PUBLIC HEARING – CRONK, 6966 40TH STREET NORTH – CONDITIONAL USE PERMIT FOR ## AN OVERSIZED ACCESSORY BUILDING Planner Max Lohse provided an overview of the Conditional Use Permit (CUP) request at 6966 40 th Street North. The zoning of the property is R-2 Low Density Housing, where second sheds and oversized sheds are allowed through the CUP process. The applicant is seeking to add an oversized shed. The property is 1.3 acres and contains a single-family home and previously contained a shed as well. The proposal is for a 920 square foot shed, 320 square feet of which would be a covered patio area. There is an existing power easement on the eastern 75 feet of the property. Under the applicant’s plans, the building would be placed 10 feet outside of the easement, ensuring there are no encroachments. Based on the site plan, the building would meet all relevant setbacks for an accessory structure in the R-2 district, including the 30-foot requirement from the front lot line and 5 feet from other lot lines. Dimensions for the proposed shed would be approximately 46 feet by 20 feet, with a 16 by 20- foot covered patio. The criteria for the CUP require that an oversized accessory structure be under 1,500 square feet in size. Based on the proposed dimensions, this requirement is met. The elevations for the proposed shed would be approximately 11 feet tall with a 7-foot tall door. Under the City Code no door can exceed 10 feet in height, and the structure itself cannot exceed 25 feet in height. The requirements are met. Mr. Lohse provided an overview of the CUP review criteria for the request. He stated that staff find that the CUP review criteria have been satisfied, as detailed in the staff report on file. Staff recommend approval of the request subject to conditions listed in the draft resolution. Mr. Lohse indicated that there was one comment received in opposition to the request that was shared with the Commission. Chair Pierson opened the public hearing. Shane Cronk, 6966 40 th Street North, the applicant, indicated that he had started to move land prematurely. It was a misunderstanding on his part, and he apologized for his actions. Motion approved. iii. THE ENERGY CONSERVATORY, 403 HAYWARD AVENUE NORTH – SITE PLAN AMENDMENT Mr. Lohse provided an overview of the site plan amendment request. The property is zoned B-3 Light Industrial. The existing building is approximately 25,000 square feet in size. The Energy Conservatory is seeking approval to allow a new 1,140 square foot stand-alone building southeast of their existing building. The new building would be used as a training center for participants to learn how to perform energy audits, weatherization techniques, and building testing technologies. The new building would partly resemble a small walk-up apartment building with incomplete mock apartment units. The Energy Conservatory previously requested, and had received approval for, a site plan amendment in September of last year for a building addition for the same purpose. In that request, the mock apartment structure would have been built within an expansion area connected to the building. They are now requesting a detached, stand-alone building as it would provide more realistic training conditions for the testing facility. Mr. Lohse detailed the proposal’s compliance with the Zoning Code which included meeting the requirements for parking, exterior building materials, landscaping, and setbacks. Mr. Lohse stated that staff find that the request complies with the Zoning Code, subject to certain conditions being met. Staff recommend approval of this Site Plan subject to conditions. The conditions include obtaining approval of the civil construction plans by the City Engineer, the building cannot be used for dwelling purposes, the parcel cannot be subdivided as long as the additional building is situated on the property, the developer must provide details for rooftop screening and a photometric plan, and they must obtain permits and approvals from all applicable outside government agencies. No comments were heard. ## PLANNING COMMISSION REVIEW ## a. OLD BUSINESS i. CONTINUATION OF PUBLIC HEARING – OAKDALE MARKETPLACE PLANNED UNIT ## DEVELOPMENT PLAN AMENDMENT Planning Manager Luke McClanahan provided an overview of the ordinance and resolution amending the Oakdale Marketplace Planned Unit Development. On November 26, 2024, the City Council adopted Ordinance 937, an amendment to the Oakdale Marketplace Planned Unit Development (PUD) allowing commercial retail and residential uses on certain property located within the PUD area. Also on November 26, 2024, the Council approved Resolution 2024-89 amending the 2005 Oakdale Marketplace PUD Plan. One of those changes redesignated the portion of the PUD property located at the southeast quadrant of 34 th ## St N and Market Place N from retail to restaurant/fast casual dining in connection with a multi-tenant commercial use. The 2005 PUD Agreement pertaining to the Oakdale Marketplace PUD contained a provision by which the City agreed that it would not change the land use regulations relating to the PUD without the property owner’s consent. The property owner and the City disagreed over whether that provision was enforceable. The matter went to court and the trial court ruled in the City’s favor. That ruling, however, was later reversed by the Court of Appeals. As a result of the Court of Appeals’ decision, the PUD plan must be amended so that any retail use allowed in the B-1 District and former C-2 District would be permitted on the site located at the southeast quadrant of 34 th Street North and Market Place North. Mr. McClanahan stated that if approved, the amendments would supersede Ordinance 937 and Resolution 2024-89. Staff recommends approval of the ordinance and resolution for Oakdale Marketplace. Motion approved. b.NEW BUSINESS i.PUBLIC HEARING – MARTY, 7582 25 ## TH ## STREET NORTH – CONDITIONAL USE PERMIT FOR ## AN OVERSIZED ACCESSORY BUILDING ## Co mmunity Development Intern Connor Zielinski provided an overview of the Conditional Use Permit (CUP) request at 7582 25 th Street North. The property is 0.2 acres and contains a single- family home. The property previously contained a small accessory structure, which was removed 9 ## Planning Commission Minutes July 9, 2026 Page 4 earlier this year. The applicant is seeking to add a new oversized accessory structure, specifically a second garage. The zoning of the property is R-2 Low Density Housing, where single family homes are permitted to have one garage and one additional accessory structure up to 200 square feet by right, and larger structures are only allowed through the CUP process. The applicant indicated that the second garage would be used primarily for recreational vehicle storage. The second garage would be located northwest of the existing home, more than 90 feet from the front property line. Based on the site plan, the structure would meet all setback requirements and would be 30 feet from the front lot line and 5 feet from the other lot lines. The proposed structure would be 400 square feet in size, measuring 20 feet by 20 feet. The criteria for the conditional use permit require that an oversized accessory structure be under 1,500 square feet in size. Based on the proposed dimensions, this requirement is met. The elevations for the proposed second garage would be 12 ½ feet tall with a 7-foot-tall door. Under the City Code no door can exceed 10 feet in height, and the structure itself cannot exceed 25 feet in height. Based on the renderings, the requirements are met. The City Code also states that a property owner may not have more than one additional oversized accessory building. This is the applicant’s first request, so this requirement is met. Mr. Zielinski provided an overview of the CUP review criteria for the request. He stated that staff find that the CUP review criteria have been satisfied, as detailed in the Staff Report on file. Staff recommend approval of the request subject to conditions listed in the draft resolution. There were no questions by the Commissioners before the public hearing. There were no statements made by the applicant before the public hearing. Chair Pierson opened the public hearing. There were no public comments made. PUBLIC HEARING – NINETY FOUR EXCHANGE, 7049 4 ## TH ## STREET NORTH – COMPREHENSIVE ## PLAN AMENDMENT, PRELIMINARY PLAT, AND SITE PLAN Mr. McClanahan provided an overview of the request for two light industrial buildings at the northwest portion of the site. The request involves a comprehensive plan amendment, preliminary plat, and site plan. The property is zoned B-2 Business Campus. A Zoning Ordinance Amendment was approved in January 2026, which allows Light Manufacturing use in B-2. Also, the amendment added higher exterior design standards for industrial uses in B-2. The site is currently guided Office/Limited Business. The request is to re-guide a portion of the site to Industrial/Office, to allow manufacturing use. The remainder of the property must maintain its land use guidance as Office/Limited Business. For the preliminary plat, Mr. McClanahan noted that the three outlots shown on the plat must be consolidated into 1 outlot and should encompass the wetland and buffer areas. Certain easements will be required, as will fulfillment of park dedication. Review comments from the Minnesota Department of Transportation remain pending. In response to a question from Commissioner Campbell, Mr. McClanahan explained that the three proposed outlots must be combined because they do not satisfy frontage requirements. Once combined, the outlots would be re-subdivided upon future development proposals. Mr. McClanahan reviewed traffic and infrastructure information. The developer must cover the cost for traffic signal improvements at 4 th Street North and Hale Avenue North deemed necessary by the City Engineer. The developer must also cover the cost for pedestrian improvements at the intersection of 4 th Street North and Hale Avenue North also deemed necessary by the City Engineer. Parking requirements have been satisfied through the plan’s provisions. Stormwater infrastructure is also being proposed on site. Mr. McClanahan provided an overview of wetland impacts and an environmental site assessment that was completed for the property. As part of the recently completed Gold Line project, an eight-inch sanitary sewer line was extended along Hudson Blvd N to serve the subject property in anticipation of development. There is a sewer connection charge that must be paid by the developer as part of the development and entitlements process. For tree replacement requirements, Mr. McClanahan stated that 25 percent of significant trees on site can be removed without prompting tree replacement requirements. Based on the developer’s tree mitigation data, a little more than 2,000 inches of tree replacement must be covered via fee in-lieu. The developer’s landscaping plan shows that 80 trees will be planted on proposed Lot 1, which satisfies the ordinance requirements. 11 ## Planning Commission Minutes July 9, 2026 Page 6 The B-2 district must contain higher exterior building material standards. The developer must provide additional information on the exterior building materials to ensure compliance with the Zoning Ordinance. The Zoning Ordinance also contains requirements for trash enclosures, rooftop, and ground mechanical equipment. The developer must provide additional information on those items. Mr. McClanahan stated that staff recommends approval of the request subject to the conditions of approval found in the agenda packet. He summarized the conditions of approval in the resolutions. Mr. McClanahan acknowledged that the developer submitted revised materials earlier today in response to City review comments. The revised materials will be reviewed ahead of this request being heard by the City Council, likely on July 28 th . In response to a question from Commissioner Campbell, Mr. McClanahan indicated that the developer would pay for the traffic signal installation, however, there is flexibility as to whether the developer or City would install the traffic signal. Details will likely be worked out through the development agreement and the entitlement process. In response to a question from Commissioner Campbell, Mr. McClanahan indicated that the delineating of the bus lane would need Metro Transit decision. He further indicated that the City would likely have some say in that decision. In response to a question from Commissioner Willenbring, Mr. McClanahan indicated that tree mitigation elements have been in the zoning code for a long time. The amount of caliper inches proposed for removal specified is perhaps more noticeable with this project due to the large scale of trees in this area. There was some discussion as to how the funds are used when they are collected. In response to a question from Commissioner Wilson, Mr. McClanahan indicated that the entire area in question is zoned B-2 already. It is important to maintain future land use guidance along the areas for future development. Ideally, the City would like to retain high visibility frontage along the interstates for commercial use rather than industrial use. Peter Mork, Capital Partners, provided an overview of his company. Capital Partners is the largest owner and operator of industrial real estate in Minnesota. Capital Partners does work in other states as well. In response to a question from Commissioner Campbell, Joe Radach, Capital Partners, indicated that they do not have an exact truck count for anticipated vehicle trips. They based their traffic analysis on a previous traffic study completed by SEH for an office/commercial space. The proposed use would have much less traffic than previously shown. There is not much semi traffic anticipated. 12 ## Planning Commission Minutes July 9, 2026 Page 7 Mr. Radach indicated there would be a lot of mitigation costs involved with this project which could be cost prohibitive. He asked if there is a way to defer some of these costs. Chair Pierson indicated that they should work with City staff to discuss. Chair Pierson opened the public hearing. Brian Richie, 6923 4 th Street N, expressed concern with all of the changes being made in this area in such a short amount of time. He does not like that the area would lose more trees, more grass, and wildlife habitat. He was also concerned about increased traffic, more traffic lights, and increased traffic noise. Chair Pierson closed the public hearing. In response to a question from Commissioner Shava, Mr. Radach provided information on noise impacts on the neighborhood. Construction could begin this fall and could last two to three months. Vertical construction would likely begin in the spring of 2027 and be completed in about seven months. There would be construction noise during those times, but noise standards would be met. Once the buildings are completed, it would be quiet office and industrial businesses with no distribution traffic. The buildings could act as a sound barrier to freeway traffic. Commissioner Campbell agreed that the buildings would likely provide a better noise barrier than trees and landscape. Discussion occurred with regard to the exterior site plan. Mr. Radach indicated that complying with the Code requirement to have 70 percent class one material on all four sides of the buildings may be problematic. The docking side of the buildings cannot consist of class one material. Mr. Radach asked if the City would consider allowing painted precast panel on the docking side of the buildings. The remaining facades of the buildings would contain 70 percent class one material. Additionally, the docking sides of the two buildings would face each other and would not be highly visible from the street or the freeway. Mr. McClanahan indicated that the exterior is reviewed by the Development Review Committee as part of the site plan review. That committee makes the determination if the plan meets the requirements. Currently condition number 8 in the resolution requires all four sides of the buildings to contain 70 percent class one material. The proposed use is automotive retail, involving the sale and installation of new tires. The building is approximately 8,200 square feet. The developer’s request involves a preliminary plat to re-subdivide the existing outlot into one buildable lot and two outlots for future development, and a site plan to demonstrate technical conformance with the City’s Zoning Ordinance. The parcels are zoned Oakdale Marketplace PUD – Planned Unit Development. The entirety of the site is approximately 7.5 acres, with the proposed Parcel A being approximately 2.2 acres. Currently the site is vacant and is split into two sections by 33 rd Street North. ## Location Map – Les Schwab – Oakdale Marketplace ## ZONING DISTRICT REQUIREMENTS The subject property is currently zoned Oakdale Marketplace PUD. Proposed Lot 1, approximately 1.2 acres, would contain the tire store. The other two outlots, consisting of approximately 1 acre and 5.3 acres, would be reserved for future development. (2) Streets and Access: The developer’s plan includes a proposed access off 33 rd ## Street North – a private street. This access would be shared with the proposed outlot adjacent to the east. The internal roads will be private streets. As part of the application submittal, the developer provided an emergency vehicle movement analysis. However, the analysis shows turning movements for only the southern portion of the site. The Fire Department has requested a revised turning movement analysis. • The developer must provide an updated emergency vehicle movement analysis, to the satisfaction of the Fire Department. (3) Easements: The City’s subdivision/plat regulations require easements for utilities and drainage purposes. As mentioned, the proposed access to 33 rd Street North would be shared with the outlot adjacent to the east. Any necessary easements must be included within the final plat. (4) Park Dedication. As part of the platting/subdivision process, the developer must comply with the City’s park dedication regulations, which is based on acreage for commercial and industrial property. Given that there are no planned public parks to be built within the subject property, it will be required that the developer provide a park dedication fee in accordance with the City’s adopted fee schedule. Although park dedication was collected for the overall plat of Oakdale Marketplace, in 2005, as confirmed by the City Attorney’s Office, State Statute enables the City to collect park dedication if a new lot is created through re-subdivision of the property (Minnesota Statutes, Sec. 462.358, Subd. 2b(i)). A credit for proposed Lot 1, in the amount of $2,684 (based on the park dedication collected in 2005, at a rate of $2,200 per acre for commercial land) will be applied to the Les Schwab site. Based on the City’s 2026 Fee Schedule, and factoring in the credit noted above, the park dedication amount for the proposed tire center is $18,985.88. Park dedication will also be collected for proposed Outlots A and B, upon re-subdivision/future development. • At time of Final Plat and Development Agreement approval, the developer must satisfy park dedication requirements. 17 (5) Other Regulatory Reviews. Due to the property being located adjacent to County Highway 14 / 34 th Street North, the Washington County Public Works Department reviewed the plat. The County did not have any comments regarding the request. ## SITE PLAN ANALYSIS Site Plan review considers the relationship between the plan elements and conditions both on and off the property to ensure conformance of the Comprehensive Plan, Z oning Ordinance, and design standards. (1) Building Height, Setbacks, and Minimum Lot Size: Buildings in the PUD district follow the maximum building height standards of the B-1 Commercial district, which limits buildings in the district to a maximum height of 40 feet. The elevations show that the average building height is approximately 23 feet, which satisfies the height standards. As a commercial site, setback requirements of the B-1 district apply to the building. Setback regulations are 30 feet for the front and corner yards and 0 feet for the interior side and rear yards. The Site Plan and Preliminary Plat show that the setback requirements are adequately met. Impervious surface coverage for the commercial lot cannot exceed 90%. This requirement is met as impervious surface on Lot 1 is shown on the plans as being approximately 63%. (2) Parking: Minimum parking requirements for automotive service and repair use, per the City’s Zoning Ordinance, are one (1) space per 300 square feet of gross floor area plus one (1) space per repair bay. Based on the size of the building, approximately 8,200 square feet, and since the building includes six repair bays, 32 parking spaces are required. The site plan shows that 41 parking spaces are provided, which include 35 in the surface lot and six for the repair bays. As such, parking requirements are met. (3) Exterior Building Materials and Design: Non-residential buildings in all zoning districts must adhere to higher exterior building material standards (i.e., minimum of 70% Class 1 materials such as brick, stone, or glass). The elevations provided by the developer show that each of the building’s facades will exceed the 70% Class I materials requirement as the exterior of the building will consist primarily of brick veneer product. The commercial building must be fully compliant with Building and Fire Code. As such, the building must be properly outfitted with fire suppression systems. Hydrant locations and fire department connections must also be identified in the developer’s civil plans. • The developer must comply with Building and Fire Code requirements. (4) Tree Removal and Landscaping Plan: The developer’s plans show removal of seven (7) trees on the site, which currently contains 10 trees. As required by the City’s Zoning Ordinance, 51 trees are required for the site. This requirement is met as the developer is proposing 51 trees on site (2 existing deciduous, 10 proposed coniferous, and 39 proposed deciduous). (5) Screening of Utilities and Trash Enclosures. As required by the Zoning Ordinance, rooftop and ground mechanical equipment must be screened from view with materials that are compatible and comparable to that of the principal structure. Although not screened by special material, staff find that the rooftop mechanical equipment is acceptable given the use of similar colors to the building itself. Alternative methods to the screening requirements are allowed by the 18 City’s Development Review Committee, with consultation by the Planning Commission, in accordance with the Zoning Ordinance (Ch. 25, Art. 25-10, Sec. 25-10-701). • The Planning Commission should confirm if the rooftop mechanical equipment is acceptable without the need for additional screening materials. The elevations provided by the developer show the external trash enclosure structure will consist of the same materials as that of the principal structure (thin brick) and will have a roof. These features satisfy the Zoning Ordinance requirements. (6) Site Lighting: As required by the Ordinance, site lighting cannot exceed 0.5 foot-candles at any property line, and light fixtures cannot exceed 30 feet in height. Based on the photometric plan provided by the developer, these requirements are met. (7) Signage: The developer will need to obtain a permit for proposed signage. All signage must conform to the City’s sign regulations. (8) Grading, Utilities, and Stormwater Management: The developer submitted plans for grading, sewer, water, and other utilities. Given the size of the development, on-site stormwater management provisions must be provided to manage runoff. The plans show a proposed underground stormwater system located east of the building, withing the parking lot area. • The developer will need to obtain approval from the City Engineer for their site civil plans. • The developer will need to work with the Valley Branch Watershed District and the City Engineer to ensure stormwater management provisions are installed accordingly. (9) Other Regulatory Review: The developer will need to work with the applicable Watershed District to satisfy stormwater management provisions. The applicant describes the car wash as having a single, fully enclosed 130-foot wash tunnel and 14 external vacuum stalls. Car washes are expressly prohibited within the Tartan Crossing PUD area, thus prompting the applicant’s request for a PUD Amendment. The subject property is approximately 1.2 acres and consists of an existing, vacant commercial building with a parking lot and drive-through. The developer is requesting an amendment to the Tartan Crossing PUD to allow a car wash as a conditional use within the PUD. This PUD Amendment is a standalone request to remove car washes from the list of prohibited uses to allow them through the conditional use permit process within the Tartan Crossing PUD. The stated purpose and intent of the Tartan Crossing PUD is to “...provide for a compact, walkable, mixed- used development along a key corridor and gateway.” To ensure this, the PUD includes district design standards to support high quality development that takes into consideration “...building design, parking, landscaping, and pedestrian spaces...” The proposed amendment to the PUD, to enable car washes, is inconsistent with these standards and the long-term vision for pedestrian-friendly uses within the Tartan Crossing area. The proposed land use and site design could generate negative external effects that staff have identified including increased noise impacts on adjacent residential property and by adding an auto-centric use that creates conflicts with the mixed-use, pedestrian supported neighborhood. While the Tartan Crossing area contains some businesses with auto-oriented features, these accessory uses support the principal uses on site that serve both pedestrians and automobile users, whereas a car wash provides services exclusively to automobile users. Staff recommends denial of the PUD amendment request for the reasons stated above. ## CONDITIONAL USE PERMIT ANALYSIS The subject property is located within the Tartan Crossing PUD, where car washes are listed as prohibited uses. As such, the use is not permitted, and the Conditional Use Permit (CUP) should be denied. ## ALTERNATIVE CONDITIONAL USE PERMIT ANALYSIS If the Planning Commission is inclined to recommend approval of the PUD amendment, the following section contains the required criteria that must be used to evaluate the corresponding CUP. General staff analysis for each criterion is also included. The zoning ordinance states the following (Code of Ordinances, City of Oakdale, Minnesota, Chapter 25, Article 25-03, Sec. 25-03-301(a)): A conditional use is a permitted use that is allowed only when it is shown that the use meets certain general and specific standards related to the proposed conditional use. 33 Conditional uses must meet all seven (7) general criteria in order for a permit to be approved. This allows the City to review the potential impacts the use may have and to ensure that the use is consistent with the vision for the area in the City’s Comprehensive Plan. General Criteria for Granting a Conditional Use Permit. The general criteria for granting a conditional use permit (applicable to all conditional use permit requests) are listed in Section 25-03-302 of the Zoning Code. All criteria must be satisfied to approve the use. The conditional use is evaluated according to the following criteria: (1) The conditional use will be in conformity with the City’s comprehensive plan and with the purpose, intent and applicable standards of this Ordinance. • Per the City's Comprehensive Plan, the property is guided Mixed Use. (2) The conditional use shall be located, designated, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. • The stated purpose and intent of the Tartan Crossing PUD is to “...provide for a compact, walkable, mixed-used development along a key corridor and gateway.” • The PUD also emphasizes “pedestrian spaces”, whereas car washes do not support such goal. (3) The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noise, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. • The proposed use is anticipated to generate potential impacts on nearby property due to the noise generated from the 14 vacuum stalls on the external surface lot and 130-foot car wash tunnel, queuing of vehicles on the site, and vehicle circulation. • The developer should propose mitigation methods to address concerns about noise, lighting, and traffic impacts to the adjacent residential property. (4) The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. • The preliminary plans show substantial space provided for vehicle stacking in the drive- through, but there is potential during peak business hours for the vehicle queue to back up into the one-way access point from the south, which is accessible via commercial property to the south. • Although there are concerns about vehicle circulation, the applicant provided a report on trip generation and vehicle queueing, which has been reviewed by the City Engineer and is found to be acceptable. (5) The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. • The property is served by existing public services. (6) The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the city. • The project is privately funded by the developer. As such, the proposed use should not create any additional requirements at public cost. • However, as a high-water user, there are some concerns about allowing a car wash in an area that does not permit the proposed use. o On-site water reclamation (for 50% of water usage) should be required through a condition. 34 (7) The use shall preserve and incorporate the site's natural and scenic features into the development design and cause minimal adverse environmental effects. • Due to the presence of some trees on the property, the applicant would be required to submit a tree preservation plan as part of a formal Site Plan application. Specific Conditional Use Permit Criteria for Car Washes. The specific criteria for granting a conditional use permit for a car wash are listed in Section 25-09-107 of the Zoning Code. (b) Screening of automobile headlights shall be provided. Screening must be at least three (3) feet in height consisting of a wall, fence, dense vegetation, berm or grade change or similar screening as determined by the City Council. • A formal landscaping plan and photometric plan have not been provided as part of the PUD amendment or CUP application. • The applicant would be required to demonstrate conformance with this requirement at time of Site Plan application. (c) The car wash facility shall not be located within fifty (50) feet from a residentially zoned property. • The parcel is located adjacent to residential property, New Perspective senior living, which is bisected by 11 th Street North. As indicated on the site plan, the main assembly hall for the church would accommodate 98 people (the applicant anticipates that average service attendance will be approximately 50 people). Conditional uses must meet all seven (7) general criteria in order for a permit to be approved. This allows the City to review the potential impact(s) the use may have and ensure that the use is consistent with the vision for the area in the City’s Comprehensive Plan. General Criterial for Granting a Conditional Use Permit. The general criteria for granting a conditional use permit (applicable to all conditional use permit requests) is listed in Section 25-37(g) of the Zoning Code. The conditional use is evaluated according to the following criteria: (1) The conditional use will be in conformity with the City’s comprehensive plan and with the purpose, intent and applicable standards of this Ordinance. • The proposed use is in conformity with the City's Comprehensive Plan as the property is guided Industrial/Office. Places of worship are allowed uses in all zoning districts provided that they are reviewed and approved through the Conditional Use Permit process. • This condition is met. (2) The conditional use shall be located, designated, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. • The property is located in an area that consists mostly of commercial and industrial office uses. Additionally, there is another place of worship located roughly 800 feet to the south at 420 Hayward Avenue North, which is also zoned B-3 Light Industrial Zoning District, in a property that is guided for Industrial/Office. • The property itself consists of an existing building that is approximately 5,500 square foot in size and contains 41 parking spaces shared with the neighboring tenant. The applicant indicates that there are no plans for exterior additions or expansions on the site. • This condition is met. (3) The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noise, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. • The proposed use is not anticipated to generate negative externalities and nuisance conditions. • This condition is met. 46 (4) The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. • The property contains 41 existing parking spaces that are in a shared lot with the neighboring tenant. The applicant noted in their application that they have executed a signed, shared parking agreement with the adjacent property owner. • The maximum occupancy of the building is 148 people, per the concept floor plans. Per Code, a place of worship is required to have 1 parking space per 6 persons of the maximum occupancy. Given this, only 25 parking spaces are needed per the City’s Zoning Ordinance. • The worship services occur primarily on Friday evenings and Sunday, outside of the peak operating hours for the surrounding businesses. The average attendance of 50 people noted by the applicant should not generate excessive traffic in the area. • To ensure that adequate vehicle circulation can occur on site, including large public safety vehicles, staff is recommending as a condition of approval that the applicant install “no parking” signage along the east drive aisle and along the north side of the building. (5) The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. • As an established commercial property, it is served adequately by public services. • This condition is met. (6) The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the city. • The proposed use is not anticipated to create any additional requirements at public cost. • This condition is met. The balance of the building will continue to be occupied by the existing commercial tenant. The request involves a change of occupancy only. No additions, exterior building modifications, site alterations, or expansion of the existing parking lot are proposed. Existing access drives, parking, utilities, landscaping, and stormwater facilities will remain unchanged. ## Description of Proposed Use Josiah Center is a community church that provides worship services, fellowship, educational opportunities, and outreach programs for individuals and families. The applicant is planning to add a new electronic message sign component to the existing pylon sign. Electronic message signs are allowed through the CUP process. The proposed electronic message sign is 24 square feet in size. In 2010, a CUP was approved for an 11-square-foot electronic sign at the site; however, the sign was removed several years ago. Given that the proposed sign is bigger than the 11 square feet allowed by the original CUP, a CUP Amendment is required. This allows the City to review the potential impact(s) the use may have and ensure that the use is consistent with the vision for the area in the City’s Comprehensive Plan. In addition, some conditional uses have specific criteria that must be met which are intended to address potential issues that may arise associated with that type of use. If an application meets all the criteria in the ordinance, then a conditional use permit shall be granted. (1) The conditional use will be in conformity with the City’s comprehensive plan and with the purpose, intent and applicable standards of this Ordinance. • The proposed use is in conformity with the City's Comprehensive Plan, as the property is guided as commercial, and electronic message signs are permitted via CUP provided certain conditions are met. An approved Conditional Use Permit for a smaller electronic sign is also already on file. This condition is met. (2) The conditional use shall be located, designated, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. • The electronic message sign will be located on an existing commercial site and will not alter the character of the area. This condition is met. (3) The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noise, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. • The applicant has stated and has provided product specifications showing that the sign will adhere to the brightness, dwell time, and operating hours restrictions as laid out in Section 25-11-205 of the Zoning Ordinance. This condition is met. (4) The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. • The proposed electronic message sign is not anticipated to create traffic issues. Additionally, the sign plans have been reviewed by MnDOT with no concerns. This condition is met. 57 (5) The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. • The site is served adequately by public services, and the sign will not require additional services beyond those that can be provided by existing utilities. This condition is met. (6) The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the city. • The proposed electronic message sign should not create any additional requirements at public cost. This condition is met. (7) The use shall preserve and incorporate the site's natural and scenic features into the development design and cause minimal adverse environmental effects. • The proposed sign will not impact natural features and is not anticipated to cause any adverse environmental effects. This condition is met. In addition, some conditional uses have specific criteria that must be met which are intended to address potential issues that may arise associated with that type of use. If an application meets all of the criteria in the ordinance, then a conditional use permit shall be granted. Specific Conditional Use Permit Criteria for Electronic Message Signs. The specific criteria for granting a conditional use permit for an electronic message sign is listed in Section 25-11-205(b) of the Zoning Code; staff evaluation of the application follows the citations: (1) The lamp wattage and luminance level in Nits shall be provided at the time of permit application. • The applicant has provided lamp wattage and luminance levels in the attached materials. The sign would be rated for 10,000+ nits but be programmed to comply with City standards. This condition is met. (2) Public service messages, in addition to messages such as Amber Alerts, are to be provided at no cost to the public. • The applicant has stated that the sign will be programmed to comply with this provision. This condition is met. (3) Electronic dynamic business signs are prohibited as temporary signs. • The sign will be permanent in nature. This condition is met. (4) Electronic message signs must have minimum display duration of thirty (30) seconds. • The applicant has stated that the sign will be programmed to comply with the 30 second minimum duration. This condition is met. (5) The sign must be rectangular in shape and all messages contained within. • The proposed sign is rectangular in shape, with dimensions measuring six feet wide by four feet tall. This condition is met. (6) Such displays shall contain static messages only; change from one (1) static message to another shall be instantaneous without any special effects, through dissolve or fade transitions, or with the use of other subtle transition that do not have the appearance of moving text or images. 58 • The applicant has stated that the sign will be programmed to comply with this provision. This condition is met. (7 ) Allowed Usage: The sign shall not be allowed on any buildings. • The proposed sign will be installed on an existing pylon sign. This requirement is met. (8 ) All electronic message signs shall have installed ambient light monitors and shall, at all times, allow such monitors to automatically adjust the brightness level of the electronic sign based on light conditions. • The applicant has stated that the sign will have these features installed. This condition is met. (9 ) Electronic message signs shall not exceed two thousand five hundred (2,500) Nits between the hours of civil sunrise and civil sunset and shall not exceed five hundred (500) Nits between the hours of civil sunset and civil sunrise as measured from the face of the sign. • The applicant has stated that the sign will be programmed to comply with this provision. This condition is met. (10) Electronic message signs shall have a fully functional monitoring off switch system that automatically shuts the electronic display off when the display deteriorates, in any fashion, five (5) percent or greater until the electronic display sign has been repaired to its fully functional factory specifications. • The applicant has stated that the display will be programmed to comply with the specified brightness requirements. This condition is met. (11) When a static billboard is replaced with an electronic message sign, a permanent removal of two (2) square feet of existing static billboard shall be required for every one (1) square foot of electronic message sign. • This is not a request for a static billboard conversion. This condition is met. (12) Conversion of a nonconforming static billboard sign to a dynamic display electronic message sign is prohibited. • This is not a request for a nonconforming static billboard conversion. This condition is met. (13) A Conditional Use Permit is required. • The applicant already has an approved Conditional Use Permit on file. The purpose of this amendment is to increase the allowed size of the sign from 11 square feet to 24 square feet. Upon granting of a Conditional Use Permit Amendment, this condition will be met. DESCRIPTION OF OPERATION OR USE The applicant requests an amendment to the Conditional Use Permit approved for the property in 2010. The 2010 approval authorized an 11-square-foot, double-sided, south-facing electronic message sign. The requested amendment would authorize a 24-square-foot electronic message display face measuring 6 feet wide by 4 feet high. The proposed cabinet is double-sided; under the City's sign-area method, the area is calculated using one sign face only. The new electronic display will replace the existing manual changeable-copy reader-board cabinet on the established freestanding pylon sign. The existing MC's Pub identification cabinet, pole, sign location, and overall support structure will remain, subject to final structural and electrical review. No new freestanding sign location, driveway, parking area, building expansion, drainage change, or change in the principal commercial use is proposed. ## 2.
