[3:44] uh first item on there would be to the approve the minutes from 114 there's a
[3:50] couple one on 115 and one on 1112 we can approve them collectively or individually I'll stand for

[5:21] and Water good morning good morning Mr chair members of the board I'm Lisha O'Hare water resource specialist from
[5:27] The Soil and Water Conservation District I'm here to uh present on our Mississippi River St Cloud comprehensive
[5:34] watershed management plan uh for the past two years I've been working with our uh state and local Partners to to
[5:42] write up this plan and I do also want to thank commissioner dedri for serving on the policy committee for uh that group
[5:49] the plan is now complete as a draft yay and we will be having a public
[5:55] hearing for that um draft on November 5th 11:00 a.m. at the Sherburn History
[6:02] Center um and what I would need from uh the board today is a uh authorization to
[6:10] the policy committee to then authorize to send the draft to the Board of Water
[6:15] and Soil resources so that they can review and approve the plan once that's complete we will have access to funding
[6:23] it is about a million dollars um total uh for the for the entire entire group
[6:29] over uh to uh for the banum um and we'll then have access to that and we can
[6:34] start implementation next summer so uh if you want I have a draft motion
[6:41] if that's helpful but it's basically what I said it's um authorized the Mississippi River St Cloud Watershed
[6:46] policy committee representatives to authorize the comprehensive watershed management plan for final submission to the Board of Water and Soil resources

[7:05] together I think they've learned from from all the other watersheds particularly our North for Fort Crow

[7:18] moving forward there's just been such good input um everyone involved and I think this is a good plan um and ready
[7:25] to go to that next step so thanks for all your hard work it's uh funny you think back because uh
[7:33] I think I was in some of the same rooms as you was it probably five six years ago when the conversation just first
[7:39] started when going into these plans these one water sheds and it's nice to see that it actually came through and
[7:45] now there's actually money in there because I think for a while the discussion was well this is the plan but there isn't any def this there was no
[7:52] incentive to do it because there was no money allocated to them so that would be
[7:57] frust yes so a lot of hard work appreciate uh your time commissioner Dietrick in that and uh moving

[8:45] the opportunity to introduce uh the newest attorney who's joined my office yesterday was his first day uh Kyle day
[8:52] Kyle lives in at SEO with his wife and four children um he graduated from the
[8:57] University of Minnesota did um a career outside of law for a bit and then went back to law school um he graduated law
[9:04] school 2015 he has the the honor of being the last class of William Mitchell before they combined Willam Mitchell and
[9:11] and Hamlin um he's had kind of a diverse career he was a public defender out of Scott County and he was with a private
[9:18] law firm and most recently did about three years with the St Cloud City attorney's office so he's going to join
[9:24] my Civil Division um initially going to focus on a chips case load but May
[9:30] diversify into kind of a utility uh player in the in the Civil Division so happy to have uh Kyle join our office I
[9:37] think he's going to do great things for us and just wanted to introduce him and present the certificate of appointment
[9:43] which I provided to Mr kryer well welcome Kyle uh it looks like
[9:48] you bring a wealth of knowledge to our organization you'll be a great asset to the county and the citizens of right
[9:55] County welcome aboard thank you I appreciate it I'm looking forward to it uh live in Wright County have for the
[10:01] last four years looking forward to making a positive impact on my community
[10:07] which uh which I'm looking forward to so I appreciate it thank you welcome well we always hear the

[11:38] public hearing yeah Mr chair this section is just to schedule the public hearing so we can publish notice of that um notice
[11:46] does need to be mailed or I guess published this Friday so I have a deadline of noon to get it to the paper
[11:53] so December 3rd at 1:00 if that works for everybody would be our suggested
[11:59] time or do we want to do it right after the professional shots the which one the
[12:04] professional shots that same day on the move it up in the morning yeah just move it up we can do it at you want to do it

[14:01] Montrose at 12 and 12 um mad as a project next year in Howard Lake Waverly and Monro doing pedestrian improvements
[14:08] and this is our share of that construction cost pretty

[15:34] morning good morning Mr chair members of the board good morning I am requesting the
[15:42] adoption of this resolution proclaiming tomorrow November 20th 2024 as National
[15:48] GIS day in Ray County I would like to read a small section of the resolution please do okay
[15:55] um Ray County recognizes that an understanding of geography and geospatial Technology provides critical
[16:02] information to stakeholders and helps Community leaders and government officials make data- driven decisions
[16:08] and is crucial to operating our infrastructure sustaining our national natural resources and stimulating
[16:14] economic growth thus benefiting the welfare of the general public throughout R
[16:20] County um I chose this passage because I think it speaks to a small part of the wide variety of work um the gis team
[16:26] does at re County My Hope for the future that we continue to grow the uh Services we provide to right County stakeholders
[16:33] and the general public well Lin I can speak well to say
[16:40] that you've taken on some great projects that have uh brought on huge amount of value to this organization and other
[16:46] organizations outside of uh this building uh so I give two thumbs up to
[16:52] yourself and your team and the things that you're doing I hoping we can better educate through weeks like this on the
[16:59] need and the demand for people with these skills because uh it's the wave of the future and the being able to
[17:05] quantify information in this manner is efficient and probably the best
[17:11] understanding understandable way to quantify data thank you um do you mind if I just
[17:18] really quickly highlight on a a project we just finished up absolutely be great um so there's been a uh an ongoing
[17:26] project at in the gis Vision since 2017 um there's a Statewide initiative called
[17:31] Next Generation 911 the state of Minnesota as well as a handful of other states are leading the charge and
[17:37] modernizing the way uh data is provided to dispatchers when making a call for service so for context the current
[17:44] technology being used was developed and implemented back in the 1970s um so I'm
[17:49] happy to say that R county has finished our validations with the state and uh
[17:54] whenever the state is ready to go live with this with this initiative we'll be uh ready for it and one of the
[18:00] unrecognized benefits of this uh uh project is that right County will now be
[18:06] a part of a Statewide aggregate of address and Road uh Road data so what
[18:12] this means is that the state will be uh sharing our address and Road data with
[18:17] uh Downstream applications like Google and um Apple to ensure that our addresses and roads in right County will
[18:24] be updated in those applications in a more timely manner so just wanted to to highlight that that we finished that
[18:30] last week so wonderful awes wonderful Mr chair I just want to want to add just
[18:35] proud of you and your team for all the heart work and the impact that you have on the county thank you thank you Mr
[18:41] chair I want to say it's really fun to go to my City Council meetings and share
[18:47] all the things that you've been doing especially when it relates to the Cannabis and the setbacks they were so
[18:53] excited to have that tool it's going to be very helpful for them plus I also
[18:59] have to note that tomorrow they really geek out and last year had the cutest
[19:04] little outfits on which we will have again this year does Elizabeth take part in that
[19:11] too then we did not get her a t-shirt maybe we can Qui quickly order
[19:18] one well wonderful I'll entertain a motion to adopt uh November 20th as
[19:24] National GIS day in Ry County moved I'll second motion by commissioner diet

[19:44] the entire uh Ed agenda item moving on for items for consideration first item would be to authorize staff into a
[19:51] license agreement with law enforcement agencies for the use of the right County Law Enforcement Training Facility uh
[19:57] this is kind of going back to some previous meetings that we've had and uh working on developing this agreement so
[20:03] we can uh allow outside agencies to contract use for the facility yeah Mr
[20:09] chair and board just real quick a summary of this item so the board has asked us to bring forward the
[20:14] opportunity for agencies outside of Wright County to use the Law Enforcement Training Center so we've already adopted
[20:21] a fee schedule as part of the overall fee schedule um through the County's process for that so the next step here
[20:26] is to approve an agreement that we can use for engaging these agencies for use of that facility so what we've done is
[20:32] we've taken the license agreement that we had that we used for counties that or for um communities that are inside
[20:38] Wright County and we already have executed a few of those and just modified it very slightly simply to
[20:44] remove the cap of the number of times that it can be used as well as to subject the users of this to the fee
[20:51] schedule but other than that the agreement before you is the same as what we had utilized for the communities within rright County so looking for for
[20:59] adoption of this and then following adoption of this we'll work with the agencies that have an interest in using it to execute it and begin the use of it
[21:05] so with that looking for questions otherwise that action today Mr chair I just want to clarify that the scheduling
[21:12] of it as priority is our Sheriff's Department first and they will be involved with what gets scheduled into
[21:19] uh the use of the facility correct yeah Mr chair board members that's correct and the way the agreement is draft is
[21:25] that the um Sheriff's Office Captain who's in charge of this facility will be instrumental in working with those
[21:32] agencies that want to use it to schedule it to ensure that exactly that that our sheriff's office has priority thank you
[21:39] Mr chair yes thanks Clay for bringing this forward I had a question on number
[21:44] 10 on page two on the fiscal impact on the first page it talks about staff time
[21:50] and I see the first line it says may have a range safety officer present at firearms training what's the plan on
[21:58] that being different from if they want to use use the facility for just use of force or something like
[22:05] that I don't know if we've specified it to that level yet I think it's going to
[22:10] be up to the discretion of the Sheriff's Office to determine if that's something where they need someone out there or not which is why we have the language in
[22:16] there that they may have someone present if they fa feel that there's a use that they need someone present for it they
[22:23] certainly can but they're not obligated to have someone there as I and I talked to Chief about this I in favor of
[22:30] having a staff member out there at a $9 million facility and have our people be
[22:36] the last to leave and not just say shut the lights off when you're done and see
[22:41] you next time um so I I'm kind of leaning more toward unless someone says
[22:47] differently to have a shell there but I would hope for consideration and flexing the time that
[22:54] if someone's using it in the evening that it's not just a like an overtime money grab to where at the end of the
[23:00] year somebody says oh the fee schedule didn't come out too well cuz with overtime we actually lost money I I want
[23:08] that to be part of the consideration also any other board members have
[23:15] thoughts yeah chairman v um I agree I I
[23:22] don't I don't want any overtime um when we rented our huge uh um performance uh
[23:31] the the pack performance Activity Center it was very expensive but we still had
[23:37] somebody that you know would go in and make sure that things were running well
[23:44] um and that nobody would touch any like the equipment that being said it wasn't
[23:50] overtime it was specifically paid for through Community Ed as that
[23:56] specific time frame so you know I don't and I don't know um
[24:03] how to go about this but I think it would make sense if it's maybe just a
[24:09] person that can go in with that being a duty instead of
[24:15] overtime Mr chair I'm not sure how we're getting onto the overtime I think that's something that the sheriff is in charge
[24:21] of the scheduling of the facility and um I I don't know that we're in a place to say who should who should be getting
[24:27] overtime or not not if it's a if it's a position that needs to be there to lock the doors I mean I think that that would
[24:33] be something that they can handle I think I mean I understand the points here of the board members is
[24:39] saying that you know we want to utilize it with other facilities but we also don't want to do it at the demise that the fact that it's costing us more money
[24:45] than it is to operate uh based on the fees schedule uh
[24:51] in almost all likelihood situations even with overtime you'd still be ahead on it
[24:57] you wouldn't be you wouldn't be netting as much with overtime on it but yet you'd still be netting something I mean
[25:03] I guess it's it I think it's the sheriff I would say as well as the chief would
[25:09] probably be in their their best uh favor to try and do it without overtime but
[25:15] there might be situations where that is impossible um I don't know maybe it's something that I guess it's at at their
[25:23] piece to manage it and I don't foresee it being a situation where either way we would lose money money at it so Mr chair
[25:30] another line I was wondering about is how did we come up with no firearms training allowed between the hours of
[25:36] 8:00 pm and 8:00 a.m. with an indoor range I don't see why that would matter
[25:42] to neighbors of anybody else and it doesn't specify that that I saw anyway
[25:47] that you can't have use of force training or some other indoor training after eight so I'm wondering why why
[25:54] that was spelled out that way and Mr chairman board I think that was pertaining to the outdoor training I
[26:00] don't know that we specified it in there but just given that there are neighbors we don't want to have that noise
[26:05] overnight like that I don't I mean I don't think there's a strong preference from the administrative standpoint about
[26:11] the overnight use I would defer to the Sheriff's Office for their opinion on that it may be more challenging for them
[26:17] to find someone to monitor the facility during those time periods but that'd be a question you need to ask them and uh
[26:25] administrator kryer that's those time frames for the outdoor shooting is mostly in line with what we require of
[26:30] other entities that have outdoor shooting with the those quiet periods it's similar to it I believe Mr chair
[26:38] members of the board I it's been a while since I dealt with the Delano
[26:43] schwartzman's club and I should know it after how many public hearings I sat through on it but
[26:50] I I I want to say and Barry's not in the room to help me here either right now but I I want to
[26:57] say it's maybe 9:00 is how late it goes because they had a lot of school events down at the Delano Sportsman's Club but
[27:04] it's in the ballpark that's times are yeah that ballpark and there's also state regulations on those that I think
[27:11] give them a lot more leeway whereas we can limit our own facility because it's not a public use um we can limit our own
[27:18] facility because we control it but a cup dealing with it for a private club they
[27:23] have different statutory protections that may be even broader
[27:28] just throwing this out there if you want to continue to limit its use um law enforcement is mandated by the post
[27:35] board to shoot in low light inclement weather conditions and so by putting an 8:00 cap on there that is probably going
[27:42] to take someone out that's looking for a place to get their fall or their low light qualification done so we certainly
[27:49] don't abide by that law enforcement doesn't so if you're looking to get it out there we're mandated once a year to
[27:55] train in low light conditions so 8:00 in June probably isn't going to work for
[28:01] them I'm wondering that's what I'm wondering sheriff is how did that time frame get in there so you folks I haven't I haven't seen this I have no
[28:08] idea okay so I then at the very least it should say
[28:13] indoor there's no limits on indoors no reason to and a night shoot you could have at noon if you shut the lights off
[28:20] in inclement weather they used to put an ice CU ice cubes in a cooler and you're supposed to Mill your hands around you
[28:26] remember that and that counted as weather swe to God that happened and it
[28:33] it didn't happen after I took over sometimes you schedule it and the weather's nice but uh but if you don't
[28:39] have a conflict then I I just and now we do get calls about the 9:30 10 at night
[28:45] shooting out there I'll I'll admit that uh that the neighbors and you can hear this from a long ways but I think that
[28:52] time frame needs to be justed at the very least to say uh doesn't include the
[28:58] Indoor Range there's just no reason to limit I think like you already discussed up here more maze in this document would
[29:04] be great because we can effectively manage what's going on out there I've told you all along I'm concerned with
[29:10] the neighbors out there I don't want to make a bunch of enemies out of our neighbors by renting out our facility for a little bit of Revenue we're going
[29:17] to effectively manage that if we have a long-term leaser out there after the
[29:22] first couple of times they might know the Rope certainly we're not going to let them lock up at night we're going to have to do that stuff but as far as
[29:29] OverWatch on them if if their firearms instructors are out there will determine
[29:35] how much of our involvement we need to have we're going to make sure that we're taking care of our our training center
[29:42] so more Mays instead of shells would be great and we can truly folks effectively
[29:48] manage it uh commissioner catch marker you requesting that we just men that to
[29:53] that agreement to say 8 to8 on the indoor or uh outdoor range I I would Mr
[29:59] chair I think I don't see a problem limiting the out of County for higher people to not be shooting at 9930 at
[30:06] night I think that's fair we we've got they do what they do here but I think we
[30:12] can put those parameters on but not limit the indoor because that doesn't affect anybody I think that's fair Mr
[30:19] chair uh commissioner catchmark if you're looking to make that amendment I think we could just simply just add the word outdoor between no and Firearms so
[30:26] no outdoor firearms training shall occur between the hours of 800 p.m. and 8: a. be a simple change there and I I didn't
[30:32] hear anything else I don't think there's consensus on the first issue you brought up commissioner catchmark so I won't
[30:38] offer an amendment there unless I hear otherwise from the board well then again I point there was
[30:44] that I think our we should have a County employee whoever that might be be the last person to leave the facility on a
[30:52] training day by some other agency that we're not turning over to Keys and codes
[30:58] and saying shut the lights off when you're done and this says all that I
[31:03] read through just says that they may have someone for safe for uh Firearms only but I think in the interest of the
[31:10] Ray County facility we wouldn't do that anywhere else yeah and I guess it's the the nuances as to saying that okay a
[31:17] right County employee closing it up or does the one have to be there the entire time because based on like uh what the
[31:22] sheriff is saying there might be situations where there might be there might be there for 4 hours and maybe
[31:28] that person opens up gets them going and they come back for the last hour I don't know I I'm just putting out their pieces
[31:35] to it or do you want are I'm just and I'm trying to get clarification or do you want it to be just for the opening and closing or do you want it to be a
[31:41] shell has to be there the entire time I think for a 9 million facility with all the on and offs there if something goes
[31:47] wrong then the the department is sitting there standing and waiting for someone to come or saying this doesn't work I
[31:53] guess we have to leave I just think with a facility that offers that kind of training that we can justify having a
[32:00] person now could it be facilities maintenance on up it could be anybody
[32:06] but I'm just saying it shouldn't be left unattended from County staff and County
[32:11] staff should be the last to leave would that have been considered in the fee schedule though that
[32:17] cost well that isn't spelled out that way Mr chairman board members it does say in the fee schedule that if there is
[32:23] sheriff's office staff required that that is accounted for in the Fe schedule I think I don't remember the rate I want
[32:30] to say it was like $75 an hour that they would pay for that that staff but it is accounted for I believe in the fee
[32:39] schedule well Mr chair in comparison if some group wants to use this at night
[32:44] for something does everybody from the county go home and say shut the lights off last one leave and see you next time
[32:52] how is this place dealt with because we have after hours meetings I've seen people at 6:00 coming and going here
[32:59] what do we have Administration um Mr chair member katchmark um at least for
[33:04] Planning Commission meeting staff shuts down the building and make sure everyone's out of it on Planning Commission nights on Thursday um and to
[33:10] help move the discussion forward commissioner katchmark I can offer a proposed motion to address both of your points if you'd like um it would be to
[33:18] amend paragraph 10 of the license agreement to state in the first two sentences the right County Sheriff's
[33:24] Office shall have a range safety officer or other designity present when lensy
[33:29] uses the training center and then the next sentence would be amended to add
[33:34] the word outdoor between no and Firearms I think that's a fair I and I I
[33:42] and want to mostly clarify that because uh I want to make sure that we weren't just trying to open and close I think
[33:48] the request it's an expensive building there's expensive equipment in there and we can always modify if we find out that
[33:54] the fee schedule doesn't accomplish that down the road we can always modify by that but I I think this this is a good
[33:59] starting point thank you I'll make a motion then to authorize that agreement
[34:05] with those couple of changes proposed by administrator kryer I'll second all
[34:11] right motion by commissioner catchmark second by commissioner Holland who uh authorized the license agreement with
[34:17] law enforcement agencies for the use of right County Law Enforcement training facilities with the uh mentioned
[34:23] amendments uh any other discussion uh one more thing commissioner

[36:09] last couple months yes it is Mr chair before you is the resolution to adopt the findings as presented by hearing
[36:16] officer Scott Anderson um dated November 13 2024 for the cases and Albertville um
[36:23] I believe the board has had sufficient time to review the findings um and the the legal concl iions presented by Mr
[36:29] Anderson assuming everything in his order I would ask that the board adopt the resolution I I would note I do need
[36:36] to make one Amendment to the resolution and that's to include a $22,000 civil
[36:41] penalty as well uh in the let me see which paragraph it
[36:46] is it's the second uh be it further resolve paragraph We would add a
[36:52] $22,000 uh civil penalty that was in inadvertently omitted we still a 30-day
[36:58] suspension but Mr Anderson did also recommend a $2,000 administrative fine as well so add that that's consistent
[37:05] with our ordinance that is consistent with our ordinance I appreciate uh hearing
[37:10] officer Anderson's thorough review of this uh uh case and the I believe he has
[37:17] come to a uh good findings here for adoption by
[37:22] the board and would support uh the approval of hearing officer Anderson's
[37:27] uh findings agreed all right I'll make a motion to approve and commissioner dedri
[37:35] is that what the amendment I stated for the $2000 correct thank you I'll second all right we have a motion by
[37:40] commissioner Dietrich uh second by commissioner Holland to approve the findings by hearing officer Anderson
[37:45] regarding the uh tobacco violation appeal and with the modification of the
[37:52] upholding the ordinance uh fine of $2,000 in conjunction with other

[38:19] recommendations uh first one be the way and means recommendations sorry so we
[38:26] have a a couple recommendations here under the ways and means which would be the handbook updates uh for the
[38:33] commissioner handbook and the second would be the review and additional items for the uh consideration so it be the
[38:40] review of the committee consensus there was a few of them there that were uh modified maybe prematurely or not
[38:48] updated correctly from the committee's list I think uh uh Minnesota Ro caucus was was removed on on an error and the
[38:56] second uh seat on the EDP needed to be updated uh I know myself I'm sitting
[39:02] down with uh mati here in the next week to review uh making sure that those are
[39:07] all up to date prior to our uh organizational meeting for these
[39:13] appointments in December so Mr chair and and you cut me off at the pass a little
[39:18] bit because you got word on a couple of them I got a couple more that aren't mentioned in here and it's actually
[39:24] Minnesota rural counties that you called Minnesota something caucus but so they
[39:30] change the rules to get us in there I brought up in the past is this redundant coverage or not uh they do share the
[39:39] same interest as far as drainage law in particular as far as that registry and making extra Hoops to do ditch work they
[39:46] support not doing that which is what we like um but if you're going to take
[39:51] another look then make sure that we're not duplicating efforts or lobbying and all that but it didn't make the list so
[39:58] it looked like some decision was made that hey it's not here so I looked through the whole thing and I got some I
[40:05] think was meant to be alphabetical but the egg Society Fair board is not on
[40:11] there I'm a non-voting member currently I'm the one serving on there but I wanted to share the experience as we go
[40:17] forward and I was told by staff that this was a time and place to do it so we're listed on the agenda which is not
[40:24] given out until the meeting meeting starts and you all know how I like that
[40:31] there's nothing to prepare for or ask questions or anything you don't know what to you get there then me as a non-voting member am listed as a guest I
[40:39] think there's a difference there but in their eyes I'm a guest non- voting member you know how do you really Define
[40:45] that I didn't ask for much while I was down there but what I did ask and Mr chair this was your idea to send an
[40:51] extra 40,000 down there ARP money remember last year we had leftover got
[40:57] had to get reallocated and you said how about we send it to the fair and we did we sent them an extra 40,000 don't look
[41:03] puzzled just agree cuz it was good it a good I'm trying to remember what it was for but there's a lot of stuff but so I
[41:09] said hey I you know I don't ask for much but I'd like to be included in the discussion on spending this and the next
[41:16] meeting came up the minutes were there and it wasn't in there I had to say it twice because they didn't wasn't good
[41:21] enough to say it once never got contacted for this discussion on the $40,000
[41:27] our staff said recently hey are they going to do anything with that was you got to have some plan by the end of the
[41:32] year so I brought it up to them oh before you know what the host of invoices came up here to get reimbursed
[41:39] for the ARP money that's relevant as we talk because uh I think this could be one of those on
[41:45] the list that maybe has an asterisk and maybe it's uh when needed if requested
[41:52] kind of a thing uh voluntary then I was I was told well
[41:57] they like to get your county updates too to know what's going on well a lot of people would like that but I go to my cities and townships maybe once a year
[42:03] not once a month and I'm just sharing that for the future that uh that's why we're talking
[42:10] about this list do with it as you wish for the next year but uh I'll bring up a couple others that I think an asterisk
[42:17] could be next to and I don't know that someone has to be assigned but uh does anyone have any questions about that
[42:24] piece sense commissioner catch mark we and I I would support that we've we've
[42:29] done that on a number of ones last year we were we had an appointment uh was it maybe two years ago on the clear water
[42:35] river Watershed District which once again we weren't a voting member on and we would go there to sit in the audience
[42:41] as a guest and I was like when we're appointing somebody when we didn't even have a forum to even that one we didn't
[42:47] even have a comment period it was like kind of okay I'm not quite sure why where there there was an appointed seat
[42:53] on there when you're not an active member of it when when it's an open public meeting I
[42:59] we could attend at any time so this is to me kind of one of those same situations we don't really have to have
[43:04] an appointment to it if we're not an interested we're an interested party based on the fact that we allocate funds
[43:11] to them but attending their uh regular meetings when we don't have any active
[43:17] participation on it I I don't necessarily know that that makes sense that'll be a decision for the next board
[43:23] I guess that first meeting but that's why we're here to talk about it there's there's another one the local EMS
[43:29] meeting and the fire chiefs says one commissioner I've gone to a lot of them seldom if ever anything really County
[43:36] Commissioner related one thing I can think of is when there was a little bit of interest in having a training center
[43:42] for them at the Compost Facility but that died on the vine there was lack of
[43:48] interest on their part but I again I'm there I give updates and then I'm gone
[43:55] uh it could be an as requested if request Ed there's other heavy County staff presen at this meeting so that's
[44:03] uh for consideration however you want to take that into next year Highway 12 Coalition
[44:10] is more relevant and that didn't make the list State Highway 55 made the list but
[44:16] not US Highway 12 did not make the list so I think that should be there that's
[44:21] important that runs right through District 5 typically that would be the the commissioner there but noticeably
[44:28] absent uh there's I think seven of the eight townships touch Highway 12 they never show up I've tried to get them to
[44:34] go but they don't I a lot of the residents Cross or drive on Highway 12 regularly so that should be added to the
[44:40] list I think active presence there would be
[44:47] good MRC we talked
[44:52] about I think the rest are adequately accurately noted
[44:59] here so that's all I had on that piece or people looking to get language
[45:06] related at at this time to get add to the list or do you want to do that at a future meeting language to the sorry
[45:14] language to what I oh to uh you know you got the list and the appointees on on here I just brought up commentary on
[45:21] things that aren't on the list and and things if you can because what I'm going
[45:26] to be doing here that I said in the next week or two prior to our organizational meeting uh working with mati to update
[45:32] this if you or any other board members that have uh questions about appointments that you're on or ones that
[45:37] should have appointments to it if you could send them to me or mati so when we have that as most up to date whether
[45:44] it's a description of what the committee is or where they're at or whether it is one that maybe should be changed from an
[45:50] appointment to an as requested or needs to have an appointment to it uh where it
[45:56] previously did not so if you can quantify those up either to myself or mati so we can uh get ready
[46:03] for that meeting in December perfect Mr chair yep um I would like to speak to the Ways and Means Committee
[46:09] recommendation here um regarding it was under agenda number three review and discuss how minutes are documented with
[46:16] the recommendation that the committee's consensus was to accept changes applying to committee minut minutes to include
[46:22] only attendees and actions which would be a recommendation I honestly was shocked to read that the
[46:29] ways and means proposal um would be to eliminate the minutes and only print the recommendations I will argue against
[46:35] this till I'm blue in the face in all my years on public and Community boards have never participated in meetings that
[46:41] did not keep summaries of the minutes at least at the minimum um otherwise
[46:46] verbatim the Ways and Means Committee recommendation goes against our County Board strategic objective to provide
[46:53] continued transparency and Empower Community Eng engagement in order to keep our citizens informed and build
[47:00] trusting relationships within the county uh summarized minutes would allow the nuances from the discussion to be heard
[47:07] this helps understand what was discussed and how decisions were made included including only the recommendations from
[47:14] meetings eliminates the dissenting voices which have every right to be heard um summarized minutes also provide
[47:21] rebuttal evidence for accuracy and accountability to people in our County per state statute this also keeps from
[47:27] misrepresenting the truth of what was discussed during the public meetings um therefore to be consistent
[47:34] with our County Mission Vision and values I would like to make a motion to approve the ways and means um
[47:41] recommendations with the addition of summarized minutes to be included with
[47:46] the recommendations and a record of the attendees for public record as a whole
[47:52] those three items at a minimum so uh I think there
[47:57] some information that was maybe missed in that piece but there is coming out of this that the board members would get a
[48:03] memo of information as to the topics that were discussed and how the consensus was built for the
[48:09] recommendation in that committee uh so we can quantify that Mr chair if you look at the minutes coming out of of the
[48:16] ways and means and the Personnel it's just the agenda item and a recommendation there's no minutes
[48:22] included in those already so I I'm saying we've always had those comments
[48:29] um and haven't been verbatim so I would you know I agree um but that allowed the summary of the discussion to be heard
[48:35] and we don't need to make this more contentious than than it is because it's to me it's a a simple understanding uh
[48:40] Missing of some a couple informational language which we can absolutely Mr chair point in order if we got a motion though we need a second oh yes thank you

[48:54] recommendations but also to include a summary of of the discussion um in the
[48:59] minutes for minutes there's no minutes anymore basically if you read this as is

[49:11] so that people can understand how we made these decisions that's been a normal practice I don't know for we sure

[50:41] out of the association in Minnesota counties this is one of their U best practice initiatives that they're
[50:46] putting forward it was presented at the county administrative heers conference and um presented by Julie ring as a
[50:53] method of moving forward staff has looked at different various minutes across different boards um I've spoken
[51:00] with Bruce messel the administrator for Sherburn County and they he indicated to me their minutes simply reflect the
[51:06] motion and vote that's all that they state in their minutes because they believe that people that the verbum
[51:11] record is on YouTube it's online if you want to see what happened the verbatim record is online um I didn't want to go
[51:17] that far in making a recommendation for the full board because I believe we still need minutes here at the board but
[51:23] we were looking at incrementally instituting this best practice as recommended by AMC um at least at the
[51:31] committee level and um seeing how it works at least for a little while and we can always change it
[51:37] back I disagree I disagree we need to be as transparent as possible government
[51:42] entities only consist because we tax tax taxpayers and they should know exactly
[51:47] what we're doing in our discussions and how we make decisions Mr chair yes thank you well I
[51:54] looked at the meeting minutes and what led up to this and I it was like a piece of Swiss cheese of course there was just
[52:01] nothing there it looks like it that that idea got test fired before it got approved because the version of the
[52:07] minutes from your ways and means doesn't include who said anything about anything
[52:13] and it kind of put the cart before the horse it got test fired here and there's really nothing to tell
[52:19] me now administrator craer chimed in that AMC thinks it's the best practice
[52:25] and someone else thought it was a good idea and we're bringing up verbatim which we've never done but I'm going to
[52:31] use this example for about two years I've been asking for uh when is the next
[52:37] Personnel commit committee meeting can I see the agenda I've been told finally after many discussions apparently on
[52:43] third floor yes you can see it still still not seeing it not seeing an agenda
[52:49] now you want to present just some recommendations out of that unknown
[52:55] meeting agenda and meeting date and time and and then we can't see who said what
[53:00] it it almost looks like somebody's afraid of who might see them who said what and if that's the case that there's
[53:07] a fear from that side of the room or this side of the room then we have a different problem that's kind of what it
[53:12] suggests that somebody doesn't think they can speak freely so with my experience on just that Personnel deal
[53:19] that it seems like then if we try and recreate that committee up here to for
[53:25] the people that weren't present because there's only two Commissioners that are at these offshoot meetings then we're
[53:30] going to have board members speaking for people that aren't here that aren't going to come up and speak what they had
[53:37] to say um I I'm not in favor for those reasons for my experience with Personnel
[53:43] that there's been shade cast on that I'm not giv the information and I'm not given uh the same opportunity even less
[53:51] now because I can't see who said what now I know the chair can give some discretion where some of this could be
[53:58] redundant because I might ask a question that was already discussed and asked and answered right but I'm not going to know
[54:04] that because it's not in writing could could make for longer discussions could could be more contentious like Mr chair
[54:11] wants to avoid I I'm not U Connecting the Dots here to to go with this I I
[54:17] wasn't there it's not in writing who said what so I I'm not in on board with
[54:22] it right now and what I'm I'm posing on this is that there is about another I
[54:30] I'm not going to call it minutes I'm going to call it a memo of information that that that Recaps the information
[54:36] that was presented and the points of interest so that there is some
[54:42] information that goes with the recommendation I mean when I say I mean EI that you can call it summary minutes
[54:48] I'm I'm not going to say verbatim minutes because we we haven't done that and I'm we're not going to begin that practice nobody's asking that no
[54:57] so so looking at the the Ways and Means Committee that that I feel like has a
[55:05] lot of information what more would we want to have in there because then it gets to be so onerous that and in the
[55:12] past when I've asked for uh hey can you find the minutes that said this you know
[55:18] back 10 years ago nobody could bring out any information I feel like this is more
[55:24] streamlining like hey here it was dis discussed you know so the we know that
[55:30] it's been touched by the Commissioners uh and then it'll be broadened out to
[55:35] the Commissioners because of course we can't we can't talk all together until
[55:40] we're in this big room but it does say the high the high points of this so that
[55:46] at least in a word search we can say okay they talked about this they talked
[55:51] about this and and uh at least we knew it was talked about then so and then
[55:59] from a broader sense the chair is then going to bring out and and talk with the
[56:06] Commissioners that weren't there to if they have any questions is that am I getting that right Mr chair can I speak
[56:12] to that there's no there's no discussion points in there those are just the items that you discussed that is just that's
[56:18] just the agenda and Mr chair that what you're bringing up now is kind of after the
[56:24] fact to say there's going to be a memo coming later that's not part of this either that's where we're saying we
[56:30] could quantify that in there do you want to quantify that I think that's I think we're going round about to the same thing I think if you want to quantify
[56:36] whether you want to say that there will be a summary minutes or a memo of information uh along with the
[56:42] recommendations that's my motion that's my motion that's what I had said so
[56:48] summary so more so than this yes more summary than this yes Mr chair I think
[56:54] are you talking about something that would only be released to Commissioners in this
[56:59] memo what I'm hearing is a a public minute summary is what commissioner
[57:05] dedri wants but you're talking about a memo that would just go out to Commissioners is that right the so the what I would be proposing is well you
[57:12] can do it one of two ways because we're trying to because what I'm trying to stop doing is asking three people to
[57:19] vote on minutes that they weren't even that one of the person may potentially two people or sometimes three weren't
[57:25] even at that meeting so it's it to me it's it's awkward to approve minutes when you don't even know whether any of the information was factual or not
[57:33] factual so I'm saying okay let's change it to a memo of information that would be sent to the Commissioners after this
[57:41] uh committee meeting uh letting them know that here's what the information that was presented and here's what their
[57:47] recommendations and that would be included as part of the agenda packet but it wouldn't be minutes that are approved because as you know if you
[57:53] weren't part of a Personnel committee approving minutes that weren't part of is awkward I would say because you don't
[57:59] know whether that is factual or not factual but Mr chair all of these things that come before us we have to trust
[58:05] that they're putting the information out that is truthful and honest and transparent and has been discussed this
[58:10] is not something new I would like that summary minutes or memo whatever you
[58:16] want to call it included in the document that gets presented to the board as part
[58:21] of saying that I'm just saying we just would't be proving them as separate not separate to someone to said it it would
[58:26] be included with what is put forward to the board and that was what I just said
[58:32] that it would be in theend I'm just saying that it wouldn't be approved as you wouldn't be approving the minutes
[58:38] but as far as the recommendations so right above here you would have the the
[58:43] memo of information with the recommendations below it in as part of the agenda but you wouldn't be in the
[58:50] front side of the agenda as you see here you have to approve the committee of the uh ways committee minutes which there's
[58:58] no minutes in it that's just an agenda with a recommendation there's no minutes at all there's nothing it's a feudal
[59:03] exercise that I'm trying to get no that that is we've never had that before we've always had a summary included with
[59:08] it so this test drive as commissioner katchmark is saying was already put forward Mr chair can I call the question

[59:21] called so at this time we have a motion by commissioner Dietrich to approve the
[59:26] the or I got to make sure I restate this right is to uh modify the recommendation for
[59:35] committee um M that's what they're called they're called minutes they're called minutes but uh so to approve
[59:42] minutes and as part of the recommendations for the said committees
[59:47] within the commissioner handbook you know was second by commissioner catchmark and with no discussion
[59:53] questions called all in favor say I hi Mr chair I'm not clear on and if you're

[1:01:26] this is clear right now you need to be clear with the motion
[1:01:32] so we have two options so we have the motion we have a second and at this point uh they're looking to move forward
[1:01:39] with adding minutes to the recommendations to the committies in the handbook all in favor say I I oppose

[1:02:10] best practices for AMC recommendation so that there's still a memor of
[1:02:15] understanding to what came forth of the committee so that we do know all the

[1:03:26] to have minus Personnel because we can't have any of those discussions as the big
[1:03:32] room in the big room all these discussions will be put forth in a
[1:03:38] workshop so that we will have transparency or a board meeting is am I
[1:03:43] correct at that that wouldn't necessarily always be the case uh these Ways and Means recommendations were not
[1:03:50] ones that came forward within a workshop sometimes they do some sometimes they do sometimes they don't depends on the
[1:03:56] timeliness of it with us having workshops on once a month uh but the committee members are always welcome to
[1:04:02] refer uh any items that they have within it to if they think it's contentious to
[1:04:07] a workshop or to a committee of the whole uh which has happened historically uh but a lot of these ones are not
[1:04:15] necessarily controversial ones and we we we try to make sure that these recommendations are if they are
[1:04:20] controversial ones that they would go to uh a a venue of that sort but uh Mr
[1:04:27] chair if I could just add to commissioner Holland's statement and anything that comes out of committee or Workshop has to come before the board
[1:04:32] for approval yes everything does have to come into this room for approval those committees are not a final
[1:04:38] decision-making body and that's what I was getting at we there will be transparency because it will be listed
[1:04:45] and we can have a discussion at the big table or in the workshop and if and in situations like this they could always
[1:04:51] refer these back to a committee the whole if board members that were in the ways and means did not like the
[1:04:58] recommendation that came out of it if there was three board members or more that would want to refer it out to a
[1:05:03] committee of the whole to uh discuss it in a moral thorough fashion they absolutely can that is always at their
[1:05:11] Liberty so Mr chair just to clarify and make sure this is the correct motion
[1:05:16] it's in it's including a memo that summarizes what was discussed the
[1:05:23] attendees and the recommendation that's what we're moving forward with
[1:05:28] correct I'm looking for the motion maker for clarification and the second

[1:05:41] recommendations there would also be a paragraph up here that would State uh what was presented and who is in

[1:07:15] handbook being fluid and needing to adopt uh changing environments based on practices within the state and the state
[1:07:22] statute and making sure that we are uh in compliance yes Mr chair uh what you see before you in these policy changes
[1:07:29] as a direct result of I'm probably kind of cut the pages short but the 1600 page
[1:07:34] Omnibus Bill that was passed on the last five minutes of the last legislative session so um trying to incorporate all
[1:07:42] the paid sick changes all the earned safe and sick time changes trying to get everything in line with what the state
[1:07:49] has mandated that we do by January 1st I'll make a motion to approve

[1:08:15] information from our quarterly investment which was informational ownly we had the Minnesota inter counties
[1:08:21] Association membership uh the consensus to move forward with uh uh preparing a financial package for
[1:08:27] membership for Micah uh the discussion on the federal lobbyist and the recommendation on that uh we had the FBI
[1:08:35] request for extension uh which was rescheduled and we had the cmrp uh
[1:08:41] update which was informational only which we really didn't get a chance to get into which uh we'll do it a later
[1:08:47] date and the fair board uh clarification of their
[1:08:53] audit and and with that I'll stand for a motion to approve the workshop uh
