Luke presented the proposal for Les Schwab Tire Center, seeking approval for a preliminary plat to create three lots and a site plan for an automotive service and repair business. The location is the southeast quadrant of 34th Street and Marketplace. The site is zoned Oakdale Marketplace PUD, and previous ordinance amendments allowed the proposed use. The plan included provisions for shared access, stormwater management, and met all parking and setback requirements. Commissioner raised a question about a prior approval on 'Outlaw B' lot, which was not directly addressed by staff during the meeting. The commission proceeded to vote.

Passed (motions to recommend approval)

Dissent: Staff recommendation was for denial, but commissioners including Tom, Yaya, and the Chair explicitly voted against the motions to deny (which implicitly supported approval), leading to subsequent motions for approval passing.

Staff, led by Luke, recommended denial of both the PUD amendment and CUP for Mr. Car Wash, citing conflicts with the Tartan Crossing PUD's intent for walkable, mixed-use development and concerns about residential adjacency and nuisance. The applicant, represented by Ed Capables and Ashley Aster, argued that the PUD had evolved into an auto-oriented district through previous amendments and approvals. They highlighted the project's compliance with design standards, noise mitigation efforts (to be further studied), and economic benefits. Public comments included support for convenience and concerns from an adjacent property owner regarding noise and traffic. The commission members expressed varying opinions, with a majority ultimately deciding to recommend approval of the applications, overturning staff's recommendation, based on the site's evolving character and the potential for new business and tax revenue.

Luke presented the application for The Josiah Center, seeking a Conditional Use Permit to establish a place of worship within an existing light industrial building. The property is zoned B3 Light Industrial, where places of worship are allowed via CUP. The plan included an assembly hall, offices, and classrooms, with sufficient existing parking. Staff found all CUP criteria satisfied and recommended approval with a condition for no parking signage in certain drive aisles to ensure adequate circulation. The applicant clarified they were not yet operating as a place of worship on site, awaiting approval for interior renovations. No public comments were received.

Connor presented the request from MC's Pub to amend a Conditional Use Permit to allow a new 24-square-foot electronic message sign on its existing pylon. The property is zoned B1 Commercial, where such signs are conditional. The proposed sign is larger than a previously approved and removed 11-square-foot sign, necessitating the amendment. Staff noted specific criteria for EMS, including brightness limits and auto shut-off functions, particularly due to nearby residential properties. Commissioners questioned a discrepancy between the staff report's recommended nighttime brightness (500 nits) and the city ordinance's requirement for residential adjacency (250 nits), requesting staff clarification before city council review. No public comments were made.

Today, the Titan Crossing Pud explicitly lists car washes as a prohibited use. We're asking you to amend the language and add a car wash as a conditional use... All this amendment does is move the use from prohibited to reviewable.

I just wanted to say I think it'd be really handy to have a nice car wash there because right now the really the only good choices are up past Menard's... and what I notic is that they both get really backed up, especially in the spring.

We've been meeting offsite, so we are not currently utilizing the space as a place of worship. We've moved our possessions in and are waiting for approval before we can demo it.

The applicant MC's Pub is seeking to add a new electronic message sign component to the existing Pylon sign... Given that the proposed sign here is bigger than the 11 square foot sign that has been removed and was originally allowed by the uh original conditional use permit, a conditional use permit amendment is required.

But earlier one of the the ordinance says signs adjacent to residential property shall not shall have a maximum of 250 nits from civil sunset to sunrise. So should should the condition be changed to it shall not exceed 250 nits?
