[Music] so I am going to call to order the Planning Commission meeting for January 22nd 2025 we will start with the Pledge of Allegiance pledge allegiance to the flag to the flag of the United States of America to the repu for stands Nation indivisible andice okay we have Susan on zoom and Jenny and zoom and then Joe so we will get going approval of the meeting agenda I would recommend approval with the amendment of removing number s the concept comprehensive plan Amendment because there's more information coming so we're going to wait till March so I would make that motion I'll second Susan second I'll call for the vote Scott I I Susan Susan I Lyn I okay now I would look for a motion to approve appr the November 20th 2024 joint Planning Commission city council meeting minutes I move that we uh approve the November 20th joint meeting minutes motion's been made by Robin Scott I'll second Scott second I'll call for the vote Scott I Robin I Susan I Lyn I now we will move on to number five uh public open form is there anybody that would like to address the Planning Commission moving on to number six public hearing and discussion for CTI garage cond cup Amendment elanar would you read the notice as published in the forest lake times absolutely uh notice is hereby given that a public hearing will be held by the city of Columbus Planning Commission on Wednesday January 15th 2025 at 6:00 p.m. or as soon thereafter as parties may be heard the hearing will be conducted in person and by interactive technology at the Columbus City Hall located at 16319 Kettle River Boulevard Columbus Minnesota to consider a request to amend the existing conditional use permit and add two additional buildings to the facility at 13305 Humber Street noreast members of the public interested in attending in person monitoring the meeting or wanting more information should contact the city offices at 651464 3120 or visit the city website at Columbus mn. us the hearing shall continue until all evidence and testimony has been heard thank you Elanor and Joe is via zoom and for the record did you receive a copy of the staff uh report developed by elanar Han dated January 10th 2025 yes I did and regarding this application the report notes some certain findings number 1-4 on pages 9 and 10 uh she also note some conditions numbering 1 through 24 do you understand these recommendations and conditions and do you have any questions uh yes I do and I had called Elanor on two of the just to clarify a couple of them uh 15 and then number 23 and I think she was going to address them tonight okay so elanar would you like to read the uh absolutely application um so this application is an expansion of the existing garage condos complex um let me pull up some plans for you guys nope that one on Humber Street um there's been quite a few expansions as of now we're moving on to these two buildings here um and expanding it that way the two questions that um Mr bayy uh addressed with me were on conditions number 15 which states um that the CTI shall submit a copy of the proposed plat prior to the issuance of any building permit so I'm going to explain how these plats work for these particular condo they work a little bit differently than any of the other plats that we usually do here um these are um Community interest yeah Community interest plats uh which is done for condos where the um each individual unit is its own parcel and is owned the land underneath it and the parcel is owned by the um buyer and then the um areas outside is a community interest area that is owned collectively by everyone else the way that condos and and um tow houses are split up now these plats are surveyed and filed after the building is built so that they can have accurate lines on where the the building actually ended up so this particular condition will actually be uh the CTI shall submit a copy of the plat after the building has been built and once that is um final filed with the county we would want a a final copy of that plat not prior to the building being issued because it cannot be completed before then and then the final one is um on condition number 23 saying that CTI shall be obligated to pay the costs and expenses um in connection with any proceedings to revoke said cup including reasonable attorney fees and consultant fees um it is cti's intention once this development is complete um on all of these Parcels that the ownership be passed on to the HOA of all of these facilities and not have any connection with that the cup would then be transferred on to um that HOA and that HOA would be obligated to pay any cost of the revocation of that cup because it would be uh conveyed over once that development is completed and he wanted some assurances in these conditions that he would not be held responsible for the revocation of a cup after he is no longer the owner of that c once the land is passed on which is what will happen but we can add some legal language to make that clearer for him um I would open this up to any questions from the Planning Commission for either me or Mr bayy okay Joe is there anything you wanted to say to us before we start asking questions um nothing other than it's you know what I'm doing is is the same I've done since 2008 so the buildings and all that are going to look just like what we have there now um nothing nothing of the construction style or or type is going to change from what we have already so it's just basically adding another roughly 25 units to the complex and then that will maximize all the square footage I own and Fin the project out other than that it's pretty much the same same old same old I've been doing for the last 16 years so so now I will open the floor to the Commissioners if they have any questions for Joel I think it looks I can't believe there's this big a demand for these things so congratulations on finding uh a a great business Venture that's all I can say is you can fill out all your land and all of these places that's amazing yeah it's been a fun ride Susan did you have a question I know I was just agreeing just with uh yeah absolutely just what a great U business it's I've watched it grow I've been in the area for a long time so congratulations thank you Cat did you have any questions uh yeah hi Joe um I agree with the other other Commissioners here just a question I have Joe is I know that in the past there's been some noise complaints uh are you aware of those noise complaints um yes I believe they I don't believe we've had any issues in the last couple years okay um I I've always talked to Elizabeth about that and I I know since she's left we haven't had any but we I believe it's been at least two years if not three since we've had any complaints um unless you guys have something that I don't know about um but we we we address those with the individual garage owner and the neighbor and I believe it you know in from what I understand it all got settled so okay um yeah I mean obviously that's part of the conditional use permit um you know that you're you're maintaining the noise standards uh within levels um so that's why I'm asking that question the other thing too is I'm sure some of these are reported a 911 to the Sheriff's Department which we don't necessarily have that data if they do get reported but I honestly I'm happy that you're um resolving those issues on your own and protecting that conditional use permit that yeah we you know I'm on the board uh for the HOA and we remind people all the time that you know what you do inside your garages your business for noise and and such like that but you can't leave the doors open and you know start firing your your car wide open at especially after hours but even during the day too it's somewhat restricted so we just you know we try to keep everybody responsible for that on their own but we do do a reminder once a year when we have our annual meeting so okay thank you at this time I would look and see if there's anybody in the public that would like to say something and I don't believe there is so I will close the public hearing and is there any further discussion amongst Planning Commission no I'm good no ma'am okay then I will look for a motion she's looking at you you are looking for a this is got I'll I'll make the motion okay so the motion the motion would be to recommend approval to the city council for the concept comprehensive or for the CTI garage condos cup Amendment right correct okay this is Robin I'll second that it's been motioned and second I'll call for a vote Scott I Robin I Susan I and Lynn I so Joe that will be pre presented at the city council meeting next Wednesday January 22nd at 6:00 p.m. and our our recommendation is to approve it oh well thank you you're welcome have a good night thanks Joe you as well thank you planning commissioner's report I have nothing nope Susan I have nothing I have nothing as well City administrator a call okay planning um I would like to state that our organizational meeting to elect the chair and uh Vice chair of this committee will be happening in the first meeting of February there might be some organizational changes coming up with the vacant City Council seat I believe that everyone got that email that that is open to you guys to um apply for that position by 9 by 8:00 a.m. on the 17th if you if you'd like to be considered um after that position is filled then we will have the organizational meeting for our committee perfect well I will look for a motion to adjourn
