Cannabis Retail Licensing and Local Zoning Regulations

The city identified five retail locations as the initial allowable number under state law (one per 12,500 residents). Cannabis retailers will be permitted in the same commercial districts as tobacco and liquor stores (PCD1, PCD2, PCD3) to allow geographic distribution rather than concentration. Cannabis cultivation, manufacturing, processing, wholesaling, testing, transportation, and delivery operations are limited to industrial districts and must occur in enclosed buildings. A 500-foot setback requirement applies to schools, daycare facilities, and residential treatment facilities. Operating hours are restricted to 10:00 a.m. to 10:00 p.m.

72nd and France TIF District Establishment and Macy's Site Redevelopment

The city established a new Tax Increment Financing district to support redevelopment of the 9-acre Macy's Furniture and Mattress Gallery site on France Avenue. The project, developed by Enclave Companies and Lifestyle Communities, includes four new buildings: an 11-story condominium with office and street-level retail/restaurant space; a 7-story mixed-use building with apartments; and two 7-story apartment buildings (one with restaurant space). The existing Macy's building will be relocated and the original structure demolished. All buildings include indoor parking for residents, employees, and customers, with street-level parking available to the public. The site plan incorporates new roadways, sidewalks, landscaping, and preserves the Nine Mile Creek bicycle trail. Total planned investment is approximately $310 million. The city and Housing and Redevelopment Authority pledged up to $23 million in TIF and SPARK fund reimbursements for eligible costs including site preparation, building relocation, property cleanup, and public benefit features.
