all right um call the order here the city C meeting of January 4th 2024 uh Kim would you take a roll call please council member here council member Wilson here council member Hatton here mayor Bishop here will you join me in the Pledge of Allegiance please I pledge Alle to United States of America and to the Republic for which it stands one nation under God indivisible Liberty justice for all the uh first order of business is that we adopt the agenda I make a motion that we adopt the agenda is there a second I'll was that a second from you Tim yeah I'll second that all in favor I second thing on the agenda is the consent agenda um in which a is approved monthly claims and B is the November 2nd 2023 city council meeting minutes is there any discussion concerning the consent agenda can I have a motion to approve it I will approve the consent agenda I'll second the motion all those in favor I I at this point we have uh the third uh thing on our agenda which is public comments apparently there's a concept plan review by Bob Lind um actually I guess what I'd like to propose is uh to do the basically the same thing I did uh a little bit further uh North up the road for 1656 Z Second Street north um is just to put up a another shop um uh just if you have the the lot um do they do they know where the lot is at yeah I put the PS on the agenda so they were able to look up if they wanted to it is a vacant lot though right yes oh yeah yeah it's vacant it's full of trees um so I guess the reason I'm here is um to see if I could move forward with that um as far as purchasing the property and then um just do the same thing that I did right down the street um with this one I'll just jump in here um Boba had contacted me and and we discussed this and I suggested he come in for a concept plan review to get some feedback from you guys um I would tell a little bit more about what uses yeah and and then if we we need to if the use if it's the same as the other thing a cup would be required and kind of based on uh your feedback he will proceed move forward with the Cup app so basically what what I have um in in our current shop right now it's uh myself uh for Linn uh landscape and ly bus company and we have uh four of the Stalls and then we have shine Windows who has uh two of the stalls and um uh their their business is growing and um uh so they they need more space and I'm actually going the opposite direction I'm not looking to we're we're downsizing basically in everything that I do um and my son will take over the landscape company so so basically what I'm I'm trying to do here is uh um I I did my landscape and my limo bus company out of out of my house in West Lakeland for for 20 years um and I had a uh a 6,000 ft um shop SL garage it was it was technically 2 200 ft on the bottom level 2500 in the middle level and then it had 1,000 squ ft on on top and uh um I I know how hard it is for uh contractors whether you know I'm a landscaper it could be a concrete guy uh welder whatever it may be um I I know how difficult it is to uh work out of a residence um and I had 10 acres um and we still had some you know issues there with uh some of the neighbors uh they just don't like you doing what you're doing out of a residential uh place even with a conditional use permit and all the proper things that you need to run your business out of your home so long story short I'm just trying to look after other small business contractors is what it's going to be no retail uh no late hours it's going to be basically Sun up till sun down um and keep it as lowkey as we possibly can um so that that would be the people that um we'd be targeting is uh people that are going to get there at 7:00 in the morning and people that are going to go home by 7: at night so I take it from what you've indicated Bob that the um you would not be occupying any of that building uh I I can't say yes or no at this point right now it all depends on how it pans out with the shine boys if they take over our current shop then then yes I will be moving over to the new one and if I stay in my current shop then they'll probably be moving into the the newer one so that is yet to be determined how much land is there it was like 1 Point uh little over an acre and um I pretty positive I know where it is but uh uh is there um any residential homes on either side of it in front back or something okay it's just the the two empty lots that are uh north of uh Mayday um so I have not I I I kind of drove in there uh probably a couple years ago um when Tellis had it listed um I I think his name was Steve um I I talked to him a few times and we were kind of interested in it back then and then then it just came off the market um so it's technically not even on the market right now but I I've talking to the guy directly and um uh so I I know for a fact there's houses um on the on the east side of the property and on the north side of the property and I I know what I did uh at our current shop was um they allowed me to put up a 6ot fence and um uh so I have I have it fenced off on two sides of that property and um uh I I uh put a bunch of arbores up uh for one of the neighbors um and then on the other neighbor I asked him what he wanted and he just said he would just take a bunch of lilac so I I got him a bunch of lilac uh bushes and planted them for him so um yeah whatever I need to do to um so it's on the north side of the MayDay has the building and then the empty lot where the car lot so you're looking at the north side of that street yes yes I think yeah okay and mayor and council members I will note it is Zone commercial commercial yeah and in terms of screening and plantings those would all be made conditions of of approval you guys can require that he do that same thing for those neighbors and so would the uh building be approximately the same square footage as the one you're presently uh I would work with Kim probably on that because um it's that lot is exactly twice the size of our current lot and um I would probably try to maximize uh what I can uh there uh permeable versus impermeable whatever whatever I can do as far as square footage um I would take advantage of so if it's if the lot is twice the size I'm assuming it'll probably be uh up to 14,000 square ft because our current building is 100 by 70 mayor and council members I will note that um any building size would be subject to city organes has to make the setbacks he would also have to go through the wmo for the impervious and get that approved so it would meet current ordinances whatever the size ends up being MH I don't know if there's any I know you the lot you were on Now you had some pipeline issues but I don't know if there's anything that goes through there or not yeah no I wouldn't have the issues on this lot that I had on that other one yeah you know you got City Water septic as long as you have that area SE section of I mean is is that Second Street there if it is it's Second Street South um I'm on Second Street North I think that's First Street is it first street it's First Street that Larry Supper Club don't damage the news Paving we did there PVE the street so your uh any kind of entrance to it would be coming off of First Street yes yes I wouldn't even attempt to come off of uh St C Trail um I I tried that with the other one and um it it didn't make any sense and it it it also didn't make any sense to go in between two people's houses either to get back to our shop but that's that's what they had me do and you know it was it was a little bit of a tough go at first but I get along with the neighbors all of them just is fine um if they need anything if they have any issues any problems whatever they just they come right to me and I I address it but we keep it as quiet as we can and there's just nobody coming and going so how many square feet if if it's um if the lot is twice the size of what we have right now I'm I'm going to try for the maximum size which I'm I'm assuming it would be 14,000 ft and then would there be a second floor slot too just just like a garage space no office or well ret no no retail no retail okay no retail um uh it's going to be if if they choose to have a a mezzanine uh for an office yeah um then uh that would be that would be on the structural plans um and I didn't have anything like that on the structural plans at the first one I I learned a lot put it that way uh the first time around and um we we made it through and um the shine boys do have a a little office up above and it was all approved um so if I I will have tenants well before that thing is even built that's that's how demand the how high demand so it might have to be sprinkled or um well I know every 5 have the waterline Fe like we had the last time cuz he never notified the fire department the city or nothing and they shut down that street bu whoever cut who dug dug through the he I think he did a lot of things that he wasn't supposed to do so we have to make sure that any of that has to PR pre- plan and we have to get it to the fire department to have them look at it all of that she'll take care of that yeah if there's if the application comes in with all the required submittal um a survey uh detailed s plan size building architectural everything and that would all be reviewed by your Consulting Planner yeah and the wo so I can assume that Bob that uh this is just uh an effort on your part to alert us to the fact that you might be doing this yes and um but you understand walking away from this uh uh informational meeting uh that um there have been no uh promises or anything given to you that uh as to what we would approve or would not approve yeah I just wanted to you know get in front of you guys and just kind of give you heads up as to what was going on and um and May and council members like I said I did suggest that he do this to get some general feedback from you there's no plans to review at this point um but also to give you a chance to raise any concerns that you may have within his application um kind of like just for example Landscaping that would be you know re the reason I brought up the the fire because other at our fireboard meetings there's other communities where they haven't taken care of that and now that's being an issue so they're making us make sure whenever you do something we get it looked at first which is a great cuz we don't want we don't want him to have to come down and say he can't open up until you get that sprinkled and then he doesn't have the money for it like this other building in well it is commercial to the fire department what have yep they they came in everything that we're going to do whether um I know if things did not change from the time that we built that building to now it was 5,000 square ft and we do have a a big firewall in that building yeah um so if if we can do it that way that would be my first choice um and if we can't I would have to sprinkle it yeah cool okay I I have no further questions thank you Bob okay thank you guys going to Issue four um unfinished in new business we have the consideration of resolution number 20241 the fee schedule is there any discussion on whether any of these should be altered in any way Kim I was going to just say mayor council members there were no changes for last year um I don't see the need to revise any of these fees at this time any questions from the city council no that was the only one I had if there were any changes and I didn't even get to ask it dang um so uh can I have a motion to approve the resolution number 202 24-1 2024 fee schedule I will make a motion to approve resolution 20241 uh I will second it all those in favor I I going to B which is consideration of resolution number 20242 appointment list thanks thanks guys thank you Bob uh mayor and council members I did clean it up a little bit uh just for example um uh change out the city treasure um because Neil was listed um put Joan on um stenland oh the typing didn't work they're in columns sorry I'll it's not stenland um stenland uh inspections uh Dewey is semi yes sem semi retiring he's working the year with his son and his son is taking over the business um his son is already already been doing a lot of things so um ising he did all the commercial stuff for us so I recall yeah y yep so um so it is still uh stenland inspections I know I'm old I coached him in hockey um I have already revised the applications with the new address and email and so on and so forth so just up the road um oh the other change is the City attorney um the gentleman from Kelly uh larkson is um retiring I am recommending Lakes National Law Firm who is Joel holstead he's the City attorney for Albert Lee he is local though he is out of white bear um I actually work with him so there will probably be some um pre legal advice and his was his fee was incredibly reasonable um $175 an hour much lower than any going rate so that was the only other change that I had made is there any uh discussion anybody want to change their position here like the culbert inspector or um you know anything else that might uh you know you have any great interest in or would you like to leave it pretty much as it is I take it since uh I don't hear anybody speaking up that uh we need at this point to have a motion to uh approve resolution number 20242 appointment list I'll make a motion to approve 2022 O2 appointment list I'll second it all those in favor I I going to C under four is consideration of res resolution number 20 2403 flashing pedestrian light um Kim can you give us a little background as to how this came to your intention yes mayor council members um the is it five cities yes okay uh discussed this at was it safety meeting saf or I'm sorry the five City meeting the five City meeting um the five cities uh came to the conclusion that they would like to get get a safety FL at that intersection it is a County Road it is up to the county so they were requesting um all the cities pass this resolution and then they're going to submit them to the county and see what happens and is it my understanding that this would be just across uh County Road 18 but not necessarily Fourth Street it's just at the roundabout intersection of County Road 18 adjacent there's only one school pedestrian on the north side of the Circle North Side okay is there any further discussion concerning uh resolution number 20243 flashing pedestrian light I have a motion I'll make a motion 2020 403 Fast Flashing pedestrian light for approval I'll second it all those in favor I going to 4D consideration of resolution number 20244 uh 2024 election judges Kim I'm assuming that uh from looking at the list that this is similar to what we've had in the past I know Joanie and Judith are um are the other three uh people that have we worked with before yes they they are they all have been election judges uh this is quite honestly keeping for the county um it is the city is allowed the your elections official if any of these people can't make it there and there are three elections this year um they can absolutely appoint somebody else on their own uh that doesn't have to be approved all the judges do have to go through required training do they have to live in the city no no they don't okay going I have a motion then if there's no further discussion uh for uh approval of resolution number 20244 2024 election judges I make a motion to approve our 20244 d404 for the election judges resolution I will second that all those in favor I I going to 4E consideration of resolution number 20245 2024 polling location which would appear from the resolution in front of me is at Embrace Church kitchen table at 16600 7th Street South Lakeland Minnesota 55043 is there any discussion concerning this Mr Mayor and council members I just will note that um again this is another paperwork go but it has to be done and uh your elections coordinator has already reserve the church on those election days so okay they're all set uh that would be meld uh can I have a motion as to uh resolution number 20245 2024 polling location I'll make that motion uh I'll second it all those in favor I I and then finally under four is 4f uh we have uh adopt earned sick and safe time employ policy I'm assuming that this is once again something that is supposed to be done by each City within the county um again it's my understanding I but I could be wrong that uh the way I've read what limited I've read about it uh is is that we really have no employees that qualify for it is that correct with that in mind is there any further discussion somebody please make a oh we're not U approving this one what are we doing yes yes we need to approve it just a motion need to adopt the poliy yep y um have a motion to adopt the earn sick and safe time employment policy I will second that all those in favor I I I uh go to item five under uh B for today Council and staff reports staff updates city clerk uh mayor and council members I'll just note uh in the past for your January meeting I've had the uh meeting schedule on the uh agenda for you to approve just to give you guys something to do um I didn't do that tonight but I I could wonder I couldn't sleep but I I'm going to be worried about that for a month I did do a calendar um I believe the only conflict of course is uh 4th of July week and if there is a July meeting that is scheduled for June 26th which is Thursday before okay um and this will be posted on the on the website so that's my only update other than that it's the first Thursday of every month Y and is there anything additional Kim uh just that it is noted that uh all meeting times dates are subject to change or be canceled so which is on the notice so people know okay any uh comments from Individual council members starting with uh Tim schroer uh some of the neighbors have contacted me they like the streets uh with all the co and that people are out walking biking skateboarding and uh they like the nice streets go up and down I did notice it tends to have people drive a little faster but that's about it well I'm just glad that you're getting some credit for all the work you've done in the streets because people seem to call you more than they ever call me so I appreciate your efforts you know I'll tell you a story later okay uh Tom Wilson I have nothing damn hat yeah no nothing I've uh really have nothing uh the um I was going to comment that I thought what they've done towards the end of the year as far as snow removal has been incredibly good and um with that in mind uh I would entertain a motion to uh adjourn the meeting
