All right, moving on to our uh agenda items for this evening. It looks like we have um one public hearing, two public hearings tonight. The first one is uh we have an applicant that is requesting approvals necessary to redevelop the northern portion of the parking lot at 11609 Leona Road. A new driveway drive-thru Shake Shack is proposed to be constructed in the northwest corner of the site and a new Valvoline Instant Oil Change is proposed to be constructed in the northeast corner of the site. The developer is proposing to plat so each building is contained on its own parcel. The proposed PUD requires waivers for front yard setbacks, side yard setbacks, sign area and a sign setback. All right, we have an applicant who will give us an overview and then we'll have staff and have the public hearing. Go ahead if you could state your name and address for the record, please. >> Good evening. My name is Gary Dreyer. My address is 200 Southdale Center, Edina. Um thank you very much, Madam Chair, members of the Planning Commission. We're delighted to be here today. Um as you all know, the initial stage of the redevelopment of the site took place in 2024 with the partial demolition of the old Office Depot. So what we're in front of you today for is the completion of the project. Uh as indicated, uh including Shake Shack and Valvoline. >> The um as you know, the the project's located at 11609 Leona Road. Um and uh as indicated, the Planet Fitness opened in 2025. We at that time had approvals also for a Starbucks where the Shake Shack now is located. Unfortunately, uh due to cost overruns, um that fully negotiated agreement went away. Um but we're delighted to have Shake Shack. they're a great tenant, obviously a great national name, uh, and a uh, great amenity for the project. So, here's the past condition. As you could see, the the Office Depot pretty run-down when we bought it, but we knew it was going to be a redevelopment opportunity. This is the current existing condition. So, in as indicated, the building the Office Depot building was 31,000 sq ft. We demolished about 12,000 sq ft of it. The parking lot to the east was completed in that first phase. Um, so now we're just focusing again on the north side of the site. The again in these, uh, aerials, you can see the parking lot on the, um, on the left photo has been completed. The the new access drive off of Den has been completed. Um, and now we move to the final phase. So, this shows the site plan indicates the area where the actual construction will take place. So, that's what you see as, you know, on the dotted lines. Um, again, as we indicated, the east-west access road off of Den, uh, was completed in the past. And then there's currently a curb cut on Den Road north, uh, almost to Leona, which will be shut down. So, really, I think a huge benefit with circulation through this parking lot. As we all know, it's right now it's, uh, it's it's kind of confusing to to maneuver through. Um, you have in your packet, too, these, uh, elevations. Um, we worked with staff, the tenants worked with staff to, um, come up with design that integrated in with the current buildings. So, the materials are consistent, uh, for all three. A little, you know, each are a little different, but we we like a little differentiation in trade dress. So, it was a good process working with staff. Here are the renderings of Shake Shack. Again, the the brick the dark brick will match and the wainscot on the bottom will match um the Planet Fitness building. And uh then you can see kind of a lighter brick and trade dress. Very nice building. And here's Valvoline. Pretty straightforward, but again same materials throughout. Renderings. So, from the standpoint of the overall project, you know, it's a hugely uh beneficial project, I think, to us as owners and to the city as well. We uh put in a large amount. We had to redo the the watershed out of requirement to redo the ponding and we did some underground ponding, you know, at a at a substantial cost. But but it really purified the water coming off the site and, you know, brought it to a very high standard. Um as you saw before with the site plan, you know, now where we have the access off of Leona, there's a sidewalk that's going to come all the way up to Planet Fitness and tie in with the other uh with the other uh uses. So, much better connectivity. That's east-west drive is a big uh you know, big improvement. Really, I think you can see it just improves the circulation, makes it intuitive when people come on the site. Um enhanced landscaping. Uh Shake Shack will have a couple of EV charging stations. Uh as we indicated uh using uh reusing material, uh especially in the signage. And then um reduction of impervious uh surface. So, there's more green space than in the past from a percentage standpoint. So, that's That's it for us. I'm happy to answer any questions. We also have our civil engineer here if there's any specific questions uh, that are above my pay grade. >> Thank you very much. Any questions from the commissioners for the applicant? Otherwise, I'll turn it over to Jeremy for a staff report. >> Madam Chair, yeah. Sorry, just a quick question uh, about the uh, Valvoline project. What's the purpose of the easternmost driveway parallel to Den Road? >> It's It's a basically a service drive. So, the nice thing about Valvoline now is that they um, they have trucks that come in and actually kind of hook their hoses, if you will, to the building and take out all of the dirty solvents and and oil, etc. So, that's really all it's used for. Secondarily, you know, it could be used as for a bypass if people, you know, decided not to wait. >> Okay. Just wanted to make sure. >> Very Very minimal use. >> Yeah. >> Yeah. >> Okay, thank you. >> You bet. >> Anyone else? Go ahead, Jeremy. I assume you'll walk us through the waivers as well. >> Yes. I think Thank you, Chair Commissioners. Um, as you described, there are four uh, entitlement requests or applications to be reviewed tonight. Um, all part of this project. Um, they're requesting a PUD concept review, PUD district uh, review with waivers, uh, a preliminary plat to create the three lots and the outlot, and then site plan review. There is no zone change, there's no comp plan amendment. We see those often, but not in this situation. The developer did mention the proposed Shake Shack in the north uh, northwest corner, and then the Valvoline in the northeast corner, and then the third lot will be the existing Planet Fitness building uh, that was improved a couple years ago. The waivers are requested are the front yard setback waivers for both the Shake Shack and the Valvoline site. The Shake Shack is proposing an 18 and 1/2 ft um setback off of Leona Road where 35 ft is required. And then uh the Valvoline is looking at a 21.3 ft setback off of Den Road where 35 ft is required. Um staff can support these uh front yard setback waivers because what they do is they kind of bring the buildings closer to the the outside property lines and then allowing additional parking internal to the site. So, they kind of create an edge uh where those buildings are located and then the internal kind of network and circulation provides the circulation and the parking for that area. So, the waivers for front yard setback uh were just described there. In terms of sign of waivers, there's an existing sign at the northwest corner of the property. Um they are going to uh reuse uh much of that sign base, but they would like to enlarge the sign area. Um kind of does a couple things. One, the the sign base is is located in the the required front yard setback of of 15 ft. They're asking for a waiver to 10 and 1/2 ft. Um and then uh what they're proposing to do also is combine two of the freestanding signs that would be allowed in this development and put all that signage into one freestanding sign at the corner. Very prominent corner off of Flying Cloud Drive and Leona Road. A lot of unfortunately a lot of folks sitting at that stoplight waiting for the light to change. We'll get some good visibility there. They're looking to consolidate the signage onto this location or two other signage in this location. With a really a four lot subdivision in this area, there's opportunity for many more freestanding signs and they're choosing to consolidate uh existing signs um or permitted permissible signs into one kind of facility so that staff can support that to try to avoid a sign proliferation issue cuz you could dot a lot of signage in this area uh without the waiver. And the sign size issue uh again uh a sign or excuse me a a lot with a lot on a corner um with you know two street frontages could have two freestanding signs. And so they could have two, one at 80 square feet and the other at 36. They're combining those again, same size just in one location. And the sign setback off of Leon Road, we can support that because using the existing materials, the sign that's there has kind of two legs um with uh the sign which kind of um sign copy kind of above. The alternative would be one big solid which would create quite a bit of mass and maybe detrimental from a from a view perspective and so we see that opening in the existing sign base is advantageous to reuse that um based on the kind of character of this of this development. So staff can support that. Um uh those two sign waivers. Should also point out that this sign that's there has a already an agreement with the Qdoba and the Caribou lot that they can have signage on that lot. So we'll work into the development agreement as part of the PUD that the sign that's on the corner that's on the Shake Shack lot can also advertise for the Planet Fitness and for the Valvoline again to address a sign proliferation uh concern. Um during the review of the project Excuse me, um there was quite a bit of work on kind of access and parking and circulation and make sure of all that worked. Um and the developer working with staff um proposes to shift the uh the driveway off of Leona Road and I have this the the the site plan on the screen or will shortly here. Um the driveway off of Leona Road will shift to the east to provide the Shake Shack lot to be a little bit bigger than what the existing driveway allows. So, basically what that does is shifts the driveway to the east enlarges the Shake Shack lot so that Shake Shack can meet all of its parking requirements on site. Uh same thing with the Valvoline. The Valvoline can meet all of the parking requirements on their lot. So, no parking waivers are requested or required. Uh the uh Planet Fitness site does exceed the parking requirements based on their size. Um it I think there's 93 required based on the size of that that building and they provide 105 on their parcel. There will be a cross parking and access easement for all of the parcels that parking can be shared um between uses because they will have differing peaks. Um obviously the Qdoba and Shake Shack they will be very lunchtime peak heavy. Um so, there will be a parking premium on the we'll call it the west parking lot. Um but they do meet the requirements. There's no waivers from a parking requirement and there's opportunity to park further to the east in that kind of vacant space or the the space between the driveway and the Valvoline. There's a you know, 40 45 spaces in a in a parking lot there. Um people can park there within a relatively easy walk to um to the Shake Shack and the Planet Fitness. Um the developer did mention it on site um kind of pedestrian improvements and circulation and there are additional sidewalks through the site to connect the kind of parking areas so that um folks can walk through the development in a safe and efficient manner in a logical way, so that they're not crossing haphazardly through crossings and things like that. Um so we did look very carefully at the parking and and a parking study was done and traffic study was done and uh we're comfortable that the the proposal that you see uh in front of you is um consistent with the city code and city standards in terms of parking requirements. Um one comment that we had as a staff um reviewing the project was the architecture and the developer shared, you know, go to this. The developer shared um some of the elevations, which were also included in your packet. Um the buildings meet the requirements from a material percentage um material variety um uh requirement. Staff did have a comment that generally what we try to do in um in developments where you're part of an existing PUD or you're part of a PUD, there should be some I'm going to use the word communication between the buildings. Um that they they don't necessarily all have to match, um but there's some central theme architectural building material wise that kind of carries through. The Shake Shack here on your screens does share that. Um they have a wainscot um kind of level here. Kind of in the lower portion of the building that uses a kind of a thinner stacked type stone similar to the existing uh Planet Fitness building. They also show and it's very subtle in pictures, but you can see it more clearly in the elevations. Um there is a a band of kind of soldier course brick um that emulates what's in the major or the the main Planet Fitness building. Our only comment there is it's very very subtle and maybe there could be a tweak to the color of that row of brick to help kind of bring it out a little bit more from a from a visibility perspective. That's a really main comment on the Shake Shack building. In terms of Here I'm just looking at the elevations here. The renderings show you know the colors, you know the the darker brick that matches the kind of this band on the Planet Fitness building and then this lighter colored brick here somewhat matches the the front entry feature of the Planet Fitness. So there's some communication between those two buildings there. And here you don't really see that soldier course that I'd described earlier that just it's a difference in texture on the building and we recommend that maybe that color be tweaked a little bit before city council to help draw that out a bit. And then the Valvoline does a very good job of kind of bringing some of the same features from the Planet Fitness in the Qdoba building out. They use the same very similar winds coating on the lower level and then they use a band of darker color in the in the middle. I recognize the the Planet Fitness building is an older building and we don't want to just copy it because it's there. That's why we're looking for some sort of feature to help communicate some of those those characteristics between project in this development. But as I said there's no waivers required for architecture or building materials. They do meet that requirement. They do meet parking requirement. They exceed the landscaping requirement for both landscaping and tree replacement. And so staff is recommending approval of this project subject to the conditions outlined in the staff memo. I stand for any questions. >> Thank you, Jeremy, for that overview. Commissioners, do we have any questions for Jeremy before we open the public hearing? No. >> Madam Chair. Oh, sorry. Can I go ahead? Just a clarification, Jeremy. I want to make sure I heard you right when you were talking about the traffic study update and you were talking about the shared parking between the lots um in anticipation of at least looking at the numbers because there's two lunchtime rushes right now, restaurants with the Qdoba and now the Shake Shack. And you were talking about the sharing of parking and I thought I heard you say that it um that the Qdoba restaurant, which is offsite but within this PUD, can also have the benefit of sharing some of that excess parking that is between the driveway and the Valvoline um will that be memorialized? Is that true? Are they going to share parking with that Caribou Qdoba building as well? >> Uh Madam Chair, Commissioners, there is an existing agreement that allows shared parking between the Qdoba building and the subject parcel. There's a limitation of how many spaces that they can use, but that's enforced privately. Um but uh from a from a planning perspective, each of the lots meets the requirements for parking, but in reality, what will happen in the in the real world will will be many of the um the businesses or the patrons of these businesses will park where they can find a spot close by. >> Sure. Okay. All right. And there was a comment either in the staff report or maybe it was in the applicant's letter saying that in the future it's possible that these lots may get sold off instead of just being owned by the applicant. And so the uh parking easements will survive those lot um sales, that >> That's correct. >> Fantastic. Okay. Um I appreciate your comment about the not trying to force too much consistency with an older building on the site. Maybe maintaining just some nuggets of some some of those architectural features. And I certainly share that and then some. I think that the 1980s were the 1980s and and I really appreciate the the newer design especially of the Shake Shack building and they should do something contemporary and not necessarily embrace older buildings despite the fact that it's a PUD. My two cents, but great development. Thanks. Appreciate it, chair. >> Thank you. Go ahead, Commissioner Schumacher. >> Thank you, chair. Just a quick question about I know the My biggest concern and I think this is a great project. My biggest concern has just been around the the potential traffic congestion around the Shake Shack area. And I know that there's a access to park on the east side of that on that entryway. What is the best way and I'm thinking about wintertime, the best way for people who are working at the Shake Shack to be able to get to that location. Will they have to travel south and then cut over and then cut back because again, I think people will just tend to go where the easiest place is to park and they might not utilize that from parking perspective. So is there any plan to be able to open up an area to either walk down Leona to get into the Shake Shack or cutting across in any other way, shape or form? >> I'll take a stab at that Madam Chair, Commissioners. So there's a couple paths from call it east side of the main driveway to the Shake Shack. And I have the the site plan up if we can show that up there. Perfect. Um So you're referring to this parking area here. So there's a couple paths. One, there's a sidewalk along the the front of the building here, that um patrons can walk to this sidewalk and then connect to a a north-south sidewalk that connects to uh the Shake Shack property. So, uh depending on where they park, they can uh navigate to that path fairly easily. Another option, and may require some modification to the plan, but is to work their way to this sidewalk and then across and then to this sidewalk to get to the Shake Shack. There's a couple paths. Uh we do anticipate um perhaps there might be some snow storage or something here that will have to be managed as part of the applicant's um operations of the site. Um but um there are call it paved ways to get to Shake Shack and and to Valvoline and to the other businesses within the site. >> Thank you. Any other questions? Otherwise, I have a couple. Um just a couple questions regarding the signage. Um I think I question sightline issues and I think I heard you mention that staff is okay with the sightline, especially if the sign's going to be larger than what we require at Leona and Flying Cloud drives. Is that correct? >> Staff is comfortable with the size waiver as proposed. We're not concerned from a site visibility um perspective in terms of sightlines for the traveling public. And we're and we're comfortable with this cuz the sign is there. >> Right. >> Um so, that helps from a kind of what's the impact type of perspective. Uh and the sign will be just will be higher than what's there now. >> Got it. And then there's other locations that will have signage throughout the site, correct? >> Could, yes. Yeah, I'm sorry. I got ahead of myself here. Um there will be obviously wall signage on on the buildings. And then um there's a sign at the south east corner of the site. There's an existing sign there. and then um there's a potential for another one located on the Den Road side. So, there's a couple other options. Right now, they're just This application is proposing uh the new one here at the northwest corner. >> So, it's possible there could be future signage in the locations that you mentioned that would be for Shake Shack or Valvoline? >> I would call it for the shopping center globally. >> Globally, okay. That's helpful. Thank you. Um and then the access along Den Road, so it's basically closing the existing access and moving it further away from the intersection, is correct? >> Yeah, Madam Chair. Uh so, there's two driveways off of Den. Uh there's this existing one here um on on the screen, and then there's another one kind of closer to the corner. >> Right. >> That one will be removed. And then this one will be the main uh in and out, so it'll be um the one off of Den Road and the one off of Leona Road. Those will be the two ways into the site. >> Perfect. So, essentially both of these access changes are moving the access further away from the intersections, which is helpful in my opinion. >> Yeah, um Leona Road is is moving away from the Flying Cloud Drive intersection, more and more closer towards the Den Road, but yeah. >> Correct. >> More central. >> Okay. I think that's all I have. Any other questions? >> Can I circle back, Madam Chair? Sorry about the signage. When you were talking about the signage, and we understand the waiver and consolidating the signs at the corner at the northeast corner, um does that come with a restriction to the property owners and future property owners if it's subdivided that they can't install their own monument sign, which would um basically take away the benefits that we see in this consolidation waiver? So, that we don't end up later after a land sale, somebody else changing the use or saying, "I I don't need my name at the corner there. I'm going to put up my own sign." And then all of a sudden we get a signage application that it defeats the purpose of consolidated signs. >> I immediately know it doesn't restrict that ability, but um our ordinance does have certain requirements in terms of location and separation within the same lot. If that's a concern of the commissioner, we can certainly bring that recommendation forward. >> Okay. I I have that concern. So, um if if commissioners share that, that could be passed along. Commissioners discussion wishes this evening. >> Mr. Chairman. >> I'm I'm very impressed with this project. I support it wholeheartedly. Um I think it's a good completion of the project we looked at a few years ago. Uh we knew this was coming and uh even though they switched uh users for that one parcel in the northwest corner, I think it it uh follows relatively consistency with what we expected. Um I support the waivers of the yard setbacks as well as the consolidated uh sign in the northwest corner Um achieve what they're they're trying to do. I really like the circulation off Leona Road with that reconstructed driveway that you have to pull all the way into that T intersection at the Office Depot, which I think will alleviate a lot of the challenges of navigating through the parking lot. So, I think this is successful on a number of levels and I really like the design of that Shake Shack building. Thank you. >> Thank you, Commissioner Far. Anyone else? I also agree with those sentiments. I think this development is very well done. Thank you for all your work that you've done to do with this, as well as the water um water investment. Good luck at City Council. >> Thank you very much. >> All right, next item we have before us is um uh the city's actually requesting approval of a zone change from public to R1-22 on two parcels totaling 1.2 acres at 6345 Eden Prairie Road, which contains a single-family home, and there is no proposed change in use with the application. The parcels have been inadvertently zoned public since 1969, and the zone change to R1-22 is consistent with the neighborhood and the current and planned use of the parcels. I assuming the city's the applicant, Jeremy, will you take us through the staff report? >> Yes, I will, Chair Commissioners. Um as you summarized, this is a uh a city-initiated application. During the review of a building permit for the subject property for a deck, we learned that the um the property is zoned um public, which requires a significantly deeper setback than the R residential zoning district. In fact, there's not a buildable portion of the property because the setback from the north overlaps the setback from the south. Um in reviewing the history of the zoning in this property, uh we we learned that the property has been zoned public since really 1969, which is one of our first zoning ordinances. And uh in guided low-density residential, so our our goal here is to have the um the zoning match the the comprehensive plan and the use of the property. Uh the use of the property is single-family residential. The property owners wish to improve the property. They recently purchased it. It was held by the same family for a a number of decades, so not a lot of uh projects going on the property requiring us to do some some research into it. So, we when we learned of an issue, we tried to correct that uh and tried to bring property in more compliance with the intended use for the property. Um we did put a development sign on the on the property. Um as our standard practice with comp plan amendments, zone changes, new developments, we put a sign up on the property to try to again be more transparent and get people to provide uh feedback or questions on the project. While this isn't a development per se, this uh is a rezoning, so we we put a sign up. And and that did uh generate some calls and some questions. People were worried about a new development going in, subdivision or what have you. In this situation, it's a it's a correction of our zoning map error. So, we're we're fixing that as an issue. There's no development proposed. You're not asked to approve any any development, any subdivision, any site plan. You're not asked to do any of that. Just to a change our map to make it R122. Um We also heard from the neighbors about some tree removal. Every property owner in Eden Prairie is allowed to remove and and landscape their property. They're allowed to remove some trees. This developer this property owner may have exceeded that allowance. And our forestry staff is working with the property owner to address that as a as a as a correction issue. But, no no reaction or no action necessary from the planning commission on that issue. Just know that we got some comments about tree removal. Um generally, what we receive calls on the property is they don't want to see any any development. And that's understandable. The property isn't really conducive to to redevelopment. It's a single family lot. It's relatively small and deep. Not a lot of frontage. And we don't see it likely that the property will be subdivided in the future for more single family homes. Um we're recommending approval of the zone change for both parcels. Both parcels because the property owner owns both. And the property to the north is too small to be um R122. So, we need to combine them both to be to meet them to make them conforming to our zoning ordinance. As I said before, it's very um It's a cleanup of an issue. Trying to correct an issue for a private property owner, and we don't see any uh any issue with uh recommending approval of that zone change as proposed. >> Thank you, Jeremy. Last name Fay, f a y. >> Thank you. >> And I live at 15600, which is just on the uh west side of Eden Prairie Road. Um my question didn't relate um directly to this, but I understand then there's there's no development proposed, so the house is going to remain as is? No improvement going to be done, or cuz it's been a derelict property for the 40 years that I've lived across the road. Is that true? >> That is correct. >> Okay. >> Madam Chair, if I could supplement that. There's no development proposed. I can't speak to what their plans are for the exterior of the property, landscaping, or anything like that, cuz those don't require permits, typically. Um but this came to our attention because they're doing some internal re- remodel and adding a deck. >> Okay. Um so the the property will still be vacant, but my question relates to the speed limit on Eden Prairie Road, because the to the uh to the south of us, that bend is pretty much blind when we're at our intersection. And then to the north, as Eden Prairie uh road goes south, the road dips, so cars drop right out of sight going the other direction. Eden Prairie Road goes from County Road 5 to Valley View Road is 40 mph. From Valley View to town line, it's 45. And then once you cross into Minnetonka, past uh town line, it drops to 35. And my question is, could the speed limit be rationalized to 35 from County Road 5 all the way to Excelsior Boulevard? And that way, you know, that way I would get people going 45 mph instead of 55 as they come past my intersection. That's it. >> Thank you, Mr. Fay.
