Uh, we'll now open it up to the public if there are any issues not currently on the agenda that they would like to put on our agenda for tonight. Not seeing any. We will then move on to our first new business bringing us back to the commission. This is applicant Church of Saint John Newman. Approval of a preliminary subdivision. And I understand you may be presenting to us. 00:10:32,120 S3: Yes. 00:10:33,000 S5: Thank you, Mr. Chair. Members of the Commission. Saint John Newman Church is requesting approval of a preliminary subdivision to create two lots on property located at 1330 Deerwood Drive. The property contains, well. A single family home was built on the property in 1968. The church acquired the property in 1993 and used it as a priest residence until 2003, and then later converted the building for use as a youth center. Access to the property is from Deerwood Drive, at the northwest corner of the lot, and also directly from the church parking lot to the west. In 1978, an access easement was established over the east edge of the site to provide a shared driveway access to adjacent properties at 13, ten and 1300 Deerwood Drive. A trail is located on the south side of Deerwood Drive and connects to the city wide trail system. The site topography has a 40 foot elevation change, with the high point near the near the building at the center of the site. It is heavily wooded around that with a clearing around the building. There are no wetlands appear to be present. Surrounding uses are single family and the church to the west. The proposed subdivision splits off the northeastern 1.14 acres, which is proposed lot two and retains a 3.09 acre parcel lot one with the existing building. Both lots meet minimum dimensional and area standards for the Public Facilities zoning district, which is the current zoning of the property. The proposed lot two will be offered for sale. The church intends to continued use of the building on lot one for small church meetings and storage, and possibly to re-establish it as a priest residence in the future. There is no new development associated with the subdivision at this time. However, a conceptual plan was submitted illustrating how proposed lot two could be developed under the current Public Facilities Zoning standards. Access to both lots comes directly from Deerwood Drive. Storm drainage flows from the high point in the center of the property to the north, south and west. The Tree Preservation Ordinance would apply to future development, and significant tree removal would be required for any development of lot to the proposed. Any proposed development would be reevaluated for stormwater management requirements at the time of building permit. The existing building is connected to city sewer and water, and the water main and sanitary sewer are available for connection, and Deerwood Drive for development of lot two. The existing private ingress egress easement on the east side of the property serves two other lots. The parcel to the south at 1310 Deerwood Drive, is also owned by the church, and because a party cannot grant themselves an easement, a declaration should be created at the time the property is subdivided to establish that driveway access for 1310 over the east edge of the new lot two, and the easement that serves 1300 Deerwood Drive will remain in effect. A portion of water, main and sanitary sewer fees have been collected. Remaining fees will be collected at the time of final subdivision and those are detailed in the staff report. Park and trail dedications have not previously been provided. Cash park and trail dedication would be due for the new lot lot two and may be deferred while the property is in church use and collected at the time of future development. 00:14:04,210 S5: The action to be considered is to recommend approval of a preliminary subdivision to create two lots on 4.23 acres located at 1330 Deerwood Drive, and if approved, the conditions and the staff report shall apply. Thank you. 00:14:18,090 S1: Thank you, Mr. Zajac. Are there any questions of Mr. Zajac from members of the Commission? 00:14:25,330 S1: Okay. Not hearing any questions. I would invite the applicant to come forward if the applicant would like to present. 00:14:32,330 S2: We're here for questions and comments if you have any commission members. 00:14:36,690 S1: Thank you. Are there any questions for the applicant for members? 00:14:43,809 S1: Okay. Then we can move on to opening the public hearing on this application. This is for approval of a preliminary subdivision to create two lots on the property described by Miss Dudzik. Are there any, uh, Folks or community members who would like to come forward and speak on this application. Not seeing a rush on the podium tonight. We will then close the public hearing and bring this back to commission for further discussion. Are there any further questions Commission members have or anything that they'd like to share about this application? Um, and if not, we can entertain a motion. 00:15:24,320 S3: Mr. chair. 00:15:25,120 S1: Yes. Vice chair. Schwenk. 00:15:26,519 S6: I'd like to recommend approval of a preliminary subdivision. Saint John Newman's second edition, to create two lots upon approximately 4.23 acres located at 1330 Deerwood Drive. And if approved, the following conditions. One through 11 be applied. 00:15:44,120 S2: Second. 00:15:45,159 S1: Okay, I have a motion from Vice Chair Schwenk and a second from Secretary Whitfield. Um, any further discussion or comments from the members? Um, with that all in favor, please raise your hand and say aye. 00:15:58,519 S6: Aye. 00:15:59,600 S1: I and that has passed 6 to 0. I understand that that will be on the City Council agenda for Tuesday, July 7th. Is that right, Mr. Schultz? Just double checking. Yes. Okay. Oh 21st of the 21st. Okay. Thank you. Well, thank you very much to the applicant for your time here. Appreciate this. Easily the quickest session that we've had in in recent memory. So I wish you all the best in front of the city Council as well. Thank you. Um, with that, Mr. Schultz, is there any other business for the commission to consider tonight? I'll keep it short. No other business. Okay. Um, I will then entertain a motion to adjourn. So I have a motion from Secretary Whitfield. I have a second from Member Donaldson. All in favor, please raise your hand and say aye. Aye aye. Aye. And that passes 6 to 0. We are adjourned. Thank.
