There we go. Okay. Like to call the to order the city of W Park Heights city council meeting for Tuesday, January 13th. First item is the pledge of allegiance to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all. >> Next item would be a summary of the close session for our December 9th meeting. Uh thank you, Mr. Acting Mayor, members of the council. Uh the city council did hold a closed session uh way back on its last meeting on December 9th, 2025 in relation to labor negotiations strategy under Minnesota statutes 13D.03. Uh and the city administrator did provide an update to the council on the status of negotiations of various labor uh union contracts. uh and got some generalized direction from the council on those negotiations but as of that time nothing was finalized and the negotiations negotiations were ongoing and then the meeting uh the close session was adjourned from the end of that meeting. >> Thank you. Next item would be the approval of the agenda and I would have one item change would be under consent poll item B. will be subject to a separate vote simply because I'll be abstaining on that with that a motion to approve the agenda as presented. >> So second motion in a second all in favor five saying I >> I >> opposed motion carries. >> Uh next item is the council and staff reports for self. Do we have any from the council that they'd like to report? >> I just have one brief report. Mayor Prom. So, I just wanted to um update the council that last Thursday attended the middle St. Croy Water Management Organization meeting. Um, one of the things that ended up being brought up as part of our discussion is the ways that the costs are associated to each city. Um, historically they have been updating those costs kind of whenever they um whenever it came up. Um but because there was some I think dispute between Baytown and Bayport um I made a motion that we look at it every time the census is updated because that's one of the factors in consideration. So it's done regularly but not so regularly as to be a burden to staff. So I just wanted to let the council know that that is something that has been discussed and approved. >> Okay. Next would be the uh city administrator. >> Yep. Deputy mayor council. Uh good evening. Just a quick update here. We had an open house uh as most of you are aware last uh Thursday uh related to potential land use changes, reszoning um for the I guess what we're calling the Zimmerman application and the impacts of what that could be uh along the frontage road. Uh we had that right here uh again on Thursday. Uh had a nice turnout. Uh I think we had around 11 people sign in. There was a maybe a few more than that that attended. Uh good conversation. our uh planner was there, some of the city council members. Um I would say the majority of the folks were were supportive um of the of the changes. Um but again had just good general conversation with the residents that uh that appeared. And so just as a reminder for the council too, uh that application will be considered at uh I believe it's our next meeting. I believe that's January uh 27th. >> Thank you, Mr. After Mayor. It was it was a really good meeting. There was a lot of um assumptions that were made. You know, one of the comments was that there would be an access off of Oldfield to get into it. Some of the residents thought that. So, we kind of directed them into the right that the only access will come off of 60th Street. But all in all, I think everybody was, you know, there was very few against which was it was it was nice getting the public comment out there, give people a chance to speak. >> I I happen to been there and I would agree with it. with your statements. Um, nothing else. Next item would be the assistant administrator. >> Good evening, acting mayor, members of the council. Just one item for you tonight. Your recycling award winner, the first winner of 2026, Patricia and Daniel Schlikert at 5831 Oak Green Court North. They were they had the recycling out for collection on pickup day. So, they get a choice of award. Police Chief. >> Good evening, Deputy Mayor and Council. Uh just two quick updates. Our new officer hire, uh we've narrowed that down to one candidate. Um we've offered a job offer. He's got two more hoops to get through. Uh the psychological and the physical. So, I'm hoping to get that to the next council and that final for final approval. And so, we're moving right along on there. Uh second, we had the Metro Transit Police Chief stopped by with his command staff earlier today um at our command meeting. He dropped off a appreciation plaque award to the city and the police department for back in June we helped uh and assisted with the funeral of their lieutenant that had passed away back in June. And so he was just wanted to pass on his thank you for that support. It was hosted at or was at the high school is where it ended up being. But we helped with public works and PD getting them around through the city and took care of them for that. That's it. >> Okay. Anything else from anyone? Approve a resolution designating the STOA Gazette as the official newspaper of for publications in 2026. Approve a resolution authorizing the St. Paul Pioneer Press as the alternative newspaper for publication in 2026. Approve the 2026 engineering rates. Approve the resolution appointing professional consultants for 2026. Approve resolution granting the application of Ducks Unlimited St. Croy Valley chapter to conduct a one-day raffle at St. Croy Events Center on May 7th, 2026. Approve joint powers agreement between the state of Minnesota and the police department. Approve the resolution amending the adoption of the records retention schedule for the city of Op Park Heights. Approve the 2026 home occupation permit renewals. Conditional use permit for the cannabis retail dispensary 1399 960th Street North. [snorts] Uh Scott, >> yes, deputy mayor, uh members of the council, good evening. Uh the applicant High Minnesota LLC has made this application for the conditional use permit. Um the property is uh uh the retail service center that's anchored by Hall Family Chiropractic. uh they're proposing to take about 1,700 square feet of that building at the center uh of the of the structure. Uh planning commission uh reviewed this, held a public hearing at their December 11th meeting, 2025 and uh recommended the application uh with conditions. This is a pretty straightforward uh request. Uh really no different than others that we've had uh in multi-tenant buildings such as the one uh approved for the Still Water Crossing um uh site. Uh looking through the uh report uh again no issues with comprehensive plan. The property is zone B4 limited business district. Um again conditional use permit required for this type of a retail cannabis operation. [clears throat] All the buffering um requirements are met. All the other performance standards such as hours of operation, odor, etc. will have conditions on all that. Um the uh uh parking uh the 20 uh required parking stalls for the center uh there's 34 on site. Uh again, no conditional use permit uh is required to analyze that because they are not making any changes to the site. All said, all that you're going to see that's different about that building is the signage uh on the wall and uh on a the freestanding monument. I assume that they'll have a sign there. Uh so with that, u the um uh the resolution uh for your review is uh in front of you this evening. again reflects the uh planning commission uh conditions uh for approval and u any questions at this point.
