Staff recommended revocation of the CUP because it was the fifth cannabis license when the city had capped them at four, the applicant had not moved forward, and there were outstanding unpaid invoices. The applicant was notified but did not attend the meeting to be heard. The council approved the revocation.
Request for approval of the extension of the conditional use permit at 14608 60th Street North
Dissent: Mayor Doughty voted against tabling the motion, preferring a decision at the current meeting.
Moved by Councilmember Swenson [33:10] · Seconded by Councilmember Liljegren [34:25]
The council previously tabled this item. Concerns arose from the property being listed for sale, suggesting an intent to monetize the CUP rather than operate the business. The applicant explained the listing was for market valuation purposes and not an active sale. Delays in construction were attributed to a contract allowing the existing business (Joseph's) to operate until year-end. The City Attorney advised against adding a non-transferable condition to the CUP. Ultimately, the council tabled the item to a future meeting for further negotiation and documentation from the applicant regarding their good faith efforts.

Uh before you here is a revocation recommendation for a CUP that was issued to Power Plant Cannabis Shop 2 LLC. Um this is for the old McCormick's uh furniture site. Uh this was approved by council here in January of of this year. Uh this, if you recall, was the fifth cannabis license. We've capped it at four. Uh they haven't moved forward uh since that time, too. They've had some uh outstanding invoices that have not been paid to the city.
And if I could, Mr. City Administrator, just to confirm, I think you had some actual interactions with the applicant, and so we know that they got the notice and were aware of it.
Um obviously seeing this, you know, retail property for sale with CUP approval, um looks like their intent has been to uh monetize, you know, this CUP um here.
Um that listing was a very old listing. It was only out for a very short period of time, and that was really to help us derive some market data with regards to evaluations.
I think based on our discussions right now, the furthest I'd go would be tabling this to our next meeting, which would be still within your one-year period. It'd be October 27th for the purposes of you providing documentation that this was a valuation decision that you do all swear. That'd be as far as I'd feel comfortable going given our condition of were you good in good faith utilizing it?
I don't I I'm not particularly comfortable with that simply because in general the concept of a CUP is something that runs with the land uh by definition under state law um and so it would be transferable to future owners.
