have a statement that I want to read and share uh this is [17:58] related to denouncing acts of violence against elected officials on behalf of [18:03] the city of Woodbury we are deeply saddened by the tragic shooting and killing of Speaker Ammerida of the [18:09] Minnesota House of Representatives Melissa Hortman and her husband Mark in the early morning hours of June 14th we [18:16] offer our heartfelt condolences to the Hortman children family and all who knew and loved them our thoughts are also [18:23] with State Senator John Hoffman and his wife as they recover from their injuries in the hospital after their tragic [18:28] shooting the situation that unfolded that morning was gut-wrenching [18:34] our democracy was built on the idea that everyday residents keep everyday residents step up to serve the public [18:40] and make their communities better we strongly condemn any acts of violence or threats against elected officials our [18:47] public servants must be allowed to fulfill the responsibilities to our communities without fear of their safety [18:53] or that of their families we are grateful to all the law enforcement involved whose quick thinking [18:59] potentially derailed more tragedies from happening and whose hard work and bravery eventually led to the asalent [19:05] being captured in the meantime we thank Speaker Ammerida Hortman for her service [19:11] and will keep her and Mark in her memories her children Sophie and Colin issued a statement with some suggested [19:18] ways to honor their memory they include among other things to plant a tree to visit a local park and make use make use [19:25] of their amenities especially a bike trail and to pet a dog [19:31] a golden retriever is ideal but any will do they went on to say "Our parents [19:36] lived their lives with immense dedication to their fellow humans this tragedy must become a statement i'm [19:42] sorry this tragedy must become a moment for us to come together hold your loved ones a little closer love your neighbors [19:49] treat each other with kindness and respect the best way to honor our parents' memory is to do something [19:55] whether big or small to pass uh we have no public hearings tonight so I'll move on to the discussion so the [21:22] discussion uh are these two items related to road rehabilitation that were um conducted in an open form at our last [21:30] meeting uh we had closed that form and we're continuing on with some discussion um the projects are really important to [21:38] our community they're important to staff and to the work that we've got set ahead uh because at the time it was going to [21:44] require four-fifths vote we were missing a council person um it was determined that it's very important for everyone to [21:50] weigh in on that um and so with that we are bringing these back for vote tonight [21:56] so um if anyone has anything to say about this we're in that discussion mode otherwise if there's nothing that [22:02] anybody wants to say we'll just move forward with vote well I have some things to say [22:07] um I will renew my um motion to have an updated feasibility report when we come [22:14] back to approve the road rehab projects in the March or April timeline whenever [22:21] that comes before us um I'm hoping we got an estimate from Bolton and M on how [22:26] much that would be to include that uh updated as we have in the past had those [22:32] reports i also have questions regarding the Afton Road project um [22:40] and I can take them separately between the neighborhood project and the Afton Road project if you want [22:47] chris would you like to share with us um I think you've got some things ready to explain a little bit about how you do [22:52] these projects and how they come before us yeah uh Mayor Bert uh members of the [22:58] council uh thank you for pointing out that the public improvement hearing was opened and closed so really uh what [23:05] we're talking about is tableabling we tabled the resolutions for the meeting tonight again those public improvement [23:10] hearings were for the 2026 road rehab project as well as the Woodlane Drive Bailey Road to Wooddale Drive project [23:18] um the recommended resolutions and actions before the council is two separate ones it's on one slide here um [23:25] there are some slight differentiations the Woodlane Drive we're not asking or requesting authorization of professional [23:31] engineering services that was already authorized but in both cases uh we'd request council to order the project [23:38] approve the preliminary report authorize plans and specs authorize preparation and acquisition of easements and [23:44] professional engineering services as necessary so maybe to give a little background for [23:50] those members of the public who are not familiar with um what's required as part of our Minnesota statutes 429 uh a [23:57] feasibility preliminary report is required it's considered a planning level document which generally has the [24:03] scope of the project and the most important part is it necessary cost effective and feasible typically uh [24:10] cities do not update those with tabulated bid awards and we historically had not until we started doing that [24:16] roughly in 2015 and we stopped in 2021 in another requirement with part of [24:24] Minnesota statutes 429 amongst many this is one of the just major ones is the assessment hearing that shows the total [24:31] project cost it reflects the asbid scope it lists funding sources based on the [24:36] low bid which also includes the assessment totals per the policy we also provide public access to the assessment [24:43] role and as we discussed last meeting that we would now be providing a link to for council to see the entirety of the [24:48] assessment role uh before it was always available at city hall which is a remnant of probably before email existed [24:55] uh engineers don't change much um and the other uh um is it offers the public an [25:03] opportunity to appeal so updating the feasibility preliminary [25:09] reports it's not required by Minnesota statutes that's not part of anything that um we're required to do in order to [25:15] pass the smell test with 429 staff considers it really an operational [25:20] tabulation it's not policybased the biggest issue that we have and I know there's a small cost uh relative to [25:28] this but it's reduced staff capacity during key key periods there's a short window between bids and a hearing and [25:36] why we stopped doing this in 2021 it really came to a head when we were trying to update the the feasibility [25:42] reports ahead of the the actual um improvement hearing and then while we were doing that we're still pres you [25:48] know preparing the documents for city council there's a lot of things that reviewing bid abstracts tabulations [25:53] making sure everything's correct so updating another document and then updating the council meeting ended up [25:59] having some errors in both the feasibility the improvement hearing and the updated feasibility relative to we [26:04] bought we brought it to council and it created a lot of confusion at the time at the council meeting and so this was a [26:11] time in our period in our history where we were talking about what can we stop doing because we have limited staff [26:16] capacity and we still do um to date you know in my time here we've had minimal [26:22] to no public interest in asking for updated preliminary reports uh in the [26:27] past these reports when we did update them unless you have a really great understanding of the assessment policy [26:34] nine times out of 10 it just create a lot of confusion with the public and so what we find more effective if somebody has a question about exactly how their [26:41] assessments are calculated we ask them to to talk to staff and we walk them through the process we give them a [26:47] grounded understanding of the assessment policy and how it works in this situation staff really doesn't utilize [26:53] these reports and the other thing is if we don't award the project at that meeting which happens infrequently but [26:59] if we don't those documents now become invalid and we have another document that's floating out there that doesn't [27:04] make sense and we have to update another uh feasibility report with a final so [27:10] with that I mean I think staff would recommend that we continue not to update the the premarium feasibility reports [27:16] for all the reasons I just listed thank you for summarizing that does sound a bit redundant and unnecessary [27:23] and takes costs staff time there might be a cost but it might I know you were we put pressure on you to throw out [27:28] numbers last time which wasn't fair because you weren't prepared for that but um again it's more of a timing the [27:34] information is available elsewhere uh nobody's asking for it or looking at it other than maybe one person in the [27:40] community um so it's hard to justify the need to update the preliminary report in [27:46] my estimation well Mayor Barrett I'd like to continue on with that i have asked for it and about 2015 is when the [27:53] new road assessment policy went into place and that is when the um updated [27:58] the updates started going as the things started changing in terms of how we were assessing for sidewalks the percentages [28:06] the minimum minimum assessments um things along those lines so I found it very valuable um I again I have um asked [28:14] for them in the past pre-consel pre my time on council i found them very helpful um I also um have asked for some [28:24] sort of uh there has to be a way you're determining how much the assessments are [28:30] i've asked for the spreadsheets or the graphs or the updated reports and none [28:35] of those things have ever been provided um saying that they don't exist so if [28:41] something like that doesn't exist the question is is how do you know what to assess someone when they come in here [28:46] and then how can you point to a document to show and explain to them how you've come up with the assessment policy or [28:53] the assessment amount based on your policy yes so I can answer that so in my [28:59] time here now I don't I mostly see almost every request that comes in the requests that I've seen come on come in [29:06] have asked for an updated preliminary report we don't have that available anymore what we do get is the [29:12] tabulations that how we calculate that internally but a lot of that time is [29:17] spent developing that all the way up until when we write the council letter because we spend a lot of time combing [29:24] through that making sure there's no errors doing what we do with the bid tabulations putting into the formulas [29:30] and just consistently making sure that we've dialed in every aspect of that but [29:35] that really becomes available after we develop the the council letter and all of the inputs that go into that so there [29:42] is a very short window and of course if uh any council member or member of the public says I would like to see the said [29:49] tabulations we can provide those it's simply an Excel spreadsheet but we don't have an updated per report and we have [29:55] not done that since um 2021 and is just to be clear is the is the feasibility [30:02] report prepared by Bolton and Mink or prepared by city staff the feasibility report is a combination of prepared by [30:08] Bolton Mink but staff combs through it and make sure that all of those elements in the feasibility report match the [30:14] intent of the project making sure that it follows our assessment policy we they [30:19] essentially work on our behalf but we at the end of the day have to spend all of the time reviewing it developing it and [30:25] making sure it's correct in its entirety okay i will um my um motion stands for [30:31] an updated feasibility report uh it has been used in the past it is transparent [30:37] and shows citizens how the assessments are um justified and come to whether [30:44] that be the u minimum assessment amount or based on the straight percentages or [30:49] your special benefit appraisal but regardless I feel something needs to be out there as it has been uh for the past [30:56] seven years before that so well yeah and so just to clarify it was only there since 2015 and it occurred by resident [31:02] pressure by one particular resident but um I don't think that's true i don't Is that true that's my recollection it [31:09] occurred because of one particular resident we had a resident requesting uh the you know an updated preliminary [31:15] report but we have had almost no inquiries requesting that so in 2015 you [31:21] started providing updated preliminary reports because a resident asked for it correct [31:28] and that continued until I was here from 2018 to 2021 we were we continued to do [31:34] that and what was happening was uh staff was feeling super pressured in that time frame and we're under capacity it was [31:42] causing issues with them not being able to evaluate both the bid results and the tabulations and and putting together the [31:47] assessments and so when it came to a head when there was an error and I said why why are we doing this because it's [31:54] really not benefiting staff well kudos to you for looking at things all the time that what what do we need to stop [32:00] doing because we can't keep adding more and more things to our plate we got to stop doing things so um I appreciate [32:05] that and again there's a little demand for it it's not required the information is available elsewhere it's so nice that [32:10] you offer to the community if they have questions you'll sit down with them for those that really want to know but no one's looking at it and no one's asked [32:16] for it so why are we doing work that no it's not necessary asked for it and I've asked for it in a number of different ways being told it doesn't exist but now [32:23] I know to ask for the bid tabulations the the specific request would be to ask [32:29] for the tabulations that you know to calculate the assessments and those do come just to warn council member Wilson [32:36] if you do request those it's likely that those are still in motion all the way up until we write the council letter so it [32:43] will be available probably following when the packets go that money must have some sort of formula in place so you [32:49] know how much to assess i mean that's what I'm trying to figure out this this feasibility report lays it out very [32:54] clearly for citizens to be able to look at it and go I am in responsible for 33% of this and 33% of this these are based [33:02] on the low bid here it is there's no question not on the feasibility report yes it is well the feasibility report is [33:09] there's no bid yeah there is there's a projected value no bid has been received [33:16] red text is based on low bid and that has been provided before the assessment hearing they get the bid in February and [33:24] then they go and put it into the feasibility report so everything in the feasibility report that's in red is [33:30] based on the actual bid not Yes can I clarify i think the report there [33:37] you might be referencing is the 2021 report correct what they were doing is [33:42] so with the preliminary report the calculations are the exact same it shows the calculations how many reus all we're [33:49] really doing is when we get the bids we take those numbers and we divide the n the cost by the the percentage and then [33:56] there's a a calculation between is it the minimum assessment the calculated [34:01] assessment or the special benefit appraisal 99 it's all based on a policy that's been written so you're following [34:07] the policy in 2015 and 99% of the time it's either the minimum assessment or the special benefit appraisal because by [34:14] and large Um if you look at every time we bring improvement hearing or assessment hearing we're almost never [34:20] collectively at 33% of the overall cost of the project and so what you're [34:26] referencing is is in red we're putting it back into the the feasibility the preliminary report while at the same [34:31] time we're combing through the calculations preparing for the packet information that goes to council so what [34:38] we do now is we have pure spreadsheets we don't [34:43] provide an updated preliminary report we don't put it back into the preliminary report right so the preliminary report [34:48] is based on a on a projected bid not an actual bid received because we have not put the project out to bid i'm sorry [34:55] clarify that Chris so could we clarify that yes so the preliminary reports are [35:00] really what is the general scope of service what is the the the constraints of the project and is it necessary cost [35:06] effective and feasible and it outlines the how the assessment policy would work during the process of plan development [35:13] there's minor changes made to the plan that you know may or may not have been contemplated during the feasibility [35:18] report generally the scope doesn't increase in terms of the limits but some elements do change you know pavement [35:24] thicknesses depending on geotechnical borings all those things really should be updated and then um what we do is we [35:32] calculate how much the assessment is we put the the bid awards back into the spreadsheet and then that spits out the [35:38] numbers but we still have to comb through that after we've comb through the bid abstracts so if you were to [35:44] request if if you're really just look asking for the numbers and for how each individual assessment is calculated the [35:50] request would specifically be can I see the spreadsheet tabulations for the [35:55] assessment how the assessments were calculated but granted but what we would staff would appreciate is not making [36:02] that available online because it's just confusing to people because they don't understand our assessment policy there's [36:07] an additional consideration that I would ask council again for for what our role is in this process and and then if we [36:14] then hold that information the assessments can be objected to at any point in time in the assess up to the [36:20] assessment hearing they object to that that then becomes over to our city attorney's office and that becomes a [36:25] legal proceeding and so if we insert ourselves in this process and we're communicating to individuals we're doing [36:32] things outside of what staff that's outside of the scope of our role in as [36:37] as a council member and it potentially puts us in a d in a situation that could [36:42] have negative effects on the city attorney's ability to defend the city's position without knowing ex city [36:49] attorney knows who's supposed to be communicating and doing those things we insert ourselves in that process with um [36:55] by just inserting ourselves in the process it's just bad form is my suggestion i have two uh two questions [37:01] regarding the feasibility report and then I'll move on to Ept Road number one in the past it was based on low bid [37:08] correct and the numbers in here were based on the actual bid you received the red text the red text is based on the [37:15] low bid results correct okay and then um we do post the initial feasibility [37:22] report out online correct that is residents are able to look at it yep and the key things that they are looking at [37:28] is the general scope of assessments and the general scope of the project so they understand am I getting a full [37:33] reconstruction they're replacing my sewer and water or am I are they just fixing my driveways all of those are the [37:38] aspects that we want residents to pay attention to okay next moving on to Afton Road for a minute i think at the [37:44] last meeting you said it was going to be 24 feet wide yes um the last we heard it [37:50] was 28 feet wide so I'm trying to figure out when that went down to 24 and for what purpose and that sounds like it [37:56] costs a lot more money say that again it went from 24 to 28 or 28 to I'll kind of from 28 to 24 we were [38:05] narrowing the the east side of it to 28 to meet up with the existing 28 but now [38:11] the whole thing is going down to 24 okay council I think no Donna is saying [38:17] that's not right why don't we let Chris answer because he's got the answer if you don't mind so mayor members of the [38:23] council I didn't I don't have the graphics in front of me but I can generally explain what is occurring so [38:28] if you if you're moving along from west to east on Afton Road currently it's pretty wide [38:35] at the entrance and then it necks down and narrows down to 24 ft and then it [38:40] opens up again uh through a section to I believe 28 ft now our standard roadway [38:46] would typically be 28 ft wide but we also have this goal of providing [38:52] pedestrian access while minimizing impacts so this is one of those situations where we'd say context [38:57] sensitivity we have to weigh the pros and cons of being able to add a trail [39:02] minimize impacts and it's obviously not ideal from a public works standpoint to go down to 24 ft wide but it's certainly [39:10] acceptable in the ind engineering industry in terms of the lane widths and so it'll do two things one the what i'm [39:16] sorry lane okay so what we'll do what what it will do is slow down traffic but it will very [39:24] much minimize the impacts to those residents on the north side where we're constructing the trail [39:30] in addition it actually it will be not very expensive we are actually shrinking [39:36] the roadway so in the long run the delta between the slightly wider road which we're going to have to remove anyways [39:42] and narrowing that is very little and then ultimately the long-term maintenance cost is you know two feet on [39:48] either side less maintenance in the long run this is not a standard we would like across the city it is a little harder to [39:54] plow and it's it's not what our standard is but it's all about context [39:59] sensitivity while trying to add trails and sidewalks in community but we already have trails and sidewalks where [40:04] it's 28 ft we do not so on Afton Road this section from Radio [40:11] Drive where it meets up to the kind of the city hall loop correct there is [40:16] there's no uh trail on that on either side of the roadway correct and it's a critical gap in our in the in the [40:24] connectivity pedestrian connectivity so we're shrinking that portion of the roadway down to 24 ft wide and then [40:31] allowing a small boulevard 5 foot boulevard and then the trail and by reducing that and offsetting the road as [40:37] much as we can we're minimizing those impacts to the north side still allowing some level of snow storage and and quite [40:43] importantly the power lines are on that north side so that boulevard allows a place for those poles to go because when [40:49] you reloc relocate electric utilities you it's required to provide them some room to put them back in you can't [40:55] underground them what you you physically could if you wanted to pay millions of dollars and that's what the Ron resident [41:01] last week that was his big thing in in question going to go yeah and I think he [41:06] was happy to know that we're bringing it closer to the road and not closer to his property and but the rest of Aftton Road [41:12] according to the memo is 28 ft correct so it's 24 ft so the very beginning from [41:18] going west to east we're going right to left if you're looking at a map [41:25] the beginning Okay I'm confused left to right on the map west to east is [41:30] left to right yeah sorry that's west are you going the other way to I'm east to west you're going east to west i'm [41:36] confusing everybody that's my own problem and engineers should know how to do math right right from radio from [41:41] radio it's wider and then that there's a section of Valley or Afton Road that [41:47] exists as 24 ft wide and it's really where that narrow steep section is by the trail all we're doing is extending [41:54] that to Radio Drive all the way and allowing that trail to continue once it gets past that it opens back to 28 ft [42:01] wide and we would continue with that width as it as it stands so the whole road is not being narrowed to 24 ft wide [42:08] no it's just the beginning section to allow that where all the turn lanes are uh there's well there's turn lanes there [42:15] there'd be opening of the turn lane and it would neck down so there's turn lanes where the signals are but then it necks [42:20] down i I wish I had the graphic last meeting i did watch the last [43:54] meeting and I would say that I would I would support council member Wilson's um [44:02] desire to maintain the high level of transparency that our government has and that city staff does and and I'm also [44:09] concerned about the transparency of of our actions and the and the foundations but as as the director just kind of [44:16] outlaid I think that transparency is there the other part that we we are charged with weighing is not just the [44:21] transparency but a fiduciary responsibility of public funds and and the cost benefit or the cost gain of [44:29] this not just in staff time but the actual just that cost benefit for me didn't as I watch back the meeting I had [44:35] the opportunity not being here I had the opportunity to think about it for a week um and so I do appreciate the the [44:41] tableling of it and giving us all that chance but I I just thought that that benefit did not outweigh the cost so I [44:47] will make Can I make a for clarification did we ever get an estimate on how much it would cost for Bolton and Mink to [44:54] update the feasibility report i did not i know I did not uh get the collective [45:00] will of the council to to direct me to do that but at the same time my frame of [45:05] reference is the cost although small was a minor issue to me it was really the staff capacity was the issue which is [45:12] what I really which is what I express today right and in my mind I also equate that to cost it is cost well and I guess [45:19] I would just uh go on to it one um my lack of um seconding the motion is just [45:25] because I don't I think the um proposal is for a additional conversation um I [45:33] would like to possibly have it earmarked for when we whenever the street task force um street assessment task force [45:41] you know gets brought back up again and I know that that is something that unfortunately has been pushed out for a [45:46] couple of years just from a timing of everything i would like more feedback I think from residents in terms of use of [45:52] is this important is this a valuable tool um again is it already there and so maybe it's not to me it was a little bit [45:59] I was curious like you know what was that cost i am hesitant right now in terms of again [46:06] I would say sort of that precedent of you know what is the the process and I guess I would just rather build that in [46:13] as a you know if in the future as you know who knows what our assessment policy might look like in the future [46:19] after that task force and so um that to me is more about again I think it's a [46:24] just a larger conversation um with regards to it so so I'll make a motion to approve resolution 25-13 32 a [46:32] resolution approving the preliminary last council [47:10] meeting it was the same council member Wilson you had the same objection on the the second one that's it that was my [47:15] only difference otherwise I would have I'd be voting yes if we'd get a updated uh feasibility report because but [47:22] because of the lack of transparency I can't do it do you have Well hang on there is transparency because the [47:27] information is available there's nothing hidden it's available it can be found it can be asked for it is there yeah I just [47:33] want to make that very clear i absolutely object to the you I do I object to the the I'll find it then no [47:38] no no no i I object to your use of the word of lack of transparency it insinuates that the city is not [47:44] transparent and we have and director just talked about how transparent we are all the information is available we [47:51] simply don't go back go back and update a report from the very beginning of the project because it's not time sensitive [47:56] so I do object to the use of transparency the the the claim that we are not transparent in that being said I [48:02] will make a resolution to adopt resolution 25-133 a resolution approving the preliminary report ordering the [48:09] project authorizing prepar preparation I hate that word of plans and specifications and authorizing [48:14] preparation acquisition and if necessary condemnation of easements for the Woodlane Drive Bailey Road to Wooddale [48:21] Drive pavement rehabilitation project second yep motion a second any discussion so [48:28] but council member Wilson did you have additional questions about this project i do not i and based on my uh data [48:35] request in the past asking for this and now I'm finding out that the I used the term spreadsheet and I should have used [48:41] the term tabulation or spreadsheet tabulation so so when I say there is a [48:47] lack there is a lack but I'll I'll bring it up during the uh workshop [48:53] motion second we have a quickly highlight upcoming meetings okay [50:24] for the planning commission meeting on June 30th preliminary items we have three uh indoor pickle ball at 390 [50:29] Commerce Drive a conditional use permit uh Ranch Road edition at 8040 Ranch Road a resoning and preliminary plat and then [50:36] at 4225 Woodlane Drive a planned unit development concept and if those proceed [50:42] they would also be public hearings scheduled for July 16th and then I'll just highlight the workshop for council [50:48] on July 16th um because we covered utility rates this evening we no longer need to do that then and then we did [50:54] just had a planned um public safety building update but however we just did that and really don't have any new [50:59] information we need um council's guidance on so I won't cancel it yet [51:05] let's see let's see how the rest of the meeting goes after this but most likely we'll cancel the workshop for Okay oh [51:12] interesting be still yeah um just Yeah good opportunity between now and then we [51:17] have the Fourth of July so we do have a Fourth of July celebration so looking forward to having the community out and [51:22] enjoying that if you remember
