The Edina City Council discussed potential changes to the city's Tree Protection Ordinance during a work session Tuesday, focusing on implementation challenges and fairness concerns raised by residents.

The ordinance has processed approximately 250 permits since implementation, with only a handful of problematic cases, according to city staff. However, several issues have emerged, particularly with undeveloped lots where topography creates complications for tree replacement requirements.

Council Member Jackson expressed concerns about the ordinance's potential punitive nature, citing cases where homeowners face substantial escrow requirements. "Whatever policy we come up with, it can't be punitive," Jackson said, noting instances where residents must deposit tens of thousands of dollars that may not be returned if replacement trees don't meet size requirements.

City staff reported holding nearly $1 million in escrow funds, with approximately $200,000 refunded to property owners who successfully completed tree replacement plans. The majority of remaining funds are expected to be returned as projects are completed, according to Community Development staff.

City Attorney Dave Kendall has recommended adding due process mechanisms to the ordinance, including appeal procedures for property owners who dispute tree protection requirements. The council expressed support for implementing these changes to address fairness concerns while maintaining the ordinance's tree preservation goals.
