um August 8th so order first is the place Pledge of Allegiance I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all for the agenda for tonight and it'll be under a new business item e new SWAT rifle to be purchased from contingency next is Council staff reports um I have a few meetings coming up the next couple weeks with League Minnesota cities national league and Metro cities and then I did attend the neighborhood meeting last week regarding the stop sign on 58th Street that's it councilmember Dougherty I have nothing to report councilmember Johnson I attended night two night this month as well as the neighborhood meeting thank you um councilmember uh just an update that the Planning Commission will be meeting on Thursday the 10th 6 p.m and we do have a couple public hearings thank you councilmember 1. I was also at the neighborhood meeting the other night and that's about it thanks um next is Staff reports Chief Hanson you uh Mary console just a couple of things first of all thank you everybody that attended the night to unite event we had our largest turnout we had approximately 13 block parties that was an awesome response hopefully we get that again next year even though the weather was a little rainy but everybody came out so it was great new hire update hopefully uh next councilman will have a a confirmation or for you guys to approve our one of our new hires so that's moving right along and then we are back on an additional one so hopefully that comes to an end here in the next month or two and then lastly just an FYI we do have the Ragnar events coming up to Foot Race you'll see approximately 220 teams consisting of 220 Vans driving throughout the area of Oak Park and Stillwater throughout the entire day of Saturday it's kind of spread out and even into the evenings but they'll be occupying the part of the high school parking lot as their event checkpoint so this should be quite a quite a bit activity but they're going to primarily just use the bike path and not walking path so it should be too much disruption but you'll see a lot of unique Vans with heavy painted phrases and signs and stuff running around our city in Stillwater so that's it mayor thank you next is assistant City administrator pinski mayor council Jennifer and Dave Smith at 5725 Newgate Avenue North were chosen as the most recent recycling Award winner next is our visitor public comment section and we have two visitors tonight that I invited and we would like to thank them both Senator Housley and representative Hill so can you come up um Senator Housley we'll have you come first we can both come on thank you so much for all of your help this last session with all of the efforts and um we did really well with Oak Park Heights on behalf of both of you with all of your you worked hard thank you very much um you get the you get the bipartisan support uh in this District not all of them get that first of all I say hi neighbors you know who you are neighbors um and it was fun to see some of you at night to unite and we did a bunch of them until it started to rain at 6 30 and then I was off to Hugo for an inside meeting it was a busy session um the busiest I've ever ever gone through this was my 11th session um one party control we had that in 2013 and 2014 when Governor Dayton was the governor but that was a lot slower than this session was there was so much pushed through quite quickly I I think quicker than I wanted it to so some of it we're we're realizing now that still needs to I call it clean up and aisle eight so when we get back to session next year we're gonna have to fix some of these things just to make sure that the language is clear because I know um with the the laws that just passed or went into effect August first there's a lot of questions around them so still still seeing how all that plays out but both Park Heights was at the top of Representative Hill in my agenda in the king power plant and we were happy to get that in some of the funding in the bonding bill this year my new role was the minority lead on the capital investment committee so it was it was fun to kind of have a little bit of control of what the Republicans say is in that bill so um I'm going to keep that gig for all all the cities and municipalities in my district um also I brought a bunch of pins for you guys because I didn't give these away during the fair we just finished the Washington County Fair five days of I'm there every day 10 a.m to 10 p.m um so so so much fun uh probably the number one well there's two of the biggest questions now you can say what your yours were your booth but we get different people at our booths different people we had some we had some overlap um for me it was mostly the the questions surrounding legalizing marijuana that was that even from law enforcement and County Commissioners they were asking a lot of questions so that's that's what I think we really have to do a deeper dive on and also um giving the money back with 17 and a half billion dollar Surplus I think some folks were disappointed that they thought maybe they were going to get two thousand dollar checks back but they're only getting less than 200 so those were my two biggest questions at the fair um we both are and I'm sure you talked to Anne lincheski to going to be authoring the bill for the bonding bill for phase two of the king power plant and hopefully we can get that next year we're starting our bonding tour next week we won't be coming to the Metro until way into the fall but we're starting up in Northwest Minnesota but the two of us will be dropping that bill soon and you know what it's been so great working with Josiah I have to say representative Hill um he's worked really really really hard and he listens really well too so not just to me but but he did an amazing job for his first session so I want to thank him too because it's been it's been great working with him and hopefully when the bonding tour comes it's not snowing and bright cold like it's been the last several times and we'll do it again separately so Josiah will be here when the house does the tour and then we'll do it when the Senate comes so I'll give you these and then the meteorologist first yeah yeah there you go I'll check well a couple of things thank you mayor McCumber and to the council members for the opportunity to be here and I want to Echo a lot of the things that Senator Housley said I want I want the people of Oak Park Heights to know that they're in really good hands with the work that mayor McCumber does she is someone that is known at the Capitol and somebody that knows how to operate down there and so I am very confident as we move forward with next year's bonding request to continue the work down at the the king plant and the work that we are putting in place for when we stop burning coal down there to make sure that Oak Park Heights has an opportunity to use that space and use it as soon as possible a couple of things about the session what an honor it has been to represent the communities that raised me here in the Saint Croix valley and what a moment to have arrived and the the number of things that we believe have been kind of caught or stuck over time we're so thrilled to have to make some motion and so as we look ahead and look at the record-setting Investments that we placed in the great state of Minnesota and the great things to come the work is never done you know we're looking forward to getting back there and continuing to fight for our communities and I would Echo what uh what Karen said a great partnership working for our communities here and uh so proud of the things that we were able to bring back to the valley so thank you for this opportunity to be here and what an honor well thank you so much for both of you coming we really appreciate it was a little tough trying to get everything coordinated until now but just know that you are very much appreciated for all the hard work that you've done for our city thank you thank you anyone want to say something thank you good now we're going to watch the baseball field I might take my associates out here before there's a an answer but I really talked earlier you were worried and you young ladies were just perfect your Dad should be really proud of you they did a nice job know if I trust the photographer thank you so much thank you okay next we have a presentation from high school baseball softball field update and vision and planning and I believe that's Mike Molina yeah come on up come on forward and uh my friend Nancy matchy Mike Mike here's a clicker for the Paul presentation if he could introduce yourselves to again we already know who you are up and down there it should be all set there you go thank you I'm going to introduce you I'm here as a grandpa I'm I'm here supporting my grandchildren I'm not here as a council member I just want to make sure that that's very clear and also another grandpa is Ron fredkov a volunteer extraordinaire baton Town board member for 30 some years but I'm going to introduce you to Nancy matchy they've got me or got us working on a field upgrade at the high school the boys and girls athletic fields the football fields in top shape the soccer fields are on great shape the lacrosse field but the the fields for the boys and girls baseball and softball team are not very good but we're working on trying to improve that and we want to make sure that Oak Park Heights is kept in the loop because it's a project in all Park Heights and that's part of the requirement at the high schools we keep everybody in the gnome so with that I will turn that over to Nancy thanks there this is a milestone moment for us so so thank you for giving us a little Podium time I'll go pretty quickly I know when I did this in front of the school board they gave me three minutes and I made it so we'll have a little more time than that but we've called ourselves uh a team of passionate parents that have experienced great success with their kids in these programs but we felt that there wasn't much area for Community to celebrate and to really maximize the impact of the experience there at the high school we want to make this a community project and so we've called softball booster club excuse me so quickly never before have the team of people like this and they're listed here I won't go through them but we've now partnered with a third party expert oh architect firm excuse me and um so we're coming up with some designs that we're about to fundraise for Eric Johnson's been in the loop from the early days he knew what we were up to and wanted to make sure everything was getting blessed on the front end so our vision is to upgrade the experience through lighting and turf fields and Legacy recognition and a concession there's no concessions in this area area there's no restrooms and we want to change all that we want press boxes we want to be able to stream the experience and we have a lot of people behind us that are excited about this opportunity so we just went through a feasibility study with the help of a third party sponsor in town and we have confirmed that the design can fit in with the constraints of the space that our design meets the needs of both the softball program and the baseball program as well as the community need and we've also gotten approval from the superintendent at the high school along with his staff that they like our design and we have thumbs up to move forward and that we're in compliance with what you all need here in Oak Park Heights so here's a quick look um we're about to reveal this on social media and through emails to our fan base so you can see there's a b field at the high school where typically the 10th graders play that will be the space for our new Varsity Field the current Varsity Field will transfer into the B field space and we'll maximize what's going on in softball in its current location and we'll make improvements along the way so if this was larger I could describe a few things but everything including Turf will be upgraded for the kids to be more on par with what's going on in other communities in the state of Minnesota so this is the view from the parking lot if you were looking towards the from the pack into the center you'll see that there's a grandstand for softball on the right and a grand stand for baseball and then what you're seeing in the middle is the building that would hold the restrooms and then a deck where you can sit and watch the games from up there and then the concessions will be down below so that's really what I came here to share with you today are there questions regarding the project um we're hoping that really in April of 25 we're able to have some games in the field and then host some night games with extended play due to lighting I said April 2025. that's the goal right now [Music] um how is this being funded and what is your timeline for construction and so the goal would be to displace the current fields for one season and depending on when the money is collected we would want to start right after the season ends next spring and then we can work on moving dirt around there's a fair amount of dirt that has to move around within the baseball side of the project softball is much more simple but then that would leave us the fall and into the winter to do the infrastructure is this all going to be done at one time or is it going to be phased um right now the goal is one time but we have a priority of having the fields complete first and then that could allow play to happen while the grandstands and the concession building could follow that slightly so to answer your question about where is the money going to come from it's not from a tax referendum it's not from tax base at all it doesn't need to be confused with what's going on at the high school right now with their efforts to build new elementary schools this is totally separate from that and it will be through um donations from foundations and independent corporate companies so you won't be requesting money from the all the different studies then not at this time okay okay how much is the project we're have an estimate right now including everything that we know up to 7 million is what we're looking at looks nice any other questions for well thank you very much for coming and presenting on this thanks for hearing me out that's great I'll have a good night thank you and this is also the public comments section this is a time for anyone in the audience who would like to address the Council on anything any concerns no do you have a question Mike yeah okay thank you I will move on to the consent agenda which is approved bills and Investments check 69599 through six checks 69656 for a total of 420 000 um fifteen dollars and ten cents and approved city council minutes from July 25th 2023. I move approval second launched by council member Doherty second by council member run here councilmember Doherty yes councilmember Johnson yes council member Lord yes council member Runk yes mayor McCumber yes um next we have Apollo Curie tonight which is public hearing to consider the interim ordinance prohibiting cannabis businesses Jennifer favorite console you recall that City attorney sandstrom brought this to your attention a couple of meetings ago and at last meeting you had made it taken action to schedule the public hearing to consider a moratorium until January January 1st 2025 to allow you time to conduct studies and realize the effect that these types of businesses would have in the community um so the public hearing was published in The Gazette and notices were sent to businesses in the city and so your public hearing is tonight turn it over to City attorney sandstrom if she has anything to add thank you Kevin yeah thank you madam mayor members of the council this won't come as a surprise to you that we are recommending this moratorium ordinance we discuss it at prior meetings and as their legislators suggested here today some of this legislation is a hot topic of conversation and perhaps was rushed through the process rather quickly and expected to be potentially subject edits in the next session in this cannabis adult use cannabis regulation is is certainly in I think in the in the spotlight as one of those things where it's probably in need of some editing but regardless of whether it was perfect or not um the the new law is clear that it's controversial and a hot topic of discussion and the law itself allows for cities to enact a moratorium against new businesses to be licensed within our city there is some conflict in the law so and and some of the language if you looked at this draft ordinance there's references to cannabis businesses and hemp businesses the the new legislation does make a drastic and distinct difference between those two categories of businesses and those are terms of art used in the new statutes the new statutes specifically allow for a moratorium to be enacted by cities in relation to a cannabis business and these are actually two separate licenses that will be issued by the state at some point here in the future under this new legislation the new legislation does not specifically allow for a moratorium for hemp related businesses but despite that fact our office is Recon mending and um is putting in place ordinances much like this for most if not all of our communities that have Commercial Business districts that will essentially put a moratorium under the new statute as related to cannabis businesses and then utilize the existing state statute regarding just zoning moratoriums in general to affect a moratorium in relation to hemp businesses and so what you see in here is the new statute allows the moratorium for cannabis businesses to run through January of 2025 under the state's existing moratorium zoning ordinance which is referenced in here 462.355 those moratorium are allowed by law to last up to a year and so what you'll see in this ordinance is that the hemp business moratorium will run for a 12-month period and essentially this is to freeze everything and make sure that these businesses aren't going to be opening up in your city until we've had adequate time to study the issue and put in place any zoning regulations that we want to or authorized to put in place under the new statutes yeah and make sure those things are all in place before any business is allowed to open right now the state is going to be in charge of Licensing and their licensing process isn't up and running yet but hypothetically it could be up and running at any point in the future here in the next 12 to 15 months and so this will ensure that even once the state's licensing program is up and running businesses will not be allowed to come in and get a license in relational Park Heights because we will have this moratorium in place and so we will let the state know if and if and when their regulations come into play and they start announcing that they're authorized to issue licenses that that doesn't necessarily mean that businesses are going to come into or Park Heights until we are ready for them and have our ordinances in place and so this proposed ordinance will one confirm that the city is intending to conduct studies on these issues and so we will have further discussions on the particulars of zoning ordinances over the next 12 to 15 months but then putting in place a moratoria related to both these types of businesses going forward so you are required at least under the new statute related cannabis businesses to hold the public hearing so I recommend that you open the public hearing and see if the public has any comments on these moratoria thank you Kevin um I'll open the public hearing is there anyone in the audience who would like to address the topic of cannabis state your name and address please David beaudette 6400 Lookout Trail North uh it would be good to uh amend the park ordinances and maybe playgrounds uh every place that the public could gather that tobacco use wouldn't be allowed and neither would marijuana use either vaping out or smoking it or using it and coming so the the city could be well practiced when it really does become legal where people have availability to the drug that would be extended to protecting all the young people in the Parks and other public places thank you thank you would like to address the topic is there a motion to close the fellow carrying so moved second motion by council member Johnson second by council member little children all in favor is there any questions for Kevin I think you did a really good job you know stating yeah what your goal is one more thing just to be clear you have an existing licensing scheme set up for the cannabinoid edible products that were legalized last year in the intention of this is not to stop that licensing program and not to stop business businesses from applying for those licenses that statute which is 151.72 still exists it will be repealed eventually once this new licensing program is up and running with the state and then it's basically sunsetted under the newly enacted laws so that last year's law will go away in the spring of 2025 and so the intention would be for now we're going to continue to license businesses to sell just cannabinoid edible products and so that is a subset in a subset and derivative of what are now defined as hemp hemp products and so those will be allowed and that is I think referenced in section one subpart 4 of this ordinance uh and just to quickly respond to Mr baudette's comment that is actually the next item on your agenda is a separate ordinance dealing with Banning of smoking or other use of um cannabis products in your parks and other public places and so this is just a moratorium but you will consider that issue uh coming up here shortly how about the THC infused beverages that's separate category altogether so THC infused beverages are does fall under last year's law the cannabinoid edible products includes both products to be consumed like eaten as well as Beverages and so the THC seltzers would fall into that category in a business that if they wanted to sell those products would need to come in and get a cannabinoids license under last year's law and once the new law is fully in effect those THC seltzers will fall under the hemp business category and what would be required to get a hemp business license to continue selling those products thank you any other questions for Kevin so is there a motion to approve the ordinance as presented so move mayor and members of the council there is a resolution as your next agenda item in the packet just to do a summary publication of this newly enacted ordinance that you've just passed to cut down on the published publication class in this new moratorium will be effective as soon as it gets published is there a second Robert Johnson second by council member little Chagrin all in favor I'm sorry mayor Collins I believe that requires a roll call about being a resolution I was thinking just the summer okay so council member Doherty yes uh council member Johnson yes council member Lil durgren yes councilmember Rock yes mayor mccomber yes sir okay we'll move on to new business which is approved interim [Applause] sorry all businesses approved proposed ordinance prohibiting use of cannabis and hempog products in public spaces is that you sure no public hearing notice announcement for this one so I'll just start us right off again as I just mentioned a moment ago in the new law there are Provisions that allow cities to regulate the use of cannabis or hemp products in what the statute calls a public place and this proposal or in essentially the city has to enact its own ordinance if it chooses to regulate the use of cannabis or hemp in public places and so this proposed ordinance is drafted in a manner to essentially ban the use of marijuana warhamp products in as broad an area as the statutes will allow us to ban and so this you'll see in the definitional section in this proposed ordinance 1126.01 subpart a defines public place and then with a series of three subparts this is essentially straight out of the new statute and says this is how the limits of how a city can define a public place and so this is going to include essentially Parks playgrounds schools but also sidewalks city streets and City Hall any other public place in your city trails and really in my view of the way the legislature has worded the definition of public place it's not just public property it's public places and it includes so you see sub part A and then Sub sub part two you cannot restrict it on private property that is not generally accessible to the public but in my read of that it this will ban use of pot on private property that is generally accessible to the public and so it's not quite clear yet how that is the legislature intended that to work or be defined but in my view in just my gut reaction and reading of it for example your parking lots of Walmart and Menards and other places like that is private property that is generally accessible to the public you know people can come and go from those parking lots as they please for the most part and so hypothetically people will be banned from using marijuana products in those areas as well but regardless and if that definition is further clarified At All by the legislature that might change but at a minimum for sure your public property this will be banned uh and this is going to include smoking of products vaping of products it's going to include THC Edibles and and beverages so any THC related product banned for public use and so if that sounds like uh the level of Regulation that the council thinks is appropriate in the scenario we'd recommend the enactment of this ordinance that's what I was looking for after the last meeting does anybody have any questions for Kevin I do in the definitions of public place and I think that goes back to my last meeting my point about making sure that this allows people who live in multi-family housing units or like Sunnyside condos are able to kind of have these products to the extent that they're able in in their homes or in their probably not public areas but common areas I mean is that something that we'd rather want to clarify that in mixed use housing that they there's certain parameters or how should we um so this particular area of the new statute the definitions that are included here are what's allowed in the statute and what the city is allowed to regulate there's actually a different section of the statute that talks about use of and I think if I recall correctly it talks about medical marijuana rather than adult use cannabis but it does have some Provisions in relation to multi-tenant facilities and my read of that those Provisions to my memory is you cannot smoke Vape or use marijuana products in like the common hallways and things of that nature that basically the Clean Indoor Air Act bans that sort of thing in common areas of apartment buildings people would be fully entitled within their residence to use those products and so you could utilize them in your within your private apartment in your in your building I mean so the Clean Indoor Air Act generally prohibits smoking in public places but you can smoke within your own home you can smoke within your own apartment and you can smoke marijuana now within your apartment and so that would be allowed whether this would affect say their ability to smoke marijuana on the Common Grounds of exterior grounds um I'm not quite sure how that plays out and how that falls in this definitions of subparts one two and three as defined by the legislature I think it's a little bit unclear it probably at the very least I think it's probably up to the individual owners of the apartment building to decide how they regulate that because it is technically private property it's I don't know if you say that's generally accessible I wouldn't say it's generally accessible to the public and so what this says I think you'd fall under subpart 2 here private property not generally accessible by the public would then say that it's up to the that private property owner as to when as to whether they're going to allow the use of those products on their Common Grounds or not okay thank you I just know that there are some debate about Equity issues and I wanted to make sure we were trying to resolve to the extent we quote Yeah and I'd say at a minimum people could use it within their homes you know if they have small children in their homes and whether they want to be smoking in the presence of children I guess that's their personal choice to make maybe not the best choice but for as far as secondhand smoke but I think they would be prevented to use it there for sure thank you any other questions for Kevin I'll move the resolution second ordinance on this ordinance it's an ordinance prohibiting use of cannabis and hemp products and spaces so what should my council member run second by councilmember Johnson here no there's no public hearing required mayor McCumber yes councilmember Doherty I apologize you're my backwards councilmembered already Yes councilmember Johnson yes councilman yes councilmember Runk yes mayor mccummer yes and then is there a motion to approve the summary publication resolution so second that's my council member Doherty secondary council member Johnson Eric council member Doherty yes councilmember Johnson yes council member logergren yes councilmember Runk yes mayor McCumber yes move on to new business which is approve interim City administrator agreement with Chief Keith Hanson Kevin thank you mayor members of the council and and just to briefly update too I am we did request an update from Matt Fulton on the status of their recruitment process and he provided a short kind of one paragraph memo that was forwarded on to Eric and myself and I I thought Eric might provide it to the council I think Eric thought I was going to provide it to the council and so I apologize for not uh sending that along to you but uh I can summarize it here in a short fashion because it is a short report for Matt essentially they I think if I recall correctly they've got about 22 applicants who have applied for the positions so far and we're nearing the end of that application period at this point Matt's take I think from his memo was maybe half of them are worthy of their kind of screening interview process and and vetting their credentials I think about half were from out of state and about half from within Minnesota although that doesn't necessarily mean they're they're only vetting people from Minnesota and not anywhere out of state those don't necessarily correspond with each other but it was just rough numbers and so their intention is still to have everything ready for the council's preliminary review of potential candidates at the your next August 22nd meeting for a closed session I assume and and Matt recommends that that would be a closed session at the end of your council meeting rather than trying to do a a closed session Workshop before your meeting in case you wanted more than one hour to review information he recommended that it be set at the end of the meeting for a closed session and so unless the council thinks otherwise I think staff will just plan to have that on your agenda for the next meeting for our closed session and so then getting to the interim position we did discuss that at your last council meeting and there was discussion in um recommendation by the council to move forward with an agreement with Chief Hanson to be your interim administrator uh following Eric leaving his position and so I did put together this draft agreement it was based upon other similar agreements we've done for other cities and this is slated to run from September 1st through November 30th or sooner if you get a new candidate that starts before that um but at the very least we know that the interview process for finalist candidates is not slated to occur until late September and Eric will be gone as of September 1st so there will be at least a few weeks of uh necessary um Gap coverage through Chief Hansen um I think for the most part this is fairly straightforward the level of additional compensation uh that's going to be recommended for Stephen is a requested by Steve Chief Hansen and generally it seems acceptable to me is a request for two thousand dollars per month of additional compensation over and above Chief Hanson's existing salary uh to help compensate for the added workload and overtime that he will cover those duties the rest of that I think is the rest of the agreement is relatively straightforward that he's going to be performing the duties of both police Chief as well as City administrator and there's uh Provisions in here that may clear to the extent he needs to lean on other staff members or Consultants he certainly will be authorized and expected to do that particularly given the nature of his existing workers police chief and his need to make sure those duties remain intact as well and so I think through relatively straightforward agreement if the council has any questions or comments for me or chief Hansen I think uh we're happy to take them any questions for Kevin I don't have any questions concerning the agreement with Steve I am questioning concerning the timeline because I don't know I had it I had that we were having a separate Workshop for this on the 29th because that was when Chuck was going to be able to zoom in from wherever no I think that we originally talked about doing it on August 29th as a separate work session but then Chuck was going to be out of town so we asked the consultant to accelerate their working process and do that review process on August 22nd before Chuck leaves town okay so so we'll be doing is as a workshop after our 20-second meeting well essentially as part of your regular agenda technically but as a closed session due to the confidential nature of the non-finalist applicant review process at that point in time and so it will be a closed session it'll be part of your regular agenda so we'll have a work session for the budget before the meeting then a regular meeting and then a closed session after session okay okay I move approval of the agreement second uh motion by councilmember Johnson second by council member Lil Duran do you want to roll call on that Kevin um sure council member Doherty yes councilmember Johnson yes council member yes councilmember Runk yes mayor McCumber yes next we have an enhanced sweeping Grant opportunity yes Council um so middle Saint Croix Watershed district and the Washington County Conservation District approached us with a grant opportunity for what's called enhanced street sweeping and really what that is is just an additional Suite per year in areas that have uh heavy tree cover and produce a lot of debris in the city gutters and on the streets if we were to accept this grant funding we must cause an additional street sweeping in those targeted areas at least one time per year over the course of three years and for that the Washington Conservation District is uh incentivizing us with a grant of nine thousand seven hundred and twenty dollars so broken down over three years that's about three thousand two hundred dollars which would almost cover that additional sweep so it's a no-brainer not only are we going to have cleaner streets will prevent pollution Downstream but we're financially incentivized to do that through these organizations which is fantastic so um I'm here to recommend that we accept their Grant offer and and to build this into our operations in our budget and do it thanks for looking out for the fact thank you for that great yeah it well number three site preliminary site recommendations Eric is well we'll just throw right over to the pesky city engineer over there say it much better than I thank you Mary members of the council as directed we have been pursuing uh the the items that are needed for constructing uh well number three within the city three percent potential sites have been identified all three sites are currently owned by the city one site is the site that is just on the North End of Memorial Avenue on the east side which is lot one block one Stillwater Motors on the second site is Autumn Hills Park and the third site is across the street at the site where the currently water tower number two is situated near Walmart uh those these three sites have been reviewed for their suitability and constructability of the well and future treatment and storage facilities and we did it attach site exhibits to the memo that show possible layouts of each of those sites if they were to be utilized I'm sorry Lee those looking at the document looks like those were a little muddled we the PD at least in the the PDFs didn't size appropriately so I apologize so I didn't catch that as my mistake but they are hypothetical layouts so correct correct so the consideration of where to cite well 3 does take into includes considerations for future future drinking water treatment as well as future Water Tower in regards to water treatment as the council is aware the city has been put on notice that once the epa's proposed maximum contaminant levels or mcls for various pfas chemicals are finalized later this fall it is expected that the MCL will be significantly lower than current standards if the MCL is finalized at the proposed levels the city would need to treat the water at Wells number one and number two and as likely also for future well number three um the preliminary preliminary analysis of how the city would approach treatment and consideration of the available City properties where while three could be cited suggests that the city might end up having two treatment plants to treat the three Wells with the treatment of the city's water there would have to be raw water mains that would go from each well to the treatment plant directly before that water can be then distributed out to the system so the farther away a well is from a treatment plant significantly impacts the cost of the system that gets put together an advantage of having two treatment plants is to be able to maintain service in the event of an outage at one of the plants whether it's unplanned or to conduct maintenance in the conceptual scenario one treatment plant could be located behind City Hall near well too treatment at this location would serve Wells one and two the second plant would be co-located on the same site with well three the reason for two plants again is that regardless of which of the three sites is chosen for well three there was one treatment plant behind City Hall to treat all the wells there would be significant expense and disruption to install raw water mains along 58th Street to route to a plant behind the city hall in addition a new distribution main would need to be installed along 58th Street going back the other way in order to get the additional water back to the rest of the system with the new well so we would need to uh provide that main as well to provide capacity for the additional water tower that would be supplied by well three and on the west side of the city therefore the site analysis for while three takes into consideration the space needed for an adjacent treatment plan in regards to a future water tower best location for that is on the west end of the city this provides the best balance of flow for the city's water pressure also the closer the well and treatment plant are to the tower the more efficient the system can be so we did in the memo here show some site comparisons site one again lot one block one Stillwater Motors uh was purchased by the city in 20 2010 after environmental site assessments were performed to determine the suitability of the site for uh additional well no issues were reported during those assessments that could not be mitigated and would disqualify the site for a water supply well the advantages of site one include plenty of space for construction which will reduce construction costs no interference with Wells one and two is far enough away that there wouldn't be any any interference between the three there is room on the site for the well a treatment plant and a future water storage tank hydraulically this is a good location for those three facilities it also has enough space for a future Public Works building if that's something that the city needs at some point and if that is not needed a portion could potentially be carved off and sold for a small development the disadvantages of site one are the portion of this site utilizer City facilities would not be able to be developed site 2 and Autumn Hills Park a Southeast Squadron a 58th Street and Norwich Parkway Autumn Hills was dedicated Autumn Hills Park was dedicated the city without Wells development the advantages are there's plenty of space for construction reduces again construction costs for that minimal interference likely or none with well number one and number two and there is room on site for the well and a water treatment plant disadvantages of site 2 are possible negative public perception of utilizing Parkland for additional City facilities that's not a good site for a water tank across the street from existing water tower number two and it's not a good site not as good as site hydraulically in relation to a future tower Tower on the west side of the city site number three which is the on the Northwest Quadrant of 58th Street in norelle Avenue the advantages are it keeps site one and site 2 free of that well footprint also minimal interference likely with Wells number one and number two the disadvantages of site 3 are construction spaces significantly more limited and construction costs will be higher it is also questionable whether it will be economically feasible to fit a treatment plant on the site and if a treatment plan cannot feasibly be constructed on site three more costs will be introduced for water main connections from the well to wherever that plant is located based on the information that we put together here in this memo it is recommended that site 1 be designated for well number three the site has the space for the well a treatment plant and a water tower the site is at a good location in relation to the rest of the system there's also enough additional space again for that future Public Works building or to be utilized for some other purpose it's further recommended that site 2 will be looked at as a backup site for the well in case during the drilling process it's found that site well is unsuitable for a well this is not expected based on our knowledge of the geology in the area however it's prudent and typical to have a backup site identified your site one were to be found unsuitable it would be recommended that the well and treatment plant be located at site 2 and the future water towers still be located at site one because not being able to support a well does not mean that it can't support a tower site 3 is not recommended due to space constraints and related higher construction costs so with that said um this information and whatever site the council chooses we need to include with the Eda application the draft of which has been submitted and is being given a initial look at and the the possibility of viewing site one and site 2 also can allow for the opportunity as we go further in the process and do some more financial analysis of treatment plants and locations and whatnot these are really the two basic areas where a well can be put as far as where the city owns property and is far enough away from the other two Wells questions really I was able to just for example Stan Tech and Lee provided this is a the site on Memorial Avenue potential layout of of those facilities um Lee I'd certainly let you explain what what what they're looking at so if you look at the cul-de-sac there which is uh North is to the left uh the tower the tower is on that Northerly portion of the site north of the drainage and utility easement that goes across the site from Stillwater Motors and then the well house and the potential treatment plant are just south of that north of the power line easement and again you can see that open space there that would be available for a future Public Works building or some other use that the city May deem desirable I do have the other two sites if you wanted to look at those two I've seen them I'd like seeing them two juice out of curiosity sure that sites the Autumn Hill site site two and the and there shows again a well and a treatment plant right next to each other just south of the Wetland area there in the park this being 58th Street and this is that uh pond wetland and Autumn the playground would be about here and the shelter about here just to the right parking lots there that's what and then the last one yeah I don't either quite a bit lower in elevation too isn't it yeah and see where it was let's see which one's this I don't like that one I know we've looked at this before quite a few times over the years since keeps coming back to site one and I think that's probably the right choice I think that's kind of what we've always been looking at hasn't it it has been the purchase of that we just got the addition though the treatment now that we have here yep and the last one here mayor council is the uh current well I'm sorry current Tower two site as an example we want to just go with the recommendation yes I think so I'll make that as motion to second also by council member Rock second by council member Lil durgrin to go with staff recommendations all in favor yes we only allow it in the visitors public comment section or are updated that's right we updated our our statement all comments can be done during the visitor section instead of at each point [Music] are you gonna allow me to speak or not no that's into um administrator Johnson and then he will share that with us I I find it very amusing that you don't say that for visitors well I did say any item it does didn't say restricted to any item on the agenda it was in anything except that that is attended Memorial until this rule has come up it's always been the perception of this city that you can the public had always come as the items correct and why didn't I know you did bring this up the changes that they wanted to do this so and that was agreed to quite a while ago okay um all in favor yeah we've already voted but you have to no because I didn't get to the vote I just had the motion in the second thank you Chuck um then uh improve signage at Osgood Avenue and Anderson Way at that meeting on Tuesday night with the neighbors there was a discussion about the stop signs and um how there seemed to be so much traffic that was being diverted on 58th Street and one of the items that came up and and Lee and I talked about it on the side I know he's going to be looking at a lot of different things but one of the things that kept coming up was it's so confusing for since the old Frontage Road has been closed off how do people get to the businesses whether it's Carbones or um McDonald's or something and I had brought up that sometimes you'll see places where there's um you'll see like business access it'll have an arrow uh as to how to find those places and maybe have Lee look at that um or Andy to see if if we could put up a sign I know it's county road so it might be just distracting but where are you thinking you know right by Stone is it stogies yep yeah um because that's where the furniture the furniture is connect right there and if you're going north or south on Oz good it could be confusing as to how do you get there yeah and it might help alleviate some of the traffic coming through on 58 because it might be cutting through things that are going to the West yeah not a terrible idea we'll see what we can do okay I think I think another areas you they have had I'm thinking O'Brien Snelling Avenue in Roseville you know they just have a sign a county sign saying you know access to local businesses or something I just saw one today but it was due to construction it was one of the orange ones that says you know to go there but this should be something more like and you know even like for access to downtown Still Water you know there's like directional signs so if you could look at at that and you yep okay there was a issue with stop sign so I did send a tear to forward out to all of you for weekly notes that um and I sent it to the chief as well that there is a stop sign there it just seems that um either it's blocked or people just don't want to stop I have a feeling when we move one issue from here move somewhere over here unfortunately um okay and we'll move on to new SWAT rifle from our contingencies Chief if you want to just address a little bit of that so I was looking uh tonight to see if we get approval to replace our SWAT rival we were borrowing one from Cottage Grove Police Department for the past 20 years they have asked for that to be returned and we did so uh earlier this year so tonight I'm looking to replace that it should not exceed three thousand dollars and it's specifically dedicated obviously to our SWAT officer that we've been a part of the County SWAT team for the past 20 years as well so do so I would certainly like to order that sooner than later because of some of the sourcing issues that we've already seen or experienced here I make a motion we approve the purchase exactly both of my councilmember Dory and we'll have council member Robin second all in favor
