which includes the approval of the March 27th the April 10th April 24th and the approval of the payments of the bills as posted I'll make the motion to approve the consent agenda as presented in Item B of May 8 2024 city council meeting packet is there a second um I'd like to ask you to amend your motion um I'm going to request that we pull item three the approval of the April 24th minutes um there are uh some substantial changes to those all right so I'll amend my motion with the removal of item number three the approval of April 2024 city council meeting minutes is there a second Rob live with my stepdad there Lloyd raybine and uh my concern today is the neighbor two doors down uh the drainage ditch has got a covert too high and it's holding water back so much that I can't even uh Farm the field out back that we own and I brought it up to the wed and I and I've talked with Jim here about it and uh I it just seems like I keep going in a circle and and I know that it's a private ditch but it's illegal to hold water back yeah so I just thought I would bring it up to you guys and see what you guys would have to say about it all right Jim you're you're the expert on this so far and Kevin our engineer no no expert but um so so we've had some conversations over the last couple of years and um what my recommendation to him was you know contact the neighbor and see if you can work it out because it's a private ditch and really not a city matter and and he's attempted to do that a couple of times and you know to no avail um we met last last week and you know I said I I think your recourse at this point is to come to the city council meeting and just say hey this is my issue is there anything that you guys can do to help so that that's kind of where we're at today um basically what it is is like you said he lives at Lloyd Ray B's property and there's a pond in the back and the neighbor has an outlet Culvert that who knows when people put them in or or what they do but it's too high and it basically holds water back so what he'd like to do is just simply clean it out but you know his neighbor is not cooperating so I guess the the question to the city council is is there anything that we're willing to do as the city to to help I have a question Jim is it a storm water Pond is it a pond that we have responsibility over because of a development or is it just a private pond that somebody dug I can't answer that it it is not a storm water Pond that I'm aware of um it's been there for you know a lot of years more prior to my time here so I I'm assuming that it's a p that somebody dug but just a straight assumption on my part can we check can we check on that I don't know where you would check on it but I know there's documentation at least for some developments I got a couple pictures yeah I don't I think it might be in the probably in a development document or so the picture oh go ahead trouble is it's all priv well that's what I'm asking that's what I'm asking is if that storm water Pond is whose responsibility is it to maintain the storm water pond we're both looking it up right now so good thank you I'm lost is this Lloyd rine it's Lloyd's land that I'm trying to farm but it's just too wet you can't even get out there is this at the end of the call the saac there yep okay and then it's the resonance to the when you go going down to Lloyd's place it's off to the right yep not the new place yeah it's up off yeah yep farther down to the end where is land yeah so it's Rob uh question for you is how are they damning it up are they using like boards like 2 by 12s or something to kind of restrict the water they back it up with dirt or no this guy that owns the property now just bought it a couple a couple years ago and he wasn't the one that installed it it was the previous owner sure or something like that and it's it's you if you even went back and looked at it you can see that it's jacked up like this H and the end the one end is fine with the water but the other end you know it's like right now there's maybe that much water draining out of it sure sure and and the water in my ditch out at Lloyd's is level with the grass that's how backed up it is gotcha and it's never been like that before and you know it's a drainage ditch it's supposed to drain out in Lake to and it's just making mosquito Fest you know and uh I yeah I don't know Mr engineer yeah Kevin bner city engineer um we were just looking at the property records it's not it's not a platted piece of property so I can't pull a plat up on it so there at this point there's no evidence of any type of public type of drainage easement that would require some additional research but it's it's doubtful that this is a public Waterway or something that the city would have a public yeah I mean I bring it up because there have been previous conversations about there are storm water ponds all over the place here and in some cases there was sort of a a sign off to the city for maintaining them with the developer and in other cases there weren't and one of the questions that I know that Elizabeth was working on is which are which and I don't know how far she got into doing that I I wasn't sure if this was one of them that was presumably our responsibility to maintain or would not appear that it would be um just at a very superficial level here so Mr Mayor it would be or it is your conclusion Kevin I I didn't hear it what's s what what was your conclusion that this is likely a private drainage Pond or private stormwater pond or just a private pond period I guess so if that's the case counselor can I ask one another other question neighbor to neighbor deal if if somebody dredges on a pond like that is there typically a permit that gets pulled if they do it right if there's if are they supposed to pull a permit to do that would there be anything in a permit that might help figure that out well a city permit would be required if you're handling more than 200 cubic yards um otherwise it may fall under the jurisdiction in this area of Rice Creek depending on what's Happening and what it's impacting so I mean on the picture it looks pretty large that he gave us well if this was an excavated pond in total yeah it would have required a permit at that point so whether that was obtained or not so maybe we need to look into that into our own records to see whether or not there was a permit pulled and and whether there's anything related to a developers agreement or anything like that looking at historical photos too in 1965 it does not appear that it's there but it's there in 1977 so that's before there were any regulations or permits or anything practically so this sounds like it's a neighbor deal Mr Mayor and council members absent um you know finding that there's a development agreement storm water Pond agreement yes it's a neighbor to neighbor dispute it's not something the city would get involved in um and and we do have to be careful when when something's purely private that the city not inject itself into a private matter but I think it's worth tying down those loose ends to make sure that it's not something that we have some responsibility for and what is his reason when you have talked to him that he doesn't want to lower the pipe he says that he doesn't have time but and then the next day I see see him out snowmobiling you know what I mean it's uh I even I even offered to help him with it yeah because if a guy just took a shovel you know on on each side of it on the one end and just dug out and got it to drop down some we would be fine but you know is this something that just creeped up over the years has it been going up and up or you've been digging it out for years no it's it's been jacked up for the last I would say six years because of the drought it's kind of well I I moved back to Lloyd's about four years ago and I was going to farm his back field but it's just been too wet and and it just the water doesn't drain down and even now when the water's High it ain't moving on the one end the far end it would be to the West it's moving and the farther you get Downstream it it's almost stopped on the property line because of the water he's holding back well here's what we can do or I'm sorry did you have something more no Jack if you'll look or have someone look if there's any kind of agreement which I doubt in the 70s and I would say you better start talking to them tell them you'll dig it out you'll stomp on the pipe and get it down well that's why I told him I said I'll bring my trctor over and rip it out oh I don't think that's a good idea but I was just joking though you're probably at that point though well start on that and we'll start on this and you signed in on the just giving the plan Planning Commission report as uh Council Le on filling in for council member hanra um reporting on the Planning Commission that uh meeting that happened on 5124 um there was a public hearing for a cup on property located at 15186 West Freeway Drive in Columbus p number 2432-22 4210 the applicant um was Melissa Carpenter Anderson she is applying for a cup to build and operate uh Minnesota veterinary neurology which is a new state-of-the-art uh 10,000 ft neurology specialty veterinary hospital um it has the architectural appearance of a northern uh barn style feel to fit in with uh Columbus's sort of look and um excuse me veterinary hospitals are listed as uh conditional use in the community commercial District which is where this is located uh M uh Dr Carpenter has been a practicing veterinarian in Minnesota for the past seven years um she she did a great job on her application there was a lot of detail um and so it left really very little to be questioned there was no public comments that were put forth during the hearing the only question that the Planning Commission had um was related to the staff recommendation to accept the deviation from the performance standards of 50% or greater masonary products um and this was due this recommendation was made due to the other architectural enhancements that were proposed in the designing including uh multiple gabled roofs decorative BMS um large front porch with a canopy ENT entrance Etc there's no metal sighting on this building um it's board and batten sighting on the lower level and lap sighting um on the upper elevation the Planning Commission was enthus excuse me was enthusiastic uh with the presentation and we'll discuss and vote on a recommendation to the council at their May 15th meeting anybody have any questions everybody knows where it's located right and we I I missed that meeting but I think everybody else was there and it'll come to us after the next Wednesday's meeting two week cor cor yes thank you mayor it it was a quick meeting I thought um was there any talk about do we in that District do we have to have uh masonary forward facing is there a certain percentage we need to obtain there I think the they going to apply the performance standard it it didn't require a from what Dean said it didn't require a variance because the ordinance gives discretion to allowing less than 50% if there's other enhancements and she definitely has a lot of enhancements architectural enhancements in her design sure I just wanted to make sure we wen't going to fall into that little no deal so thank you yep anything else that n or was that it that was it it was short and sweet about 15 minutes then we're on to our administrative variance on 13463 jrell street it's Pages 1 through 34 in our packet and Jack do you want to give us a we've been dealing with this for a while but give us a quick overview please thank you Mr Mayor Darwin Smith filed a request for an administrative variance on April 1st 2024 to extend the deadline to comply with a code notification to replace a septic system that was deemed non-m FL Mr Smith's property is located at 13463 jodrell Street and is served by a septic system that has been deemed non-compliant for existing Minnesota Pollution Control agency regulations this system has displayed no signs of operating in a manner that be a threat to Life Safety or health concerns or not be protective of groundwater the issue with the non-compliance in this case is that the system predates current regulations as does not conform with the present rules of of the mpca due to a lack of vertical separation between the bottom of the drain field and indicators of seasonally wet soil many systems in Columbus are in a similar State and are not required to be replaced with the system meeting current code until the property is sold the system is creating an imminent health and safety threat or additional bedrooms are added the non-compliant designation occurred as a result of a compliance inspection relating to a building permit application several missteps were made by City staff at that time relating to the process of the permit including it was only partial reviewed with and not explained properly to the applicant a more detailed explanation of this situation is prepared and shown in your staff report Mr Smith is request and relief from the deadline of August 1st 2024 to replace his system to meet the current code requirements Mr Smith has met all the thresholds and the requirements for the issuance of a variance the finding and facts in this matter R the system is currently a functioning system with no evidence of effluent service sech charge a compliance inspection was not necessary for this system as the proposed plan and the initial building per permit application did not meet the threshold requirements to prompt the review the two occupants of the residents plac little Demand on the system resulting in low volume discharge to the absorption beds the system met design requirements at the time of installation syst system is not located in a floodway flood plane Wetland and meets all setback requirements required by city code and the setic compliant inspection was triggered by requirements not thoroughly explained to the applicant and their interpretive application did not fit the circumstances of this situation staff has reviewed the request and recommends approval of an administrative variant subject to the conditions described above for the property located at 13463 J Jr Street North Northeast pin 32 32 22 3204 and the compliance deadline for Mr Smith's non-compliant septic system be extended to the time the property is sold or until the system poses an imminent threat to public health safety whichever comes first any questions anyone or anything more to to discuss I'm just curious why we have to extend the deadline the reasons for extension of the deadline is this is an area where we feel that the compliance inspection was not required in the first place due to a misapplication misinterpretation of City staff at the time this was issued the fact that the system is currently operating properly there's no evidence of any evident threat to Public Health or safety and that this is the situation of many systems in the city of Columbus that were put in actually pre 2008 yeah yeah that part I understand I was wondering why we need why do we need to extend it to August 1st of 2024 no it's not being extended to that's the date that he was given that he has to replace it by and we're extending it to point of sale uhhh okay okay that makes sense thank you anything else anyone so let me make the motion then to approve an administrative variance for the property located at 13463 Joell Street Northeast pin 3232 2232 004 subject to the conditions described in the staff report for item C2 on May 8th 202 for in our city council packet to extend the compliance deadline for the non-compliance septic system at this address to the time that the property is sold or until the system poses an imminent threat to Public Health or safety whichever comes first is there a second this is Sue all second any other questions I'll call for the vote Ron I sue I Janet I Rob I and Jesse I we did it on to number three scoring and discussion for the city administrator position Pages 35 and thir through 37 in our packet uh Sue and Janet will leave it or will lead the discussion and the motion is be to be determined so so we do have and the is Sue we have Ellen um our consultant that is on our Personnel committee that is going to walk through the discussion for us all right come up to the microphones pull it up close I can pass it on for sir I can't hear you Savage Minnesota perfect okay feel like I'm eating this microphone you do have to kiss it I guess so anyway as you know I've been working with the Personnel Committee in the search process to help you identify your next uh permanent City administrator so we've done a lot of good work to get us up to this point and we had a lot of qualified applicants we whittel that list down to six that we refer to as semifinalists the semifinalists went through a rigorous interview process and those were taped and of course you all listened to the tapes you looked through all the applicant materials and most importantly you did the scoring and the ranking of those applicants and so the go tonight is to uh decide who's going to go into the finalist category that we will continue to talk to and present that to the council in a future date for interviews and I feel like this is somewhat like the voice one of my favorite shows that I watched last night where everybody's qualified so but here we are so uh what um uh to think about what you uh did with your scoring and your ranking the handout shows the summary of that data and you'll see that three candidates have their scoring and ranking highlighted in green what the Personnel committee is suggesting is that we have three finalists going into the next round the reason for that is because there is a lot of movement right now in city government with a lot of Si cities conducting searches similar to the city of Columbus and chances are some of these folks are semifinalists or finalists in some of those searches so the recommendation of the three that are highlighted in green came about from your scores and removing anyone with a score of five or a six and that gives us the remaining three that we think are the best and most qualified and best fit for the city of Columbus to consider for their permanent City administrator so questions or comments I have a question since I'm not on the Personnel committee I'm a little bit outside of how it all happened I thought we were going to do just two finalists right how did we get to three we we we had consider that we're recommending three because of the high volume of activity in other cities looking for an administrator okay got me kind of confused why would you want to do three if other cities are looking I mean I'm kind of confused are you thinking someone's going to drop out yes so if somebody drops out do we drop down again um we we would not want to do that if one drops out we still have two uh finalist candidates to interview and bring to the next process to the council I kind of looked at the scores here and I'm looking I don't want to mention letters or anything like that but I look at the one that's four and four and the one at six and six I I look at that there must be a kind of a quorum here amongst us all somewhere along the line that these two are fourth I mean number the one that's six and six we all kind of agree on somewhere along the line that that that person's the one to drop off right then I look at the four and four and we all kind of an agreement somehow there we one of us voted for one or wherever we put it there so I just wonder why those two weren't dropped down so this is Sue I will and I was the one that compiled the score so I just wanted to mention that I mean you're right there was some commonality or consensus but it wasn't the same for the different candidates or numbers so the ones that are both had a four or both had a six or even the one it was a different members that were choosing the same candidate so it was really across the board it was all over the place well yeah but I'm looking at the four and four that four us five had to say that can that candidate was four right and then four of us had to rank them as number four no no it just mean that's the place so the consensus the majority had the candidates ranked in this order so the most city council numbers ranked the top one number one so there was like three of them so that's not a it's not a number it's a it's a ranking so it's not the number now I'm starting to understand okay thanks so I just looked at it and I thought well but number the one that's got six we somewhere we all agreed or then there was an extra person somewhere I know who voted twice who voted twice uh anything else I I don't know I just know one thing is we spent a lot I know all of us did because if if you even just watched them and even read the resume this was a 12h hour or 11h hour deal so I'm sitting here looking that we all ranked them somewhere there and I happen to rank a couple that are pretty close at the top or whatever so now we're going to bring in a third thir person and is there something we're missing or did we not get enough information no I think we got enough information and the reason that we're that we really decided to go a three instead of two was what Ellen had mentioned is just the amount of movement in the in the environment that we feel like it it would it it's going to be better for us if some if somebody dropped out then we would still have two candidates and it's not going to be that much extra time yeah it's going to be a few extra hours to add one more person to that next level but we're we're still going to go through that next level process what oh I was going to add that the process uh was laid out quite a while ago and that's not changing based on if we have three finalists versus two okay I I gather like I said this is starting to drag on in my of mind and this is a normal yes and I agree believe me because Jan Janet and I and Ellen um and Megan have been involved in every single minute of it but this is a normal time frame oh it's the 10th still on then what's what was the 10th May 10th that was going to be our hiring thing right no the 10th was if we couldn't make up our mind tonight and we wanted more time to think about it okay so then where would this move up let's say we take the top greens yeah on there when are we how are we going now we're doing really good we can just get on to the next step oh yeah when's the next step yep so the next step is I'll contact all of the candidates let the folks know what the decision is tonight and we will move forward uh and hopefully have a decision Sue and Janet what do you think that we can bring them before councel well I think it's going to depend on their availability for in-person interview so the next step are bringing them back for an in-person interview with us a meet and greet with the public uh meet and greet sort of interview with the staff and to your point Ron it I mean I don't know how much extra time it may be that one person's not going to be available for a few days or I don't know I mean three is harder to coordinate than two so you're right there it might be a might not matter at all or it might spread it out it's just going to depend on availability even at that if the council decides to go with three finalists making calls tomorrow somebody might say I just got an offer and then we'll have to so I think the qu there's there's a couple questions for the council is do you want to have that extra insurance or if you go with the top two then if one drops out you have the one so it's it's up to the council whether they whether you want sort of the extra buffer of having a uh a pool of two to interview rather than a pool of one should one drop out so can you uh just invite the top two and then go back down to the third if we can't come to an agreement well we didn't want to do that only be for planning purposes for getting on schedules and scheduling dates it would be easier to do all of them right now just contact all of them get this schedule set up um we really didn't want to have to go back so yeah so on this topic I think one of these candidates that rank really high and I don't know so because I haven't heard but in those interviews one of the one of the people that interviewed said they saw that Columbus already hired somebody but I think he was alluding to Forest Lake I don't know what was alluding to I don't have any one of these candidates cuz I heard H Forest Lake just hired their person no no no that's not the case I just that's why I was confused from that interview I'm like what's going on here I we were too I they have 16 more candidates I just happened to this 16 and they're not meeting with them till the 13th of May okay and I don't know if our candidates are in there or their candidates are over highly highly likely yeah so what are we looking for then so I think that's the first question are the recommendation of the Personnel committee right now is to move forward with those three what we had originally talked about was to pick the top two we made a decision to include a third sort of contingently on who the top two were and I think since now there's more open searches um Ellen I think especially felt it was and I don't know maybe Ellen has more information inside information that we don't have um about who's who's applying where she suggested that we consider three so that's the first qu that's the first question to answer and then the second question is if it's the three is are you in agreement with the three that are highlighted and if it's two then you have to decide what are the two that you want to go forward with so is there a big difference timing wise between two and three we've been dragging the sun since October no no well I don't know that you can I don't think you can say that I mean let's be honest about that it's going to depend on their availability so if somebody's on vacation for the next week it will be a difference if they're not if everybody can come in when we ask them to then it won't be and we don't know well if they can't come when we ask do we just drop them off and we go with the other two we'd probably have to talk about that you'd have to special meeting to decide if you want the job or not well what are we going to do is this one of these days like we pick 5:00 in the afternoon and it's 1 2 3 right after each other 1 23 it it would probably be one one person comes in in the morning one person comes in in the evening or one person comes in in the morning and one comes in in the afternoon I mean you have to spread them out so that they're not all here at the same time M and that they could meet with each of the groups that we talked about and ideally if everything was the way you'd like it to be you could do it perhaps in one day or two days and it would be one after another but like I said if you call you know one of the candidates and say you're a finalist we'd like to set you up for you know Council interview meet and greet with the public and a meeting with the staff he are the dates and they say well you know I'm not available I'm sorry but I didn't know and I'm not available for 5 days then that's that's what you'd have to work around and I don't know if that's a problem or not yeah well and I think we've been going along this process long enough and it's an important process okay three more days five more days is not going to kill us no but I kind of go along with what Rob says if they can't make it that's you know that's life we move on so how does that work Ellen you're the expert I the committee would have to talk about that what's the reason um yeah how much of a delay if we have other high Talent we might decide to move forward with that I would you tell that to the number three guy or whoever can't come in and you say okay so you go home tomorrow tomorrow morning you call everybody and say you win when can you be here and one says I can't be here till June and then you say well we're still that would really delay our process we the decision may be made before you have your opportunity right I are you more concerned that the problem will be in trying to set up or is it that you get through the the two or the three and you make the offer and then they drop out is I mean you would know right away if you called people tomorrow you would know right away if there was like oh I'm sorry I've already accepted an offer or oh I'm sorry I'm I'm assuming they would let us know if that were the case so you're not so concerned about this stage you're concerned that you'll get through the process you're you're making the offer and then it's like oh I have another offer is that that that could happen but I'm thinking more in the short term that within the next week if we have three finalists they self- select by taking another job now we've got two we might land right where you want us but if we have two and somebody takes another job then we've got one and you're thinking well is isn't that okay well that cuts off part of the process that we laid out where staff would be able to spend a little time with the candidates the public could be invited in to meet and greet with the finalists so yeah so we know about what's happening in Forest Lake is there another and then I think you mentioned aen was doing a search who are where is doing a search right um I've heard from a couple folks on other cities that are looking but honestly I can't remember which ones okay but do you do you have a sense of how far along in the process they are I mean if it's like if it's like Forest Lake who's not even going to meet on their first cut until the 16th I don't know I like I said I just heard from people over there that said that their next council meeting is on a Monday I think it's the 13th and they're going to either interview during the day I don't know how they do it but I heard they had 16 they had like 45 apply or something I I don't know so they're probably going to use that time to decide who their semifinalists are and then do a process like us to come to their finalist but it'll probably be over the next several weeks so we want to be done and hopefully we're done by then yes before them okay is there any reason not to go for the three except it's more time and more juggling anybody I guess my question is is so we go with the three the next step is we interview them publicly like we did with our interim right so we're going to interview three and then we're going to Hash it out like which one of the three do we want we're not going to say oh let's do another round two people because they're just too good to pass up right right no well it's going to be we come to some kind of a scoring census of those three yep similar questions or we have draft questions and actually um after this meeting you'll get those and you can add you know I think I don't know how you felt but I know when I when I listen to the interviews they're like oh I wish we would have asked this question or I wish we would have dug deeper here so you can add okay and and modify the questions so we want it to be the questions that the council wants and then I think the staff will have their own you know set of questions that they'll want to ask and then share their their insights from their their meet and greet or not it's not as much a formal interview as it is you know getting to learn the three candidates and and getting your feel for them too so and there will be the ability and I don't know that we actually decided whether or not we were going to just do a meet and greet for the public public or if the public just would be invited to hear our interviews I I don't know that we actually landed on that so great well okay so if you invite the public to our hearing or discussion interview that just knocks out one slot of time so you don't have to come in at 10 in the morning come back at two see if anybody shows up there's no crowd you can see and typically and typically I mean I know that other places have had some sort of like I don't know coffee or something and they can come in and and meet them I don't know how many people actually do that I mean I have actually heard from three residents currently about their Impressions with our current interim and they've been very very positive so I think you'll have some people who are interested and want to um to weigh in I just I just don't know we haven't completely figured out how to do that yet the best way to do that if you have you have input on that tell us and we know time is of the essence and we do want staff to have that opportunity to interact with the candidates and give us feedback we have members of the of the public out there we could ask them what they think the public would want I just mentioned ice cream oh good idea well this is serious business not birthday party uh okay so if we have our meeting at 10:00 in the morning with candidate number one staff is all next door we get done in an hour or so I'm just looking at how this is going to work they come in or he goes there she goes there and visits for half hour or an hour well I mean our our interview will be public so if you're doing three different interviews it'll be potentially three hours at least that will be recorded and on video and I don't know again I don't know if we'll do that one right after another or if we'll you know do one in the morning one in the afternoon so some of it's also going to be our our availability yeah so and again in answering the three verses too that's that's really the biggest issue whether or not you want to whether or not it's important enough to have three that you are going to be okay with that scheduling um issue whether it is an issue or not I don't know it's less you know it's one less with two and that was what we had originally thought we would do but we didn't know that there were all these other concurrent searches going on at the time we made that decision well I'm fine with two another hour or so for number three if they don't drop out hopefully they'll drop out before you call them then we're back to two what's one so you're and 2024 fee schedule review for escrow requirements two of the items that were on the agenda that was sent out Friday were removed uh one of them is due to the fact that we need to get a little bit more information on and the other was set up for another meeting earlier so those are the meetings or the items that we would suggest be on the workshop if you have have any additions or deletions uh add those and we can set that agenda upon your approval so Jack I have one question can you remind me what chapter 14 is chapter 14 is the revision of our septic portion of the ordinance oh okay I be that long the building department report is more of an informational item if you have any questions on that the same way with the budget software proposal we want to go over that and get some kind of indication if it's something we can move forward with or not I don't think those will take too long the 2024 fee schedule review escrow requirements what we want to do there is take a look at the fee schedule for our escrow cost I think some of them are too low especially for some of these larger projects and consider maybe raising them before we get another large project so we can have enough money established in the escrow UPF front that we don't run into these problems at the end when we're manage it and have to go back and say you owe us more money okay and the financial and budget pre-budget report will be probably the more lengthy one although it shouldn't take that long just depends on how many questions this is just to get some basic information out to the council for what we're doing and for the upcoming meetings to discuss the budget and get direction from you on where you where you're looking to achieve uh whatever we're looking for for the levy okay yeah I'm good well we'll have to stay in touch all right city engineer report Kevin yeah just a quick update on our projects um you'll see some material being hauled into our yard um that's material for our micros surfacing project I don't have an exact date but I'm I'm I'm thinking they're going to start in finished next week um our crack seal we did have a precon um with our other two contractors crack ceiling will also begin sometime in the middle of next week and uh chip ceiling will probably start sometime in mid June otherwise I have no other report oh oh one other thing I want to mention is that uh our the brown beagle development uh there on West Freeway Drive uh obviously they're working on their buildings uh they're going to start on the utility work potentially next week as well so that's that's the public portion of that project otherwise I have nothing further C the attorney report Mr Mayor and Council two items this evening the first is um regarding The Collection efforts um with Joshua Markham Builders um and we were successful this afternoon and reaching a settlement agreement um I it's it's outlined I'd like your um Authority a motion if you think it's appropriate to finish up that settlement agreement so we can get it uh signed we don't have to wait another two weeks to get it done so I'm just going to outline the key points if you like I can pass out the draft but I'm going to give you the key points and see if you're if you're interested in reading a draft on the Fly because I know you don't prefer that um so the the key points are um payment and full so they hired an attorney to dispute the payment amount uh after a lot of back and forth um very good work by Cheryl um and with help from Jack Davis um we got them to agree to pay the full amount we applied um uh staff applied a engineering escrow to the remaining planning amounts and and so it was slightly smaller than the original demand but um that was a net amount of let's call it uh $1,849 so that's the amount that they've agreed to pay the um the relief that was offered and they've agreed to staff has agreed to and recommends is that they would pay $5,000 immediately that was their original offer was to only pay 5,000 uh they'll pay 5,000 immediately and the remainder over 12 months as they close units if they don't close all the units in 12 months the the balance is still due the enhancements we've got um are that if they if they miss if they close and they don't pass then it's all due immediately and we added that attorney's fees would be charged against them if we have to to go to a collection process so all in all we ended up uh agreeing to the full amount just giving some time over the next 12 months to pay the balance if you're comfortable with that outline um then I just ask for a motion to authorize that settlement agreement I I do have a question mayor so this is for the St Clair Lakes it is project and even though they're still building houses there and they have to do a final lift on the tar don't they yet done that's done oh okay last time I was just a few weeks back I was through there it wasn't done yeah all of the uh improvements are done other than the Home Building okay so there's not a lot of work to do we also clarified in the doc doent that they will continue to pay ongoing charges if there are any okay and and because the other concern was that's are they having to maintain those streets themselves as an association or as a city yeah so so any issues with curb and gutter or say a a dumpster gouges out the binus are they liable still for that to fix that for the developer is while the developer is still active um at some point it transfers to the association it's a private Street okay Public Utilities private Street and so the association is liable for the um private improvements once it's turned over to the association okay thank you appreciate that you're welcome we repeat the motion and then I'll repeat it to authorize um the mayor and City administrator to enter into a settlement agreement for the payment of $1,849 from Joshua Markham Holmes with Time payments over the next 12 months I'll make that motion is there a second this is Su second any other questions were they agree were they satisfied with your deal bill I think so um what's interesting you know just this is an aside uh staff almost eight weeks ago proposed this very same thing and and the meeting was cancelled and so we essentially got to the same point that we could have gotten to two months ago without all the attorney time but you know be that as it may it's it's it's a full payment it's a successful conclusion with some enhanced uh relief if they don't pay I should say enhanced remedies don't pay very good I'll call for the vote Ron I sue I Janet I Rob I Jesse I yeah my own only other item is legislative update and really um uh the mayor and Council member heglin should really give the update because we had a good uh hearing uh and good coverage in in the paper about a hearing at the Senate tax committee I believe it was on I wrote it down was on April 25th um Senator KW arranged for it uh with the Senate tax chair and rest um it was helpful to get our issue back in front of the uh committee it sparked a lively debate and with that I just want to turn it over to the participants since I was an obser see if they have any additional comments uh Senator K did a good job introducing it and then I gave a little bit of background and very little information in the city and then Janet carried the whole show and really explained well I believe as good as it could be explained and regretfully we weren't well we didn't Prevail this year no but we actually didn't think we would I mean we went into it with the expectation that it's it was not a budget year so there may not have even been a tax bill and then when there was we didn't know if we would make the cut um but it was it was very positively received by the chair and uh information back from Senator KW um he felt that in talking to an NOA County Representatives who initially were against this they were also supportive now of it so he feels that and and also a number of other um members of his of his caucus so there is good Positive Vibes going into next year and he's feeling much more I mean who knows what next year will bring but based on that that it that we'll be well positioned to bring it up again in a budget year and they all thanked us and wished us well and I got a question I I I seen you on TV you did a good job Janet but when they lay over like that does it have to be resubmitted or does it next yes uh so we'll start a new bium with the election and so everything will kind of reset um and so it will have to be reintroduced but I I do believe the groundwork has been laid we have two good authors two strong authors the tax chair you know perhaps she'll be tax chair again after the election understands the issue and actually did a really nice job of explaining it to people who were getting confused confused about whether the Met Council has anything to do with it and so forth so it's a good way to to set the record we now have the reports of the staff analysts about the distribution so it's it's all there for us to pick up and and work on next year and we still have I did want to report our bonding request is very much alive at this point we um our indication is that the the uh the parties are working on a bonding bill so they haven't just gone off to their Corners um they understand the importance of having a bonding bill in an actual bonding year U so with any luck we'll end up uh with funding for that portion of North Hornsby so successful um in in the getting the hearing and presenting the issues and hopefully successful in AB bonding request at the end of session did anybody else watch that it's kind of amazing I was going to and then I well it's kind of amazing how the outstate people don't know what's going on in the metro area and I was just stunned at some of the comments there there was one one fellow who did some pretty impressive grandstanding yes yeah yeah it was both parties too you like what's this about you know but anyway you did a good job thank you thank you that's all I have that's it so quick question on this to bill um would it make sense to try and meet with the individuals that were opposed to this and and help educate them and use this next time as an education stance or Mr Mayor uh council members they weren't really opposed it was more um taking shots at the Met Council taking shots at uh fiscal disparities as a whole taking shots at outstate versus Metro so I I think um you know it's always good to meet with opponents but I don't think there were any true opponents they it was folks who wanted to talk about pet issues and and we just happen to be the the way for the the conversation to get started I mean I don't know if there's others who think that there were true opponents in the room no and I think I think Senator K has already started that work behind the scenes I mean we are so fortunate to have his interest in this I mean he is he has put forth such an effort and has really taken this on as a cause and that's been very different than what we've had in the past and I think you know for as far as we got and the good reception um I we all worked hard and certainly your office was tremendously helpful too but I think it really matters to have someone who cares enough about it to do the behind the scenes wheeling and dealing and hand shaking and all the stuff that happens that we don't get to see so well and if the if the Senate flips a little bit or another Senator Goes Wild next year after the election we could have a different makeup who may be more more commiserate with us to to vote a little bit our way yeah I I don't think as as Bill said I don't think that there was any opposition in particular to it I think there was just well they just didn't want to do it they would rather it was less of a partisan issue it wasn't a one side versus the other it was more there was other stuff tied in with it or um Mr Mayor and Council Senator KW took uh pains to make sure that the members knew it was a bipartisan bill that in Prior years Democrats had uh Chief authored the bill that there were um communities represented by democrats that would be benefited so I I I think the I think the um the purpose for which you know we kind the objective we set was met by bringing the issue back to the top and and kind of getting a read in the room and nobody came out and said you shouldn't be asking for this um okay it's good to hear yeah so then what do we do Bill after the election start storming the capital before and meet with these people and with KW and with you and Margaret and whoever we have to to get it back up on top of the pile in their minds before they go back into session 2025 Mr Mayor and Council that's the best approach now what happens in a year when there's so many seats that change you know there's new there's there's freshmen legislators they're finding their offices they're finding their committee assignments so we always like to be pre session with these um meetings now hopefully we'll have you know our our uh well Senator KW I don't believe is up no he's not and and representative West will be up so hopefully we have the same two folks in place but we would we would reach out to them right after the election and make sure that they're you know going to be be on board we would do some work prior to session and then we'd hit the ground because it's it's the longer session right it starts in January it starts like couple days after the holidays so yeah so we would be at hard at work but we've got the template now we've got a couple Alternatives um and we have their attention if they remember it over the summer right it's been a couple years since we've had a hearing so y so now it's just uh it's fresh so it won't be a storm in the capital it be professional meetings we'll figuratively storm the coun oh yeah that's right we're being recorded all right anything else bill that's it thank you uh City Council Members report Ron uh that was Janet planning commissioner no it's the mayor and the city council members report letter D number three yeah you're right I see she did our Planning Commission report early I was so excited I couldn't wait okay do you have anything no not that not for the Planning Commission that how about your city council oh no nothing really I just noticed something the other day and it's not a complaint or nothing like that but it goes to show you the park is getting used but Monday is it Monday or yeah Monday I turned down uh Notre Dame Road and the cars were parked out on Notre Dame probably oh maybe 15 20 and the parking lots were all full the ball fields were gone and it didn't you know I know we got no parking signs there I don't think it was causing a traffic issue but uh I it just want to say that it was pretty well being used both parks so was that girl softball on Monday night right I I yeah and they didn't have a tournament going on this is just regular it was you know I went by there too and there was a ton of people there I I thought maybe it was a tournament no no and I got to applaud our police offic that we have sign signed here because he was sitting over here and he could see him you know and that's good he didn't write any tickets or push them I mean there wasn't no big traffic issue sometimes I wonder why we got those signs there but JW must know why or it was a recommendation was it it keeps the honest people out so um I don't have much I just I attended uh last Wednesday the boy who came in that is doing his Eagle Scout um he we met at the park we walked and the um Park board members were there and we walked where they're going to where he's going to plant the trees which is on this side of the street over by the ball field and uh he's excited so he's got his instruction on what to do and he's going to get started um just a quick update on on broadband so we've been working again with midco um and you heard that we will we were hoping to have a report for the workshop but um what will happen is on Tuesday we will meet with uh Ellie burough who is their governmental liaison I believe she is going to give us a update on what they're doing in terms of um submitting grants they were they were going to submit a grant to Anoka County for I think it was three or four different neighborhoods in Columbus and then inoka County pulled the RFP and then I was trying to talk them into submitting what they were going to submit to inoka County to to um deed because they had a grant deadline that was the 10th but then NOA County put the RFP back out there and they still feel like Anoka countyy is the best way to go if they don't get that they'll they'll try to go um with with deed but I think she said that she they would hear um in a couple of months about the inoka county one so there is potential that by the end of this summer we will have met the goal of bringing Broadband to all areas of Columbus with the exception of a few little pockets I should I should qualify that they won't necessarily have the wires but we will have funded Broadband to every part of the of the city and that's what I'm hoping that she will show us I think that that's where we're at so there's been a lot of progress made in this area and fortunately there was a lot of funding that finally flowed down that we were able to access or they were able to access so pretty happy about that we'll have the updates after we meet with her yes is that at our regular one o00 meeting or is that another meeting um it is it's at our regular one o00 meeting yep you you'll get you'll get the sneak peek Mayor Rob anything um just I've been dealing with a little influx of uh uh since since Ron's thing had went through on Iverson there's been there's been more houses and all that popped up I think they saw what happened there and some other neighbors called on other ones so that kind of blew up this week um but other than that you know Sean's doing his job so he's he's not being invasive he's just following up on on U calls that were received so um and then just a big thanks to my wife it's our anniversary today and she understood how important this meeting was so thanks Michelle yeah that's it Jim anything Public Works I do have just a little update um I've been working with the fire department and they're doing some training or they do training on and off and they asked if they could hook up to some of our hydrant to do some fire training so I directed them to um use fire hydrant north of the roundabout they are going to do training on 59 and 516 both from 6:00 to 9:00 so if you happen to be driving by there and you see the road closed that's that's kind of what they got going on I just thought I'd bring it to your attention in case somebody happens to uh call but that's that's what they're going to be doing there so just a little update that's all I have thanks Jack uh to follow up on Rob's report regarding Sean's efforts in Code Enforcement uh he did follow up with one of those other neighbors that uh was had a complaint filed on them I think he's uh give him time I think he'll work through that one too he also did one on Ferman Street he dropped by the conversation with the person in question was very good Sean handled it brilliantly we even had a couple neighbors call and ask if they could get involved and they have and that situation has been totally rectified within 3 weeks of the call into City Hall so Sean's doing a very good job and he's showing some results of his efforts and the clean up of things around in the city the other thing is that we still have a special meeting called for Friday morning and I think we should probably recommend having a motion to cancel that because it has been posted on the website no interviews too bad so I would move to cancel the uh special meeting scheduled for May 10th at 8:00 a.m. this is Su I'll second I'll call for the vote Ron I sue I Janet I Rob I and Jesse I our meeting is cancelled so I do have one question Jack and maybe uh bill so the gentleman that came in in the public open Forum with his neighbor that is clogging water on his his land what if he called and made a complaint to Shawn that would probably not be a city issue that we could address okay so he would Sean would say that's an ordinance or some other kind of issue and and and actually he has talked to Shawn about that and Sean talked to me about it and he talked to Jim about it and that's why it was recommended he come to city council so he could get a further explanation and clarification on that I think it's good that we'll go back and check and see if there was ever any types of drainage easements that were recorded against that that might help us a little bit if we were to get involved but uh it's something that uh this is on private property between two private citizens and it's not addressed in their ordinance or code unless there is just seems like there's something that we should be able to do about it well you know so I do have a question about that I mean in our storm water management plan don't we have something that says you can't you can't push your water onto somebody else property you have to keep your water on your property I mean yeah because I mean what about that uh resident that was up by the lake Lake and his drainage pipe was going on the neighbor and flooding them out yeah so so I I was I was thinking the same thing that it might not be something where it you know has to do with ditches or anything but and maybe Kevin can weigh in on this but we do have a storm water management plan and I think that's part of it you can't shove your water off to your neighbor well that's not entirely true if there if there's a natural drainage pattern that goes from one property to the other uh that typically has to be preserved um and I don't know what the natural drainage pattern was historically there um but if that's the way the water went typically you have to maintain that drainage path and it's not so much shoving water onto the neighbor's property it's it's allowing the property that um historically Trav there to continue to do so but when when they've dredged down a pond and then have plugged that I mean it sounds to me like they potentially altered that natural by the Culvert and all that so I we'll have to look into it because I if that were the case then I do think it might be under a city ordinance I I think you almost have to look at it just again it's probably a a private drainage dispute um you know that it appears that pond was there at least back to 1977 so it's it's there there's some um prescriptive rights for it to be there um that's a legal question but um but if the if there was like a frost heave or something that moved the Culver so now that wasn't doing the job it was supposed to do it still would probably be a private dispute so um that is also my um understanding with the facts we know today facts could change looking at the record the danger is we we don't want to start the precedent of trying to um mediate private drainage disputes because then once that precedent is established and relief is given to one property owner they'll point that you know they can look in the record and say well you did it for this one why aren't you intervening in mine so we have to be really careful where that line is but but if there is is a public drainage easement or if there's an agreement or if there's a storm water um management uh agreement those are all things that would give the city the opportunity to intervene if it chose to and the distinction you know for others who would seek intervention by the city if those things weren't present so I think it's it's really good the questions were raised I think we just have to follow that line and and make sure that we hone to it okay Personnel committee report we already did it nothing else I don't I mean unless I don't know I we talked about whether or not we were going to discuss posting did you have a chance to follow up on that issue Jack posting Connor's position uh we haven't followed up on that yet I think we're probably waiting to see how this is going to play out we discussed at least going out and Contracting out some of the services that he did in terms of his website Web Master duties and probably making some postings to uh some Facebook accounts we'll be looking into that and we'll have a report next week for you in in in the interim con Connor will be here actively working until the 31st so he'll continue doing those things to give us time to find an alternative to that portion of his job duties so I mean under normal circumstances we would be we would be telling you that we're going to move forward with posting it right away so that we could try to but I think that the question is do we want to uh revise the the job description do we want to hold off on hiring because you know there's there's some unanswered questions about pro project or parts of that job that are no longer part of that position and so I think Jack was going to do some uh Digger deeping deeper digging into into that question so that's why you're not getting a recommendation on moving forward with replacing that position yet and again that that will be brought up by no later than the next council meeting we've got several sources that we'll contact to see what's available and have some recommendations so the announcements and reminders are as posted so uh now we're going to have a closed meeting Mee the city council meeting will be closed to consider offers to purchase city-owned real estate identified as P 24 32222 00005 and P 24 32221 11-06 pursuant to the Minnesota statutes section 13d 05 subdivision 3 C3 uh the council will recess to conduct this closed meeting and we're going to go to the community Center everybody this is different but we can get close up to our big uh our big televisions in there and then Jack and Bill can show us all the parcels do the explanations and we'll all be able to see it instead of staring across field trip so we're going on a field trip y are we coming back here then or we don't we have you don't need to thanks everybody
