of development or use proposed. A soil investigation completed in December 2021 confirmed the soils are suitable for residential development. The site is not within a shoreland district or flood plain district. As conditioned, the Plat will meet this finding. ● The proposed development is consistent with the City's Comprehensive Land Use Plan. The Future Land Use designation for this area is low-density residential. The proposed 52-lot single-family detached subdivision is consistent with this designation. ● The City will not face unnecessary interrupted use of public roadways, facilities, or property for an unspecified amount of time due to development the City is not ready for. Any interruption to roadways or facilities will be handled through proper channels including right-of-way permits and building permits, as conditioned in this resolution. The Development Agreement will include requirements for traffic control to ensure that any interruptions in public roadways are mitigated appropriately and safely. ● The subdivision will not prohibit the orderly growth of the surrounding areas or the City as a whole. The property is currently undeveloped and this proposal will promote orderly growth of a planned residential area anticipated since the original Fossum Fields plat. ● The Plat will be developed per the construction and development standards that have been set within the City. As conditioned, all plans are required to be reviewed and approved by City Staff and the City Engineer to ensure that development standards are being met prior to recording of the final plat. ● The subdivision will not create a negative fiscal or environmental impact upon the City. The proposed subdivision will not create a negative fiscal or environmental impact upon the City. ● The City will not face undue financial hardship due to the development in question. The proposed subdivision will not create a negative fiscal impact upon the City. Resolution 26 -37 Page 4 NOW THEREFORE BE IT FURTHER RESOLVED, that the Becker City Council, based on the findings put forth in this resolution, hereby recommends approval of the preliminary plat request for Fossum Fields Third Addition subject to the following conditions: 1. No work shall commence on properties within the Plat until all necessary City, State, and Federal permits and approvals are obtained. 2. To ensure safe access to and throughout the preliminary plat, including parking and circulation, any required improvements as requested by City Staff, including the City Engineer, must be completed. 3. All comments and conditions of the City Engineer must be addressed to the satisfaction of the City Engineer prior to recording of the final plat. 4. All required easements and rights-of-way shall be dedicated as shown on the Plat. 5. The final plat must be recorded within one (1) year of the date of its approval by City Council. If the final plat is not recorded within one (1) year of the date of its approval, a new preliminary and final plat shall be required. 6. Sanitary sewer stubs must be exposed and caps on the unused stubs must be inspected and replaced, if necessary. Indication of all existing utilities, sewer and water stubs, within the development, must be indicated on a Civil Plan Set submitted by a currently licensed Engineer within the State of Minnesota. 7. Six (6) foot sidewalk must be installed along one side of all streets running throughout the development. 8. Based on the original submitted preliminary plat, submitted and approved under Resolution 2004-94, a ten (10’) foot bituminous trail must be installed by the Developer around the perimeter of the development adjacent to 153 rd Ave SE and 127 th ## Street SE on the western and southern boundaries of the plat. Said trail must be installed during the first phase of the development. A portion of said trail will be required to be installed across Outlot E of Fossum Fields when either of the following occur: ○ Development to the east of Fossum Fields Third, and subsequent phases, occurs. ○ When the City determines a turn lane is necessary on 127 th Street SE. 9. All drainage systems that will adequately take care of the surface water runoff within the preliminary plat boundaries must be provided including storm sewers, drain inlets, manholes, culverts, and other structures and easements, as recommended and approved by the City Engineer. 10. Any required changes as noted by City Staff and the City Engineer must be incorporated into the preliminary plat drawings prior to recording of the final plat at Sherburne County. 11. To ensure adequate road facilities for the residents within the development, the developer is required to construct to urban standards all roads within Rights of Way as indicated on the preliminary plat and Civil Plan Sets as revised and approved by the Zoning Administrator and Engineer. Timing of installation of the roads must be addressed in the required Development Agreement. Resolution 26 -37 Page 5 12. Civil engineering plans, including site plans / grading plans, and any changes requested by City Staff and the City Engineer to said plans, for any future project occurring within the preliminary plat boundaries must be submitted to, reviewed and approved by City Staff and City Engineer before any building permits are issued. 13. The developer of the plat must sign a Development Agreement with the City and remit all securities required by said agreement and law. The Development Agreement must be executed prior to the beginning of construction and recording of the final plat. Development Agreement approval is contingent on final review and approval by the Zoning Administrator, City Engineer, and City Attorney. 14. Park dedication fees and any other applicable fees shall be calculated pursuant to the City of Becker fee schedule in effect at the time of final plat recording. These must be paid at time of Development Agreement execution and before recording of the final plat. 15. A vegetated buffer must be installed along the perimeter of the development adjacent to the 127th Street SE Right of Way. Said buffer must be approved by the Zoning Administrator and City Engineer prior to installation. Maintenance of said buffer shall be the responsibility of each property owner that abuts the Right of Way where said buffer is installed. All planting material must be maintained in its natural and proper state according to accepted landscaping and horticultural practices. Determination that the buffer is not being maintained is at the discretion of the City. If the City finds that maintenance is not occurring or that accepted landscaping and horticultural practices are not being properly followed the City shall notify the property owner of their responsibilities to maintain said buffer. In the same event, the City will fix any issues, including but not limited to pruning, replacement, and removal of debris, that arise from lack of maintenance and adherence to accepted landscaping and horticultural practices and will bill all costs back to said property owners. If payment is not made to the City for all costs incurred by the City within sixty (60) days of the date of the invoice, the amount will be assessed against the property and said assessment will be recorded against title at Sherburne County. The Developer must provide the buyers of Lot 12, Lot 13, Lot 14, Lot 15, Lot 16, Lot 17, and Lot 18, of Block 2 of Fossum Fields Third Addition a copy of Resolution 26-37, Resolution 26-40 and the executed Development Agreement highlighting said buyer’s responsibilities of maintaining said vegetated buffer. 16. It is not anticipated that the development will depreciate the surrounding area. ● Will not impose an undue financial burden on the City of Becker. The City and Developer will enter into a Development Agreement to ensure the City will not face undue financial burden. All utilities, parkland dedication fees, public utilities, road construction, private utility stubs, driveway aprons, sidewalks, ten (10’) foot bituminous trail, lighting, mailboxes, site grading and erosion control, and SAC/WAC fees are all being paid for by the developer. All fees paid will ensure that that City is able to maintain it’s sewer, water and utility infrastructure now and in the future. The road, curb and gutter, and other improvement installations must be approved by the City Engineer, per the Development Agreement, prior to said improvements being dedicated to the City Resolution 26-40 Page 3 ● Will not impair an adequate supply of light and air to adjacent property. The proposed single-family residential subdivision will not impair adequate supplies of light and air to adjacent properties. ● Will not unreasonably increase the congestion in the public right-of-way. Traffic generated will be consistent with single-family residential development. Access is provided via multiple existing public streets. The City Engineer noted that there would only be room enough for one-sided street parking. ● Will not increase the danger of fire or endanger the public safety. As conditioned, the development will be served by municipal water and fire hydrants as required. ● The request is consistent with the spirit and intent of Article I. The proposed subdivision meets the intent of the Unified Development Ordinance by meeting all applicable standards and complying with land use zoning, except as expressly modified by the PUD approved in Resolution 26-36. THEREFORE, BE IT RESOLVED that the City of Becker City Council hereby adopts the following Findings of Fact, as required by UDO Article I Zoning, Section 1.13: ● The Plat, as conditioned herein, is consistent with the construction standards, design standards, and other requirements set forth by the City's Unified Development Ordinance. ● The physical characteristics of the site, and area surrounding the site, including but not limited to topography, erosion, flooding potential, soil limitations, and overall suitability for the type of development or use proposed. A soil investigation completed in December 2021 confirmed the soils are suitable for residential development. The site is not within a shoreland district or flood plain district. As conditioned, the Plat will meet this finding. ● The proposed development is consistent with the City's Comprehensive Land Use Plan. The Future Land Use designation for this area is low-density residential. The proposed 52-lot single-family detached subdivision is consistent with this designation. ● The City will not face unnecessary interrupted use of public roadways, facilities, or property for an unspecified amount of time due to development the City is not ready for. Any interruption to roadways or facilities will be handled through proper channels including right-of-way permits and building permits, as conditioned in this resolution. The Development Agreement will include requirements for traffic control to ensure that any interruptions in public roadways are mitigated appropriately and safely. ● The subdivision will not prohibit the orderly growth of the surrounding areas or the City as a whole. The property is currently undeveloped and this proposal will promote orderly growth of a planned residential area anticipated since the original Fossum Fields plat. ● The Plat will be developed per the construction and development standards that have been set within the City. As conditioned, all plans are required to be reviewed and approved by City Staff and the City Engineer to ensure that development standards are being met prior to recording of the final plat. ● The subdivision will not create a negative fiscal or environmental impact upon the City. No work shall commence on properties within the Final Plat until all necessary City, State, and Federal permits and approvals are obtained. 2. To ensure safe access to and throughout the final plat, including parking and circulation, any required improvements as requested by City Staff, including the City Engineer, must be completed. 3. All comments and conditions of the City Engineer must be addressed to the satisfaction of the City Engineer prior to recording of the final plat. 4. All required easements and rights-of-way shall be dedicated as shown on the final plat. 5. The final plat must be recorded within one (1) year of the date of its approval by City Council. If the final plat is not recorded within one (1) year of the date of its approval, a new preliminary and final plat shall be required. 6. Sanitary sewer stubs must be exposed and caps on the unused stubs must be inspected and replaced, if necessary. Indication of all existing utilities, sewer and water stubs, within the development, must be indicated on a Civil Plan Set submitted by a currently licensed Engineer within the State of Minnesota. 7. Six (6) foot sidewalk must be installed along one side of all streets running throughout the development. 8. Based on the original submitted preliminary plat, submitted and approved under Resolution 2004-94, a ten (10’) foot bituminous trail must be installed by the Developer around the perimeter of the development adjacent to 153 rd Ave SE and 127 th ## Street SE on the western and southern boundaries of the plat. Said trail must be installed during the first phase of the development. A portion of said trail will be required to be installed across Outlot E of Fossum Fields when either of the following occur: o Development to the east of Fossum Fields Third, and subsequent phases, occurs. o When the City determines a turn lane is necessary on 127 th Street SE. 9. All drainage systems that will adequately take care of the surface water runoff within the final plat boundaries must be provided including storm sewers, drain inlets, manholes, culverts, and other structures and easements, as recommended and approved by the City Engineer. 10. Any required changes as noted by City Staff and the City Engineer must be incorporated into the final plat drawings prior to recording of the final plat at Sherburne County. 11. The request comes as part of a potential high-density, mixed residential development the applicants are working on, south of Edgewood Blvd SE and LuAnn Drive SE. The Becker 2040 Comprehensive Plan currently identifies Medium Density Residential as allowing 6-12 units per acre and High Density Residential as allowing more than 12 units per acre. Based on the applicant’s narrative (attached), the proposed development would include 210 residential units, resulting in a calculated density of 10.9 units per acre. Although the applicant is requesting a minimum density reduction to accommodate a specific project, any change to the city’s residential density standards would apply not only to the subject parcels but to all properties designated in Becker’s 2040 Comprehensive Plan / Article I Zoning of the Unified Development Ordinance as High Density Residential / Multi-Family High (MFH) and Medium Density Residential / Multi-Family Low (MFL) throughout the city. Among similarly sized communities in Minnesota (approximately 5,000 residents), high-density residential ranges vary widely but commonly fall between 10 and 30+ units per acre. After evaluating the broader implications of lowering the minimum density citywide, staff conclude that the request satisfies the required findings outlined in the Unified Development Ordinance (see findings in RES 26-41). These requests are part of the Edgewood Village Mixed-Use Residential Development planned on property on the south side of Edgewood Blvd. within the City of Becker. We prepared applications for both requests and offer this narrative to provide additional information to assist in the review of the requested amendments. Please note we attached the current preliminary site plan and the boundary survey as a reference for these requests. ## Proposed Project Characteristics: The project includes a range of residential units that includes 152 apartment units in 4 38-unit buildings, 20 homes in 5 4- unit buildings, 24 homes in 3 8-unit buildings and 14 homes in 7 2-unit buildings. All homes are planned to be owner occupied with the exception of the apartments, which will be for rent. The total number of residential units is 210, which results in a density of 10.9 units per acre. In addition to the buildings, we illustrate sidewalk pedestrian connections, an outdoor play area on the apartment property, parking areas and carports. The mixture of unit types and the configuration creates an attractive neighborhood and also serves as a transition between the existing commercial uses along the service drive for US 10 and the existing homes to the east of the proposed development. ## Comprehensive Plan Amendment: The Comprehensive plan currently refers to mid-density as 6-12 units per acre and high-density as more than 12 units per acre and there appears to be an inconsistency that needs to be amended to allow this development, at 10.9 units per acre in the high-density district, while still meeting the needs in the community for higher density developments. ## Unified Code Amendment: This request includes city review and amendment of the density standards in the Unified Code to align district standards with the Comprehensive Plan. We believe Sections 1.3.4 MFL, 1.3.5 MFH districts need to be amended but there may be additional districts that need to be amended to eliminate inconsistencies. In addition, Section the 1.3.13 PUD Planned Unit Development district standards allows the city the flexibility to increase the density associated with specific projects but it does not allow the city to consider reductions to the minimum density for developments. 2 ## Edgewood Village Mixed-Use Residential Development Comp Plan and Ord. Amendment, City of Becker, Sherburne County, Minnesota ## Summary: We request your review and consideration to amend the Unified City Code and the Comprehensive Plan to allow the upcoming applications for the Edgewood Village and Edgewood Village Apartment project. The facility supports more than 2,000 members and welcomes thousands of users each month. At the heart of the center is its aquatic facility, featuring a pool, hot tub, and sauna— amenities that provide both recreation and wellness opportunities for all ages. Young children build confidence and learn to swim in the zero-depth entry area, while adults take advantage of lap swimming and water exercise. Despite its longstanding importance to the community, many of the pool’s core elements—including critical mechanical systems—have seen minimal updates over the years. As part of the 2026 Capital Improvement Project, the Becker Community Center aims to modernize these essential components to extend the lifespan of the facility, enhance safety, and create a refreshed, inviting environment for all users. This project has been discussed at great length over the last year between multiple departments. ## Mechanical Room Upgrades This project will include relocating and replacing the existing heat exchanger, moving it from the upstairs building mechanical room to the pool mechanical room. This change will allow for the removal of two outdated pumps—one of which is nearing failure—as well as the replacement of old, rusted valves that have become inefficient and pose potential operating concerns. By modernizing these critical components and optimizing their location, the new heat exchanger system will improve overall efficiency, reliability, and safety within the aquatic facility. McDowell Companies was selected due to our existing service contract for our boiler systems, and their familiarity with our facility. ## REQUEST FOR COUNCIL ACTION ## MEETING DATE: May 5, 2026 ## CITY COUNCIL ACTION  Approved  Denied  Amended  Tabled ## Sand Filter Replacements The project will also include replacing the sand filters in both the spa and pool systems, with each requiring two filters. One of the existing spa filters is currently cracked and in need of immediate replacement. Given the unknown age of the remaining spa filter, it is most practical and cost-effective to replace both at the same time to avoid staggered failures. The pool filters are at least 16 years old, and both the tanks and internal components are now obsolete, making repairs or part replacements no longer feasible. In the event of a failure, lead times for new filters could result in an unexpected pool closure of 5–7 months. While replacing the pool filters now represents a higher upfront investment, it provides critical reliability and mitigates the risk of extended downtime due to aging infrastructure. We solicited quotes from Horizon Commercial Pools and Aqua Logic. We are recommending using Horizon Commercial Pools. ## Pool Surface Replacement, and Suction Grates This project will include replastering the pool, which is completed on an as-needed basis and is now necessary due to several visible and structural concerns. The pool basin is showing signs of aging, including hairline cracks along the bottom, surface staining, and deteriorating plaster that is beginning to expose rebar, which has started to rust. Due to its high water volume and noise level, we have seen a decline in engagement, particularly among younger children. While the zero-depth entry area remains a popular space for preschool and elementary-aged users, this feature no longer aligns with the needs and preferences of the community. We are proposing an upgraded water feature that is more visually appealing, aligns with the overall theme of the space, and is designed to be interactive and engaging for children. This improvement will better support play, creativity, and a positive user experience in the aquatic area. This water feature will also require an updated pump adjusted to the appropriate flow rate for the features needs. We explored play features from multiple vendors including Vortex, Aquatix, and Water Odyssey. The feature that was selected is from Water Odyssey by way of Horizon Commercial Pools. ## Structural Paint The pool area features large metal structural beams along the southern wall that support the window system. The existing paint on these beams is chipping, chalky, and no longer aligns with the current color scheme of the space. As part of this project, the beams will be repainted to create a cohesive, refreshed appearance within the aquatic area. The epoxy flooring in the observation deck area located in the northeast corner of the pool will remain uncovered by Aqua Tile. To ensure visual consistency, this surface will be recoated with a similar epoxy finish in a color that complements the new Aqua Tile flooring. Additionally, we are proposing to repaint the lower perimeter of the walls below the mural in a warmer tone that better complements the updated color scheme of the space. This improvement will not only enhance the overall aesthetic, but also refresh areas currently affected by chipping paint and staining, creating a cleaner and more cohesive appearance throughout the aquatic facility. We contacted 3 commercial painting companies. Fransen Decorating, JP Coatings, and High Performance Coatings. We are recommending going with High Performance Coatings. ## Sauna Refurbishment & Heating Element The current heating element for the sauna has reached the end of its expected service life and is in need of replacement. The proposed solution is to install a new heating element that is compatible with the existing structure and electrical wiring, minimizing disruption while restoring safe and reliable operation. In addition, the interior cedar boards of the sauna are showing significant signs of aging, including separation and wear. This deterioration not only impacts the overall appearance but also creates conditions where moisture could become trapped, increasing the potential for mold growth behind the panels. Replacing the interior cedar will improve aesthetics, address potential maintenance concerns, and extend the overall lifespan of the sauna. This project will be done with in house. Materials have been priced out. ## Water Slide Repair Small sections of the paint on the inside of the water slide is chipping. For safety, this needs to be sanded down and resealed. Fixing this will also extend the life of the slide until we can replace the whole structure in a future CIP cycle. In Lieu of multiple bids on this project we are working with the company that did the most recent waterslide refurbishment in 2019. ## Timeline These projects are expected to be completed in a 6-week time period beginning in August 2026. If granted approval for the above project items, we will move forward with scheduling work to be completed. A large portion of the work will be completed by Horizon Commercial Pools, which allows for easier scheduling, and ensuring the timeline is compatible. Our priority is optimizing the time that the pool is shut down by scheduling projects concurrently wherever possible. During the time that the pool area is shut down, BCC members will have the option to utilize the Monticello Community Center aquatic facility at no additional cost. ## Budgetary / Fiscal Impact: $529,000 has been budgeted in the 2026 CIP for this project. In total, the above items will cost $513,293.45. There is a variance of $15,716.55 for any unexpected costs. This project is not to exceed the allocated amount of $529,000. Overall, there are areas where we found a need for improvements that were more costly than budgeted such as the pool filter replacement cost. Fixing this will also extend the life of the slide until we can replace the whole structure in a future CIP cycle. In Lieu of multiple bids on this project we are working with the company that did the most recent waterslide refurbishment in 2019. ## Timeline These projects are expected to be completed in a 6-week time period beginning in August 2026. If granted approval for the above project items, we will move forward with scheduling work to be completed. A large portion of the work will be completed by Horizon Commercial Pools, which allows for easier scheduling, and ensuring the timeline is compatible. Our priority is optimizing the time that the pool is shut down by scheduling projects concurrently wherever possible. During the time that the pool area is shut down, BCC members will have the option to utilize the Monticello Community Center aquatic facility at no additional cost. ## Budgetary / Fiscal Impact: $529,000 has been budgeted in the 2026 CIP for this project. In total, the above items will cost $513,293.45. There is a variance of $15,716.55 for any unexpected costs. This project is not to exceed the allocated amount of $529,000. Overall, there are areas where we found a need for improvements that were more costly than budgeted such as the pool filter replacement cost. Certificate of Achievement for Excellence in Financial Reporting-Sarah ## Rathlisberger representing the MN Government Finance Officers Association explained the process to apply for the recognition. This distinction shows the city goes beyond the basics for financial reporting. There is a list of over 600 items that need to be completed as part of the application. This certificate is for fiscal year 2024. This is the third year the city has received the achievement. The reporting shows transparency and helps in receiving higher bond ratings. Job well done. ## B. The EDA met on April 13. The reserve funds and ideas to use them were discussed. Nothing was decided. They received planning updates on Luann Drive. The ## Fire Board met last night. The audit will be presented in June. Calls to date are similar to 2025. The grass rig is being rebuilt, and a new computer needs to be purchased. 7. Public Hearings-Mayor Kolbinger opened the public hearing at 5:14 PM. Jacob Sanders explained the change to the Building Permit Fee Schedule. Rum River goes by the State Building Code Fee Schedule; Becker goes by the 1997 schedule. The new schedule is more transparent on how some fees are calculated. Motion by Hendrickson, second by Olmscheid to adopt Resolution 26-29 allowing staff to enter into a contract with G&M Companies for the pond liner project on Hole 10 at Pebble Creek Golf Course. All in favor, motion carried. B. 2026 Street Improvements Bid Award – Phil Knutson presented the lowest bid received for this season’s street improvements. There were two base bids and one alternate bid. The lowest bid was from Capital Paving for $1,337,622.38 which includes the alternate. The engineers estimate was $1,750,566.62 so bids received were very favorable. The projects will be paid thru various CIP funds and a developer. Motion by Olmscheid, second by Henrickson to adopt Resolution 26-30 awarding a contract for the 2026 Street Improvement Project. All in favor, motion carried. C. 2026 Street Life Extension-Micro surfacing – Chris Lisson explained the process of micro surfacing to extend the life of pavement. This application can extend the life of the street by 6-10 years. The streets have been identified and bids were advertised. A portion of the funds will come from the MSAS for general street maintenance and Streets CIP. Motion by Dingmann, second by Hendrickson to adopt Resolution 26-26 authorizing staff to contract with Astech to complete micro surfacing work as described for a price not to exceed $128,600. All in favor, motion carried. ## 9. Administrator and Staff Reports A. Building Official Professional Services Agreement – At the last executive session, Rum River presented their proposal for fee schedule and a draft services agreement. Jacob Sanders provided the new contract which was reviewed by the city attorney. The current contract with Rum River is for $95/hour which will be cost-prohibitive. Motion by Hendrickson, second by Olmscheid to adopt Resolution 26-27 approving the professional services agreement with Rum River Consultants for designated building official services. Northland Securities TIF Assistance Professional Services Agreement-The city has received TIF applications for two potential districts as part of the LuAnn Drive SE housing development. Jacob Sanders had engaged with Northland Securities as they serve as the city’s public finance consultant. Since there is not existing contract, Northland presented an agreement to analyze the TIF proposals. Motion by Olmscheid, second by Dingmann to adopt Resolution 26-28 approving the professional services agreement with Northland Securities, Inc. for TIF analysis assistance. Proposed Change to Section 6.27 of City Code, Hours of Operation for Massage Establishments-Greg Lerud updated the language in the code to allow the current 6 AM – 9 PM hours to expand thru the weekend. The subject of data centers came up. Area communities are grappling with the topic. Becker has been dealing with data centers for a decade. When the Realtor’s Round Table was held the biggest concern was replacing the tax base with the closing of Sherco and solar farms. Pursuant to City Code, the city is authorized to issue a maximum of two cannabis retail business registrations, separate from lower potency hemp edible registrations. Retail registrations are issued on a first-complete basis to the first two applicants that submit the required local registration fee, provide proof of a valid state cannabis retail license, and satisfy all applicable city requirements. This application represents the first cannabis retail registration submitted to the city meeting those criteria. The city has received a complete application for a new Cannabis Microbusiness License Registration from Great Cannabis LLC, to be located at 14275 Bank Street, Becker, MN 55308. ## Key Application Details • License Type: A Cannabis Microbusiness license issued by the State of Minnesota allows limited cannabis business activities as authorized under Minnesota Statutes Chapter 342. Well #6 has tested near the recommended level for municipal water supplies, with a couple of the quarterly samples exceeding the recommended limit but the rolling 12-month average below the recommended levels. Because of this, the MPCA has requested to work with the city to site three monitoring wells within the city to see if they can identify the source of the potential PFAS. These two sites are in the industrial park; a third site is at the fire department with the Joint Powers Fire Board approving an agreement for that site already. Since the original identification of the PFAS, city staff have been working with the MPCA on monitoring and testing, this is the next step in that process. ## Board Commission / Committee Action: This was first received and discussed on April 17 th , with full details given last week. The MPCA is authorized to enter the Property to take these actions under Minn. Stat. § 115B.17, subd. 4 and § 115.04, subd. 3. ## Agreement 1. Parties. The Parties to this Agreement are: ## A. Minnesota Pollution Control Agency (MPCA); and B. City of Becker (“Property Owner”). 2. Access. The Property Owner hereby consents and provides authorization to the MPCA, its employees, agents, and contractors to enter the Property for the following purposes: A. To investigate and/or take such response actions as the MPCA deems necessary to respond to the release or threatened release of hazardous substances and pollutants or contaminants at the Property, including collecting analytical soil, groundwater, and surface water samples as depicted in Attachment 1. To facilitate groundwater sampling, MPCA contractors will advance temporary borings and stage investigation- derived-waste as depicted in Attachment 1. The precise location of the groundwater boring will be determined in the field following subgrade utility locating including positive identification via a vacuum truck (‘potholing’). 3. MPCA obligations. The MPCA will notify the Property Owner at least 48 hours before entering the Property. Work will be conducted during the hours of 8:00 a.m. to 5:00 p.m., unless the MPCA receives permission to conduct work during different hours. 4. MPCA and Property Owner precautions regarding work. A. The MPCA will conduct its activities to avoid unreasonable interference with the use of the Property. If the MPCA must disturb any portion of the Property, the MPCA will restore the property as close to its original condition as is reasonably possible under the circumstances. B. The Property Owner will take reasonable precautions to ensure that the equipment of MPCA and its contractors on the property is not damaged, and that the work being conducted by MPCA, its employees, agents and contractors is not disrupted. 5. Minnesota Department of Health (MDH) Permits and well sealing. The MPCA will obtain all necessary MDH permits for installation and maintenance of any borings, monitoring wells, remediation wells, and/or water wells installed by MPCA or its contractors, should they be necessary. All borings, monitoring wells, remediation wells and/or water wells will be installed, and upon completion of all necessary sampling or remediation, will be sealed in accordance with state law and MDH rules. 6. Notification. MPCA Liability. The MPCA shall be liable for injury to or loss of property, or personal injury or death, caused by an act or omission of any employee of the State in the performance of the work described above, under the circumstances where the State, if a private person, would be liable to the claimant, in accordance with Minn. Stat. § 3.736. 8. Effective date. This Agreement shall be effective upon the date it is signed by the MPCA. 9. Termination. This Access Agreement shall terminate six months from the Effective Date above unless extended by written mutual agreement of the MPCA and Property Owner or terminate fifteen (15) days after notification by either party to terminate the Access Agreement at an earlier date. 10. Rights of MPCA reserved. In accordance with Minnesota Statutes, the financial statements within the City’s Report must be audited on an annual basis. In addition, the city has elected to complete an Annual Comprehensive Financial Report, which meets and exceeds these requirements. The audit has been completed by Abdo, who will present at the May 5, 2026, council meeting to review the results of the audit with the City Council. A short summary of each of the three documents attached is below: ## The Annual Comprehensive Financial Report This is a document regarding the finances of the City of Becker and is prepared by the City. The Report includes narrative discussion, financial statements, note disclosures, statistical information, and much more. Maybe the most important aspect of the Report is the Independent Auditor’s Report which is issued by our external, independent audit firm, Abdo. The audit report outlines that the City has received an unmodified opinion, also known as a clean opinion, and is the best opinion that can be given. This is the fourth year the city has gone beyond the minimum requirements of generally accepted accounting principles and prepared an annual comprehensive financial report (ACFR) that demonstrates a spirit of transparency and full disclosure. The City submitted for and was awarded a Certificate of Achievement for Excellence in Financial Reporting for the 2024 ACFR which was the third consecutive receipt of the award. The City will submit the 2025 report for consideration of the Certificate of Achievement for Excellence in Financial Reporting (COA) program for the fourth year.
