the southeast quadrant of Helmo Avenue and Fourth Street and it's also located [1:53] immediately east of the Norhart apartment building So if you recall the final plat for Enclave was approved at [1:58] the prior council meeting on May 27th and as a condition of approval for the plat uh there was a a requirement that [2:06] the developer vacate any unnecessary public easements and zoning code [2:11] prohibits encroachments onto easement areas So as such the developer has formally applied to vacate the existing [2:19] uh utility and drainage easements that are no longer needed Sufficient corridors have been provided as part of [2:24] the uh u have been provided for utility and drainage uh as part of the final [2:30] plat for Enclave HL station that was just approved And there is also a request to approve the development [2:36] agreement for Enclave And the development agreement specifies the terms and conditions that the developer has to satisfy in order to build certain [2:43] site improvements for the development in including a new park And uh with that staff recommends approval of the two [2:50] easement vacations and those are resolutions 2025-57 and 58 that are in the agenda packet And [2:57] as a reminder this is a public hearing for uh the easement vacations Um and oh I I should also mention that staff [3:03] recommends approval of the development agreement as 5th last week and um held public hearings on the comprehensive [5:58] plan amendment for the Glen Brook small area comprehensive plan um and also a public hearing on the zoning and [6:04] subdivision code update and the zoning map up amendment and um had some good [6:09] discussion and um that was pretty much their meeting Wonderful Uh award bid [6:17] none So we'll move into community development We have a couple items uh [6:22] tonight Luke taking us through this Welcome on back [6:27] So yes this uh site plan amendment it's for Collins Electrical Construction They're actually relocating from their [6:33] headquarters in the city of St Paul to here in Oakdale And the location of their site is 711 Hail Avenue So this is [6:40] the former Spartan Promotional Building if you're familiar with that This site plan amendment request involves [6:46] expanding the existing building by approximately 19,000 square ft and adding a dedicated outdoor storage area [6:53] for business equipment So after reviewing the uh request staff finds that it complies with the zoning [6:59] requirements including the standards for parking landscaping exterior design standards screening and light site [7:06] lighting Um so staff recommends approval of the amendment subject to the following conditions that are found in [7:11] the resolution 2025-55 And I would like to note that since the agenda packet was actually published the developer [7:18] submitted updated plans that satisfy conditions 2 three and four in the resolution So those uh conditions are a [7:24] bit moot Um but I'll read through the the five conditions here So number one is uh that the developer has to obtain [7:31] approval for the uh civil construction plans by the city engineer Number two [7:37] provide details methods of screening for trash collection areas for external trash collection and the developer [7:42] actually u they pointed out that there's an there's an existing internal trash collection area Um so that's what will [7:48] be utilized Number three uh the condition here demonstrate compliance with the exterior design standards The [7:55] uh developer provided updated elevations and the ex building expansion is compliant with our design standards [8:01] Number four revisions to the phototric plan to comply with the city's site lighting requirements and the updated [8:08] plans uh show that they are in full compliance And finally number five permits and approvals must be obtained [8:14] from outside government agencies and those pro approvals must be uh provided to the city We do do feel confident that we could get there here in the next few weeks Uh the developer again is working with city [9:38] staff both on the development agreement and also working towards obtaining a last recent years with um her late husband Corey and she was very appreciative of the [12:08] relationship and the service that the fire department provided her So with that she provided an $800 our owner's rep [12:49] to come up for it's about the new um public work or sorry sorry city hall [12:54] sorry and police facility This is our next project So we got two projects going on It's pretty exciting So Don [13:01] thanks Welcome Thanks Chris Good evening Mayor Council Once again I am Don Tyson the owner's representative for the [13:07] public works project and this these uh the police remodel expansion project and the city hall remodel project It really [13:14] is a privilege to serve in these roles for you uh on these exciting projects Also in attendance with us tonight is [13:21] Mike Phillips He is a senior project manager with Krauss Anderson and with your approval tonight of the contract he [13:28] will be leading the project for the Krauss Anderson team So tonight we're requesting two actions for these [13:33] projects The first action is approval of the construction manager at risk contract Back on March 11th you approved [13:40] the process to select the construction manager with the projects in compliance with Minnesota statute 471.463 [13:48] You also appointed the city administrator city police chief and project architect as a selection committee Uh for this process there was [13:55] a robust selection process that took place that began with a issuing a request for qualifications The city [14:02] received eight responses and after scoring those responses we sent the request for proposals then to three [14:08] firms and then after scoring those proposals the top two firms were interviewed As the conclusion of those [14:14] interviews the combined scores of the qualifications the proposal and the interviews were told up and the [14:21] selection committee is recommending Cross Anderson uh construction company for these projects As you know Krauss [14:27] Anderson is the current construction manager on the public works facility They have kept this project in budget [14:33] and progressing forward even under challenging site and weather conditions that we've experienced out there The [14:39] transition to the police department and city hall projects will really be a smooth seamless effort for city staff uh [14:45] to keep this the next project going forward As a side note the team of BKV Group the [14:52] uh architect for these projects and Cross Anderson recently completed a joint facility of public works and uh [14:58] police department in Rosemont and we actually toured that uh last week to see that So this team of architect and [15:05] construction manager have really completed some uh great projects here in the cities together [15:10] The request for council action does contain financial information on the construction management fee and pre-construction services I do want to [15:17] point out that in the times we're in where everything seems to be costing more the construction management fee [15:23] percentage is less than the construction management fee percentage on the public works project that was approved two [15:28] years ago And thanks go to your city administrator Chris Vulkers that negotiating this this uh reduction in [15:34] fee from one two two years ago So with that mayor we and council we're requesting that city council authorize [15:41] the mayor and city administrator to enter into an agreement with Krauss Anderson Construction Company for [15:46] construction management risk services for CIP project B2025-1 [15:52] and B2026-1 [15:57] Thank you Don Uh council members any questions for Don or Chris Because you [16:03] know we know Chris does so much on these projects Any questions All right let's look for a [16:10] recommendation I move we authorize the mayor and city administrator to enter into an agreement with Carl Anderson [16:16] Construction Company for construction management at risk services for CIP project B2025-1 [16:21] the expansion and remodel of the police department facility and B2026-1 [16:27] the remodel of city hall Uh there's a motion Is the action you took back on August 14th of 2024 for the public's works project [16:48] giving the city administrator a level of change order approval authority This action tonight is for just the police [16:54] department and city hall projects For new council members and the public I want to reiterate three points that we [17:00] made back in August about this change order authority Uh first of all change orders are a necessary part of any [17:05] project There are things that the owner decides they want during the construction and no plan is perfect [17:11] Change orders are just a fact of life with a project Field revisions are needed With that we need timely review [17:17] and approval of a change order so we don't see delays because delays cost money for everybody on a project Most [17:24] importantly to that point though there is a vigorous change order review process that's in place that will be also in place for this project [17:32] Change orders are reviewed by the project architect the construction manager the owner's representative myself uh and even before a change order [17:40] is drafted the team reviews these change orders or potential change orders with the city administrator and get their uh [17:47] the city administrator's approval even start processing those So that rigorous process ensures transparency and [17:53] accountability and that it's actually a needed and a and a a wellpriced change order [17:58] So with that mayor we do request again uh that the city council authorize a city administrator to approve individual [18:04] change orders up to $100,000 provided that the increases in the project cost [18:10] within the city council's approved project budget for the police department and city hall projects [18:17] Thank you Don Uh council members any questions for Don on this one Yep Go for it Yeah I was just uh could you speak to [18:23] the number of change orders above 25,000 that have been received for the public works building to this point [18:29] I don't have that number council member but we can get that to you I would say it's right now it's uh less than 10 Sure [18:36] So and comparison to the scope of other projects of this size Is that fairly standard Is that more Is that less Yeah [18:43] The the primary the largest change over so far have been related to the winter conditions working over the winter and [18:49] dealing with frozen ground Um and that's so those have been the most significant [18:54] ones moving the earthwork but nothing unusual for a project of this size or [18:59] magnitude Um the change order budget itself right now also is in uh excellent [19:04] condition compared where we're at with the project with the progress that you saw out there last week So yeah No [19:10] perfect Yeah the weather conditions are a big factor in any project So I appreciate sharing that That's the only question I had Thank you Uh any other [19:18] questions for Don All right Uh who would condition related almost Um but I do [20:05] appreciate the the faith you have in the staff to really vet this stuff There have been times where we've said no or [20:11] no we're not going to do it that way We're going to find a different way which is why our change order our whole budget is in really good shape So be [20:17] assured we're trying to work hard on that So um as far as this agenda item it [20:23] is about city policy um CCO2 which is city council policy Council only has a [20:28] few policies This is one It's about advisory boards and commissions And what we're trying to do is clarify a more [20:35] clear process for both both the applicants as they go through the process to be in a commissioner board [20:40] The council as they consider the applicant and then um the council as they're managing the commissions These [20:47] are this is a council thing The commissions and boards are council They are not staff We only support you guys [20:53] make the decision So what you've got in front of you is a proposed um well several proposed based on council [20:58] discussions previously on um eight sections and it really [21:03] clarifies the term of the appointments the application process and how that flows So it clarifies some hiccups we've [21:10] been having just because we didn't allow enough time for everything Um reappoints what happens in that so that [21:16] commissioners know if they want to be reappointed how that process works and how council's involved vacancies [21:22] attendance attendance is a big one It is very important that people who become part of our commissions and boards [21:28] attend the meetings So the council is interested in putting a threshold for attendance expectations So that's in the [21:35] policy organization overall u meetings and then the annual work plan that they [21:40] will prepare work plan and council will review it They'll have discussions It'll be an open discussion with the commission's board So lots of great variety of fruit fresh fruits and [23:39] vegetables also baked goods lots of things out there Um usually there's also some city staff either recreation [23:45] department or maybe community development So if you see any of our team out there stop by and say hi We really appreciate that Uh it'll be [23:50] continuing through October 8th Uh city offices will be closed on Thursday June 19th in observance of the Junth holiday [23:57] Uh offices will reopen the following day Friday June 20th Every summer the city recognizes the [24:02] eye-catching landscaped properties with the Starts at [25:31] 6 PM heads down uh 15th Street from Transfiguration Church to Walton Park Um [25:36] after the parade uh stay in Walton Park We have food trucks We have the Lions Club beer garden Um we're going to have [25:42] live local music uh local musicians performing in the band shell Um so stop [25:48] down for the first kind of official night of all of the fun in Walton Park Uh Friday starts a little earlier this [25:54] year The fund starts at 11:00 a.m in Walton Park Um the Oakdale recreation uh department will be out there with the it [26:00] truck We're going to have pony rides There will be giant inflatables for the kids to jump around Plenty of food and [26:05] beverage Um at 5:00 we'll have the third layer skateboard competition That's always a fun time Um and Free and Easy [26:12] is back this year and in the band shell They are always they've been very popular the last few years So we're excited to have them back and they'll be [26:17] playing from 6:30 to I think 10:30 Um so come on down for some live music in the park And then all of the Summerfest fun [26:25] uh yep that was the last thing on there Uh uh comes to a head on Saturday It [26:31] begins bright and early with the Oakdale Nature Preserve 5K Starts at 8 a.m at the Discovery Center Um I'll be out [26:36] there I'm not running I'll just take pictures and say hi So um come on out Cheer on the runners If you're not a [26:42] runner it's like that line in the movie Greece If you can't be an athlete be be an athletic supporter So um we [26:48] definitely want to cheer on the runners after the Nature Preserve 5K You like that huh [26:55] Uh all the fun starts down in Walton Park again at 11:00 a.m Uh we have balloon artist I keep saying we it's [27:01] Oscar the group behind Summerfest They do an amazing job There's going to be balloon artists There's going to be pony rides The inflatables will be back Um [27:08] the the teddy bear band will be performing Saturday afternoon That's always a fun time for the for the kids [27:14] Food trucks Uh the Little Blues Traveling Zoo is back again this year so you can hang out with the animals Uh the [27:20] Oakdale Fire Department is once again hosting a pop-up splash pad A big thank you to the fire department for doing [27:25] that That starts at 1:00 p.m Uh the Minnesota Twins are sending TC Bear out [27:31] uh to hang out with kids 4 to 5:00 p.m So you'll see see the bear walking around the park Um and then all of the [27:37] Summerfest fun kind of accumulates with uh a concert by GB Leighton a Midwest favorite Um a truly tremendous band 6:30 [27:44] to 10:30 and then the Oakdale firework extravaganza is at just after 10 o'clock [27:50] So we hope everybody will join us Uh Summerfest is always so much fun Uh and as I mentioned all of this is pulled [27:56] together by a group of five volunteers It is unbelievable all of the work that the Oakdale Summerfest Community Organization does for this community [28:03] event every single year Um a big thank you to them A big thank you to our staff um who play a huge role in making sure [28:10] the logistics in Walton Park are set up and available Everything from food [28:16] vendor food truck licenses to um having electric out at the park all of the [28:22] public work staff doing cleanup u throughout the event It is truly a team effort and we appreciate everybody's [28:27] hard work on that Uh a reminder I don't know if we ever actually said this but [28:33] uh this is our only city council meeting this month We canled the one the week of Summerfest um so we department in Washington County and in the region has had a tremendous relationship with Sheriff Star Um during his two terms don't don't you dare [29:11] Um during his two terms uh he's been with uh the sheriff's office Oh I don't even know how long he's been Um just a [29:18] leading force in public safety um and community engagement in the east metro for so long Um thankfully he's not done [29:25] quite yet He'll be around till January 2027 So we we can all benefit from his experience and passion for the East Metro a little bit longer but um Sheriff [29:32] Star has been such an asset for public safety for everything in the East Metro for so long We wish him well in [29:38] retirement We are bummed to see him go Um we got to pay bills H the bills Let's [29:45] see Claims roster 2 in front of us Uh an amendment to the [32:45] property use agreement by Ames Construction Mr Getsoff welcome Thank [32:50] you Mr President Commissioners uh the the item before you is approval of the [32:57] second amendment a temporary property use agreement with Ames related to ED own EDA owned property at Tanner's Lake [33:03] Uh Ames entered into this agreement November 16 2022 uh for temporary use [33:08] related to the Gold Line bus rapid transit project Um that agreement was amended April 15th of 2024 extending [33:16] those terms to no November 23rd 2024 Uh condition of that agreement was that [33:23] Ames was to um in exchange perform some sewer relocation work at their expense [33:30] um end up the the as did not perform the location work because it it wasn't needed based on the design of the uh [33:37] Tanner's redevelopment um project So in lie of that we've worked out an arrangement um with as [33:43] that they pay the approximate cost of what it would have been done to do the work but we are just limiting that to [33:49] the materials only knowing that you know they would have been on site and been able to do that So and those numbers [33:54] have been verified by the city engineer Um so that amount would be $27,500 [34:00] with the recommendation that that go into the municipal building fund So the action before uh the EDA here today is [34:07] at the um recommendation of our city attorney to make sure we just memorialize this in an agreement form [34:13] for for future auditing purposes would be to authorize um EDA president and executive director [34:20] to sign and execute the se second amendment to the temporary property use agreement with Ames on behalf of the EDA [34:27] Happy to answer any questions Uh commissioners any questions No questions I have one Why is it going to the [34:33] municipal building fund Uh our past practice is money yielded from public lands goes to parks So why the ch Well I [34:42] guess it's a council tradition Um why the change now So Mr Mayor city council [34:48] that was very deliberate to give you flexibility on wherever you want to move it to after that That's the right place to move it to So you have full [34:54] flexibility Wouldn't we have the same flexibility with just putting in the general fund Um there are rules about [35:01] this specifically and without going into too many details with the auditor who's not here It does this this does give you [35:08] you can move it back to the general fund This gives you the most flexibility Yeah Because of the source of the funds That
