[Music] welcome to the Planning Commission meeting for December 18th 2024 I call the meeting to order and if you would please join me with the Pledge of Allegiance flag United States of Amica the rep okay so item number three is the approval of the meeting agenda does anybody have any comments or Corrections if not I would look for approval for the meeting agenda this is Robin I move for approval of the meeting agenda there a second Scott I'll second motion second we'll call for the vote Robin I Lin I Scot ey agenda has been approved the next item is the approval of the October 2nd 2024 joint planning commit commission and city council meeting minutes is there a motion to approve is Robin on motion we approve those minutes Scott I'll second motions made and second I'll call for the vote Robin I ly I Scot ey minutes have been approved the next item is the approval of the October 16th 2024 Planning Commission meeting any corrections or comments on those if not I'll call for the vote Commission okay next we will go to the public hearing for Camping World for a temporary outdoor storage iup on pages 9- 44 elanar would you please read the public notice of course uh notice is hereby given that a public hearing will be held by the city of Columbus Planning Commission on December 18th 2024 at 6:00 p.m. or soon thereafter as parties may be heard the hearing will be conducted in person and by interactive technology at the Columbus City Hall located at 16319 Kettle River Boulevard Minnesota to consider a request for an interim use permit to allow for the temporary outdoor storage of retail Goods in the highway commercial zoning District members of the public interested in attending in person monitoring the meetings or wanting more information should contact the city offices at 651464 3120 or visit the city website at Columbus mn. us the hearing shall continue until all evidence and testimony has been received thank you Elanor so Dan is here if you would come and have a seat at the table in the front I'm going to ask that you give your name and address and talk into the microphone and then is this Casey right online uh Grant duat from Excel Engineering okay so Dan go ahead uh Dan mouch uh 1425 West Freeway Drive Columbus Minnesota okay and elanar do you want to read the application and absolutely so this has been an ongoing compliance issue for a number of years now um it's a sort of interesting uh situation where coats RV acquired a cup to run this RV um retail uh trailer sale business um back in where was the original one 2003 um by 2018 they had um 2018 was what I found but um had started leasing the property to Camping World they are still under the same cop um for that however they expanded onto a southern property that was not included in that original cup um they have been using that southern property as additional outdoor storage for their trailers for some time and over the last few years there's been a inconsistent dialogue between sa staff and um at the city level and at Camping World as well as the fact that this is least property to Camping World they're unable to do the usual proceedings which would be a lot combination and then amending the cup to expand onto the Southern Property they have to keep it separate because it's uh a lease they don't own that property they can't combine it so there wasn't a set procedural process to have this be allowed so it took a while for us to come up with this solution which is the temporary uh outdoor storage iup which is a iup that's available in in this District tied to the business and the lease so um the temporary storage that of the RV RVs on the Southern Property would maintain that and become um compliant and legal until the camp until the secession of the business does anyone have a questions is there anything you would like to say I believe that we have uh you know met all the requirements M and uh I'm excited to Pardon Me Oh sorry is that better I believe we've met all the requirements and I'm excited to put this to bed and um we're very excited this doesn't result in any more places to park does it no this doesn't result in anything clean some stuff correct okay okay so I do have can I ask a question okay um Elanor can you bring up the picture because I'm I just want to make sure that I'm clear when you're talking about the South Side you mean that whole Square in red is at the South yes let me get to that page are you referring to to this one here yep yes so this um handle uh Northern property with this handle is the original coat is the area that is underneath that original coats RV cup actually in 2003 it was just this section and then they added this section in through that procedure of a lot combination and then amending the cup and then this Southern Property is the property that will be underneath this iup okay um and so the the amount that's there right now on the picture that's that's what's been kind of out of compliance and then we're just passing it or if we pass it it it's not going to change really no the the same amount of parking Vehicles will be there correct okay um and then my other question is how how long is the iup so it's temporary but how long is temporary so the iup instead of having a date certain we have an event certain which it would be the secession of the business or the sale of any portion of this property so it would exist for the term that Camping World exists there but if the property is ever sold any portion of it the lease ends or of Camping World um unfortunately when under had to close its doors that's when that temporary storage would end that creat creates some legal paperwork in writing that would um be if this particular business ended this Southern Property is no longer allowed to just have outdoor storage as a use because that is what the only use on that property since it's not technically combined with the northern portion the only use there is that outdoor storage and having this legal document saying hey when this is over that outdoor storage is done you can't put a new you can't lease that to a different company that's only storing Vehicles there okay all right um and then my only other question had to do with the I saw there was a permit from The Rice Creek Watershed and there was a little bit of wetlands in there m um is that the little circle that's close to close to the road uh are you talking about the yes that there's a square on the back and then there's a retention Pond up in the front okay all right this area Wetlands yeah wetlands are on the West Side following Elanor and there's a storm water management base on the east side okay all right are these Lots paved no no okay okay is there anybody in the audience or online that would like to participate in the public hearing if not the public hearing portion of this is closed any discussion that you have no my questions got answered Scott um so obviously we want this to be a conditional use permit that got missed at some point and the the iup is how we're bringing that back into compliance um is there any mechanism in place now illano or or anybody in the city that that would help us not to miss something like that because obviously the cup is is preferable uh in the future at all um we have been working on better procedures to prevent this sort of situation from happening again with um Code Compliance inspections and some better Outreach to make sure that everybody knows what kind of permits they need um for the type of work that they want to complete before it becomes a situation like this where it's not our preferred method and there's not really a way to go about that preferred method so that would be our Code Compliance department and working with them okay um and and thank you co RV for for working with the city on this it's it's it's it's appreciated and thank you for the city staff um I think it cost us a little money to go back and and and bring it into compliance if we' had just had the conditional you use permit when we combined the two together originally um so we we want to make sure that doesn't happen again um the other thing that brings that brings up in my mind so if we do if coach does um sell this to another business we have then the the compliance and Spector available to make sure that that that iup goes away and and we're not going to have Outdoor Storage storage there so there's benefit to having the compliance inspector now in place right so the scenario where the iup uh would automatically terminate is if uh Camping World uh ceases to exist however if the underlying land is sold is sold uh but Camping World Is Still uh an active use um then the iup will remain so the underlying land can transact uh but the um but the youth remains and has to be tied to the primary use on the site just to the north um and and that's where uh if for some reason there was to be a change in the site to the north that's when your Southern iup would terminate automatically automatic okay all right and one benefit I did see out of this is we did get hooked up to city sewer and and water uh is part of all this so yes perfect that's very nice okay fantastic all right thank you that's all I have thank you okay so um there are recommendations is there a motion I'll motion to approve this is Robin all second motion's to be there in case they have questions and then before we let Dan leave the table we don't get to do this very often but as co-chair of the Fall Fest um the first council meeting I thanked all the businesses but we don't get to thank them when they're here and you've been the premier sponsor for the last two years so I want to personally say thank you uh for supporting fallfest you are welcome public hearing and discussion for the uh ordinance 24-4 cannabis Management on pages 45 through 72 elanar would you read the public notice please of course notice is hereby given that a public hearing will be held by the city of Columbus Planning Commission on December 18th 2024 at 6: p.m. or as soon thereafter as parties may be heard the hearing will be conducted in person and by interactive technology at the columus city hall located at 16319 Kettle River Boulevard to consider a code Amendment chapter 4 licensing and chapter 7A zoning regulations for cannabis management regulations a full copy of the proposed ordinance is available for review during regular business hours in the city administrator's office at the address listed above or viewed on the city website members of the public interested in attending in person monitoring the meetings or wanting more information should contact city offices at 651464 3120 or visit the city website at Columbus mn. us the hearing shall continue until all evidence and testimony has been received thank you Eleanor so do you want to give us an outline well I I'm I'm glad the room is packed and there's plenty of people that want to ask questions I I I sent you probably one of my longest memos ever uh highlighting what's in your packet and I'm just going to talk about them quickly after our last meeting uh joint meeting uh you've got a Redline version that shows all of the things that happened that prior night and I forwarded that to Megan and Elanor and then created the clean copy uh for the City Council next Tuesday which is dated 12232 24 and the last item that I prepared was a a publication summary of the ordance and I'm strictly going to talk on that about what we're doing in this ordinance there are five sections in the ordinance and while it's 12 or 13 pages in length uh I'm going to keep this extremely short the first thing that we did was amend section or chapter four of the city code that's the licensing provision we added a a whole new section in there 4- 1000 and that includes uh additional definitions relating to cannabis management But it includes all of the provisions for licensing retail functions and cannabis temporary events so the licensing doesn't impact all of the other number of potential cannabis businesses that could come to the city whether it's cultivation manufacturing wholesale uh distribution whatever uh and then even um low potency hemp manufacturing those would all be done through our normal zoning procedures not licensing the second section we uh amended a lot of definitions within the zoning order itself chapter 7A of the code and then the third section included um a number of changes within uh uh the zoning ordinance to identify the permitting mechanism for the 11 different types of cannabis businesses that could come here and as you're well aware we identified all of those in at least one District within the city uh some of the uses particular particularly the retail might have been included in three or four zoning districts and then we distinguish whether these are permitted as interim uses which if you recall are limited to the retail so it coincides with the licensing provisions and the rest of them would be considered conditional uses the next section uh we did amend um article 8 which are the performance standards within the zoning ordinance and that included adding a whole new section called 78- 825 cannabis management and there were a number of details that uh are similar in some extent like hours of operation and and things of that magnitude that you might see in the licensing but it extends to all of the other cannabis businesses that would not be considered retail oriented and the final section is uh just the adoption provision for this ordinance so short and sweet that's the summary and um if the council accepts a recommendation for this they would be acting on this um summary publication rather than the Planning Commission so I'm happy to answer any questions is there anybody in the audience or online that would like to address the Cannabis ordinance okay if not the public hearing is closed um any last minute discussions from anybody I just have one quick question um of the update the redline version nothing changed since the last time we met and talked correct the the redline version that was included um identifies or shows you what we agreed to do at our last meeting okay and then the final version dated 7 23 or next Monday for the city council uh simply accepts all those changes there's no more red line but if you wanted to follow wait a minute we brought this up at the last meeting and I don't see it in here it should show up so that was the purpose of that red line otherwise we Circle that amongst the staff and consultants and um just make sure that we're all in agreement that yes that's what we talked about some of those uh included making sure that the our orders of operation were similar in the performance standards and uh the retail sales we also agreed we are not going to do any type of regulation for um the lower potency uh hemp products which are already allowed now and so that's what you would see in that red line version eliminating all those things okay thank [Music] you thank you and thank you Megan cuz you've been along with us on this uh discussion any other discussion I mean I just feel like we've had so many meetings on it that I have no further discussion but Scott no I'll keep my mouth quiet it's night St package Bethany hello sorry about that no I I mean I don't know what has been discussed before I got here but I do feel like the previous meetings we okay is there a motion motion for to recommend to the council I recommend to I Mo make a motion will be recommended to the council for approval on Monday the 23rd at 6:00 p.m. um next item is any planning Commissioners reports Scott do you have anything I have nothing tonight Bey no Rob no okay I just want to say thank you to Sue this is her last Planning Commission meeting as a council member and next Monday will be her last meeting as a council member so thank you for what you have done the last four years it's appreciated well thank you I appreciate the comments yeah um City administrator and planning report um just want to give the end of year update this is our last meeting of 2024 in the beginning of 2025 we will have an organizational meeting to um um decide on the co-chair the vice chair and the chair and I will be circulating the approved meeting schedule after it is um passed through City Council next week that's essentially um what we've got going on in the beginning of January um as a reminder since currently we do not have a vice chair so that will need to be decided among thank as Ellie mentioned there will be no meeting on January the 1st it's a holiday therefore the next Planning Commission meeting and the only one at this time scheduled for January will be on the 15th unless there's need to call a special meeting on perhaps the 29th so the city council will be adopting their calendar of meeting events on the meeting on the 23d and that will be
