The issue on the tennis sanitation bill that was discussed in the workshop is uh the city is going to authorize staff to engage in an an extension of the existing contract which is allowed under the terms of the contract for a three-year period um on the rates that were provided as part of the garbage RFP process. >> Since that wasn't included in your packet nor is it >> we're kind of vaguely referencing amending the agenda here. I move approval as discussed. >> Second. >> All in favor? >> I >> opposed. Motion carries. Uh council and staff report. Um last week the city administrator and I met with our lobbyists. Just more or less an introduction and to kind of see how things are going with that. That's about all I have. Um oh, Council Member Johnson. Last week I chaired the League of Minnesota City's improving service delivery policy committee meeting. Um one of the big we had guest speakers this time. One of the big topics was um police staffing as well as the um THC legalization process um and city rules around that. Um and then I attended the Middle St. Croy wershed management association meeting organization. >> Okay. and council member Ro. >> Um I attended the CVB meeting this month and they're very busy which is a good thing. Um second thing is the I still have not had a meeting of cable commission since the flood although I believe they are now back operating on the air covering the meetings and that which means that pony football will be following very soon. Right. And just another thing to add to the CVB because the embargo's off of it that the governor's fishing opener will be in Still Water on the St. Corey River in May. >> All right. City administrator, >> mayor, council, good evening. I just wanted to give a quick update regarding our well three. Uh things are moving along. That's the drilling of our new well three. Uh they're currently completing some test pumping out there right now. The results have been great. Um, we're getting a large volume of water, which is awesome news. Uh, look forward to getting some more information here regarding uh the PAS levels that could potentially be uh within the well. Uh, just based on its location uh some of the the testing that we've had here in in Oak Park Heights. We certainly anticipate that it will test back for PAS, but again, that remains to be seen. And so anticipate having those results uh here later this year, but again the process is moving along great. Our contractors done an awesome job out there and so looking forward to that being online and project should be finished uh I think as I shared with the council sometime in the summer of 26. That's all I have. >> All righty. And please chief. >> Good evening mayor and council. Uh just a a big thank you to everyone that uh participated in the night two night event uh earlier this month. That was a great success again here and we had great weather. So that was helpful and uh thanks to Walmart for their nice donation as well. Um and then uh lastly, the school is open and it's been very busy already for the past week for our school resource officer and we have saturation uh going to and from the start times and the end times 58th and then 57th Street right now. But other than that, it's quiet. Thank you. >> Thanks. And assistant city administrator, city clerk, >> mayor and council, recycling award winner for you this month, Jeff Anderson, 1422457th Street North. He was chosen as the most recent recycling award winner. He had his recycling out for collection curbside on the pickup day. So, he gets to choose a prize for having his recycling out. >> Thank you. Uh visitor and public comment. This is an opportunity for the public to address the council with questions or concerns on issues not part of the regular agenda. Anybody? Okay. All here for the agenda. Uh we next is the consent agenda. I'd like to um pull item I as a separate item and then we would have uh approval and bills and investment checks 72,020 to 72,77 and 7278 to 72,125. Approve city council works session notes from July 22nd. Approve city council minutes from July 22nd. Approve special event permit for homecoming carnival to Stillwater area high school with food trucks. Approve resol resolution authorizing the receipt of donations from Walmart. Approve supporting a submission to the capital budget request to the Minnesota management and budget office for the 2026 legislative session. Authorizing agreement with the valley concrete for the city hall west staircase. Approve trade in and purchase of public work vehicles. Appoint Cassandra Stemfield to planning commission to fill vacancy. Approve amendment for the planning commission bylaws. Approve staff to enter into negotiations with tennis sanitation and extension of the contract. >> I'll move the consent agenda as amended. >> Second. >> Okay. Whereas Jim Kramer has served as an appointed member of the planning commission for Oak Park Heights from February 20th 20 or February 2013 through May 2020. and from September 2023 through his res resignation in August of 2025. And whereas during his appointment on the commission, Jim Kramer served its chairman from May 2014 to March of 2018. And whereas the city council of the city of Oak Park Heights relies upon the recommendations of the planning commission to assess assist in shaping the vision of the city's development and growth. And whereas Jim Kramer's contribution of time, effort, and dedication to the planning commission have been valuable and sincerely appreciated, resulting in a positive planning and outcome for the city. Now there be it resolved that the city of Oak Park Heights commends and thanks Jim Kramer for his service, dedication, and commitment to the interests of the citizens of the city of Oak Park Heights. I'm I move that we reluctantly accept his resignation and adopt the resolution thanking Mr. Kramer for his service. I would like to add to the motion that we accept the resolution and then that the city purchase a small sign that would recognize his service to the city to be placed on the bike rack located outside of city hall. >> And I accept that amendment to my motion if you want to be the second. >> All righty. >> Second that. >> It's been moved and seconded at roll call. So, under old business, we have item A, council vacancy. >> Good evening, Mayor and Council. Um, Robert and Lisa, >> new council member. >> Oh, >> you're good. We screwed up the order. >> We were ready to go. >> And I'm so excited about the plaque for Jim. That just makes you smile to no end. >> Okay. We have a resolution that's been prepared by the council. I will read it that it's whereas the city council for the city of Op Park Heights declared a vacancy on the city council in resolution 25-06-18 and whereas the city of Bark Heights received five applications from interested parties to fill the vacancy and whereas city council for the city of Bark Heights at its discretion is allowed to fill the vacancy and whereas Mark Swinsson has been duly appointed to fill the vacancy on the city council by majority vote on August 26th, 2025. Now, therefore, it be resolved that the city council of city of O Park Heights hereby appoints Mark Swinson to the vacant city council seat effective August 26th, 2025. Be it for the resolve that Mark Swinson, having been duly appointed to said seat by the vote of the council, shall have possessed all the duties, powers, and privileges of the city council of the city of Ober Heights to complete the term effective August 26th, 2025 until the special election is held in November of 2026 and passed and adopted by the city council this 26th day of August 2025. And I will make a motion that we approve the resolution. >> And I'll just add the comment that um the council really thanks everyone who applied and everyone was um their dedication to the city was incredibly important. Um and it was a very tough decision. And now now we will move on to new business. Conditional use permit for accessory building at 14899 Upper 55th Street North. >> Thank you, Mayor and Council. Uh Robert and Lisa Benson uh have made uh or submitted this application for a conditional use permit. It's for construction of accessory building. Um it requires three conditional use permits uh uh to allow a reduced setback from what is required for a second accessory structure and for construction in a sideyard. Um uh the proposed accessory building is 160 square ft. Um the Benson have provided a narrative. Uh they did take down a a bunny hutch and have determined that this is the best place for their shed in the sideyard as opposed to the rear yard. Uh the rear yard uh has um some slope issues, some landscaping um um limitations. Uh so they're looking at uh placing that um new uh60 foot uh building uh where that bunny hutch was. Um accessory buildings, as I indicated, are are required to be in the rear yard. uh placement of this uh shed would be 2 ft from the property line and 2 ft uh from the house. Uh the 5 ft um is required for the setback. Also the uh you know the 2 ft from the house uh can be achieved through uh certain uh construction um uh practices with the with the sidewall uh for for fire codes. They have planned to uh to do that. Um there's also the conditional use permit for more than one accessory uh structure. Uh they have a a garage already. Um and the size of the two structures will be 1,76 ft under that 1,200 ft requirement that we have. Uh the planning commission discusses held their public hearing uh at the August 14th meeting and did not have any issues uh with this request uh and recommended with the uh uh conditions that you see uh in the resolution that's been prepared for you. And then item B, resolution approving extension to conditional use permit and design guideline site plan review for 5963 Odell Avenue North. >> Um, yes, Mayor and Councel. uh back in August 27th to 2024, you did approve the conditional use permit, the design guidelines site plan review uh for an office warehouse building at 5963 Odell Avenue. Um the applicant is is not ready to uh construct that and has requested a uh uh an extension uh of that uh request. Um and uh in this uh case, he has uh submitted a request for a one-year uh zoning extension of the conditional use permit. Um the resolution reflects that and u uh we would recommend that you move forward and and approve this. >> I'll make that motion. >> Second. >> Okay. And do we have any other council items or announcements? >> Mayor Council, I just say that our new planning commission member, Carissa, out there. >> Oh, so on the agenda that should probably be >> Well, thank you. >> Thank you for for agreeing to to serve. >> And don't get the idea that because our meetings are 20 minutes longer than yours are. Just like the five that applied for the city council position, we certainly we had multiple that applied for the planning commission and certainly appreciate those residents stepping up and so um look forward to Chris joining our planning commission. >> Make the motion that we adjourn. >> Second.
