[0:00] [Music] [0:30] I call to order the January 9th 2025 [0:32] Planning Commission meeting please join [0:34] me in the flag [0:53] pledge Miss Erikson will you please do a [0:57] um roll call of members [1:06] here [1:09] here here draus here M here all right [1:14] agenda item number three approval of [1:16] minutes so November 7th 2024 Planning [1:19] Commission meeting minutes and December [1:21] 5th 2024 Planning Commission work [1:23] session minutes fellow Commissioners any [1:27] changes all right then the minutes will [1:29] stand [1:31] um Miss Jensen any [1:35] announcements uh only that if these [1:37] aren't if these items are not table they [1:39] will move forward to the January 21st [1:42] city council meeting right thank you all [1:45] right agenda item number five the [1:47] Kenrick Corner second edition this is a [1:50] public hearing to consider the [1:51] application of mezen brink construction [1:54] and Engineering for the preliminary plot [1:57] of one commercial lot to be known as [1:59] Kenrick corner second edition and the [2:01] vacation of public drainage and utility [2:03] easement located north of 205th Street [2:06] and East of Kenrick [2:10] Avenue sorry I'm taking a look to see [2:13] who I [2:21] have is there anyone here to for that [2:24] project I don't have oh I do I'm so [2:26] sorry [2:28] Jennifer e [3:06] hi hi good evening um members of the [3:09] commission it's very nice to be with you [3:11] this evening I have no idea what was [3:12] said before I walked in anything very [3:15] short okay uh so my name is Jennifer has [3:18] Camp uh I am the owner of Camp real [3:20] estate and development I work with mess [3:22] and Brink construction and Engineering [3:24] who is the applicant this evening uh [3:26] they are proposing to essentially plat [3:30] and Outlaw for purposes of building and [3:33] developing a uh multi-tenant commercial [3:36] retail space so the property is about [3:40] 1.6 acres uh the land use and the and [3:43] the zoning are both commercial so from [3:45] that perspective what they are proposing [3:47] to do is consistent uh with what the [3:50] current guiding and Zoning is for the [3:51] property uh it was an outlaw that was [3:54] the subject of a uh development [3:57] agreement uh and a master planned area [3:59] prior it never got built on never was [4:02] constructed uh there were some [4:04] improvements that were made uh primarily [4:06] landscape buffering that was required as [4:09] part of that initial uh [4:12] process those trees are actually mature [4:14] at this point which is great uh we [4:16] intend to keep the majority of those and [4:17] then add to it so uh the project itself [4:22] is about a 9600 square foot building uh [4:25] we are proposing at this time that there [4:26] would be two users so they would [4:28] essentially be on either end of the [4:30] project uh each of them would have their [4:33] own um parking lot associated with them [4:35] as well although obviously overflow uh [4:38] could go in either you can tell uh the [4:41] parking lot on what would be the East is [4:45] a slightly larger parking lot uh because [4:48] that tenant space is proposed to be [4:49] slightly larger um so with that um let's [4:53] see [4:55] here we skipped really quickly [5:00] uh from a a construction building [5:02] perspective I think that it fits uh the [5:05] character that is uh in the city of [5:08] Lakeville today uh especially with some [5:10] of your newer uh retail commercial [5:12] spaces uh the majority of it is pro [5:14] proposed to be a black brick uh [5:17] construction material consistent with [5:18] your material requirements um and so uh [5:22] M and Brink uh does quite a bit of [5:25] development in this area uh and so [5:28] obviously we've designed some something [5:30] that hopefully fits within what you were [5:32] hoping would be here so um for [5:35] that very short and sweet um and I'm [5:40] just glad I kind of made it was close so [5:43] close thank you so anyway with that I [5:46] will turn it back over thank you thank [5:52] you good evening [5:57] Commissioners Jack can I get my [5:59] PowerPoint [6:03] no not that [6:14] one oh you're fine [6:33] thank [6:34] you all right so this is the Kenrick [6:37] Corner second edition it's a preliminary [6:39] pla in easement [6:42] vacation uh it is located north of 205th [6:45] Street uh east of Kenrick Avenue if [6:48] you're familiar with the Porter House [6:49] Restaurant it is just North of that [6:54] location uh here's the Zoning for the [6:56] area it's pretty much just uh C3 [6:59] commercial the town homes to the north [7:01] are the [7:03] rm2 uh medium density Town Homes [7:07] there uh this is the preliminary plant [7:10] it's a very simple it's currently an [7:12] outlaw it's being replatted just as a [7:15] single lot so not a lot of change on [7:18] that [7:19] one uh they are doing an easement [7:21] vacation the when the original uh [7:24] Kenrick Corner plat was recorded it [7:27] included drainage and utility easement [7:28] on the outlet lot uh in order to keep [7:31] the title clean as we record the new [7:34] plat we're having them vacate this [7:36] easement and they will be rededicated [7:38] with the final plat so there's no change [7:40] in easement [7:43] there uh site plan Miss has Camp kind of [7:46] reviewed that um dual uh multi-tenant [7:52] commercial building parking lot on [7:53] either side uh buffering Landscaping to [7:57] the north fairly straightforward access [7:59] off of the private Drive um and there [8:01] will not be access from Kenrick [8:04] Avenue uh grading plan uh as you can see [8:08] there's they are not getting into the [8:11] existing uh burm and buffer to the north [8:14] um which helps buffer the view to those [8:16] Town Homes to the [8:17] north uh this is the landscape plan they [8:20] do have plantings along the parking lot [8:23] uh the foundation of the building on the [8:25] side additional plantings here and then [8:27] here are some of the additional trees [8:30] that they are adding just to help fill [8:31] in some of those gaps uh for [8:35] those um as has Camp showed the building [8:37] elevations talked about the materials um [8:40] they do meet the exterior material cor [8:42] requirements with 65% brick and windows [8:46] on the site which is the grade A [8:49] materials uh and then this is just the [8:51] floor plan for retail and then the [8:55] wellness clinic [8:56] there um I did have one other item I [8:59] wanted to mention the site does not show [9:03] um a trash enclosure at this point if [9:06] they are going to have an exterior one [9:07] they need to update the plans to include [9:10] that information otherwise if it's being [9:12] handled interior then no additional [9:13] changes are needed um if the Planning [9:16] Commission chooses to recommend approval [9:19] of the preliminary plat for Kenrick [9:21] Corner second edition and the easan [9:23] vacation staff does recommend it be [9:25] subject to the six stipulations listed [9:27] in the December 13th report and I will [9:29] stand for any questions you may have [9:32] thank [9:33] you and this is a public hearing so [9:35] anyone wishing to speak on the public [9:38] hearing can please come [9:43] forward Madam chair yes motion to close [9:46] the public hearing second all right I [9:48] have a motion and a second to close the [9:50] public hearing all those in favor of [9:51] closing the hearing signify by saying I [9:55] I I all opposed all right the public [9:57] hearing is now closed uh fellow [10:00] Commissioners any [10:01] [Music] [10:03] questions Madam chair yes um are there [10:06] uh are there tenants identified yet of [10:09] of either of these two [10:14] spaces Madam chair members of the [10:16] commission so I don't believe that uh [10:19] the actual leases have been signed but [10:21] there are two tenants that they are in [10:23] discussion with um and so hopefully it [10:25] will be fully occupied once constructed [10:29] great thank [10:33] you any [10:35] additional [10:40] comments Madam chair yes uh I motion to [10:44] recommend approval of the Kenrick Corner [10:46] second edition preliminary PL and [10:48] easement vacation subject to the six [10:50] stipulations listed on the December 13 [10:52] 2024 planning [10:55] report second I have a motion and a [10:58] second Miss Ericson we please take a [10:59] roll call [11:02] vote [11:03] i [11:05] i [11:07] i i [11:10] i all right thank you um good luck on [11:14] your project and it looks like this one [11:16] would go to City Council on January 21st [11:19] that is correct thank [11:21] you all right agenda item number six [11:25] this is the city of Lakeville this is a [11:26] public hearing to consider amendments to [11:28] Title 11 zoning of the city [11:31] code and we have Tina good evening um so [11:36] during the summer we've did quite a few [11:39] zoning updates and then we discovered a [11:41] few more and then we also had a work [11:42] session and talked um primarily about [11:45] parking ordinance and some changes that [11:46] we wanted to make that would better [11:48] align market conditions or Market needs [11:51] for parking for different uses so I'm [11:53] just going to go quickly through the [11:55] staff memo um you received that um the [11:58] ordinances and in front of you um in [12:00] your packet or on your device um again [12:03] anything that is underlined is proposed [12:05] as new text anything that is stricken [12:07] out is proposed to be removed sometimes [12:10] you'll see sections stried and then [12:13] moved um for just realignment um so it's [12:16] not always just new text um so just a [12:19] quick summary um in the definition [12:21] section we're proposing adding a [12:23] definition for commercial recreation [12:25] facilities as one does not exist and [12:27] this is a use that specifically ly [12:29] allowed um in certain industrial [12:31] districts we're proposing adding it to [12:33] another one and it is defin definitely [12:36] definitely different than what you would [12:37] think of as a commercial um Athletic [12:39] Club like a lifetime so we wanted to [12:41] make sure that definition was created [12:44] then within the parking section which is [12:45] the bulk of this update um we went [12:47] through and identified certain uses and [12:49] adjusted the parking accordingly um [12:51] based on our own research um input from [12:54] our um planning um consultant Dan lick [12:58] um as well as just understanding what [13:00] we're seeing in the market um what the [13:03] demand has been um and trying to adjust [13:05] to that coordinately so that's the bulk [13:07] of the [13:07] changes and then um we had some [13:10] amendments to the sign code um we have [13:13] some major Parks um and wonder [13:15] facilities being created in the city of [13:17] Lakeville and they have a need for [13:18] additional signage both from just a [13:21] standpoint of helping people get to and [13:24] understand where these facilities are [13:25] located but also for sponsorship reasons [13:28] so we need a little bit bit more signage [13:29] allowed um so specifically um we want to [13:33] add freestanding signage um in the Grand [13:36] Prairie Park as well as additional wall [13:38] signage for the permanent Pavilion at [13:41] the new uh the new permanent Pavilion at [13:43] the H Arena as well as in the Grand [13:46] Prairie um um Park so the Grand Prairie [13:50] is looking for a second Monument sign [13:53] there's one that will be located on [13:55] Cedar Avenue and they are looking for a [13:57] second one to be positioned on Hamburg [13:58] Avenue [13:59] um that one doesn't meet the letter of [14:02] the law because it's not on a major [14:05] collector or arterial street so we want [14:07] to create an exception because it's a [14:09] community park um we feel that kind of [14:12] Park is deemed um is warranted really [14:14] for having that additional signage and [14:17] then additional wall signage is proposed [14:19] again on um the new Pavilion and then on [14:22] the Grand Prairie um grand stand so that [14:26] new baseball grand stand so hopefully [14:28] you've all seen I was looking for one [14:30] today to throw up on the screen I didn't [14:31] find one late this afternoon but [14:33] hopefully you've all visualized that [14:35] Park and there's a um major grand stand [14:38] and on the South Wall of that they want [14:39] to have the sign for that as well as the [14:42] sponsorship so we believe all of that is [14:44] reasonable and we made these exceptions [14:47] specifically to community parks and the [14:49] special use [14:50] Parks then within the M2 mixed juice um [14:54] Cedar Corridor District um we found a [14:57] discrepancy um this ordinance allows for [15:00] multif family with a conditional use and [15:02] then it has certain standards one of [15:03] which is a standard for um area the area [15:08] requirement and so right now it reads at [15:11] 1,675 Square ft um per unit which meets [15:15] the low density for that range but the [15:18] comp plan for this um zoning area or the [15:22] land use that this zoning area falls [15:24] under um stipulates between 26 and 40 [15:27] units so we need to address [15:29] that range so we're proposing changing [15:31] that 1675 to 1100 to meet the [15:34] comprehensive [15:36] plan um within the i1 light industrial [15:39] conditional uses um we received a couple [15:41] of inquiries to allow um limited outdoor [15:45] storage for auto repair uses right now [15:48] that use is allowed as a conditional use [15:50] but all the vehicles have to be stored [15:52] inside so the amendment includes quite a [15:54] few conditions to really limit this but [15:56] to allow some outdoor storage provided [15:59] it's not visible from a principal [16:02] arterial provided that it's not more [16:04] than 20% or 10,000 square ft of the lot [16:07] area screened and so forth so we think [16:10] those are enough um conditions to allow [16:14] that but on a very restricted basis in [16:16] the i1 again as a conditional use and [16:20] then in the I2 section for conditional [16:22] uses we're proposing adding that [16:24] commercial recreation facilities this is [16:26] something that we allow as a conditional [16:28] use in the i1 District we've received [16:30] some inquiries in the I2 we've kind of [16:33] held off but we do have some older [16:35] buildings that could benefit from this [16:36] change and so we're at asking to add [16:39] that with the same standards that are in [16:41] the i1 so both those districts have that [16:44] flexibility and then finally in the [16:46] administr in the I3 under administrative [16:49] uses um the Mac has submitted building [16:51] permit plans for a remodel for their [16:55] Maintenance building so if you've not [16:56] been to the airport um where the flight [17:00] school is located there's a maintenance [17:01] building the remodeling that and they [17:03] need to create a sleeping quarter so we [17:05] have snow events um the max staff is [17:08] able to stay overnight and so that's [17:10] technically not allowed currently in the [17:12] ordinance so we need to add that [17:14] provision to the ordinance so that about [17:17] sums up what is included in this um [17:20] again this kind of ends the 20204 zoning [17:23] updates staff apologizes that it took so [17:26] long but we've been quite busy in our [17:28] office um we're need to get ready for [17:30] the 2025 update um but if you have any [17:33] questions I would be happy to answer [17:35] them thank [17:37] you and this is a public hearing so [17:40] anyone wishing to speak on this agenda [17:42] item can please come [17:51] forward mam chair yes motion to close [17:54] the public [17:56] hearing second all right I have a motion [17:58] in a second to close the public hearing [18:00] all those in favor please say I I all [18:03] opposed all right the public hearing is [18:05] now [18:07] closed H [18:09] commissioner um good road uh just for [18:12] the public can you kind of like outline [18:15] what some examples of the commercial [18:17] recreation facilities might be yes so [18:20] some of the um we've received some um [18:24] proposals for indoor playgrounds um [18:26] indoor pickle ball courts um there could [18:29] be an indoor any kind of indoor um [18:32] training facility for um Sports so youth [18:35] or adult um there's facilities across [18:38] the cities that are geared solely to [18:40] baseball or solely to hockey um so it's [18:43] really focused around those kinds of [18:46] uses and [18:47] amenities great thank [18:49] you just oh you continue well yeah um [18:53] just I think that all these changes are [18:56] great I'm supportive of them all um I am [18:59] especially kind of excited about that [19:00] one I hope that we do get more uh uh [19:05] people wanting to come in and uh develop [19:07] that stuff I know there's definitely a [19:10] um desire amongst members of the [19:12] community that I've talked to for more [19:15] indoor options during the winter [19:16] especially for for young children so [19:19] thanks to the staff for all their work [19:21] on [19:24] this any additional questions comments [19:28] that looks like we're ready for a [19:31] motion make a motion to recommend [19:34] approval of the amendments to Title 11 [19:36] of the zoning ordinance of the city [19:40] code second I have a motion on a second [19:43] Miss ericon we please take a roll call [19:46] vote [19:48] i [19:49] i i i [19:54] i and this goes to city council too [19:57] right January 21st all right awesome all [20:01] right agenda item number seven we have [20:04] some very special guests with us tonight [20:07] um we were not able to have the Planning [20:09] Commission have an opportunity to [20:11] celebrate the retirement of Frank [20:12] Dempsey so he is here come on up Frank [20:16] and we have [20:19] um here um and we've asked Daryl to make [20:23] some comments um on behalf of Staff in [20:26] the city and then um welcome any of you [20:29] to to make any comments that you would [20:30] wish and then on your screen is a map [20:34] that Chris um prepared along with our [20:37] GIS team to represent all of the [20:41] projects across the city that Frank [20:44] touched um it's overwhelming the amount [20:47] of impact that he's had on this city [20:49] that we all love um I think Daryl can [20:52] probably jump into this and explain this [20:53] map a little bit more but um we are [20:56] thrilled with um all the contributions [20:59] that Frank um provided over his 35 plus [21:02] years thank [21:10] you [21:13] oversight good evening uh it's good to [21:16] be back not as a staff person but as a [21:19] former staff person for the new uh [21:22] Planning Commission member and I use the [21:23] term new Loosely new to me uh I'm Daryl [21:27] Mur I am the former planning director [21:29] and I worked for the city for 35 years [21:33] 30 of which were with Frank and so I [21:36] just wanted to say a couple things I'm [21:37] going to keep it short I'm sure all [21:39] these folks over here will be glad to [21:40] hear that but uh it was a pleasure [21:44] working with Frank for all those years [21:46] uh I thought of three words that [21:49] described Frank during his tenure here [21:52] uh on my way in and they are dedicated [21:56] hardworking and patient especially [21:59] patient Frank dealt with so many people [22:03] that had problems or complaints or [22:06] issues or didn't agree with the [22:08] ordinance or didn't agree with staff and [22:11] he was immensely patient with those [22:13] folks and as his supervisor for all [22:16] those years I am forever grateful for [22:19] that he did a great job city is losing a [22:22] lot of institutional knowledge with [22:24] Frank uh retirement I know these guys [22:27] can to ATT test attest to that as well [22:30] so uh we worked together really hard I [22:34] think what we did here I'm very proud of [22:36] the work we did together and I'm sure [22:38] Frank is as well uh we had a lot of [22:41] hundreds of Planning Commission meetings [22:43] public hearings the time when there was [22:47] five or six public hearings on an agenda [22:49] and it was basically just he and I [22:51] making the staff reports and [22:53] presentations and we survived it and I [22:55] think the city has turned out really [22:57] well so I'm very proud of the work we [22:59] did I was very happy to work with Frank [23:02] and even though I'm not his boss or a [23:04] coworker anymore I'm still Frank's [23:06] friend and I'm very happy for his [23:08] retirement welld deserved thank you [23:10] Frank [23:14] [Applause] [23:30] got it getting out of bed I'm serious [23:32] and it happened yesterday but it goes [23:35] away rather quick any I didn't expect [23:37] this it's nice to see it you know this [23:39] chance to to see everybody again and I [23:43] really didn't maybe it's good that I [23:44] didn't have any prep preparation to [23:46] share my thoughts but Daryl kind of [23:49] mentioned a little bit what My [23:51] Philosophy was and I I do I always [23:54] enjoyed and I guess I do take pride [23:56] in working with in difficult situations [24:00] with people that are difficult in terms [24:03] of um have expectations or trying to [24:06] understand how things are planned and [24:08] this is a growing city it has been the [24:10] whole time I've been here and I I always [24:13] went out of my way to uh you educate [24:16] people on what we do the purpose of the [24:18] of planning and in today's you know [24:21] epidemic world we live in with [24:22] misinformation and how things are done [24:25] and very strong opinions I always try to [24:27] get people people to understand the role [24:30] of things and I do take some pride in in [24:33] um bringing people along um different [24:36] parts of the city neighborhoods people [24:37] that were willing to learn be involved [24:40] and understand um and so that as darl [24:44] always said we work for good outcomes [24:45] and involving people not ignoring them [24:48] not returning calls not returning emails [24:50] was something that we never [24:52] did um and I got to tell you when I've [24:55] had dealings with other with other [24:57] cities that's not all always the case [24:59] you know sure we're always busy and [25:00] they're busy too but we always made an [25:02] effort to make sure people are heard [25:04] your calls are returned and so that's I [25:07] hope that's sort of the Legacy I left [25:09] with the Department is um is is is [25:13] making sure the public understood that [25:15] we're working on their behalf and it's [25:16] important that they're involved so [25:20] anyway thank you it's been really nice [25:22] working with everybody every one of you [25:24] and I [25:24] know planning Commissioners over the [25:27] years through neighborhood interest [25:30] situations land use questions projects [25:33] building additions all that kind of [25:34] thing that goes from the neighbor the [25:36] the mayor on down you know the um [25:39] different project they've worked on and [25:41] I was like that never know what's going [25:42] to happen when you walk in one day and [25:44] what your job's [25:45] gonna be dealing with thank you [25:48] everybody [25:52] [Applause] [25:58] anyone [26:07] else well I do um agree with the patient [26:11] part I feel like you're always very [26:12] patient with all of my questions and I [26:14] really appreciate that [26:16] so um sad that you're [26:19] leaving sad that you left it's all [26:23] changing I guess that happens um but I [26:26] think that's it unless anyone has [26:28] anything else they'd like to add no all [26:31] right then the meeting is adjourned [26:47] [Music]
