Appointment of School District Legal Counsel (Agenda Item 7.1)

3-3 Motion fails.

Dissent: Member Corkran, Member Tyson, Member Christensen voted no. Member Antonson, Member Castle, Member Rebeline voted yes.

Moved by Member Antonson [29:00] · Seconded by Member Castle [29:00]

Public comment raised concerns about Mr. Beck's professional stability, the ambiguous identity of Beck Law Group, and his lack of specific experience with public school districts. Board members questioned potential conflicts of interest given the Chair's prior professional interactions with Mr. Beck and debated whether current district legal counsel could adequately address elected official-specific concerns. Superintendent Massie indicated that current counsel could provide legal guidance on policies from a district-wide standpoint.

Determine Next Steps in the Superintendent Search Process (Agenda Item 7.2)

6-0 Approved Unanimously.

Dissent: None

Moved by Member Antonson [1:04:00] · Seconded by Member Castle [1:04:00]

The board reviewed presentations from Ray and Associates (represented by Dan Bitman) and MSBA for the superintendent search. Discussion focused on the firms' experience, approach to candidate recruitment (active vs. passive), handling of existing applicant pools, and ability to foster board unity. Many members had positive feedback from references for both firms, but a preference emerged for Ray and Associates due to its active recruitment strategy, willingness to engage with previous applicants, and the lead consultant being a former superintendent. The board also recognized the opportunity for the search process to bring cohesion to the board.

Dissent: None specified, implying unanimous approval among those who voted.

Moved by Member Rebeline [1:20:00] · Seconded by Member Castle [1:20:00]

Following the amendment, the final motion was to utilize the previous school board vacancy application form, updated to contain only statutory verbage in the affirmation section, and to post it as soon as possible with a March 16th deadline for applications. The applications would then be reviewed at the March 19th school board meeting. Previous applicants are not explicitly barred from reapplying, but the new process indicates a fresh start.

Notable Quotes (12)

Mr. Beck's lack of experience representing public school districts is probably the biggest red flag because it means he's not qualified to represent Forest Lake Area Schools. While Mr. Beck's case history and affiliation suggests that he's very comfortable suing school districts. School law clearly isn't his area of practice.

Claire L [2:00]
Appointment of School District Legal Counsel (Agenda Item 7.1)

I'm wondering if that is a conflict of interest or... just to clarify, so that Beck Law Group then you have worked with them in a personal capacity or in a capacity of a previous position vote.

Member Tyson [30:00]
Appointment of School District Legal Counsel (Agenda Item 7.1)

I would say that um I would have a degree of confidence that they could provide opinion on both of those policies. Um, clear certainly from a districtwide standpoint, which would I would assume encompass elected officials as well.

Dr. Massie [37:00]
Appointment of School District Legal Counsel (Agenda Item 7.1)

Our council must be perceived as neutral, professional, non ideological, and focused on district matters, which I'm for other reasons that we've discussed at the last meeting. I don't think Alec Beck um you know would would check those boxes.

Member Christensen [39:00]
Appointment of School District Legal Counsel (Agenda Item 7.1)

He said he is knows Dr. Massie. He knows this area. He's, you know, from the Twin Cities and the greater area up here. He's got the family and he said he wants to give back and give our community a positive experience that we can feel good about and proud of.

Member Antonson [49:00]
Determine Next Steps in the Superintendent Search Process (Agenda Item 7.2)

The candidate pool did not prove to have the depth that they were hoping for given that he was a superintendent. They thought it would be he thought it would be better their their board their full board did. He said specifically in our case, we didn't get many candidates from the metro area.

Member Tyson [52:00]
Determine Next Steps in the Superintendent Search Process (Agenda Item 7.2)

MSBA wasn't willing to take our current applicant pool that we have. They said they would be willing to encourage the individuals who have already applied to the district to apply again through the MSBA system where my conversations with Ry and associates were the exact opposite. They said, you know, you send me the names and I'll get to work tomorrow morning on vetting them out.

Member Rebeline [1:02:00]
Determine Next Steps in the Superintendent Search Process (Agenda Item 7.2)

I mean to me MSBA to member Corkran's point is the gold standard. Um I did um Ray and Associates would be my second choice. And I just think that um you know this might be a good opportunity for us to come together. I mean we need a search firm. We need to get this going. Um so I'm I'm willing to vote um for Ray and Associates to get this moving and to have us come together.

Member Christensen [1:07:00]

Maybe that's something we want to consider for them helping facilitate the discussion... just with like in a workshop with just the board members or is this a public meeting I don't know.

Member Corkran [1:15:00]
School Board Vacancy Discussion (Agenda Item 7.3)

I am not directly or indirectly involved in any group that aim to overthrow the United States government. I am not part of any groups that promote directly or indirectly hate or violence against elected officials and or publicize dishonest information or deceitful propaganda about ISD 831.

Joy [1:20:00]
School Board Vacancy Discussion (Agenda Item 7.3)

I would take that part out and just keep it clean. I I you know, again, I don't have it in front of me, but... Can it just additional? Yes. Yes. That is my motion is to follow the statute.

Member Christensen [1:21:00]
School Board Vacancy Discussion (Agenda Item 7.3)

My only question question is February 23rd may be too early for paper postings due to deadlines, but we may want to go March 23rd given that if you're looking for a longer... I think member Christensen would just like it to follow the statute. Yes.
