Discuss the benefits of early planning and procedures on reconditioning water towers. Also discuss moving
forward with rehabilitating water tower #3.
## BACKGROUND/DISCUSSION
In July 2023, staff retained KLM Engineering to inspect and evaluate the condition of the City's three water
towers. Following the inspections, KLM provided recommendations for the rehabilitation and long-term
maintenance of each tower. Due to other capital priorities, including unforeseen costs associated with the
City's well system, the recommended rehabilitation project was not brought forward at that time.
Recognizing the importance of maintaining the City's water infrastructure, staff have since worked with the
Finance Department to begin setting aside funds for future water tower rehabilitation projects. Based on
the 2023 inspection findings, including delaminating interior paint and other maintenance concerns, Water
Tower No. 3 has been identified as the highest priority and is the first tower recommended for
reconditioning.
Staff invited KLM Engineering to attend the workshop to review the inspection results, explain the
recommended rehabilitation process, discuss the benefits of proactive maintenance, and outline the
potential cost savings associated with planning and completing the project before the tower's condition
further deteriorates.

## 3.0| COATINGS EVALUATION
## 3.1| Lead and Chromium Content Analysis
The total lead and chromium content of the interior and exterior coatings was not analyzed. Based on the
2001 construction date of the tank, and regulations in effect at that time limiting the use of lead or chromium-
based coatings, KLM anticipates that neither the interior nor exterior coatings are lead or chromium-based
paints and will not generate hazardous waste during reconditioning.
## 3.2| Interior Wet Coating
The tower was constructed and originally painted in 2001 by Maguire Iron, Inc. The interior wet coating is in
good condition with less than two percent visible coating failures above and below the high-water line (HWL).
Failures above the HWL consist of pinhole corrosion along the dollar plate weld seam and surface corrosion
in the roof rigging couplings, on the drywell tube rigging brackets, and on the overflow weir box. Failures below
the HWL consist of randomly located pinhole corrosion on the shell and bowl and isolated topcoat delamination
on the drywell tube. Minimal sediment accumulation is present in the bowl area. See photos in Appendix A.
## 3.3| Interior Dry Coating
Overall, the coating in the interior dry area is in good condition with coating failures limited to areas susceptible
to condensation, such as the drywell tube, bowl, and landings (sweating areas). The sweating areas have
approximately one percent overall visible failures. These failures consist of minor and isolated surface
corrosion on the bottom of the drywell tube and on the bowl. Additional failures consist of typical topcoat
delamination along the tower base plate. See photos in Appendix A.
## 3.4| Exterior Coating
The exterior coating is in poor overall condition with greater than ten percent visible coating failures observed
throughout the structure. Failures consist of pinhole corrosion on wear areas such as the roof manways and

handrail, and widespread topcoat delamination across the roof and upper torus plates. Staining due to organic
growth is visible on the lower torus and bowl, making the exterior appear dirty in those areas.
## 3.5| Replacement Coating Systems
When the next full reconditioning is required, KLM recommends preparing surfaces in accordance with NACE
guidance and applying a coating system for each area according to the following.
## 3.5.1| Interior Wet Coating
Surface preparation should be performed according to SSPC-SP10 Near White Metal Blast criteria.
Apply a two-coat system:
1. moisture cured zinc-rich
2. NSF 61 certified epoxy
## 3.5.2| Interior Dry Coating
Surface preparation should be performed according to SSPC-SP6 Commercial Blast Clean criteria.
Apply a three-coat system:
1. moisture cured zinc-rich.
2. polyamidoamine epoxy
3. polyamidoamine epoxy
## 3.5.3| Exterior Coating
Surface preparation should be performed according to SSPC-SP6 Commercial Blast Clean criteria.
Apply a four-coat system:
1. moisture cured zinc-rich
2. polyamidoamine epoxy
3. aliphatic acrylic urethane
4. fluoropolymer
## 4.0| STRUCTURE MODIFICATIONS
Structure modifications and repairs serve to bring the tank into compliance with OSHA regulations, AWWA
standards, and Department of Health regulations. They also improve areas of the tank that are prone to
premature development of corrosion, repair surface defects resultant from tank construction, remove
abandoned and unnecessary equipment, and improve tank maintenance capabilities.
The following is a list of recommended modifications and repairs to be included during the next reservoir
reconditioning. Detailed information important to each item will be determined when developing the project
specifications. Additional minor modifications, not impacting on the estimated project cost, may be identified
and incorporated at that time.

## 4.1| Interior Wet Modifications
4.1.1 Replace the gasket on the bowl manway. See photos 25 and 31.
4.1.2 Grind off all weld spatter and erection scab marks for compliance with AWWA D100-11.
4.1.3 Consider installing a submersible mixer in the tower to reduce the likelihood and magnitude of ice
formation in cold weather and prevent stratification in warm weather.
## 4.2| Interior Dry Modifications
4.2.1 Remove the cable bands in the drywell tube. Install cable brackets inside the drywell tube, equally
spaced, for the attachment of electrical and coaxial cables. See photos 26 through 29.
4.2.2 Install a pressure style manway in the drywell tube. This will improve the ventilation during
reconditioning and bring the tank into compliance with OSHA confined space entry requirements. Include a
manway step-off platform and hand grabs.
4.2.3 Replace the bowl drain plug with a stainless-steel freeze-resistant valve to better facilitate cleaning
and draining the bowl. Include replacement of the bowl coupling and install a clear, rigid, high-pressure hose
connecting the valve to the overflow pipe. See photo 31.
4.2.4 Convert the top landing of the riser into a condensate ceiling and install a drain in the low point of
the landing with a connecting line to the overflow pipe. This will prevent condensation from running down the
pedestal, exacerbating defects in the coating, and leading to corrosion and additional painting and
maintenance costs. See photos 32 and 33.
4.2.5 Temporarily remove the insulation and aluminum jacketing from the inlet pipe to facilitate abrasive
blasting and painting of the pipe. Reinstall after coating is complete. Replace any loose, missing, or broken
insulation on the inlet pipe. See photos 30 through 37.
## 4.3| Exterior Modifications
4.3.1 Install a climb assist on the exterior (roof side) of the drywell tube to improve safety while
transitioning in and out of the tube. See photos 43 and 44.
4.3.2 Remove the top +/- 6-inches of the drywell tube and wet access manway curbs just below the
existing side vents. Replace the manway lids with aluminum style lids. The existing lids are oversized and
can be a hindrance to open. The new lids should include a locking hasp and stop chain. See photos 44 and
45.
4.3.3 Replace the deteriorated rubber cover around the drywell tube with a new UV-resistant rubber
cover. See photo 44.
4.3.4 Install three hinge-covered ventilation manways on the roof, located outside of the roof handrail.
These will provide additional ventilation during the interior surface preparation and coating.
4.3.5 Replace the threaded rigging couplings with the same size unthreaded couplings with rubber
weathertight covers. See photos 44 and 47.
4.3.6 Install an additional corrosion-resistant, heavy-gauge, No. 24 mesh screen on the overflow pipe
outlet to comply with Department of Health regulations. See photo 60.

## 4.4| Cathodic Protection (CP) System
4.4.1 The reservoir does not have a cathodic protection system, and one is not required if the coating is
applied and maintained properly.
## 5.0| PROPERTY CONSIDERATIONS
## 5.1| Site and Environmental Considerations
5.1.1 The site includes the tank and the pumphouse in an open area with maintained grass. The site is
bordered by 198th Avenue to the west and the north of the tower. Cargill Animal Nutrition is located to the
south, and Storage Rentals of America to the east of the tower.
5.1.2 In conformance with Minnesota state rules, an analysis has been performed to determine the
methods of pollution control required for this storage structure during reconditioning. Precautions must be
taken to maintain air quality and to prevent the drift of dust and fugitive emissions. Such precautions shall
include, but not be limited to, the use of water or chemicals where possible or the use of a containment system
with negative air.
## 5.2| Telecommunications Considerations
5.2.1 The tower has some telecommunications equipment, including antennas, coaxial cables, support
brackets and other miscellaneous equipment. The Owner is advised to maintain accurate records of each of
the antenna sites on the tower, including as-built drawings, site manager and owner contact information,
upgrades performed, and future plans for antenna installations or upgrades. These records will help facilitate
the future reconditioning with a minimal amount of effort on the Owner’s part.
## 6.0| RECONDITIONING SUMMARY
## 6.1| Reconditioning Summary and Cost Estimate
KLM recommends the interior and the exterior coatings be inspected and evaluated again in three years to
monitor conditions, establish a rate of corrosion, and to determine a time frame for the next reconditioning of
the tower.
While not requiring repairs or coating replacement at this time, for budgetary purposes, if structure
modifications and interior and exterior coating replacements were to be performed, the estimated current cost
would be between $600,000 and $650,000. For competitive bids, the project should be bid 9 to 12 months
before the desired starting date.
An experienced tank-coating contractor with the proper crew and equipment should be able to complete the
project in 11 weeks. At the time of reconditioning, the tower will need to be drained and remain off-line during
interior structure modifications, abrasive blasting, and painting. However, most of the exterior structure
modifications can be performed prior to draining, with the tank in-service.

## 1.0| INSPECTION AND EVALUATION METHODS
Some or all of the following procedures were performed as applicable.
1.1| Methods
1.1.1
The inspection of the base metal and coatings on interior and exterior surfaces included only areas
accessible without scaffolding or special rigging. Where possible, the base metal and coating on the interior
wet surfaces were examined from either a rubber raft while the tank was being drained, by a Remote
Operated Vehicle (ROV) with the tower in service, or with both.
1.1.2 Tank plate thickness was measured at random locations on the liquid holding shell. The overall
structural condition of the tank was visually examined.
1.1.3 No structural analysis was done to determine if the tank design complies with the AWWA D100-11
Standard for “Welded Carbon Steel Tanks for Water Storage.” However, any observed non-conformance to
the AWWA D100-11 standard is noted in this report.
1.1.4 Although compliance with OSHA regulations was not a part of this inspection, any unsafe conditions or
violations of current OSHA regulation that were observed are noted in this report.
## 1.2| Examination and Evaluation Techniques
Some or all of the following procedures were performed as applicable.
1.2.1| Site
The tank site was evaluated for proper drainage conditions affecting access and lead paint abatement during
reconditioning.
Also, the following site dimensions were obtained: distance to fence(s), power lines, owner buildings, public
property, private property/buildings, school/playgrounds, public parks, and other property.
1.2.2| Foundations
The tank concrete foundation(s) were/was visually examined for cracks, spalling, conditions of grout,
indications of distress/settlement, and elevation above grade.
## 1.2.3| Tank Plate Thickness
Plate thickness measurements were taken using ultrasonic methods (UTM). The readings were taken using
a digital readout Elcometer MTG6 Ultrasonic Thickness Gage that has a dual element probe (transducer).
The probe’s transmitter element sends a short ultrasonic pulse through the material. The pulse gets

## 1.2.4| Coating Thickness
Interior and exterior coatings, where accessible, were tested in accordance with Steel Structures Painting
Council SSPC-PA2-18 “Procedure for Determining Conformance to Dry Coating Thickness Requirements”
using PosiTector-6000-F1 Type 2 gages.

## 1.2.5| Coating Adhesion
Adhesion testing of the coating to the steel, and inner coat adhesion, was performed by ASTM D-3359:
Shear Adhesion Test, Measuring Adhesion by Tape Test. In addition, subjective coating adhesion
evaluation was performed using a penknife.
## 1.2.6| Coating Serviceability
The estimated remaining coating life or serviceability evaluation was performed using a wide variety of
inspection instruments such as dry film thickness gauge, pen knife, Tooke gauge, adhesion tester(s), 30x
microscope and serviceability evaluation experience (minimum experience 10 years).
The instrument inspection was combined with a close visual inspection of all accessible coatings. This was
done to detect any holidays (misses), skips, runs, sags, surface containments, overspray, dry spray, poor
coating cohesion, inter-coat delamination, loss of adhesion to the substrate, adverse conditions of the steel
underneath the coating, or any other defects affecting the intended service.
## 1.2.7| Coating Lead and Chromium Content Analysis
Samples may have been taken of the various types of coatings present on the interior and exterior surfaces.
GPI Laboratories, Inc. of Grand Rapids, Michigan tests these coatings in conformance with ASTM D-3335

## PROJECT UNDERSTANDING
KLM understands the City of Big Lake will be reconditioning the South Water Tower in 2024. KLM has
met with City staff to review the project and discuss what is important to them.
The tower was built in 2001 and the coatings have protected the tower well for the past 22 years. The
2023 evaluation report indicated the coatings are nearing the end of their life cycle and the time has
come to recondition the tank to protect the substrate for continued service.
Key project team members were brought together to review the KLM evaluation report to prepare the
outline of services required to replace the coatings and bring the tower up to current AWWA standards
and Minnesota Department of Health and OSHA codes.
## BENEFITS TO THE CITY OF BIG LAKE
Today’s protective coating systems are designed to last 25-30 years with only minor maintenance. Tight
project specifications and full-time inspections give the coating systems the opportunity to realize their
intended service life.
1. The reservoir-specific submittals will be reviewed to verify conformance to the specifications,
AWWA, OSHA, and State regulations. KLM will respond in writing regarding the acceptance of the
submittals.
2. KLM proposes to prepare a technical specification package specifically designed for water tower
reconditioning. Our experience has shown that the more comprehensive the specification is, the
more likely it is that the project is completed on time, on budget, with quality workmanship. The
technical specifications mitigate requests for change orders during reconditioning.
3. Welding & full-time AMPP Coating Inspections during reconditioning assures that the work
performed by the contractor is in conformance with the specifications, as to maximize its life
expectancy. KLM’s inspectors monitor workmanship during all phases of work to verify the
contractor’s work meets the specification. Utilizing this process reduces reconditioning cycles
over the life of the tank.
4. Our project administration and inspection services provide a buffer between the project
specifications and the real-world challenges that can negatively affect the project performance.
To initiate the project correctly, KLM’s project management assures that a qualified contractor is
retained at an appropriate cost.
## TIMELINE
Upon execution of an agreement, KLM proposes the following schedule to perform the work:

## CONSTRUCTION SERVICES
## Construction Administration
The project manager and project supervisor work together on managing the project. KLM performs the
review of the submittals and communicates with the inspector daily to help enforce the project
specifications, as necessary. The project supervisor is the main contact between the contractor
representative and the Owner/Engineer. The project manager performs the final review of the
submittals and will assist the supervisor, as required.
## Construction Management Consists of The Following:
Attend pre-construction conference.
Periodically perform on-site review of project’s work status and report to the Owner.
Coordinate progress meetings, as necessary.
Review of meeting minutes.
Scheduling of inspections.
Project close-out administration.

The inspector assigned to this project will be an AMPP Coating Inspector and/or AWS Certified Welding
Inspector. All our inspectors have extensive practical experience and knowledge of water storage tank
reconditioning. They are experienced sandblasters, painters, climbers, riggers, coating inspectors,
welders and welding inspectors which allow the inspector to perform inspections alongside the
contractor to ensure the conformance to the project specification.

## Field Inspections Consist of the Following:
A pre-construction meeting with the client and contractor to clearly define the role of the Engineer
and Inspector, to discuss the intent of the specifications, and to ensure all parties agree to the
scope of work and expectations regarding the quality of work.
Monitor and approval of the structure repairs and modifications for conformance to the
specifications.
Inspection of the abrasive blasting media and equipment for conformance to the specifications and
to prevent contamination of surfaces during surface preparation with moisture and oil or other
contaminants.
Monitor the paint removal and disposal process for conformance to the specifications and
environmental regulations.
Monitor the contractors mixing and application of the coats for conformance to the specifications
and the coat manufacturer’s recommendations.
Approve surface preparation samples.
Record the contractor’s progress for adherence to the construction schedule.
Submit daily and weekly inspection reports & photos. Prepare and file copies of the reports on
construction activities.
Coordinate and review testing of materials for conformance to the specification and environmental
regulations.
Monitor punch list items and subsequent corrective action by the contractor.
Final inspection, substantial completion and project acceptance.
## ANTENNA INSPECTION
Antennas will be required to be removed during the reconditioning to receive the best contractor bids.
Antenna management if required will be by separate agreement.
## WARRANTY INSPECTION (2 Year)
KLM proposes to perform a ROV warranty inspection on the referenced tank prior to the expiration of
the performance bonded warranty. The warranty inspection will include an inspection report. The fixed
fee does not include any necessary warranty repair work required.

## TERMS AND CONDITIONS
1. AGREEMENT. The agreement between the parties when entered by the parties shall include the
applicable referenced agreement documents (i.e., KLM proposal/Agreement) and shall include these
KLM Terms and Conditions (the “Agreement”). The Agreement may not be modified except by
mutual agreement in writing.
2. ADDITIONAL SERVICES. Additional work or services shall not be performed without a KLM
executed change order or purchase order outlining the scope of additional work or services.
3. KLM CLIENT RESPONSIBILITIES. The KLM Client shall fully disclose to KLM its knowledge of
the condition of the project structure(s), its past and present contents and shall provide KLM with full
information regarding the requirements for the project; shall designate an individual to act on the KLM
Client’s behalf regarding the project; and provide safe access to and at the project site. When
reasonably requested by KLM, the KLM Client shall furnish the services of other consultants including,
but not limited to engineers and insurance representatives. The KLM Client shall test for pollution and
hazardous materials when required by law or as requested by KLM. The KLM Client shall provide
KLM with all necessary permits and other authorizations.
4. SAFETY. KLM shall be responsible for the safety of KLM personnel at the project site. The KLM
Client or other persons shall be responsible for the safety of all other persons at the project site. The
KLM Client shall inform KLM of any known or suspected hazardous materials or unsafe conditions at
the project site. If, during the course of the KLM services, such materials, or conditions are discovered
at the project site, KLM reserves the right to take measures to protect KLM personnel and equipment or
to immediately terminate KLM services. The KLM Client agrees to be responsible for, and agrees to
pay, any such additional protection costs. Upon such discovery by KLM, KLM agrees to use
commercially reasonable efforts to notify the KLM Client in writing, of hazardous materials or unsafe
conditions regarding the project site.
5. HAZARDOUS MATERIALS. Unless otherwise agreed to in the scope of work with the KLM Client,
KLM has no responsibility for the discovery, presence, handling, removal or disposal of or exposure of
persons to hazardous materials at the project site. To the full extent permitted by the law, the KLM
Client shall defend, indemnify, and hold harmless KLM, its employees and representatives from all
claims, including costs and attorney fees, arising out of the presence of hazardous materials or exposure
to the same on the job site.
6. SITE ACCESS AND RESTORATION. The KLM Client will provide KLM and its representatives
with safe and legal project site access. It is understood by the KLM Client that in the normal course of
KLM providing its services and work, some nominal damage to the project site may occur. KLM agrees
to take reasonable commercial precautions to minimize such damage, if any. Restoration of the project
site, if any, is the responsibility of the KLM Client, unless otherwise agreed to in writing in the scope of
work.
7. KLM LIMITED WARRANTY AND DISCLAIMER. KLM will perform services consistent with
the standard of care and skill normally performed by other like firms in the industry and profession at
the time of this service and in the geographic area of the project. EXCEPT AS EXPRESSLY
## STATED IN THIS SECTION, THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, BY
## OPERATION OF LAW OR OTHERWISE, PERTAINING TO THE PRODUCTS AND
## SERVICES SOLD UNDER THIS AGREEMENT. KLM DISCLAIMS ANY IMPLIED
## WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN

## NO EVENT SHALL KLM BE LIABLE TO THE KLM CLIENT, ITS AGENTS,
## REPRESENTATIVES, EMPLOYEES, CUSTOMERS OR ANY OTHER THIRD PARTY, FOR
## ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING
## WITHOUT LIMITATION LOSS OF USE, LOSS OF REVENUE OR LOSS OF PROFIT, IN
## CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT OR THE EXISTENCE,
## FURNISHING OR FUNCTIONING OF ANY ITEM OR
## SERVICES PROVIDED FOR IN THIS AGREEMENT OR FROM ANY OTHER CAUSE,
## INCLUDING WITHOUT LIMITATION CLAIMS BY THIRD PARTIES, EVEN IF KLM HAS
## BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. SCHEDULING. Prior to KLM scheduling its services related to the project, the KLM Client shall
furnish KLM with a written Agreement, purchase order or other written request for KLM services and
shall give as much notice as reasonably possible in advance of the time when the KLM services are
desired to commence. The KLM service schedule shall be mutually agreed upon by the parties in
writing. If a KLM inspection is canceled or delayed after KLM personnel and/or equipment are in
transit to the project site, then the KLM Client shall be billed, and the KLM Client agrees to pay for
KLM time and expenses according to the then current KLM Fee Schedule for KLM time spent and
KLM costs incurred. If KLM is unable to redirect KLM representatives to other third-party project sites
on the canceled or delayed scheduled service day, at a minimum, the KLM Client will be billed and the
KLM Client agrees to pay KLM for one (1) full day of KLM labor.
9. INSURANCE. KLM will maintain worker’s compensation insurance and comprehensive general
liability insurance. KLM will provide KLM Client with a certificate of insurance upon KLM Client’s
request.
10. PAYMENT. KLM will submit periodic invoices for KLM services provided and work performed.
Invoices are due upon receipt. The KLM Client agrees to inform KLM of invoice questions or disputes
within 10 business days of the invoice date. The KLM Client agrees to pay all undisputed KLM
invoiced amounts within 45 days of the invoice date. The KLM Client agrees to pay interest on all
overdue amounts at a rate of 1.5% per annum or the rate allowed by law, whichever is less, plus costs of
collection, court costs, and reasonable attorney fees on all such amounts. If any undisputed invoice
remains unpaid for 60 days, then KLM may, at its sole discretion, suspend or terminate services to the
KLM Client without liability.
11. INDEMNIFICATION. KLM shall indemnify and hold harmless the KLM Client and its shareholders,
directors, officers, members, governors and employees from liability, claims, losses, and damages
arising out of or relating to the applicable Project, provided that such claims, costs, losses, or damages
are attributable to bodily injury, sickness, disease, or death, or injury to, or destruction of tangible
property, including the loss of use resulting therefrom to the extent caused by KLM’s negligent acts or
omissions.
The KLM Client shall indemnify and hold harmless KLM and its shareholders, directors, officers,
members, governors and employees from liability, claims, losses, and damages arising out of or relating
to the applicable Project, provided that such claims, costs, losses, or damages are attributable to bodily
injury, sickness, disease, or death, or injury to, or destruction of tangible property, including the loss of
use resulting therefrom to the extent caused by the KLM Client’s negligent acts or omissions. Further,
the KLM Client shall indemnify and hold harmless KLM from all claims or losses arising out of the
unauthorized use of KLM’s Documents.
## 12. LIMITATION OF LIABILITY. IN NO EVENT SHALL KLM OR THE KLM CLIENT BE
## LIABLE, ONE TO THE OTHER, FOR INDIRECT, SPECIAL, INCIDENTAL, OR

## CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE
## FURNISHING, PERFORMANCE OR USE OF ANY PRODUCTS OR SERVICES PROVIDED
## PURSUANT TO THIS AGREEMENT.
13. DELAYS. If KLM service or work delays are caused by the KLM Client, by third parties, strikes,
natural causes, weather, or other circumstances beyond KLM's control, a reasonable time extension for
performance of KLM services and work shall be granted, and KLM shall be entitled to and the KLM
Client agrees to pay KLM an equitable fee adjustment.
14. TERMINATION. After seven (7) days written notice, either party may elect to terminate this
Agreement. Notwithstanding the foregoing, the KLM Client agrees to pay for all KLM services
provided and work performed through the date of termination. Notwithstanding the foregoing, the
following sections shall survive the termination of this Agreement: Sections 5, 7, 10, 11, 12, 15, 16, 21
and 24.
15. SEVERABILITY. Any provisions of this Agreement later held to violate a law or regulation shall be
deemed void, and all remaining provisions of the Agreement shall continue in full force and effect.
16. KLM'S DOCUMENTS. All reports, specifications, drawings and other documents furnished by KLM
are part of KLM's services and work for the KLM Client and the same are for use only for the project
(KLM Documents). KLM retains all ownership of said documents regardless of whether the project is
completed. The KLM Client may retain copies of the KLM Documents for reference purposes. KLM
does not represent or warrant that the KLM Documents are suitable for reuse on any extension of the
project or on other projects. The KLM Client shall not use the KLM Documents without KLM's written
consent
17. ASSIGNMENT. KLM may not assign this Agreement to any other person unless written consent is
obtained from the KLM Client.
18. AMENDMENTS. Any modification or amendment of to this Agreement shall require a written
agreement signed by both Parties.
19. NONDISCRIMINIATION. In the hiring of employees to perform work under this Agreement, KLM
shall not discriminate against any person by reason of any characteristic or classification protected by
state or federal law.
20. GOVERNING LAW. This Agreement shall be governed by and interpreted in accordance with the
laws of the State of Minnesota without regard to or application of conflicts of law rules or principles.
All proceedings related to this Agreement shall be venued in Washington County, Minnesota.
21. AUDIT. Pursuant to Minnesota Statutes, § 16C.05, Subdivision 5, KLM agrees that the KLM
Client, the State Auditor, or any of their duly authorized representatives at any time during normal
business hours and as often as they may reasonably deem necessary (but under all circumstances not
more often than once per calendar year), shall have access to and the right to examine, audit, excerpt,
and transcribe any books, documents, papers, or records which are pertinent to the accounting practices
and procedures of KLM, and involve transactions relating to this Agreement.

22. JOB SITE IMAGES, PHOTOGRAPHY AND VIDEO. During the term of this Agreement and
thereafter, KLM has the KLM Client’s permission to take photographs or video of the project site for
training, documentation, education or KLM promotional purposes. A signed Agreement that includes
these KLM Terms and Conditions constitutes the KLM Client’s written permission to KLM regarding
the use of the items and information set forth in this section.
23. WAIVER. The waiver by either party of any breach or failure to comply with any provision of this
Agreement by the other Party shall not be construed as or constitute a continuing waiver of such
provision or a waiver of any other breach of or failure to comply with any other provision of this
Agreement.
24. HEADINGS. Section headings used in this Agreement are for convenience only, have no legal
significance, and in no way change the construction or meaning of the terms hereof.
25. ENTIRE AGREEMENT. This Agreement supersedes any prior or contemporaneous representations
or agreements, whether written or oral, between the Parties and contains the entire agreement.

## BACKGROUND/DISCUSSION
The city has had a longstanding annual lease agreement with Mary of the Visitation Catholic Church, dating
back to the late 90’s. The lease agreement allows the city to utilize the open space adjacent to the City Hall
parking lot for outdoor community ice-skating rinks, a public warming house, and a space for a community
holiday tree. The city currently has two boarded ice-skating rinks, one open ice-skating rink, and a warming
house on the leased site. The city pays the Church $1,900 each year, and maintains the vacant area
throughout the year, which includes mowing the grassy area during the summer months.
Considering the future relocation of City Hall to a new location in late 2027 or early 2028, along with the
recent closing and potential sale of the entire Church property, staff is seeking council discussion and
direction on the possible relocation of the outdoor ice-skating rinks. The most current lease agreement will
end on December 31, 2026. If the city does not sign a new lease agreement for 2027, all structures must be
removed by the city prior to the end of the current lease.
In 2020, the warming house was closed to the public. With unpredictable winter weather since that time,
and the poor condition of the warming house, staff has not reopened the building for public use. Staff has
looked into the possibility of adding a self-locking door system to the building to minimize having to schedule
a warming house attendant, but found that the building framing will not support a self-locking door system.
Staff is asking council to discuss permanently removing the warming house due to its poor condition, and
direct staff to research potential new locations for an outdoor ice-skating rink.

## BACKGROUND/DISCUSSION
Lakeside Park has a fishing pier that is the responsibility of the city to maintain. Staff has noticed that over
the last few years sand has washed up around the entrance to the pier creating access issues, and is no
longer ADA compliant.
Staff reached out to the DNR Hydrologist to discuss options available to address the access issues:
• Option 1 – Excavation under the pier to create a level surface for access onto the pier. This option
would require a DNR work permit, which would cost $1,200.00 and requires an application
questionnaire and a detailed construction plan. There would be a required 30-day comment period
sent to DNR Divisions, SWCD, US Army Corps, and County. If approved this work would be performed
by the Public Works staff.
• Option 2 – Adding a dock section. This work would not require a permit from the DNR. The dock
section would be built to match the current dock sections and would allow for adjustability with
changing water levels. This work would be performed by the Public Works staff.
The DNR does not recommend Option 1 as it would be an ongoing maintenance issue and would require a
new permit every time maintenance is needed. The DNR recommends Option 2 and staff supports that
recommendation.
## FINANCIAL IMPACT
Costs to bring the Lakeside Park fishing pier into ADA compliance would be funded through Fund 198 -
Lakeside Park Allocation.
## STAFF RECOMMENDATION
Staff recommends Council authorize staff to move forward with Option 2 to bring the Lakeside Park fishing
pier into ADA compliance.

Consider authorizing the purchase of one additional City Hall fleet vehicle with a purchase price not to exceed
$10,000, funded through proceeds from prior City vehicle sales.
## BACKGROUND/DISCUSSION
As discussed at the June 17, 2026, City Council workshop, staff identified a need for an additional vehicle to support
City Hall operations.
Historically, vehicles no longer needed by the Police Department have been reassigned to the City Hall fleet for use
by Engineering, Code Enforcement, Administration, Inspections, and other City staff. As staffing levels and field
responsibilities have increased, the availability of City Hall fleet vehicles has become limited.
At the June 17, 2026, workshop, Council directed staff to investigate whether a surplus vehicle from the Fire
Department could be reassigned for City Hall use. Following discussions with the Fire Department Finance
Committee, it was determined that two surplus vehicles are being recommended to be sold to a local fire
department and that the proceeds will be used for the purchase of a duty vehicle for the Fire Department. As a
result, no surplus Fire Department vehicle will be available for reassignment.
The current City Hall fleet consists of three shared vehicles: a 2018 Ford Explorer, a 2002 Ford Sport Trac, and a 2004
Ford Sport Trac. These vehicles are used by multiple departments for inspections, site visits, meetings, training, and
other City business. As City staffing and operational demands have grown, the limited number of available vehicles
has resulted in scheduling conflicts and reduced operational efficiency.
Staff are requesting Council direction regarding the acquisition of an additional City Hall fleet vehicle. Staff
recommend purchasing a reliable four-door sedan or small SUV that can accommodate multiple employees traveling
to meetings, conferences, training, inspections, and other City business.
Providing an economical fleet vehicle for these trips would reduce the City's mileage reimbursement costs, which
are currently reimbursed at $0.725 per mile, while also reducing the City's exposure to potential liability associated
with employees using their personal vehicles for official City business. An additional fleet vehicle would also provide
greater flexibility in scheduling and improve the efficiency of daily operations.
If approved, staff would pursue the most cost-effective option available through Minnesota State Surplus Services,
local dealerships, or other sources. The goal is to purchase a reliable used vehicle with low operating and
maintenance costs for $10,000 or less.
Recent sales of surplus City fleet vehicles generated $14,150 in proceeds, including $10,250 from the most recent
auction and $3,900 from a previous City Hall vehicle sale. Staff anticipate these proceeds will fully fund the purchase
without requiring additional City resources.

As an example of current market pricing, staff identified a 2016 GMC Terrain with approximately 110,000 miles, an
estimated fuel economy of 20 MPG city and 29 MPG highway, and a sale price of $9,890. This example demonstrates
that reliable vehicles meeting the City's needs are currently available within the proposed budget.
## FINANCIAL IMPACT
The purchase will be funded entirely from proceeds received from the sale of former City fleet vehicles. Those
proceeds are currently included in the unallocated balance of CIP Fund 199 – Equipment and Building Replacement
Fund, and the purchase would be charged to that fund.
Because existing sale proceeds will be used, no additional General Fund appropriation or property tax levy increase
is required. Over time, the City also anticipates reduced mileage reimbursement costs as more employee travel can
be completed using a City-owned vehicle.
## STAFF RECOMMENDATION
Staff recommend authorizing the purchase of one additional City Hall fleet vehicle at a cost not to exceed $10,000,
utilizing available proceeds from prior City fleet vehicle sales.
Staff further recommend authorizing the Fleet Superintendent to complete the purchase of the most cost-effective
vehicle that meets the operational needs of the City through Minnesota State Surplus Services, a licensed dealership,
or other qualified source.

including all associated equipment, to another local fire department, and the use of the sale proceeds to
purchase a replacement Duty Officer Command Vehicle.
## BACKGROUND/DISCUSSION
At the July 7, 2026, Fire Board mee�ng, the Board discussed the poten�al sale of the Department’s 2000
Grass Truck 14 and 2001 Grass Truck 16, fully ou�ited with equipment, to a neighboring fire department
that has expressed interest in purchasing the units. The proceeds from the sale would be used to purchase
a newer Duty Officer Command Vehicle that would beter meet the opera�onal needs of the department.
Currently, Grass Truck 14 is being u�lized as the department’s duty officer command vehicle. While
func�onal, it was originally designed as a grass fire response vehicle and does not adequately meet the needs
of a command vehicle. Replacing it with a dedicated Duty Officer Command Vehicle would provide improved
func�onality, reliability, and efficiency during emergency responses.
In July 2025, both the City and Township authorized the sale of the skid unit equipment, including the tank
and pump from Grass Truck 14. However, there was no market interest in purchasing the equipment
separately.
Staff es�mates that the sale of both fully equipped grass trucks could generate approximately $35,000. Those
proceeds would then be applied toward the purchase of a newer Duty Officer Command Vehicle.
The Fire Board approved moving forward with the sale of both vehicles and authorized the purchase of a
replacement Duty Officer Command Vehicle with the following condi�ons:
• The purchase price shall be no more than $10,000 above the proceeds received from the sale of the
two grass trucks.
• The goal is to complete the transac�on with litle to no net financial impact to the City and
Township.
The purpose of this agenda item is to obtain direction and consensus from the City Council and Township
board before moving forward with the proposed transaction. If consensus is received, staff will work with
the interested fire department to obtain a formal purchase offer for Grass Truck 14 and Grass Truck 16 and
identify a replacement Duty Officer Command Vehicle that meets the Fire Board’s approved budget

parameters. The proposed sale and purchase will then be presented to both governing bodies for final
approval, for the City that would be at the August 19, 2026, council meeting.
## FINANCIAL IMPACT
Based on current estimates, the maximum additional cost to purchase the replacement Duty Officer
Command Vehicle would be $10,000, which would be shared equally between the City of Big Lake and Big
Lake Township. Staff anticipate that the sale proceeds will offset the majority of the purchase price,
resulting in a minimal financial impact.
## STAFF RECOMMENDATION
Staff recommends that the City Council and Township Board provide consensus to proceed with negotiating
the sale of Grass Truck 14 and Grass Truck 16 and the purchase of a replacement Duty Officer Command
Vehicle, consistent with the parameters established by the Fire Board. Staff will return with the final
purchase and sale agreements for formal approval at the August 2026 meetings.
